MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
NOVEMBER 19, 1987 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Jack Roseberry, at 7:00 P.M.

CONSIDERATION OF THE MINUTES
OF OCTOBER 15, 1987
Mr. Grubb made the motion to approve
the minutes as written. This motion
was seconded by Mr. Schubert and the
motion carried 5-0.

BA 87-18
Request of W. H. Addington to vary
from the Zoning Ordinance #1080 on Lot
19, Block 22R, Holiday West Addition,
to allow the construction of an
accessory building 12 feet high
instead of the maximum limit of 10
feet. This property is located at
5737 Rio De Janeiro.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Mr. Addington came forward. He said
his accessory building is 12 feet high
but the ordinance says 10 feet. He
said he did not know the city had a
height limit. Mr. Addington said the
ordinance was approved in April and he
got his permit in June. He said he
felt there was a time in there that
nothing was printed telling about the
height restriction.

Mr. Addington said he had a stake out
inspection and found he was 5 feet to
the side instead of the required 6
feet. He said he had previously lived
in Hurst which had 5 foot side yards.
Mr. Addington moved it to conform. He
said his permit was approved without
the height on it.
Chairman Roseberry said it looks like
Mr. Addington is trying to comply with
the regulations.
Mr. Grubb asked Mr. Royston if this
wasn't about the time of the change in
his department.

Mr. Royston said possibly it was. He
said the Planning and Zoning
Commission has asked him to review the
Zoning Ordinance to see if some
changes are needed. He said this is
one area that possibly should be
changed.
Mr. Grubb asked where the measurement
should be made from.
Mr. Royston said the inspector has the
leverage to use his own judgement. He
said if it is one foot or less, he
could approve it, but not two feet.
Mr. Royston said the inspector
probably measured from the concrete to
the top.
Chairman Roseberry said most buildings
would be taller than 10 feet if they
had anything other than a flat roof.
Mr. Schubert asked how near finished
is the building.
Mr. Addington stated it is already
finished. He said he called for a
final inspection and found it was too
tall.

Mr. Bunting asked Mr. Royston if there
is a handout given out with the
requirements in it.

Mr. Royston stated there is. He said
when they take out a permit, they are
given this handout.
Mr. Bunting asked how long this had
been done.
Mr. Royston said it had been since the
ordinance was inacted.
Chairman Roseberry said they would
continue to have this problem if the
buildings do not have flat roofs.
Chairman Roseberry called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

BA 87-18
APPROVED
Mr. Schubert made the motion to
approve BA 87-18 as requested for 12
feet. This motion was seconded by Mr.
Bunting and the motion carried 5-0.

BA 87-19
Request of Kenneth W. Parchman to vary
from the Zoning Ordinance #1080 on Lot
1, Block 10, Windcrest Addition, to
allow the installation of a fence
beyond the side building line. This
property is located at 7300 Shady
Hollow Lane.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Mr. Parchman came forward. He stated
he and his Brother started building
the fence with no permit. He said he
went to his neighbor and asked if he
had a problem with him putting up the
fence and he said he didn't. Mr.
Parchman said his neighbor's house is
built so far back on his lot, his
fence would be in the front of his
house. Mr. Parchman showed the Board
pictures of the area.

Mr. Royston stated there is an error
in the drawing that was submitted. He
said Mr. Parchman measured from the
curb. He said it is one foot from the
property line.
Mr. Parchman said he and his Brother
built the retaining wall and he wants
the fence outside of it. He said he
just wants enough room between the
wall and the fence to get the lawn
mower through to the next level.
Chairman Roseberry asked how high the
wall was.

Mr. Parchman said it is 5 railroad
ties high. He said there are several
reasons why he needs the fence. He
said there would be more room for his
children to play; and with children
walking to school, it would keep them
out of his yard.
Mr. Parchman stated he checked how
much sight he needed when he backs out
of his driveway. He said with the 12
feet from the fence to the curb, you
can see both ways when you back out.
Mr. Bunting asked how much grassy area
there is.
Mr. Parchman said 12 feet.
Mr. Schubert asked how much has he got
done on the fence.
Mr. Parchman said he has the fence
built to the back edge of the house
and the posts are already set.
Chairman Roseberry called for those
wishing to speak in opposition to
please come forward.

Arthur Asbury, 7321 Shady Hollow, came
forward. He said he lives directly
across the street. He said he was not
necessarily against this request, but

he had the same problem and it cost
him $200.00. He said they just told
him to tear his fence down, he said he
was not told he could go before
anyone.
Chairman Roseberry stated he could
have come before the Board.
Mr. Asbury said he guessed he would
need to see the results of this
request and then petition the Board.
Mr. Grubb stated there are different
circumstances for each case and the
Board would study them on an
individual basis.
Chairman Roseberry asked Mr. Royston
if he had seen the property.

Mr. Royston said not recently, but he
was aware of the problem and knew this
request would be in.
Chairman Roseberry asked if he felt
there would be a visual problem.
Mr. Royston stated there would be no
sight problem. He said in regard to
the traffic on Woodbend, Starnes Road
will be bid on December 1 and will be
put through and there will no longer
be a problem.
Mr. Bunting asked if a permit was
taken out for the fence.
Mr. Parchman said no. He said he was
not aware he needed one, but he
stopped and went the next day and got
a permit.
Mr. Bunting asked if there were
handouts pertaining to fencing.

Mr. Royston said no, there are too
many different circumstances involved.
Chairman Roseberry closed the Public
Hearing.

Mr. Grubb made the motion to approve
BA 87-19 as requested. This motïon
was seconded by Mr. Cypert and the
motion carried 5-0.
Chairman Roseberry asked if there was
any old business.
Mr. Grubb asked what had happened to
the fence requirement between the
school and Quintin's Crossing.
Mr. Royston said it is still in court.
He said an attorney came in today to
refresh his memory on the case so it
will probably be heard soon. Mr.
Royston said it has been postponed
several times.
