MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
JANUARY 10, 1985 - 7:30 P. M.

The meeting was called to order by the

CONSIDERATION OF THE MINUTES
OF DECEMBER 27, 1984
Mr. Wood made the motion to approve
the minutes as written. This motion
was seconded by Ms. Nash and the
motion carried 3-0 with Chairman
Tucker and Mr. Bowen abstaining since
they were not present at the meeting.

Chairman Tucker stated that items 10,
11, and 13 had been postponed prior to
this meeting.

PS 84-60
Request of Gibralter Savings for
replat of Lot 5R, Block 1, Carder
Addition.
PS 84-60
APPROVED
Mr. Schwinger made the motion to
approve PS 84-60 subject to the
Engineer's comments. This motion was
seconded by Ms. Nash and the motion
carried 5-0.
2.
PS 85-1
Request of Richland Hills Church of
Christ for preliminary plat of Blocks
7 & 8, Meadow Lakes Addition.
PS 85-1
APPROVED
Ms. Nash made the motion to approve
PS 85-1 subject to the Engineer's
comments. This motion was seconded by
Mr. Bowen and the motion carried 5-0.

requested to speak. He stated he
represents the church.

Mr. Perkins stated the church is a
small water user. He said they they
do not use much more than a residence
and they would like to discuss with
the city the requirement of the 12
inch water line around this property.
Mr. Wood stated this Commission does
Bot have the right to decide such as
that. He stated they could discuss
this with the City Staff or the City
Council when the final plat is heard.

Request of Bob Roark for short form
plat of Lot 3, Block 2, Henry
Addition.
PS 85-3
APPROVED
Ms. Nash made the motion to approve
PS 85-3 subject to the Engineer's
comments. This motion was seconded by
Mr. Schwinger and the motion carried
5-0.

PZ 84-82
Request of Burk Collins Investments,
Inc. to rezone part of Lot 1, Lots 2 &
3, and part of Lot 4, Richland Oaks
Addition, from their present
classification of R-l (Single Family
District) to C-l (Commercial District)
This property is located on the east
side of Strummer Drive at Bedford
Euless Road.
Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Mr. Collins came forward. He stated
he had a meeting with the homeowners a
few nights ago; it was a good meeting,
and some were for the request and some
were against it. Mr. Collins said he
was first interested in this property
two years ago, but found it had deed
restrictions on it so he backed off.
He said since then, the neighbors have
signed off the deed restrictions which
now makes it developable.

Mr. Collins said he feels the reason
Al Anz has agreed to sell the property
to him is he would be more accountable
than some other developer. He said
sooner or later, the property will be
zoned and developed. Mr. Collins said
the property abuts the large
interchange. He said if the
Commission would give him the
opportunity, he would build a good
shopping center. He said he had a
scale model to show what it would look
like. Mr. Collins said the center
would rent for from $16.00 to $18.00 a
foot. He said if the Commission turns
him down, an outside developer would
not work with the city and homeowners
as he has to try to please everyone.
Mr. Collins said he had been asked why
we need more shopping centers, but if
we did not have growth in the city,
the city could not provide the needed
services. He said he felt North
Richland Hills has done a good job
providing services to its citizens.
Chairman Tucker asked Mr. Collins
about the left turn lane. He said in
creating a left turn lane on Bedford
Euless Road, who would build it.
Mr. Collins said he would. He said he
met with the State Highway department
and gave them several proposals, one
being to straighten out the street and
they were receptive if he would align
the approach with the street to the
south. He said the State would build
the interchange, but he would build
the left turn lane.
Mr. Bowen asked if he would agree to
tieing the building permit to this.
Mr. Collins stated he would.

Betty Richardson with MB Bank, 777
Main Street, Fort Worth, Texas came
forward. She stated she represents
the Jess B. Woodard Trust who owns Lot
3 and part of Lot 4.

Ms. Richardson said they feel that
commercial zoning is the highest and
best use for the property. She said
they support this zoning change.
Allen Anz came forward. He stated he
lives on Strummer Drive and he is in
favor of this request.
Harvey Greenwald, 5016 Strummer Drive,
came forward. He said he was in favor
of a good quality commercial area.

