CALL TO ORDER The meeting was called to order by the Chairman, Jack Roseberry, at 7:00 P.M. ROLL CALL PRESENT: Chairman Secretary Member Alt. Member Dir. Planning/Dev. P & Z Coordinator Jack Roseberry Billy Cypert Ron Hubbard Forrest Grubb Richard Royston Wanda Calvert ABSENT: Harold Schubert Hans Kossler David Barfield CONSIDERATION OF THE MINUTES OF MAY 15, 1986 The approval of the minutes was postponed due to not enough members present to vote who were present at the meeting. . CONSIDERATION OF THE MINUTES OF JUNE 19, 1986 The approval of these minutes was postponed due to not enough members present to vote who were present at the meeting. 1. BA 86-10 Request of Darsco, Inc. to vary from the Zoning Ordinance #1080 on Lots 14 & 15, Block 13, Briarwood Estates, to allow the installation of a 4 foot split rail fence beyond the front building line. This property is located at 7505 & 7509 Wentwood Court. Chairman Roseberry opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Don Anderson with Darsco, Inc. came forward. He stated they have two homes located on a cuI de sac that they wish to fence. Mr. Anderson said there would be no vision problem. He said they are not on a corner lot. . Mr. Anderson stated the fence would benefit in traffic control and it also helps to contain the children of parents who come to view the models. Page 2 Z B A Minutes July 17, 1986 . Mr. Anderson showed photos of other subdivisions with fences around the model homes. Chairman Roseberry asked if the fence would be temporary. Mr. Anderson stated it would be. He said they have 54 lots which they hope to have sold within two years. He said they would take down the fences when they finish the development. Chairman Roseberry asked Mr. Anderson if he would object to a restriction of two years. Mr. Anderson said he hoped they have them all sold in two years. He said they hope to have another project started in North Richland Hills before then. . Mr. Anderson said the fences were fairly common and causes no hardship. He said he felt they would be a nice asset to the addition. Chairman Roseberry asked Mrs. Calvert if there had been any correspondence received. Mrs. Calvert stated there was none. Chairman Roseberry called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. BA 86-10 APPROVED Mr. Grubb made the motion to approve BA 86-10 as requested with the stipulation that it be for a two year period or until the models are occupied, whichever comes first. This motion was seconded by Mr. Hubbard and the motion carried 4-0. . Page 3 Z B A Minutes July 17, 1986 . 2. BA 86-11 Request of Kenneth M. Cole to vary from the controls in Ordinance #1252 (Flood Damage Prevention Ordinance) to be allowed to build a house in a flood plain on Lot 13R, Block 4, Richland Oaks Addition. This property is located at 5104 Pearl Drive. Chairman Roseberry opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Kenneth Cole, 5109 Pearl Drive, came forward. He stated he wants to build a house on this lot. Chairman Roseberry asked Mr. Royston of this lot was in the flood plain or the flood way. . Mr. Royston stated it was in the flood plain of Walker Branch which is two blocks away. He said he felt one house would not affect the flooding since there are already houses around the lot. Chairman Roseberry asked if it would be taken out of the flood plain. Mr. Royston stated that the city hopes to have a bond program and fix Walker Branch. He said once the city does the work, they will submit the figures to FEMA and the flood plain map will be corrected. Mr. Grubb asked if the city would require Mr. Cole to raise the lot out of the flood plain. Mr. Royston stated they would not because it would need to be raised 4~ feet. . Chairman Roseberry said since there are other houses in the area, they must also be in the flood plain. Page 4 Z B A Minutes July 17, 1986 . . BA 86-11 APPROVED ADJOURNMENT . r Mr. Royston stated that was correct. He said Mr. Cole would have to have flood insurance. He said he has been denied a building permit so he is requesting this variance. Chairman Roseberry asked Mr. Cole if he was aware that this lot could flood. Mr. Cole stated yes. He said he did not know the lot was in the flood plain when he bought it. He said when he lived in Riverside he lived in the flood plain. Chairman Roseberry asked Mrs. Calvert if there had been any correspondence received. Mrs. Calvert stated there had been none. Chairman Roseberry called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Cypert made the motion to approve BA 86-11 as requested. This motion was seconded by Mr. Grubb and the motion carried 4-0. The meeting adjourned at 7:20 P.
