MINUTES FOR THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
DECEMBER 15, 1988 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Ron Hubbard, at 7:00 P. M.

CONSIDERATION OF THE MINUTES
OF OCTOBER 20, 1988
Mr. Bunting made the motion to approve
the minutes as written. This motion
was seconded by Chairman Hubbard and
the motion carried 2-0 with Cypert,
Grubb, and Duer abstaining since they
were not present at the meeting.

CONSIDERATION OF THE MINUTES
OF NOVEMBER 15, 1988
Dr. Duer made the motion to approve
the minutes as written. This motion
was seconded by Mr. Grubb and the
motion carried 4-0 with Mr. Bunting
abstaining since he was not present at
the meeting.

BA 88-18
Request of Randall R. Turner to vary
from the Zoning Ordinance #1080 on
Lots 2 & 3, Block 13, Woodcrest
Addition, to allow additional signage
on existing sign pole. This property
is located on Bedford Euless Road
(Northeast Plaza Shopping Center).
Chairman Hubbard opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Randall Turner came forward. He said
he represents Western Realty 'in this
request. He said they request an
increase in signage. Mr. Turner said
they have 217 feet on Bedford Euless
Road, but the shopping center faces an
undedicated street which is 765 feet
long. He said they are requesting the
square footage of the sign be
increased from 285 square feet to 450
square feet. Mr. Turner said this
would not increase the height of the
sign; they would just fill the
vacancies in the sign.
Mr. Turner stated they are
approximately 50% occupied and they
hope with the increased signage, they
can fill the shopping center and
increase the tax base.

Mike Huck came forward. He said he
leases a space in the center. He said
the center is hidden. He said he has
a small sign. Mr. Huck said he
requests the Board grant this request.
Chairman Hubbard called for anyone
wishing to speak in opposition to this
request to please come forward.
c. R. Franchild, Weyland, came
forward. He said he is not against
this request, but he needs some
clarification. Mr. Franchild said
what he is concerned about is the
green belt. He said they have already
cut down three trees which is in
violation of the ordinance. Mr.
Franchild said he has no objection to
the sign.
Chairman Hubbard asked if there had
been any correspondence.
Mrs. Calvert stated there had been
none.

Mr. Cypert asked Mr. Turner if he had
to have 450 square feet. He asked if
they plan to go past the 10 foot 6
inch at the bottom.

Mr. Turner said it will be 4 or 5 feet
above street level, but he wants to
keep it to where the sign can be seen.
Mr. Taylor said the Ordinance states
it should be 8 feet.
Mr. Turner said his landscaper told
him the trees were diseased and they had
them removed.
Mr. Grubb stated he was on the
Planning and Zoning Commission when
this property was zoned and he would
like to see the owners of the property
adhere to the covenant. He said they
were supposed to leave the trees.
Mr. Turner said they have trimmed the
trees and cleaned up the debris.

Dr. Duer stated the green buffer makes
it look so much nicer.
Mr. Cypert said he did not see how Mr.
Turner could put 450 square feet on
the sign.
Mr. Grubb asked what the height is
from the ground to the marquee.
Mr. Taylor stated the ordinance says 8
foot clearance.
Mr. Turner said the sign is built up
and would be 5 feet from the grade.
Chairman Hubbard asked if Mr. Turner
plans to give someone the top sign
area where Northeast Plaza is.
Mr. Turner said he would if they had
some large tenant or they could take 3
spaces on the sign. He said there
would be a maximum of 385 square feet.

Mr. Taylor stated that according to
the Ordinance, each tenant can have a
banner at no charge.

Dr. Duer asked if he needed more than
385 square feet.
Mr. Turner said he would rather have
450 square feet or even 400 square
feet for flexibility. He said the
center is not visible.
Chairman Hubbard asked if they would
be changing the structure of the sign.
Mr. Turner said they would not. He
said they have had the sign checked
and the structure is okay.
Mr. Grubb asked the size of the
undedicated street.
Mr. Turner stated it is 25 feet wide
and 765 feet long.

Chairman Hubbard called for anyone
else wishing to speak to please come
forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
BA 88-18
APPROVED
Mr. Grubb made the motion to approve
BA 88-18 with a maximum of 450 square
feet and not to exceed the present
height and with consideration of the
private street.
Mr. Bunting asked if the 450 was from
the ground up.
Mr. Grubb said it is for flexibility.
Dr. Duer said they can't go more than
400 or 450 square feet because they
don't have anymore area.
Mr. Taylor said the motion needs to
have some height clearance from the
ground.

