MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
SEPTEMBER 11, 1986 - 7:30 P. M.

The meeting was called to order by the

CONSIDERATION OF THE MINUTES
OF AUGUST 14, 1986
Mr. Wood made the motion to approve
the minutes as written. This motion
was seconded by Mr. Schwinger and the
motion carried 5-0 with Ms. Nash
abstaining since she was not present
at the meeting.

PZ 86-36
Request of Johnston & Sons
Construction to rezone Lots IR & 2R,
Block 6, Meadow Lakes Addition, from
their present classification of R-I
Single Family to LR Local Retail.
This property is located at the
southwest corner of Rufe Snow Drive
and Meadow Lakes Drive.
Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Marion Massey, Attorney, came forward
to represent the applicant. He said
they are asking for Local Retail
because they did not have an acre
which is required for 0-1 Office
zoning. He stated they want to build
a professional office building. Mr.
Massey stated they would deed restrict
the property to a one story
professional office.

Mr. Wood asked why they would want to
go retail instead of residential.
Mr. Massey stated it was because the
lots face Rufe Snow. He stated the
marketing situation is caused by the
traffic and noise.
Mr. Wood stated he had noticed the
nice fence that had been installed,
but he said it was brought up in the
platting process the problem he would
have with lots facing on Rufe Snow.
Mr. Massey stated they felt this was
the best use of the property and it
would be improbable for it to be used
as residential.

J. B. Johnston came forward. He said
he had originally planned to have 3
cul de sacs and the property would
back up to Rufe Snow, but it would not
fit, it could not be done. Mr.
Johnston stated he had built a house
next to the brick wall but has not
been able to sell it because of the
noise and traffic along Rufe Snow. He
stated that the property to the north
is zoned Commercial. He said he has a
lead for a medical office if he can
get the zoning.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.

Pat Tucker, 4913 Lake Side Circle,
came forward. She stated she was not
within the 200 foot radius of this
property, but was opposed to this
request. She stated she felt this
should stay a residential area. Ms.
Tucker stated they already have enough
traffic along Rufe Snow. She stated
the neighbors do not want it to be
like old Rufe Snow and Glenview. Ms.
Tucker stated she had filed a petition
in opposition to this request.

Mr. Bowen stated there is a legal
petition which, if approved tonight,
would require a 3/4 majority of the
City Council to approve it.
Henry Erdahl, 6704 LaRue Circle, came
forward. He stated he received a
letter regarding the request. He said
he had lived here for 23 years and
wanted it to stay residential. Mr.
Erdahl stated if you open it up for
retail you would not know what would
come in there. He said it would also
create a lot of traffic and noise and
would probably be open late at night.

Lyle Welch, 4824 Lariat Drive, came
forward. He said a few years back
when they came in for zoning, it was
agreed it would be for residential.
He said just because Mr. Johnston
doesn't have room, it is not our
fault. Mr. Welch said to let the
commercial stay on the north side and
the school and residential on the
other side.
Mr. Olman, 6513 Meadow Lakes Drive,
came forward. He said he wanted it to
stay residential. He said Parkridge
Estates to the south developed and
sold along Rufe Snow.
John Raney, 6532 Woodcreek, came
forward. He said he wants it to stay
residential. He said he plans to
build him a new house on Carston Court
close to this area. Mr. Raney stated
he has 4 children and there are
several other children in the area.
He said they supported having the
library and recreation center at the
Church of Christ and he feels this
property should stay residential.

George McCaro, 6701 Karen Drive, came
forward. He said he lives across the
street from this property. Mr. McCaro
said Mr. Johnston said the property
was worthless as residential, but when
Mr. McCaro gets his appraisal from
Tarrant Appraisal, they disagree.

Mr. McCaro stated he has to pick up
trash now and it would be worse if
this zoning is approved.
Chairman Bowen closed the Public
Hearing.
PZ 86-36
DENIED
Ms. Nash made the motion to deny
PZ 86-36. This motion was seconded by
Ms. Flippo.
Chairman Bowen stated he agrees with
Ms. Nash. He said the Commission has
to look at the lots and the good of
the entire neighborhood. Chairman
Bowen stated that if they approved
this request, it would be setting a
precedent. He said he did not want
to see retail go down Rufe Snow.
The motion carried 5-0 and the request
was denied.

Chairman Bowen stated the applicant
has the right to appeal to the City
Council.