Alfred Stanford, 5101 Pearl Drive,
came forward. He said back in 1969,
Bedford Euless Road was a two lane
road with seasonal fruit stands along
the sides. He said then everyone
wanted places to eat which we now
have plenty. Mr. Stanford said he
went to Mr. Collins meeting and it
seemed that the majority would go
along with Mr. Collins. He said he
goes along with Mr. Collins. Mr.
Stanford said why not, we cannot get
out on Bedford Euless now and we need
some assistance.
David Wiley, 4901 Oakridge Terrace,
came forward. He said he was in favor
of this zoning request.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.

Doug Gilliland, 4901 Strummer Drive,
came forward. He said he participated
in Mr. Collins meeting where
approximately 100 residents came. He
said it was very productive. Mr.
Gilliland said this is a critical
zoning issue. He said it would be a
major tran£~it:~O]1 a:J.d the city needs to
listen to the older citizens. He said
the traffic has not been properly
addressed. Mr. Gilliland said it would
cause a slow deterioration of the area
and the homeowners would suffer in
property value.

Mr. Gilliland said he and the other
property owners are opposed to this
zoning request now and would like to
be able to sit down and discuss it.
Michael Szot, 5008 Eldorado, came
forward. He said he had lived here 26
years and would like to die here. He
said he felt they need to give the
area a little more time to mature.
Mr. Szot said the traffic is a mess.
He said he has to challenge the 4
lanes of traffic every time he gets
out onto Bedford Euless Road. Mr.
Szot said Bennigans expands it's
parking lot into Eldorado and
Strummer. He said they do not have
enough police protection now.

Doug Randolph, 5017 Strummer Drive,
came forward. He said when they
bought their home, they looked for a
home in a nice neighborhood. He said
they have lived there for 16 years.
Mr. Randolph said it is a beautiful
place to live with nice trees. He
said they do not need shopping centers
to come to them; they have cars to
drive to the shopping centers. Mr.
Randolph said this was a residential
area with traffic problems and
drainage problems.
Mr. Randolph said he was here to
represent Mrs. Sellers who lives
across the street and could not be at
the meeting. He said she is also in
opposition to this request.

Tirey Samsill, 4908 Strummer Drive,
came forward. He said he has mixed
feelings about the request. He said
he had served on the Mayor's Committee
for a bond program and he has lived in
North Richland Hills for more than 20
years. Mr. Samsill said he was
opposed to the request mainly because
of the traffic. He said for the last
30 days, he has had to get to his home
from the north because of the traffic
on Bedford Euless Road.

Mr. Samsill said Mr. Collins did not
say that the upper story of the
shopping center would be looking into
his bedrooms.
Roland Starkey, 5013 Eldorado, came
forward. He said he would like to see
a show of hands of all who are against
this request.
Chairman Tucker said he would ask this
when Mr. Starkey finished.

Mr. Starkey said he wonders what would
happen if they had a fire with all
this traffic. He said Mr. Collins
says there would be no openings on
Strummer Drive, but after this Mayor
and Council are gone, someone will
come up and say why can't they have an
opening on Strummer. Mr. Starkey said
they also have a drainage problem. He
said the hole for the water to go in
is only so big and only so much water
can get in, the rest will back up.
Mr. Starkey said there are lots of
empty stores in shopping areas now and
we do not need anymore. He said this
is a planned neighborhood.
Chairman Tucker called for a show of
hands of the people who are in
opposition to this request. There
were several. Then he asked for a
show of hands of the ones who are in
favor of this request and there were
about half as many.
Ms. Allen 5100 Pearl Drive, came
forward. She said she is a single
woman who built there 8 years ago.
She asked who is going to buy at this
shopping center when all the
homeowners get disgusted and move
away.

Burk Collins asked to speak again. He
said the water flow and drainage has
to be taken care of before he would be
allowed to build; it has to be taken
out of the flood plain.

