MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
NOVEMBER 20, 1986 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Jack Roseberry, at 7:04 P.M.

CONSIDERATION OF THE MINUTES
OF OCTOBER 16, 1986
Mr. Schubert made the motion to
approve the minutes as written. This
motion was seconded by Mr. Grubb and
the motion carried 4-0 with Mr. Cypert
abstaining since he was not present.

BA 86-12
Request of Quinten's Crossing Joint
Venture to vary from the Zoning
Ordinance #1080 on Lot 1, Block 12,
Snow Heights North Addition, to be
allowed to install a 6 foot wood fence
instead of a masonry fence. This
property is located at 6901 Northeast
Loop 820. This case was returned to
the agenda at the request of the Board
to review the applicant's proposed
fence design.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Phil Heimerman, Projects Manager with
Chasewood, came forward. He stated
that Tom Michaels was on his way here.
Mr. Heimerman stated they plan to
install a wood fence with brick
columns 24 feet apart.

Chairman Roseberry asked if he had any
plans or drawings to show the Board.
Mr. Heimerman stated he gave the
drawings to Greg Wheeler on Friday and
Mr. Wheeler stated that was all he
needed. Mr. Heimerman gave a photo to
the Chairman of a fence like they plan
to construct.
Ms. Calvert stated she was of the
opinion that since Chasewood did not
bring plans to put in the Board's
packets, Chasewood would furnish plans
at the meeting.
Mr. Heimerman said that Mr. Wheeler
has the plans.

Tom Michaels, Vice President of
construction with Chasewood, came
forward. He stated he had been
detained in traffic.
Chairman Roseberry asked Mr. Michaels
if he had anything other than the
picture to show the Board.
Mr. Michaels stated they gave their
only copy of the plans to Greg
Wheeler. He stated he met with Mr.
Wheeler and got it all worked out.
Mr. Michaels stated they plan to
construct a white pine fence with
brick columns 24 feet apart.
Mr. Grubb asked Mr. Michaels if he
realized the Board stipulated redwood
or cedar.

Mr. Michaels stated he did not. He
stated that after meeting with Mr.
Wheeler, they started running down the
cost of the beams and steel posts.
Mr. Michaels said he asked Mr. Wheeler
if he had a problem with going with 24
feet between the columns and Mr.
Wheeler said he had no problem with
it.

Chairman Roseberry said the Board did
not consider the cost. He said the
Board made certain stipulations that
they expected Chasewood to meet.
Mr. Michaels stated he came up with a
compromise with Mr. Wheeler.
Mr. Grubb said the Board gave
Chasewood instructions on how the
fence was to be built.
Chairman Roseberry stated the
construction and plan for the fence
was expressed at the last meeting.
Greg Wheeler came in at 7:20 P. M.

Mr. Wheeler came forward. He
presented the drawing of the fence to
the Board. He stated they plan to put
the columns on 25 foot centers with
2 galvanized posts. He said the
columns will have a 12 inch diameter
pier pad and the base would be 13~
inches with 6 inches deep.
Chairman Roseberry stated that after
looking at this drawing he did not
believe any engineer would accept it.
Mr. Grubb stated the Board gave strict
requirements to go by.
Mr. Michaels said he was of the
opinion he was to get with Mr. Wheeler
and work out a plan for the fence.
Mr. Wheeler stated he thought the
Board had just given guidelines to go
by so he agreed to present this plan
to the Board. He said he did not know
the Board wanted exactly as they had
stated.

Chairman Roseberry said he was afraid
that with this plan the columns would
fall over after a few years.

Mr. Michaels asked if he found an
engineer to accept these plans, would
the Board also accept it.
Mr. Grubb stated if Chasewood does not
want to accept the compromise the
Board stated, then the Board will go
back to the original requirement.
Chairman Roseberry called for order.

Mr. Barfield stated he is an architect
and he has looked at several
subdivisions with fences. He said if
they are not constructed right, one
column will lean one way and one lean
another way. He stated you must have
piers. Mr. Barfield stated that was
the reason for the continuous footing.
He said he was concerned that the
columns would fall over in a few
years. Mr. Barfield said he had no
problem with Chasewood using treated
wood instead of redwood or cedar.
Mr. Michaels stated he told his
attorney he would not need him
tonight. He said he went away from
the last meeting feeling good. He
said our compromise will determine
whether we can accept the plan or not.
Chairman Roseberry stated there was no
need for Mr. Michael's attorney. He
said the Board made the stipulations
clear at the last meeting.
Mr. Grubb asked if Mr. Michaels got a
copy of the minutes of the meeting.
Mr. Michaels stated he did not.
Mr. Grubb stated that Mr. Michaels was
present at the meeting and heard what
the Board said.

Mr. Wheeler stated he did not see the
minutes until today, but he was aware
the Board stated 16 foot centers with
galvanized posts and brick columns.

