CALL TO ORDER The meeting was called to order by the Chairman, Don Bowen, at 7:30 P. M. ROLL CALL PRESENT: Chairman Secretary Alt. P & Z Coordinator ABSENT: Mark Wood Joe Hallford Marjorie Nash CONSIDERATION OF THE MINUTES OF SEPTEMBER 25, 1986 Chairman Bowen stated the minutes would have to be postponed due to not enough members present that were present at the meeting. . CONSIDERATION OF THE MINUTES OF NOVEMBER 13, 1986 Chairman Bowen stated the minutes would have to be postponed due to not having enough members present that were present at the meeting. Chairman Bowen stated he has a letter requesting item #18 be withdrawn. 1. PS 86-49 Request of Birdville I.S.D. for preliminary plat of Briarwood Estates, Section 7. PS 86-49 APPROVED Mr. Tucker made the motion to approve PS 86-49 subject to the engineer's comments. This motion was seconded by Mr. Schwinger and the motion carried 4-0. 2. PS 86-50 Request of Don R. Waters for replat of Lot 3R, Block 11, Fossil Creek Trails Addition. . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this replat to please come forward. Page 2 P & Z Minutes December 11, 1986 . There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Chairman Bowen stated that the replat creates a split in the zoning of the lot. He said the additional area is presently zoned OC Outside Commercial and a residence is not allowed in OC zoning. PS 86-50 TABLED Mr. Tucker made the motion to table PS 86-50 until such time as a zoning request is submitted for the property. This motion was seconded by Ms. Flippo and the motion to table carried 4-0. 3. PS 86-54 Request of Harston Gravel Company for replat of Lots 5RA & 5R2A, Block 3, Industrial Park Addition. . PS 86-54 APPROVED Mr. Schwinger made the motion to approve PS 86-54. This motion was seconded by Mr. Tucker and the motion carried 4-0. Chairman Bowen stated the next three zoning requests would be heard together, but would be voted on separately. 4. PZ 86-53 Request of Kenneth C. Whiteley, Trustee to rezone part of Tracts IB & 2A, D. Moses Survey, Abstract 1150, from their present classification of AG Agriculture to R-2 Single Family. Moses Survey, Abstract 1150, from their present classification of AG Agriculture to R-4-SD Separate Ownership Duplex. This property is located north of the railroad and east of Eden Addition. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. . Owen D. Long, Engineer and part owner of the property, came forward. He stated that item #4 is for R-2 which is 9000 square foot lots, and #5 is from Agriculture to R-3 Single Family. Mr. Long stated this is buffered on the north by a drainage ditch. He said they plan to put R-4-SD Separate ownership duplex along the railroad and behind the County Barn. He said they plan to deed restrict them to look like the others in the area. John Barfield, another owner of the property came forward. He said they had tried to rezone this property previously to R-3 and R-4-SD and there was some opposition so this time they have some R-2 and R-3 with less R-4-SD. Mr. Barfield stated they plan to build them 1600 to 1800 square feet. Chairman Bowen stated there had been a petition submitted in opposition to the three requests. Mrs. Calvert stated some more names have been submitted for the petition tonight. . Chairman Bowen called for those wishing to speak in opposition to these requests to please come forward. ~ Page 4 P & Z Minutes December 11, 1986 . Manuel Pasillas, 7400 Boca Raton, came forward. He said he would like to speak regarding item #6-Duplex. He said he feels there is plenty of duplexes in the city; why go and rezone more, build the ones you already have zoned first. Mr. Pasillas said duplexes were very depressed now. He said there are new duplexes that have never been sold or leased. He said they buy them for tax purposes. Mr. Pasillas said if this is the highest and best use for the land, it is contributing to the downfall of the area. He said R-3 does not conform with the area. He said this would not attract people to the area. Mr. Pasillas said in Flamingo Two, 13 homes are 2500 to 3000 square feet and are being sold. He said he likes Flamingo like it is now. . Mr. Pasillas asked all the people in the audience to stand who were in opposition to these requests. There were many who stood. Mr. Tucker asked Mr. Pasillas what he wanted to do with the R-2 request. Mr. Pasillas stated most of the houses in the area are