Chairman Tucker closed the Public
Hearing.
.
Chairman Tucker said this was a
difficult case since it is a change in
an existing residential area. He said
although it is not conducive to
residential, he is not sure if this is
the right time. Chairman Tucker said
he wanted to remind the Commission of
the "purpose" of the zoning ordinance.
He read from the Zoning Ordinance,
page 2: "The purpose of this
ordinance is to zone the entire area
of the City of North Richland Hills
into districts in accordance with a
comprehensive plan for the purpose of
promoting health, safety, morals and
the general welfare of the general
public. The regulations and districts
herein established have been designed
to lessen congestion in the streets;
to provide safety from fire, panic,
and other dangers; to provide adequate
light and air, to prevent the
overcrowding of land, to avoid undue
concentration of populations, to
provide and facilitate adequate
provisions for transportation, water,
sewerage, schools, parks, and other
public requirements. Said districts
have been established with reasonable
consideration of the character of the
district and its peculiar suitability
for the particular uses, and with the
view of conserving the value of
buildings and encouraging the most
appropriate use of land through the
community."
Mr. Wood said he felt this is a
commercial area and he likes the idea
that they would widen the road and put
a light there. He said he would be in
favor of the request if it would be
tied to this.

Mr. Schwinger asked Mr. Collins if
there was a way to build a bridge and
take the traffic north to Harwood
Road.
Mr. Collins said you can get buried in
cost.
Mr. Schwinger said it would be good if
it could link to Harwood Road.
PZ 84-82
DENIED
Mr. Bowen made the motion to deny
PZ 84-82. This motion was seconded by
Ms. Nash and the motion to deny
carried 3-2 with Mr. Wood and Mr.
Schwinger voting against denial.
RECESS
Chairman Tucker called a recess at
8:30 P. M.
BACK TO ORDER
Chairman Tucker called the meeting
back to order at 8:40 P. M. with the
same members present.

5.
PZ 85-1
Request of R.G.A. Development to
rezone a portion of Tract 1, Alexander
Hood Survey, Abstract 683, from its
present classification of AG
(Agriculture District) to R-2 (Single
Family District). This property is
located on the north side of Bursey
Road at Keller-Smithfield Road.
Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Owen D. Long, Engineer, came forward.
He stated they had previously come
before the Commission and now have an
alternate plan. He said they show the
proposed Bursey Road dedication of 100
feet or whatever the city wants. Mr.
Long said they are requesting single
family because of the people to the
south. He said they would not face
any homes on the new alignment of
Bursey Road and they would leave the
old Bursey Road and Smithfield Road as
is.

Mr. Long stated there are 12.6 acres
requested for Single Family zoning.
Mr. Wood asked why the new Bursey
Road.
Mr. Long said the neighbors requested
it and Herman Smith who has the
property to the east agrees with it.
Mr. Long said they will be happy to
work with the neighbors and property
owners.
Mr. Wood said the re-alignment does
not go along with the proposed
thoroughfare plan.
Mr. Long said with the developer to
the east agreeing, they feel this
would be better.

Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
David Wells, 7508 Bursey Road, came
forward. He said he thought they had
a better offer from Mr. Austin. He
said Bursey Road has a hazardous "s"
curve and a 90 degree curve. Mr.
Wells said he speaks for all the
property owners and they are in
opposition to this request.
Bill Mabry, 7524 Bursey Road, came
forward. He said he is in opposition
to this request. He said the 100 foot
buffer is not enough. He said his
home was the smallest and it was 1,800
square feet. Mr. Mabry said he felt
they should grant R-l zoning. He said
he knows it is going to develop, but
feel they need more than this small
buffer. Mr. Mabry said they had one
meeting with Mr. Austin, but never had
another one.

Dorene Renfro came forward. She asked
what they plan to do with the
drainage.
Chairman Tucker stated at the zoning,
they only consider the best use of the
land.
John Parker, 7029 Smithfield Road,
came forward. He said he is in
opposition to this request because of
the traffic.

Charles Bathman, 4533 Glenview Court,
came forward. He said he owns the
property just south and east of this
property. He said he met with the
group. Mr. Bathman said they will
continue to have a problem with the
"s" curve. He said he felt there
should be R-1 between the old Bursey
and the new Bursey. Mr. Bathman said
he feels they need a better plan.
Ken Martin, 7416 Bursey Road, came
forward. He said he has a problem
with the "s" curve. He said he met
with Mr. Austin and he said he would
take the "s" curve out, but he has
added more. Mr. Martin said he felt
there should be R-1 houses instead of
R-2. -
Pat Buchanan, Continental Trail, came
forward. She said she never seemed to
know about these zoning changes. She
asked if Continental Trail would be
extended.
Mr. Long said it will be developed to
the east, but not to the west.
Ms. Buchanan said they have all nice
homes and feel they should build R-1
houses so the property values would
stay up.

