MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
DECEMBER 18, 1986 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Jack Roseberry, at 7:00 P.M.

CONSIDERATION OF THE MINUTES
OF NOVEMBER 20, 1986
Mr. Schubert made the motion to
approve the minutes as written. This
motion was seconded by Mr. Hubbard and
the motion carried 5-0.

BA 86-14
Request of Stylemark Homes, Inc. to
vary from the Zoning Ordinance #1080,
Section VI, on Lot 1, Block 18R, Fox
Hollow Addition, to allow the rear
yard to be less than the required 10
foot minimum. This property is
located at 7400 Dana Lane.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Will Reed with Stylemark Homes came
forward. He stated they build their
homes according to the building code
and FHA. He said the initial plot
plan was changed because in front of
the garage would be a storm drain
culvert so they redrew the plan. Mr.
Reed said they normally have the
property surveyed, but there were all
4 property pins showing so they did
not survey the property. He stated
there was a stake out made, but the
error was not caught.

Chairman Roseberry asked if the error
was the rear of the house.
Mr. Reed stated the right rear corner
of the house is 2~ feet into the
easement.
Mr. Barfield asked if it was
protruding into the easement.
Mr. Royston stated there is a 5 foot
utility easement, plus 5 feet. He
said the city has to take some of the
responsibility. He said the reverse
of the house looked okay at first; it
could not be seen by the naked eye.
Chairman Roseberry asked what the
purpose was for the additional 5 feet
next to an easement.

Mr. Royston for clearance for
machinery in case they had to work in
the easement.
Mr. Schubert said this was a corner
lot and on the original plot plan the
driveway would have been too close to
the corner.
Mr. Royston said that was correct.
Mr. Schubert said he likes the reverse
plan better.
Mr. Barfield said he could see no
problems with the encroachment.
Mr. Schubert asked Mrs. Calvert if
there had been any correspondence.
Mrs. Calvert said she had not received
any letters, only telephone calls.

Chairman Roseberry called for those
wishing to speak in opposition to this
request to please come forward.

Drew Burke, 7401 Steward, came
forward. He said he thought the
problem of the house was it was too
close to the property line.
Chairman Roseberry stated that the
rear corner of the house is too close
to the easement.
Mr. Burke stated the roof overhang
seems too close. He said he has his
house up for sale and he had comments
that the house is too close. Mr.
Burke said it looks like it is 8 feet
from the fence.
Chairman Roseberry said the ordinance
states you have to have 6 feet side
yards and a rear yard of a minimum of
10 feet.

Mr. Royston stated the corner is 7
feet 2 inches from the property line
and the overhang would be closer.
Mr. Burke stated he is in opposition
to this request.
Brent Ezelle, 7405 Steward Lane, came
forward. He said he felt the house is
too close to the property line. He
said he objects to this.
Mr. Barfield asked if it was required
for 10 to 12 feet for fire lane before
you had to put up a fire wall.
Mr. Royston said it was 5 feet for a
wall.
Mr. Barfield asked how for is this
one.
Mr. Reed said 25 feet.

Mr. Barfield said there should not be
a fire problem.

Mr. Royston said the house is well
above all minimums except for one
corner.
Mr. Reed said they have the house
sold.
Mr. Royston stated the city has not
finaled the house.
Chairman Roseberry asked Mr. Royston
if he sees any problems.
Mr. Royston stated he could see none.
Chairman Roseberry closed the Public
Hearing.
Mr. Schubert made the motion to
approve BA 86-14 as presented. This
motion was seconded by Mr. Barfield
and the motion carried 5-0.
The meeting adjourned at 7:25 P. M.