at least 1800 square feet and he feels an 1800 square foot minimum would conform to the area. He said the minimums are what they are opposed to. Mr. Tucker stated the Commission is only a recommending body, but the City Council can stipulate larger homes. Mr. Pasillas stated they would like to have the area to conform to what is already there. . Mr. Tucker stated that the R-3 request is adjacent to an R-3 in Eden Addition. ~ Page 5 P & Z Minutes December 11, 1986 . Mr. Pasillas stated he believes there was a stipulation to larger homes there. Mr. Tucker asked Mr. Royston if that was true. Mr. Royston stated that to his knowledge, there was not a stipulation. Ms. Flippo stated that R-4 is contiguous. She asked what they had rather have there. Mr. Pasillas said to just leave the land vacant. Mr. Tucker said that was against State Statutes. He said you cannot deny a person the use of his land. . Mr. Pasillas said the Commission could deny the zoning request. Mr. Tucker stated the Commission has certain limitations. Skip Weld, 8970 Hialeah Circle South, came forward. He said there is only one access road to Hialeah Circle South and North to the R-2 area. Mr. Weld stated he would like to keep it all R-2. He said anything north of the railroad has to come through Eden Addition and Flamingo Estates and the traffic would be bad. Mr. Weld said that Pulte Homes has gone on the other side of the highway and built R-2 next to the railroad and are selling them. He said he requests all the requests be for R-2. . Mr. Weld said he requests that any construction be accessed to Precinct Line Road. He said Mr. Barfield owns the property and Mr. Weld recommends they provide access so they could build a construction road through to Precinct Line Road. Page 6 P & Z Minutes December 11, 1986 . Myrtis Byrd, 7312 Hialeah Circle West, came forward. She said she was not necessarily opposed or in favor of the requests. She asked what the deed restrictions would be. Chairman Bowen stated the owners were deed restricting to whatever conforms to the City Ordinance. Ms. Byrd asked if they would have an outlet to Precinct Line Road. Chairman Bowen stated he was not sure who owned the property to Precinct Line Road for an outlet. Ms. Byrd said she would be in opposition to the requests if they do not have an outlet to Precinct Line Road. . Chairman Bowen said the Commission cannot tell them they can not use their property. Ms. Byrd said she would like to see them build R-2 with duplexes along the railroad, but not be allowed to build unless they have an outlet to Precinct Line Road. Richard Wrisley, 5812 Lance Court, Fort Worth, came forward. He said when they developed Flamingo Estates, they put in a culvert. He said the property originally drained, but now it drains into the culvert and onto his property. Mr. Royston stated Mr. Long would have to enlarge the culvert in Eden Estates. . Mr. Weld came forward. He said the Commission stated they did not know who owns the property to Precinct Line Road. He stated that the Oak Hills Joint Venture owns the property along Precinct Line Road north of the County Barn. Page 7 P & Z Minutes December 11, 1986 . Chairman Bowen stated the ingress egress would be a platting matter and these are zoning requests. Mr. Tucker stated that the State Law says zoning comes before platting. Nick Samilo, 7312 Boca Raton, came forward. He said you are going to rezone this property to R-4 Duplex then he can come back every year and change it. He said why not make him build larger houses that would sell. Mr. Samilo said the developers are trying to make North Richland Hills a dump and he wishes the owner of this property would clean it up. . Mr. Long came back for rebuttal. He said these are not just duplexes, they are single family attached which are adjacent to R-4-SD. He said the R-3 request backs up to the R-3 and the creek and the R-2 is adjacent to the existing R-2. Mr. Long stated they do not own the property to Precinct Line Road. He said they have worked with Dr. & Mrs. Harris and bought one strip that was landlocked, but they were not willing to sell the other land. He said they wanted one million dollars for it. Mr. Long stated the R-3 1600 and R-2-1800 would be larger than the deed restrictions to the west. Chairman Bowen closed the Public Hearing. 4. PZ 86-53 APPROVED Ms. Flippo made the motion to approve PZ 86-53 with a deed restriction of 1800 square foot houses. This motion was seconded by Mr. Schwinger and the motion carried 4-0. 