Adene Jones, 7512 Bursey Road, came
forward. She said they have 4 acres
there to raise their children and have
horses.

Ms. Jones said they had worked hard
for their home and they plan to live
there for a long time. She said they
had one meeting and the homeowners
requested they extend Bursey Road and
take out the "s" curve. Ms. Jones
said she heard they may take some of
their land to widen the road. She
said she is opposed to a 4 lane road
in front of her house and she is
opposed to this request.
Ms. Eddie, 8009 Valley Drive, came
forward. She said they need a
re-evaluation of the area and put R-l
there. She said they already have
too much traffic out there. Ms. Eddie
said she had lived there for 10 years
and the roads are so bad, they have to
align the cars.

Chairman Tucker closed the Public
Hearing.
Chairman Tucker said the Commission is
glad you came and the Commission does
listen. He said the city does not
have money to build roads, they depend
on the developers to build the roads.
He said as the land is developed, the
roads will be built. Chairman Tucker
said the northern part of the city is
the most undeveloped and attracts
developers. He said the large 2 acre
tracts will be no more; land is too
high. Chairman Tucker said the
developers are giving $30,000 to
$40,000 an acre.
Chairman Tucker said the Thoroughfare
Plan shows Bursey to be a 100 foot
artery with more dense housing and
some commercial zoning. He said the
people should become involved. He
said the Commission had some 12
publicized meetings regarding the
Master Plan, but not very many came.

Chairman Tucker said he felt the R-2
zoning would not make that much
difference. He said he lives in an
area that has from 5,000 to 1,400
square foot homes and they all look
good. He said it is all right if they
are custom homes.
Mr. Wood said they are only
considering the use of the land, they
are not approving the plat.
PZ 85-1
APPROVED
Mr. Bowen made the motion to approve
PZ 85-1. This motion was seconded by
Mr. Schwinger and the motion carried
5-0.
Bill Mabry came forward. He said not
to address them as rich people. He
said all they want to do is protect
their houses.

Ken Martin came forward. He said he
works for an electrical company and he
is not against growth, but you should
consider the traffic.

PZ 85-2
Request of R.G.A. Development Corp. to
rezone a portion of Tract 1, Alexander
Hood Survey, Abstract 683, & a portion
of Tract 2, Stephen Richardson Survey,
Abstract 1266, from their present
classification of AG (Agriculture
District) to R-4-SD (Separate
Ownership Duplex District). This
property is located on the west side
of Keller-Smithfield Road and
approximately 1,195 feet north of
Bursey Road.
Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Owen D. Long, Engineer, came forward.
He said if the Commission feels they
have too many duplexes, they would
take the western 300 feet out and make
R-2.

Chairman Tucker said the Commission
has to consider the request as
submitted.
Mr. Long stated they tried to work
with the neighbors, but they cannot
afford to have large lots, it is not
feasible. He said they cannot do
anything about the "s" curve because
it is not on their property.

WITHDRAWN
Mr. Long requested this case be
withdrawn.

PZ 85-3
Request of Marcus H. Roberson to
rezone Tract 4B, David Moses Survey,
Abstract 1150, from its present
classification of AG (Agriculture
District) to R-2 (Single Family
District). This property is located
on the east side of Eden Road and
bounded on the south by the St. Louis
and Southwestern Railroad.

Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Scott Stewart with Levitt Engineers
came forward. He gave the Commission
a copy of a preliminary plan for this
property. He said they wish to build
single family R-2 homes.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

APPROVED
Mr. Wood made the motion to approve
PZ 85-3 as requested. This motion was
seconded by Ms. Nash and the motion
carried 5-0.

PZ 85-4
Request of Beane & Associates to
rezone Tract 2, William Cox Survey,
Abstract 321, from its present
classification of AG (Agriculture
District) to R-2 (Single Family
District). This property is located
on the east side of Smithfield Road
and approximately 118 feet north of
the proposed Hightower Drive.
Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Charles Beane came forward. He said
he has a home and a lot on each side
which he is requesting to rezone to
single family.

Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

APPROVED
Mr. Bowen made the motion to approve
PZ 85-4 as requested. This motion was
seconded by Mr. Wood and the motion
carried 5-0.

PZ 85-5
Request of Beane & Associates to

Estates, from its present
classification of R-2 (Single Family
District) to R-4-SD (Separate
Ownership Duplex District). This
property is located at the northeast
corner of Smithfield Road and the
proposed Hightower Drive.
Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Mr. Beane came forward. He said all
the lots in Coventry Place face the
inside, but these will face Hightower
and serve as a buffer.
Mr. Wood asked why Mr. Beane needed a
buffer between single family zoning.
Chairman Tucker said he did not
understand that either.
Mr. Beane said he just thought it
would be nice to have the ones facing
Hightower to be duplex.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
John Parker, 7121 Smithfield Road,
came forward. He said he is opposed
to duplex zoning.

Mrs. John Parker, 7121 Smithfield
Road, came forward. She said she is
opposed to this request. Mrs. Parker
stated there were several lots already
platted in that area and they do not
need duplexes added. She said you
talk about a Master Plan, we have a
Master Plan for our lives and we
choose to live here. Mrs. Parker said
she feels victimized; you put is down;
the developer can come in and take
away our land. She said there was no
need for more houses in this area.
Del Weston, 7117 Smithfield Road, came
forward. He stated he was against
duplexes. He said there is no curb
and gutter on Smithfield Road and
feels that Smithfield Road should be
fixed before anymore development is
done. Mr. Weston said with this
duplex development, there would be
twice as many people as it would be
with single family.

Barney Calvert, Jr., 7128 Smithfield
Road, came forward. He said he fails
to see how duplexes would enhance the
area. He said he felt Smithfield Road
should be built to take care of the
traffic before any more building is
allowed.
Judy Rollinger, 7124 Smithfield Road,
came forward. She said she had lived
there for 10 years. Ms. Rollinger
said this development would add to the
traffic. She cannot have pets because
of the traffic and a neighbor boy was
hit by a car. Ms. Rollinger said all
the city does is come out occasionally
to fix pot holes.
Chairman Tucker closed the Public
Hearing.

Chairman Tucker said he felt there
should not be any duplex zoning in
that area. He said it would be spot
zoning.

DENIED
Mr. Wood made the motion to deny
PZ 85-5. This motion was seconded by
Mr. Schwinger and the motion to deny
carried 5-0.
10. PZ 85-6
WITHDRAWN
Request of California-Texas
Properties, Inc. to rezone portions of
Tracts 4Al & 5, Stephen Richardson
Survey, Abstract 1266, from their
present classification of AG
(Agriculture District) to C-l
(Commercial District). This property
is located on the west side of Davis
Boulevard at Green Valley Drive.
This case was withdrawn prior to the
meeting.

Request of California-Texas
Properties, Inc. to rezone portion of
Tracts 4Al & 5, Stephen Richardson
Survey, Abstract 1266, from their
present classification of AG
(Agriculture District) to R-6-T
(Townhouse & Garden Home District).

approximately 720 feet west of Davis
Boulevard.
This case was withdrawn prior to the
meeting.
12. PZ 85-8
Request of Trustees, E-Systems, Inc.
Pool Trust to rezone a portion of
Tract lA, J. Yates Survey, Abstract
1753, from its present classification
of AG (Agriculture District) to C-2
(Commercial District). This property
is located on the south side of
Watauga Road, approximately 1,700 feet
east of Rufe Snow Drive.

Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Charles Ballew came forward. He said
they feel that commercial is the best
use of the land along Watauga Road.
He said it is in compliance with the
Master Plan.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

APPROVED
Mr. Bowen made the motion to approve
PZ 85-8 as requested. This motion was
seconded by Ms. Nash and the motion
carried 5-0.

Request of Alexander Graham, M.D. to
rezone Lot 5, Block 33, Nor'East
Addition, from its present
classification of R-2 (Single Family
District) to LR (Local Retail
District). This property is located
at 5409 Davis Boulevard.
This case was postponed prior to the
meeting.
ADJOURNMENT
