CALL TO ORDER The meeting was called to order by the Vice Chairman, Forrest Grubb, at 7:00 P. M. ROLL CALL PRESENT: Vice Chairman Secretary Members Alt. Members Forrest Grubb Harold Schubert Billy Cypert Jeff Bunting Jim Kemp Tom Duer George Tucker Wanda Calvert Dir. Planning P & Z Coordinator ABSENT: Ron Hubbard Alternate member Jim Kemp will vote in Mr. Hubbard's place tonight. . CONSIDERATION OF THE MINUTES OF JULY 21, 1988 Mr. Schubert made the motion to approve the minutes as written. This motion was seconded by Mr. Bunting and the motion carried 5-0. 1 . BA 88-6 POSTPONED 7/21/88 Request of Bill VanOrden to vary from the Zoning Ordinance #1080 on Lot 15, Block 9, Windcrest Addition, to allow an accessory building to be beyond the side yard requirement and beyond the 10 foot height limit. This property is located at 7250 Windcrest Court. Vice Chairman Grubb opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Mr. VanOrden came forward. He showed pictures to the Board. He stated he went to Red Rooster Lumber company and purchased the materials to build the accessory building. Mr. VanOrden said he asked if he needed a permit to construct the building, but they said as long as it was not on a slab he did not need a permit. Page 2 Z B A Minutes August 18, 1988 . Mr. VanOrden stated he placed the building about the only place in the yard it could be put. He said if he moved it forward, it would be next to a telephone cable. Mr. VanOrden said it would be very expensive to have to move the building. Vice Chairman Grubb asked how Mr. VanOrden found out he was in violation. Mr. VanOrden said he received a letter from the city stating he needed to get a permit. Mr. Schubert asked where the cables were. Mr. VanOrden said he has three lines going into the house. He explained his house is on an odd shaped lot. . Mr. Schubert asked if the building is on concrete blocks. Mr. VanOrden said it is. Vice Chairman Grubb asked how large is the building. Mr. VanOrden said it is 10 feet by 16 feet and 12 feet high. Mr. Bunting asked if it would be feasibly impossible to move. Mr. VanOrden said it is not attached, but it would be very hard to move. Dr. Duer said it could be pulled. Mr. Bunting asked if the neighbors complained. . Mr. VanOrden said they did not complain and he has one with him tonight to speak in favor of the building. Page 3 Z B A Minutes August 18, 1988 . Mr. Schubert asked if his neighbors have accessory buildings. Mr. VanOrden said they do not. Vice Chairman Grubb asked Mr. VanOrden if he has a reason why he can not move this building. Mr. VanOrden said he has $750 tied up in the building and he does not wish to throw it away. He said he thought he checked to see if he needed a permit, but he asked the wrong people. Mr. VanOrden said it would be almost impossible to move it anywhere convenient. Dr. Duer said the building must have stuck out enough for the city inspector to notice it. . Mr. Cypert asked Mr. Tucker if they plan to raise the height limit of the buildings. Mr. Tucker said the Planning and Zoning Commission is in the process of re-writing the ordinance recommending 10 feet eave height. Mr. Cypert said if approved, this building would not be in violation. Mr. Bunting asked where do you measure from. Mr. Kemp said the ordinance says "grade level". Mr. VanOrden said there are several accessory buildings in the area that are close to fences. . Gene Woodall, 7254 Windcrest Court, came forward. He stated he has no objection to the building. He said it is well constructed and does not deter from the area. Mr. Woodall said the only time he sees it is when he passes Mr. VanOrden's house. Page 4 Z B A Minutes August 18, 1988 . Vice Chairman Grubb asked if the building will be finished with a door. Mr. VanOrden said he will complete it after the Board makes it's decision. He said he has all the materials. Vice Chairman Grubb called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Vice Chairman closed the Public Hearing. BA 88-6 APPROVED Mr. Cypert made the motion to approve BA 88-6 as requested. This motion was seconded by Mr. Schubert and the motion carried 5-0. . Mr. Cypert asked that the City Manager put information regarding accessory buildings in the Newsletter. 2. BA 88-8 Request of Thomas J. Bergerson to vary from the Zoning Ordinance #1080 on Lot 12, Block 3, Richland Heights Addition to allow garage to be converted into a room without the required covered parking. This property is located at 4316 Lynn Terrace. Vice Chairman Grubb opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mr. Bergerson came forward. He stated he had just moved into this house and needed more room. He said he has three children. He said he looked in the paper to find some contractor to convert his garage. Mr. Bergerson said he was not aware of the requirement for covered parking until he received a letter from the city. . Vice Chairman Grubb asked if the work was done without a permit. Page 5 Z B A Minutes August 18, 1988 . Mr. Bergerson said he did not ask the contractor if he obtained a permit. He said he thought the contractor would have known what was required_ Mr. Bergerson showed pictures of the conversion. He said he paid approximately $2,000 to convert the garage to look like the rest of the house. Dr. Duer asked if there had been any inspections on the conversion. Mr. Tucker said there had been none. Mr. Schubert asked whose responsibility this was. Mr. Tucker said it is the homeowner and it becomes a civil matter. . Mr. Schubert said he feels the builder knew he needed a permit. Vice Chairman Grubb asked how much space does he have. Mr. Bergerson said it is 19 feet by 20 feet. He said he turned his house into a four bedroom home. Vice Chairman Grubb asked where he previously lived. Mr. Bergerson said he is originally from Minnesota. Dr. Duer asked why the city requires covered parking. Mr. Tucker said it makes the residential area more pleasing. Vice Chairman Grubb said he feels the electrical needs to be inspected. . Mr. Tucker said he will contact the inspection department. There being no one wishing to speak, the Vice Chairman closed the Public Hearing. BA 88-8 APPROVED Mr. Kemp made the motion to approve BA 88-8 as requested. This motion was seconded by Mr. Cypert and the motion carried 5-0. 3. BA 88-9 Request of Don Roach to vary from the Zoning Ordinance #1080 on Lot 1R, Block 1, Richland Oaks Addition, to allow house to be built beyond the building line. This property is located at 8321 Jerri Jo Drive. . Vice Chairman Grubb opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mr. Roach came forward. He said this home was built 25 years ago and he tried to refinance it and found it was built over the building line. He said the mortgage company is requesting a waiver from the city. Mr. Roach said he does not plan to add to the house; it was originally built over the line. Vice Chairman Grubb called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Vice Chairman closed the Public Hearing. BA 88-9 APPROVED Mr. Cypert made the motion to approve BA 88-9 as requested. This motion was seconded by Mr. Schubert and the motion carried 5-0. . . . .