5. PZ 86-54 APPROVED Mr. Schwinger made the motion to approve PZ 86-54 with a deed restriction of 1600 square foot houses. This motion was seconded by Ms. Flippo and the motion carried 4-0. . Page 8 P & Z Minutes December 11, 1986 . Mr. Tucker said he knows what they are trying to do with the duplex zoning, but he was not sold on the idea of having to have duplex along the railroad. 6. PZ 86-55 DENIED Mr. Tucker made a motion to deny PZ 86-55. This motion was seconded by Ms. Flippo and the motion carried 4-0. Mr. Tucker stated the Commission is only a recommending body, but he thinks that once this property is platted it will throw a tremendous load of traffic on the ingress-egress. Chairman Bowen stated the cases approved tonight will be heard by the City Council on January 12th. . Chairman Bowen stated the next 4 requests will be heard together, but voted on separately. 7. PZ 86-56 Request of B. H. & L. Joint Venture to rezone a portion of Tracts 2 & 2Al, J. C. Bradford Survey, Abstract 140, from their present classification of AG Agriculture to C-1 Commercial. This property is located at the southeast corner of Keller Smithfield Road and Shady Grove Road. 8. PZ 86-57 Request of B. H. & L. Joint Venture to rezone a portion of Tracts 2 & 2Al, J.C. Bradford Survey Abstract 140, from their present classification of AG Agriculture to R-4-SD Separate Ownership Duplex. This property is located on the east side of Keller Smithfield Road, south of Shady Grove Road. 9. PZ 86-58 Request of B. H. & L. Joint Venture to rezone a portion of Tract 2, J. C. Bradford Survey, Abstract 140, from its present classification of AG Agriculture to C-2 Commercial. This property is located at the northeast corner of Keller Smithfield Road and Wilson Lane. . Bradford Survey, Abstract 140, from its present classification of AG Agriculture to R-2 Single Family. This property is located on the south side of Shady Grove Road, approximately 791 feet east of Keller Smithfield Road. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. . Owen D. Long, Engineer and part owner, came forward. He showed his overall master plan of the city. He said item #7 is from AG to C-l. He said Mr. Barfield had owned it for several years. He said it is located at Shady Grove Road and Keller Smithfield Road. Mr. Long stated there are two houses along Keller Smithfield Road that are not included in this property. He said item #8 is from AG to R-4-SD to form a buffer to the R-2. Mr. Long said item #9 is from AG to C-2 Commercial which would border on Keller Smithfield Road and the proposed Wilson Lane. He said item #10 is from AG to R-2 which would have 9000 square foot lots. Chairman Bowen called for those wishing to speak in opposition to these requests to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. 7. PZ 86-56 APPROVED Mr. Schwinger made the motion to approve PZ 86-56. This motion was seconded by Ms. Flippo and the motion carried 4-0. . PZ 86-57 DENIED Ms. Flippo made the motion to deny PZ 86-57. This motion was seconded by Mr. Schwinger and the motion to deny carried 4-0. 9. PZ 86-58 APPROVED Mr. Tucker made the motion to approve PZ 86-58. This motion was seconded by Mr. Schwinger and the motion carried 4-0. 10. PZ 86-59 APPROVED Mr. Tucker made the motion to approve PZ 86-59. This motion was seconded by Ms. Flippo and the motion carried 4-0. 11. PZ 86-60 Request of B. H. & L. Joint Venture to rezone Tract 5A, W.C. Newton Survey, Abstract 1182, and Tract 1, H.L. Allen Survey, Abstract 65, from their present classification of AG Agriculture to C-l Commercial. This property is located on the west side of Precinct Line Road, south of Shady Grove Road. . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Owen D. Long, Engineer and part owner, came forward. He stated they had tried to purchase this property some time ago to make their master plan work. He said they had to go to Oklahoma and buy a lady a house there before they could secure this property. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . Newton Survey, Abstract 1182, from its present classification of AG Agriculture to 0-1 Office District. This property is located on the west side of Precinct Line Road, north of the proposed Wilson Lane. 13. PZ 86-63 Request of B. H. & L. Joint Venture to rezone Tract 8BIA, S. Richardson Survey, Abstract 1266, and a portion of Tract 5EIA, W.C. Newton Survey, Abstract 1182, from their present classification of AG Agriculture to R-2 Single Family. This property is located west of Precinct Line Road, north of the proposed Wilson Lane. . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. Owen D. Long, Engineer and part owner, came forward. He stated they need this piece of property to give an outlet to Precinct Line Road. He said it is presently zoned AG and they are requesting 0-1 Office District on the corner with R-2 on the back. Mr. Long stated they plan to reconstruct the existing building for a sales office. He stated they have an outlet on Davis Boulevard, but need one on Precinct Line Road. Chairman Bowen called for those wishing to speak in opposition to these requests to please come forward. . Marjorie Dodd, 8125 Precinct Line Road, came forward. She said she needed some questions answered. She asked about them refurbishing the house at 8662 Precinct Line Road to an office building. ~ Page 12 P & Z Minutes December 11, 1986 . Mr. Tucker stated that if granted 0-1 zoning, it would be office zoning unless they requested another change. Ms. Dodd asked what size the residential zoning would be. Mr. Tucker said the houses would be a minimum of 1600 square feet with 9000 square feet lots. Ms. Dodd asked how much right of way would they have to have to widen Precinct Line Road. She stated the road is already torn up. Mr. Tucker stated the zoning has no effect on repair to the road. Mr. Royston stated there would be some escrow involved, but doing something to the road now is out of the question . Ms. Dodd asked what effect does these requests have on her property. Mr. Tucker said "none". Ms. Dodd asked who pays for the water and sewer. Mr. Tucker stated the developer pays for it. He said the developer puts in the streets and water and sewer and then sells the lots to builders. Ms. Dodd asked what sort of time frame are we talking about. Mr. Tucker stated he was not sure, it could be one to five years. Chairman Bowen closed the Public Hearing. 12. PZ 86-62 APPROVED Mr. Tucker made the motion to approve PZ 86-62. PZ 86-64 Request of Tony Avanzini to rezone Tract 3A2, David Moses Survey, Abstract 1150, from its present classification of AG Agriculture to R-2 Single Family. This property is located at the northeast corner of Eden Road and Everglade Drive. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mr. Avanzini came forward. He said they would like to build some homes here. . Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 86-64 APPROVED Mr. Schwinger made the motion to approve PZ 86-64. This motion was seconded by Ms. Flippo and the motion carried 4-0. RECESS Chairman Bowen called a recess at 8:36 P. M. BACK TO ORDER Chairman Bowen called the meeting back to order at 8:48 P. M. with the same members present. 15. PZ 86-65 Request of Delbert Stembridge, Trustee to rezone Tract 3, John Condra Survey, Abstract 311, from its present classification of AG Agriculture to R-2 Single Family. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Jackey Fluitt with Stembridge & Associates, came forward. He stated that when they purchased the property, they agreed to a deed restriction of 1700 square foot houses. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 86-65 APPROVED Mr. Tucker made the motion to approve PZ 86-65 with the stipulation of 1700 square foot houses. This motion was seconded by Ms. Flippo and the motion carried 4-0. . 16. PZ 86-66 Request of Debra Jackson to rezone Tract 3Al, William Cox Survey, Abstract 321, from its present classification of AG Agriculture to C-l Commercial. This property is located at the northwest corner of Davis Boulevard and Turner Drive. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Ms. Jackson came forward. She stated this property is located at the corner of Turner and Davis Boulevard. She said it is an older residence she would like to turn into Commercial. . Mr. Tucker stated the structure would have to meet the zoning ordinance and the building code. He stated that once this request is granted, it will be non-conforming and could not be used as a residence. . . . ~ Page 15 P & Z Minutes December 11, 1986 Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. Beth Davis, 7720 Aubrey, came forward. She asked if there was just one Commercial District. Chairman Bowen stated there were two, C-l and C-2 and Ms. Jackson is asking for C-1. Ms. Davis asked if this zoning would allow for a shopping center. Mr. Tucker said it would, but the size of the property would not be large enough. Ms. Davis asked how large it was. Ms. Flippo stated it is 1.4 acres. Ms. Davis said it was about the size for a 7-11 store. Mr. Tucker stated that was correct. Chairman Bowen closed the Public Hearing. PZ 86-66 APPROVED Mr. Schwinger made the motion to approve PZ 86-66. This motion was seconded by Mr. Tucker and the motion carried 4-0. Chairman Bowen stated the next four requests would be heard together, but voted on separately. 