PZ 86-39
Request of Rufe Snow/Chapman Joint
Venture to rezone a portion of Tract
3A2, William Mann Survey, Abstract
1010, from its present classification
of C-I Commercial to C-2 Commercial.
This property is located on the east
side of Rufe Snow Drive, north of
Chapman Drive.
Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Arnold Pent came forward to represent
the Joint Venture. He stated he has
two users to go into the northern
property. He said it was an auto
parts store and a self service car
wash and they are negotiating now for
other automotive related tenants.

Mr. Wood asked what were the uses.
Mr. Pent stated an auto parts and a
car wash.
Chairman Bowen asked what the others
were.
Mr. Pent stated they may have a
nursery to sell plants.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
PZ 86-39
APPROVED
Mr. Schwinger made the motion to
approve PZ 86-39. This motion was
seconded by Mr. Wood and the motion
carried 5-0.

PZ 86-40
Request of Alan W. Hamm to rezone Lot
B-R, Block 11, Clearview Addition,
from its present classification of C-l
Commercial to C-2 Commercial. This
property is located at the northwest
corner of Grapevine Highway and
Colorado Boulevard.
Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Mr. Hamm, 5125 Davis Boulevard, came
forward. He stated he wishes to up
grade this property to give additional
uses. He stated the property is
bounded by C-l on both sides with an
office supply, fast food restaurant
and an auto supply. Mr. Hamm stated
this zoning change would help with the
leasing of the property, but some of
the things allowed in C-2 he would not
want.

Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
Don Hughes, 8004 Standley, came
forward. He asked what Mr. Hamm
planned to do with the property
directly behind his property. He said
there is already a wall of buildings.
He said it would be getting away from
the residential area.
Chairman Bowen stated the property is
already zoned C-I for retail uses.
Mr. Tucker read from the Zoning
Ordinance the list of what could be in
C-l zoning. He stated it would not
change the type of building he could
have, just the uses within the
building.

Chairman Bowen stated there were some
objectionable uses in C-2.
Jerry Apple, 8008 Standley, came
forward. He stated there is a
drainage problem in this area. He
said it floods his back yard and is
cracking the foundation. Mr. Apple
stated his property is already
isolated so that he can not sell his
property, but the taxes still keep
going up.
Chairman Bowen stated the drainage
would be taken care of in the platting
process. He stated the drainage plan
would have to be approved by the City
Engineer.
Mr. Apple stated he had called down to
the city about his problem, but did
not get the problem solved.

Mr. Royston stated some of the
neighbors do have a drainage problem.
He said some would be solved with this
development of Mr. Hamm's property,
but some is caused by the lay of the
land.

Chairman Bowen closed the Public
Hearing.
PZ 86-40
APPROVED
Mr. Schwinger made the motion to
approve PZ 86-40 with the stipulation
that a proposed list of permitted uses
be selected prior to going to the City
Council. This motion was seconded by
Mr. Wood and the motion carried 5-0.
Chairman Bowen stated the next two
requests would be heard together, but
would be voted on separately.

PZ 86-41
Request of Campus Hill Joint Venture
to rezone a portion of Tract 3, L. C.
Walker Survey, Abstract 1653, from its
present classifications of C-I
Commercial and R-7-MF Multi-Family to
C-2 Commercial. This property is
located on Grapevine Highway across
from the Tarrant County Junior
College.

PZ 86-42
Request of Campus Hill Joint Venture
to rezone a portion of Tract 3, L. C.
Walker Survey, Abstract 1653, from its
present classifications of C-l
Commercial and R-7-MF Multi-Family to
I-I Industrial. This property is
located on Grapevine Highway across
from the Tarrant County Junior
College.
Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of these requests to
please come forward.

Taylor Gandy, Attorney and part owner,
came forward. He stated this is a 28
acre tract with 1700 foot frontage on
Grapevine Highway. Mr. Gandy stated
that most of the property is zoned C-l
Commercial, but 5 or 6 acres are zoned
Multi-Family. He stated he has had
engineers and land planners working on
this property. He showed a layout of
the proposed zoning.