Mr. Grubb amended the motion to allow
5 feet grade level and not more than
40 feet in total height. This motion
was seconded by Mr. Bunting and the
motion carried 5-0.

BA 88-19
Request of Superior Lubricants to vary
from the Zoning Ordinance #1080 on a
portion of Block 9, Richland Hills
West Addition, to vary from the brick
requirement in Commercial zoning.
This property is located at 6551
Grapevine Highway.
Chairman Hubbard opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Bill Cates came forward to represent
the applicant. He said their intent
is to completely renovate the place.
He said they wish to use steel
V-groove siding. Mr. Cates said
Texaco will reimburse them to improve
it and they plan to build something
North Richland Hills will be proud of.
He said the difference between brick
and steel V-groove siding is $12,000.
Mr. Cates stated the siding would be
painted grey. He showed pictures of
how the station would look.
Dr. Duer asked if they plan to
bull dose the building and start over.
Mr. Cates said they would still have
the slab and frame. He said he plans
to refurbish it.
Chairman Hubbard called for those
wishing to speak in opposition to this
request to please come forward.

Chairman Hubbard asked if there had
been any correspondence.
Mrs. Calvert stated there had been
none.

Mr. Grubb asked if the steel siding is
easily damaged.
Mr. Cates said no, but if any damage
occurs, a panel can be removed and
replaced, but if it were brick, it
would be hard to repair.
Mr. Cates said they plan to put a walk
and curb on the front and one side.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Dr. Duer stated the homes in this area
are frame homes.
BA 88-19
APPROVED
Dr. Duer made the motion to approve
BA 88-19 as requested. This motion
was seconded by Mr. Grubb and the
motion carried 5-0.

BA 88-20
Request of Trinity Interests to vary
from the Zoning Ordinance #1080 on
Lots lR, 2R, 4 & 5, Block 13, Snow
Heights North Addition, to be allowed
to NOT screen dumpsters. This
property is located east of Rufe Snow
Drive and north of Northeast Loop 820.
Chairman Hubbard opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Paul Foley, Agent, came forward. He
said they had a sanitation problem so
they took the screens down. He said
they have trouble with people putting
trash in the dumpsters. Mr. Foley
stated he had a new tenant and the
city inspector noticed the dumpsters
were not screened. He showed pictures
of the dumpsters. He said they left
the screen on the one next to the car
wash and the screen is intact on the
one next to Lee Optical and Wal-Mart.

Mr. Foley stated a Certificate of
Occupancy is being held up because of
not having the screens.
Chairman Hubbard called for those
wishing to speak in opposition to this
request to please come forward.
Chairman Hubbard asked if there had
been any correspondence.
Mrs. Calvert stated there had been
none.
Mr. Grubb said he felt the city should
enforce the pick-up of the garbage.
Mr. Taylor said some of the tenants
will not pay for a second pick-up.
Mr. Grubb said call the Fire Marshall.

Mr. Taylor said he is the Fire
Marshall.
Chairman Hubbard asked where the self
car wash is located.
Mr. Foley said it is on Lewis Drive
behind Eckerds and Minyards.
Chairman Hubbard said the pictures
show such a mess.
Mr. Taylor said the bailed trash
shown in the pictures stacked up
should be picked up daily. He said
that is a fire hazard.
Dr. Duer said he had rather see the
trash accumulate in the screen rather
than to blow into the neighborhood.

Mr. Grubb said he wants to see this
corrected. He said there are some
7-11 stores in the city that do not
have screens. He said there are a lot
of violations. Mr. Grubb said he
doesn't see this is a hardship for the
applicant; he sees it as a hardship
for the neighbors.

DENIED
ADJOURNMENT

Mr. Taylor said the Planning and
Zoning Commission is revising the
Zoning Ordinance and they plan to
leave this requirement in the
ordinance and make it stiffer.
Dr. Duer asked how the city could
require the old businesses to conform.
Mr. Taylor said if they sell, they
have to conform to the ordinance.
Dr. Duer asked when the ordinance came
into affect.
Mrs. Calvert said the Zoning Ordinance
#1080 was adopted January, 1984.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Mr. Cypert made the motion to deny
BA 88-20 as requested.
Mr. Taylor said they need to put a
time limit to get these fixed.
Mr. Foley said he would need 60 to 90
days.
Mr. Grubb said 90 days is too long.
He said he did not need more than 30
days.
Mr. Cypert amended his motion to put a
time span of not more than 30 days to
to screen dumpsters.
This motion was seconded by Mr. Grubb
and the motion to deny carried 5-0.