17. PZ 86-67 Request of Charles Schreiner Nelson to rezone Tract 2, S. Richardson Survey, Abstract 1266, & Tract 1, Alexander Hood Survey, Abstract 683, from their present classification of AG Agriculture to R-2 Single Family. This property is located west of Keller Smithfield Road, north of Bursey Road. 19. PZ 86-69 Request of Charles Schreiner Nelson to rezone Tract 2, S. Richardson Survey, Abstract 1266, from its present classification of AG Agriculture to C-2 Commercial. This property is located at the southwest corner of Keller Smithfield Road and Wilson Lane. 20. PZ 86-70 Request of Charles Schreiner Nelson to rezone Tracts lA & 2, S. Richardson Survey, Abstract 1266, from their present classifications of AG Agriculture and R-2 Single Family to R-8 Single Family Detached Zero Lot Line. This property is located on the south side of Wilson Lane, west of Keller Smithfield Road. . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. . Wes Shaver, 1250 N.E. Loop 410, San Antonio, TX, came forward to represent the owners. He showed a map of the proposed Wilson Lane and the proposed land use from Highway 377 to Precinct Line Road. He said half of Wilson Lane is in Keller and is under construction. Mr. Shaver said it is to be a 6 lane divided thoroughfare going east and west. He said it would have quite a bit of traffic. Mr. Shaver said he met with some of the homeowners. He said he was asking for R-2 next to Bursey and Keller Smithfield Road. He said north of Continental Trail he had previously asked from AG to R-3, but due to some Page 17 p & Z Minutes December 11, 1986 . objections in Fair Oaks Addition to the 7500 square foot lots and 1400 square foot homes he removed it from the agenda and resubmitted it for R-2 zoning. . Mr. Shaver stated that across the creek at the corner of Keller Smithfield and Wilson he has asked for 6 plus acres (9 including the right of way) from AG to C-2 Commercial and then south of Wilson Lane, north of the creek he has asked for from AG and .R-2 to R-8 zoning. He said there is some concern about the large amount of R-8, but the cost in developing Wilson Lane and the cost of the drainage and channel would justify a higher density. Mr. Shaver stated the traffic would be on Wilson Lane and these houses would not be readily seen by people to the south. He stated it would be in the Keller School District. Mr. Shaver said the drainage proposal meets all of the requirements of FEMA, and should help take the flow out and help some of the people to the south. . Mr. Shaver said the R-8 zoning has a minimum of 4000 square foot lots, but they intend to have lots 60 by 100 (6000 square feet), and a minimum of 1400 square feet houses instead of the required 1200 square feet houses. He submitted a letter which he read to the Commission: "Gentlemen: Regarding our proposal Zoning Case for 70.93 acres of R-8 Single Family Zoning on Wilson Lane, we would like to made the following suggested restrictions: Typical Lot Size- 60' x 100'/6,000 square foot average; Minimum Structure Size-1400 square feet; Proposed Density-5 units per acre. In addition to these restrictions, we intend to screen the proposed acreage with permanent masonry or wood and masonry fencing along Wilson Lane and along the boundary between this property and proposed C-2 zoned property (as indicated on the Conceptual Plan). At the time of platting, we intend to introduce additional restrictions, such as landscaping and masonry facades (as indicated in the elevations shown on the Conceptual Plan). Sincerely, Charles Schreiner Nelson". . Mr. Shaver stated he would like to submit these stipulations as requirements. He said they intend to do a high quality project. He said they would have lots selling from $17,000 to $20,000 and homes in the $90,000 bracket. Mr. Shaver