MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
JULY 21, 1988 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Ron Hubbard, at 7:00 P. M.

CONSIDERATION OF THE MINUTES
OF APRIL 21, 1988
Mr. Kemp made the motion to approve
the minutes as written. This motion
was seconded by Mr. Grubb and the
motion carried 4-0 with Mr. Schubert
and Mr. Cypert abstaining since they
were not present at the meeting.

CONSIDERATION OF THE MINUTES
OF JUNE 16, 1988
Dr. Duer made the motion to approve
the minutes as written. This motion
was seconded by Mr. Kemp and the
motion carried 5-0 with Mr. Bunting
and Chairman Hubbard abstaining since
they were not present at the meeting.

BA 88-6
Request of Bill VanOrden to vary from
the Zoning Ordinance #1080 on Lot 15,
Block 9, Windcrest Addition, to allow
an accessory building to be beyond the
side yard requirement and beyond the
10 foot height limit. This property
is located at 7250 Windcrest Court.
Chairman Hubbard stated Mr. VanOrden
was called out of town and was unable
to get a flight back in time for the
meeting so his request will need to be
postponed until next month's meeting.

POSTPONED
Mr. Grubb made the motion to postpone
BA 88-6 until August 18, 1988. This
motion was seconded by Mr. Bunting and
the motion carried 5-0.

BA 88-7
Request of Timothy D. Duckett to vary
from the Zoning Ordinance #1080 on Lot
11, Block 32, Nor'East Addition, to
allow a fence to be beyond the side
yard building line. This property is
located at 5400 Greenwood Way.
Chairman Hubbard opened the Public
Hearing and called for anyone wishing
to speak in favor of this request to
please come forward.

Mr. Duckett came forward. He stated
he needed to ask for a variance to
allow the extension of his yard 28
feet by 71 feet which would make his
yard approximately 1,000 square feet
larger. Mr. Duckett said he needs
this for privacy. He said he
presently has a chain link fence, but
would like to install a stockade
fence. He stated there is no house
directly behind him and his neighbor
to the north is about 28 feet. Mr.
Duckett showed pictures to the Board
of the area.
Mr. Duckett stated he needs this fence
for privacy. He said he has a
portable trailer he would like to hide
behind the fence and sometimes the
children leave toys in the yard, but
the neighbors have not complained.
Mr. Duckett said he lives close to
Davis Boulevard and he would like the
fence for safety. He said Davis
Boulevard is so busy. He said they
had a child killed about two blocks
from his house the other day and also
a house was burglarized recently.
Mr. Duckett submitted to the Board a
list of 8 signatures of neighbors who
do not object to the fence. He stated
Greenwood Way is a fairly busy street,
but Randol hardly has any traffic.

Mr. Duckett said he plans to set back
8 feet from the front of the house and
go back 82 feet. He said he also
plans to landscape the back yard. Mr.
Duckett said he feels the fence would
enhance the neighborhood.
Mr. Duckett said as far as safety,
there would be plenty of time to see
any traffic coming.
Mr. Grubb stated he feels the fence
would create a blind spot at the back
of the lot.
Dr. Duer asked if there is a stop sign
at Greenwood Way and Randol.
Mr. Duckett stated there is not a stop
sign, but you have to slow down for
the curve.

Mr. Grubb said if the fence were chain
link, there would be no blind spot.
Dr. Duer said if you moved the fence
to the back of the house, it would
take away the blind spot at the front.
Mr. Duckett said he could move the
fence back 8 feet from the front of
the house.
Chairman Hubbard stated there is a
long sloping curve and you are going
to have to slow down.
Mr. Schubert stated the present chain
link fence is beyond the building
line.
Mr. Bunting asked Mr. Duckett if he
would consider using chain link
instead of stockade.

Mr. Duckett said no, he needed
stockade for privacy.

There was discussion with the Board
and Mr. Duckett regarding the pictures
and where to place the fence.
Mr. Schubert stated when a developer
lays out these lots, he does not think
of the problems he causes. He said
they fall in the Board's lap. Mr.
Schubert said he does not feel they
should allow the fence to come so
close to the street.
Mr. Duckett stated he bought this
place because of the large yard. He
said he is a family man and wants a
safe place for his children to play.
Mr. Cypert suggested Mr. Duckett
terminate his fence at his neighbor to
the north's fence line.

There was considerable discussion
about where the fence should go.
Patricia Duckett came forward. She
stated that Ken Miller, City Code
Enforcement Officer, came out and he
saw no problem with where they wanted
the fence. She said Mr. Miller stated
they needed to get a variance for the
fence, then they could build a
building in the back without a
variance.
Mrs. Duckett said she does not feel
they should be penalized for things
they could not help.
Mr. Grubb stated the Board would not
be taking away from them they would be
giving to them more usable yard.
Mr. Cypert said he felt they should
come back 16 feet from the curb.

Mr. Duckett said he would start his
fence 8 feet from the front of the
house and set in 16 feet from the curb
and angle it to where the neighbor's
fence line is.

ADJOURNMENT
Chairman Hubbard called for anyone
wishing to speak in opposition to
please come forward.
There being no one to speak, the
Chairman closed the Public Hearing.
Mr. Grubb made the motion to approve
BA 88-7 as agreed on by Mr. Duckett
and the Board and these changes and
drawing be entered into the record
showing a 16 foot side yard. This
motion was seconded by Mr. Bunting and
the motion carried 5-0.
Chairman Hubbard stated he had
received a letter from the Mayor
regarding absenteeism.
Mr. Tucker said it was up to the Board
to adopt guidelines.
Mr. Bunting said he felt the members
could handle it themselves.
Mr. Cypert said he has to go before
Boards in three other cities and he is
thankful for our alternates. Mr.
Cypert said he plans his business
around so he will be free for this
Thursday night each month.
Chairman Hubbard said he would address
a letter to the Mayor stating the
Board has no problems with
absenteeism.
The meeting adjourned at 8:10 P. M.
