MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENTS OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
SEPTEMBER 15, 1988 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Ron Hubbard, at 7:05 P. M.

CONSIDERATION OF THE MINUTES
OF AUGUST 18, 1988
Mr. Cypert made the motion to approve
the minutes as written. This motion
was seconded by Mr. Grubb and the
motion carried 4-0 with Chairman
Hubbard abstaining since he was not
present at the meeting.

BA 88-11
Request of Mike Browning to vary from
the Zoning Ordinance #1080 on Lot 3,
Block 1, Parkridge Estates Addition,
to allow a pool to be adjacent to an
easement. This property is located at
6613 Hillside Court.
Chairman Hubbard opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Mike Browning came forward. He said
he is requesting the variance from the
rear utility easement. He stated the
water line of the pool will be one
foot off the easement. Mr. Browning
said his home is built on a cuI de sac
and he has very little back yard.

wishing to speak in opposition to this
request to please come forward.

Roger Owens, 6524 Cliffside, came
forward. He stated he is building a
home at 6604 Carston Court. He said
his property backs up to this
property. Mr. Owens stated he is not
for or against this request, but he
has some questions to ask. He said
when he began building his new home
they had it surveyed and the survey
stake was on the other side of the
fence. Mr. Owens asked if the
measurements on Mr. Browning's site
plan is correct.
Mr. Owens said because of the terrain,
Mr. Browning's property is higher than
his and even though he has a 6 foot
fence, it is a foot below his yard.
Mr. Owen asked if Mr. Browning would
be made to have a higher fence.

Mr. Grubb said Mr. Owens has a problem
with his survey. He said, from
experience, the fence will become the
property line in two years.
Mr. Owens asked where would the
measurements be from.
Mr. Tucker said the easement is taken
from the stake.
Chairman Hubbard said Mr. Owen's
second question was regarding the
fence. He said there is a 6-foot
fence there, but it is only 5 feet
because his property is a foot higher
than where the fence is.
Dr. Duer asked how close is the pool
to the house.
Mr. Tucker said it can be right up to
the foundation if it is engineered.

Chairman Hubbard asked Mr. Browning if
this site plan was drawn by a
surveyor.

Mr. Browning stated it was done by
Brookes Baker Surveyors. He showed
the survey to the Board.
Chairman Hubbard asked the dimension
of the pool.
Mr. Browning said it is 14 feet by 12
feet by 32 feet.
Chairman Hubbard said he was just
concerned that the drawning was not to
scale. He asked Mr. Browning if he
plans to put up a taller fence.
Mr. Browning said he did not plan to.
He said the fence was put up by the
developer of Carston Court.
Dr. Duer asked about the proposed
zoning ordinance change.

Mr. Tucker stated the new proposed
ordinance will allow a pool to be
adjacent to the easement. He said it
allows it now in Commercial zoning.
Mr. Tucker said no decking can be on
the easement.
Chairman Hubbard called for anyone
else wishing to speak to please come
forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Chairman Hubbard asked if there had
been any correspondence.
Mrs. Calvert stated there had been
none.

APPROVED
Mr. Cypert made the motion to approve
BA 88-11 as requested. This motion
was seconded by Dr. Duer and the
motion carried 4-1 with Chairman
Hubbard voting against.

BA 88-12
Request of Phil Kenneth Rieke to vary
from the Zoning Ordinance #1080 on Lot
5, Block 16, North Park Estates
Addition, to allow garage to be
converted into living area without the
required covered parking. This
property is located at 6436 Buckingham
Trail.
Chairman Hubbard opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Phil Rieke came forward. He passed
out information to the Board. He said
there are several reasons why they
wish to have this variance. Mr. Rieke
stated he has a family of 4 children,
3 daughters and one son. He said he
has a teenager and 3 younger children.
He said their ages are 13, 9, 7, and 4
and due to their ages and sex
differences, he believes it to be in
their best interest for each one to
have a separate bedroom.
Mr. Rieke said they have owned this
property since 1977 and have never
parked their car in the garage. He
said in his subdivision bordered by
Buckingham Trail, Watauga, Sunset, and
Chapman Road, leaving cars in the
driveway on a regular basis is not
uncommon. He said there are 636 homes
in this subdivision and on a typical
weekend morning, there were 1,226 cars
not in covered parking for an average
of 1.9 cars per dwelling. Mr. Rieke
stated that 26 homes within these
boundaries have garage conversions.