Mr. Gandy stated he is asking for C-2
on all except the property next to the
creek for which he is asking for 1-1.
He stated they do not have a use for
the property at this time. Mr. Gandy
stated there is a street proposed to
line up with the entrance to the
campus. He stated this property is
located close to Mangham Airport which
is zoned light industrial. Mr. Gandy
stated there is not a market for the
multi-family and will not be any time
soon. He said this zoning would
eliminate all of the multi-family on
this tract.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
PZ 86-41
APPROVED
Ms. Flippo made the motion to approve
PZ 86-41. This motion was seconded by
Ms. Nash and the motion carried 5-0.
PZ 86-42
APPROVED
Mr. Wood made the motion to approve
PZ 86-42. This motion was seconded by
Mr. Schwinger and the motion carried
5-0.
Chairman Bowen stated the next 3
requests would be heard together, but

Request of Richmond Bay Development,
Inc. to rezone a portion of Tracts 1,
2, & 4A, W. A. Trimble Survey,
Abstract 1520, from their present
classifications of R-2 Single Family,
R-7-MF-PD Multi-Family Planned
Development & OC Outdoor Commercial to
R-2 Single Family. This is Tract 6
and is located on the south side of
Meadow Lakes Drive west of Rufe Snow
Drive.

Abstract 1520, from their present
classifications of R-7-MF-PD
Multi-Family Planned Development & OC
Outdoor Commercial to R-6-T Townhouse.
This is Tract 5 and is located on the
south side of Meadow Lakes Drive west
of Rufe Snow Drive.

PZ 86-45
Request of Richmond Bay Development,
Inc. to rezone a portion of Tracts 1,
2, & 4A, W. A. Trimble Survey,
Abstract 1520, from their present
classifications of OC Outdoor
Commercial, R-2 Single Family, and
R-7-MF-PD Multi-Family Planned
Development to OC Outdoor Commercial.
This property is located on the south
side of Meadow Lakes Drive west of
Rufe Snow Drive.
Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of these requests to
please come forward.
Marion Massey, Attorney, came forward.
He stated they wish to change the
zoning to take out the multi-family
zoning and ask to leave 102 single
family lots, 30 to 35 townhomes, and
change the fairway of the golf course.
Mr. Wood said he thinks it looks good.
He asked if the outdoor commercial
goes completely around the
residential.
Mr. Massey showed the Commission a
layout of the property.
Mr. Wood asked if it goes around the
lower lake and across the dam.
Mr. Bob Frank came forward. He stated
it does.

Chairman Bowen asked if the R-2 zoning
would have 10,000 square foot lots and
2000 square foot homes.
Mr. Frank said the lots would be
10,450 and the houses 2000 square
feet.
Chairman Bowen asked Mr. Royston if
these requirements should be stated.
Mr. Royston stated the PD has been
eliminated and if you want
restrictions, they should be stated.

Mr. Massey said he would hope the
Commission would not hold them to the
restriction of no building permits
till the golf course is in. He said
he hoped that since there is no
multi-family, they would not hold us
to the construction of the golf
course. Mr. Massey said they came
fairly close to å date of development
of the golf course.
Mr. Frank said he guessed they could
tie it to the townhomes.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
W. D. Clark, 6305 Riviera Drive, came
forward. He stated he would like to
know what is going to happen to the
property behind his house.
Mr. Wood said it would be single
family.
Mr. Clark asked if the single family
would go to the canal.
Mr. Wood stated there is a parkway and
then the single family. He showed Mr.
Clark the layout.

Mr. Clark asked who plans to maintain
this property.

Mr. Frank stated he maintains it now,
but it will be the homeowners
association.
Mr. Clark said Mr. Frank is doing a
poor job maintaining it.
Chairman Bowen told Mr. Clark that he
should call the city if he has any
complaints.
Chairman Bowen closed the Public
Hearing.
PZ 86-43
APPROVED
Ms. Nash made the motion to approve
PZ 86-43 with the understanding that
the lot size and square footage of the
house be put on the plat. This motion
was seconded by Mr. Schwinger and the
motion carried 5-0.
PZ 86-44
APPROVED
Mr. Wood made the motion to approve
PZ 86-44 with the stipulation to
continue the requirements related to
the golf course as contained in the
previous cases. This motion was
seconded by Ms. Flippo and the motion
carried 5-0.
PZ 86-45
APPROVED
Mr. Wood made the motion to approve
PZ 86-45. This motion was seconded by
Mr. Schwinger and the motion carried
5-0.

PZ 86-46
Consideration of an amendment to
Zoning Ordinance #1080 regarding the
R-7-MF District.
Chairman Bowen stated this amendment
would change the Planned Development
to allow a maximum of 20 units.
PZ 86-46
APPROVED
Ms. Flippo made the motion to approve
PZ 86-46. This motion was seconded by
Ms. Nash and the motion carried 5-0.