stated he had discussed this with a local builder, J. B. Sandlin. He read a letter to the Commission: "Dear Members of P & Z: We have had several discussions with Wes Shaver about his tract of land along Wilson Lane in the City of NRH. We would like to build a quality product in that area on about a 6000 square foot lot and have a house size of a minimum of 1400 square feet and above. If you could find a zoning that could fit our needs we feel that this would help both us and the City of North Richland Hills. Thank you. Yours very truly, Mike Sandlin." James Wicker, Bayer and Associates, Engineer for the project, came forward. He said he had been working with the homeowners and he showed pictures of homes proposed for the R-8 zoning. Chairman Bowen called for those wishing to speak in opposition to these requests to please come forward. . Jack Frisque, 8025 Valley Drive, came forward. He stated the homeowners have had several meetings with Mr. Shaver and his Associates. Mr. Frisque stated he is representing the homeowners tonight. Page 19 P & Z Minutes December 11, 1986 . . Mr. Frisque stated that the developers had a sincere desire to work with the homeowners. He said the homeowners are in favor of some R-2, opposed to R-3, and have no problem with the C-2 Commercial, but we had no problem with the Commercial a year ago. Mr. Frisque said item #20-70.93 acres of R-8 is a problem. He said the Conceptual Plan looks good, and they have good intentions, but looks is in the eye of the beholder. Mr. Frisque stated that Mr. Barfield is trying to back out of his part in Wilson Lane; the City Master Plan calls for a 4-lane road. Mr. Frisque stated the homeowners have been working very close with Keller. He said Keller is considering changing some of their high density to single family. Mr. Frisque stated that there is low density single family across from the requested R-8. He said the homeowners are opposed to the R-8. He said none is developed in this city. Mr. Frisque said the homeowners suggest they go back to the drawing board and find something more desirable. Richard Hudler, 7313 Continental Trail, came forward. He stated that his property lies directly south of the proposed R-8 zoning. He said the houses are 2000 square feet plus. Mr. Hudler said if was zoned for 1400 square feet houses, that is what they would build. Beth Davis, Aubrey Lane, came forward. She said she did not feel the best use of the land is R-8. . Tom Duer, 7312 Londonderry, came forward. He asked if the acreage could be put in the agenda. He said it would help them. Dr. Duer said everyone says they want to build a high quality project, but some don't. ~ Page 20 P & Z Minutes December 11, 1986 . Dr. Duer said he and Mr. Tucker are on the Charter Commission and the plan to request a name change for North Richland Hills, but they might need to change the quality of building in North Richland Hills. He said builders don't want to build quality homes in North Richland Hills. He said a friend of his had his house appraised and the appraiser said if it had been 40 feet over in Keller it would have appraised for $25,000 more. Dr. Duer said the developer say they just can't afford to build high quality in North Richland Hills, but a half a mile north they plan to build an 18 hole golf course. He told the Commission to stick to their guns and require high quality. He said the R-2 adjacent to the R-2 request is 1800 square foot minimum. . Chairman Bowen closed the Public Hearing. Mr. Tucker said he felt the request for R-2 should be the same as the property adjacent to it. Chairman Bowen asked Mr. Shaver if they would agree to the 1800 square foot requirement. Mr. Shaver said it is bounded on the east by Keller Smithfield Road. Chairman Bowen stated that there was R-l zoning across the road. Mr. Shaver said for the Commission to make the decision. 17. PZ 86-67 APPROVED Ms. Flippo made the motion to approve PZ 86-67 with deed restrictions of 1800 square foot houses. This motion was seconded by Mr. Schwinger and the motion carried 4-0. . 18. This motion was seconded by Mr. Schwinger and the motion carried 4-0. 20. PZ 86-70 DENIED Mr. Schwinger made the motion to deny PZ 86-70. This motion was seconded by Ms. Flippo. Chairman Bowen said he agrees with this motion. He said there might be room for some R-8 in the area, but not this much, there is room for improvement. The motion to deny carried 4-0.