Mr. Rieke stated he has no physical
means of getting to his back yard to
build a garage. He said he plans to
retain the integrity of the original
building plan by residing the street
side of the conversion to look like
the original garage door material and
plan to put a window in the north
side.

Mr. Rieke said he believes this will
enhance the value of the neighborhood
and it will increase their living
space from 1,349 square feet to 1,719
square feet. He said this conversion
is for homesteading purposes, not for
rental purposes.
Mr. Rieke stated he has some present
who will speak in favor of this
request and he also has a petition
signed by the neighbors stating they
are in favor of it. He submitted the
petition to Mrs. Calvert for the
record.

Patrick Marshall, 7128 Oldham, came
forward. He stated he had owned his
property for 11 years. He said there
are several homes in the neighborhood
that have been converted, probably
without a permit. He said no one uses
their garage for autos and he does not
feel this would harm the neighborhood.
Chairman Hubbard called for anyone
wishing to speak in opposition to
please come forward.
No one came forward.
Mr. Schubert asked where he planned to
park his cars.
Mr. Rieke said two can be parked in
the drive. He said these houses
either have 1 and 1/2 stall garages or
a single garage, none with two car
garages.
Mr. Schubert asked what he planned to
do when his children begin to drive,
will you have 6 cars.

Mr. Rieke said by the time the small
children get old enough to drive,
maybe he can afford to get another
place. He said that would be 5 to 10
more years.

Mr. Grubb stated the ordinance says
two covered and two uncovered.
Mr. Tucker said this subdivision was
built prior to this ordinance.
Mr. Grubb said he was on the Planning
and Zoning Commission when Fox and
Jacobs built that addition.
Mr. Schubert asked Mr. Rieke what he
was going to do with the junk in the
garage.
Mr. Rieke said they had a garage sale
and got rid of some that way; then he
floored the attic and also will have
some storage space in the conversion.
Chairman Hubbard asked if there had
been any correspondence.

Mrs. Calvert said yes, we received a
letter from Mrs. Livingston who is in
favor of this request.
Chairman Hubbard closed the Public
Hearing.
BA 88-12
APPROVED
Mr. Grubb made the motion to approve
BA 88-12 as requested. This motion
was seconded by Dr. Duer and the
motion carried 5-0.

BA 88-13
Request of Fox and Jacobs to vary from
the Zoning Ordinance #1080 on Lots 14
& 15, Block 6, Ember Oaks Addition, to
allow a fence to be beyond the front
building line. This property is
located at 7901 and 7905 Woodland
Drive.
Chairman Hubbard opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Michael Langford came forward. He
said he works for Fox and Jacobs. He
said they wish to have a fence to tie
the two model homes together to
control the people.

Chairman Hubbard called for those
wishing to speak in opposition to this
request to please come forward.
No one wished to speak.
Mr. Tucker stated this has always been
a problem. He said the new Zoning
Ordinance will allow non-site barring
fences and allows the garage to be
used for an office. He said this
would be Ouasi-Commercial with
temporary power. Mr. Tucker said this
could be taken care of
administratively.
Dr. Duer said they would already have
the garages converted.
Mr. Tucker stated they can not sell
the house unless the garage is
converted back.
Chairman Hubbard closed the Public
Hearing.
Mr. Schubert made the motion to
approve BA 88-13 as requested. This
motion was seconded by Mr. Grubb and
the motion carried 5-0.
Mr. Grubb asked Mr. Tucker about the
fence at the Quintin Crossing
apartments.
Mr. Tucker stated he had tried to talk
to the City Attorney, but he had been
tied up with the Golf Course. He said
he will find out for him.
The meeting adjourned at 7:45 P. M.