APPROVED WITH STIPULATIONS
.
Mr. Wheeler stated he felt they could
go with the 24 foot centers, but said
he instructed Chasewood to not start
anything without the Board's consent.
Chairman Roseberry stated there are
brick columns allover the city that
are falling down. He said the
deminions you are talking just won't
hold up.
Mr. Michaels stated their intention is
to put a footing. He said they plan
to drill down for a small pier.
Mr. Kossler stated the Board will try
one more time to settle the
requirement. He stated the Board
wants masonry columns on 16 foot
centers with continuous footing.
Mr. Grubb stated he would go with the
treated wood.
Chairman Roseberry asked Mr. Wheeler
if he knew what the Board wanted.
Mr. Wheeler stated the Board wants
brick columns on 16 foot centers with
continuous footing, pad and piers
certified by an engineer, galvanized
posts on 8 feet and use treated wood
or redwood or cedar.
Chairman Roseberry stated there needs
to be a depth stipulation also.
Mr. Kossler made the motion to approve
BA 86-12 to allow the City Staff to
work with Mr. Michaels to work out the
following stipulations: Put brick
columns on 16 foot centers with
continuous footing, columns with pad
and pier certified by an engineer,
galvanized posts on 8 foot with
treated wood or redwood. This motion
was seconded by Mr. Schubert and the
motion carried 4-1 with Mr. Hubbard
voting against.

BA 86-13
Request of William E. Pasteur, Trustee
to vary from the Zoning Ordinance
#1080 on Lots 1 & 12, Block 1, and
Lots 1 & 12, Block 2, Spring Meadows
Addition, to be allowed to construct
two brick walls at the entrance to
their Subdivision. The walls would be
beyond the building line. This
property is located at Smithfield Road
and Cortland Drive and at Hewitt
Street and Cortland Drive.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Laurie Brantley came forward to
represent Heritage Development and Mr.
Pasteur. She stated that Mr. Elliott
with Elliott and Hughes Engineers was
also present to answer any questions
the Board might have.
Ms. Brantley stated they are
requesting to build two brick walls at
each entrance to their subdivision
with a stockade screening fence to the
corner. She stated they have started
four homes and feel this would be a
nice and pleasing entrance to the
subdivision.
Chairman Roseberry stated that the
request is for a variance to build
beyond the building line.
Ms. Brantley stated the fence would be
owned and cared for by the property
owner.
Mr. Schubert asked if the wall would
become the responsibility of the
property owner.
Mr. Barfield asked who would maintain
and care for the fence.

Mr. Walter Elliott came forward. He
stated the fence would become the
property of the owner of the lot.
Mr. Barfield stated he was concerned
about the sight. He asked Mr. Wheeler
how much length do they require.
Mr. Wheeler said usually 25 feet.
Mr. Elliott stated the fence would be
9~ feet from the curb on Hewitt and
13~ feet from the curb on Smithfield
Road.
Chairman Roseberry asked if there was
any way it could be set on the
building line.
Mr. Elliott stated that if it was
built on the building line they would
connect it to the house.

Mr. Barfield asked if the City plans
to widen Smithfield Road in the
future.
Mrs. Calvert stated they have already
given the extra right of way for
widening.
Mr. Barfield asked how far can you see
down the street.
Mr. Elliott stated there are school
zones there. He said if you turned
right you could probably see 100 to
150 feet.
Mr. Barfield asked if they could make
the wall 4 feet then slope it up to
the wood fence.

Mr. Elliott stated he would be happy
to get with Mr. Wheeler and take a 4
by 8 sheet of plywood out there and
see if you could see okay. Mr.
Elliott said his company feels they
need to do something to enhance the
subdivision so they could sell the
lots.

Chairman Roseberry asked if you could
see over the 4 feet in a small car.
Mr. Elliott said they could lower it.
Mr. Barfield said he would be happier
if they would lower it to make sure
you can have good clearance. He said
a car going 50 miles an hour has to
have 250 feet to stop.
Mr. Hubbard asked if the homeowners
are to maintain the fence, how will
the city enforce it.
Mr. Wheeler said the city would sight
them for unpleasant premises.
Mr. Hubbard asked how the individual
would know the fence is his.

Ms. Brantley stated it is disclosed to
them at the time of closing on the
property.
Mr. Elliott said they usually put up
fences for the property owners. He
said they plan to put up a stockade
fence across the back on all the lots.
Mr. Schubert asked if the fence would
be inside the property line or on the
property line.
Mr. Elliott said it would be just
inside the property line.
Chairman Roseberry called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

Mr. Barfield said he would be in favor
of sending it to the City Staff to be
sure the visibility is right on
Smithfield Road.

Chairman Roseberry said he thought it
should be 3~ feet high.
Mr. Elliott said they set back 10 feet
plus 9~ feet from the curb.
Chairman Roseberry asked Mr. Elliott
if they could set back 15 feet instead
of the 10 feet.
Mr. Elliott stated they could. He
said they have a 20 foot building line
there.
BA 86-13
APPROVED WITH STIPULATIONS
Mr. Hubbard made the motion to approve
BA 86-13 with the stipulation that the
dimension be changed from 10 feet to
15 feet to the face of the columns.
This motion was seconded by Mr.
Schubert and the motion carried 5-0.
