CALL TO ORDER ROLL CALL ~ MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, FEBRUARY 14, 1985 - 7:30 P. M. The meeting was called to order by Acting Chairman Bowen at 7:30 P.M. PRESENT: Acting Chairman Secretary Members Don Bowen Marjorie Nash Mark Wood John Schwinger Richard Royston Wanda Calvert Dir. Planning & Dev. P & Z Coordinator ABSENT: George Tucker Carroll Brents CONSIDERATION OF THE MINUTES OF JANUARY 24, 1985 1 . PS 85-5 PS 85-5 APPROVED 2. PS 85-6 PS 85-6 APPROVED 3. PS 85-7 Acting Chairman Bowen stated they would have to postpone the approval of the minutes since there are only two present who were present at the meeting. Request of Williamsburg Associates for preliminary plat of Lots 1 & 2, Block 7, Industrial Park Addition. Mr. Wood made the motion to approve PS 85-5. This motion was seconded by Mr. Schwinger and the motion carried 4-0. Request of North American Investments for final plat of Blocks 14 thru 17, Snow Heights North Addition. Mr. Schwinger made the motion to approve PS 85-6 with the stipulation they obtain a letter from TESCO granting the use of the TESCO easement for parking and right-of-way access. This motion was seconded by Mr. Wood and the motion carried 4-0. This motion was seconded by Ms. Nash and the motion carried 4-0. 4. PS 85-8 Request of Hanson Properties for final plat of Nob Hill Addition. PS 85-8 APPROVED Ms. Nash made the motion to approve PS 85-8 subject to the Engineer's comments and subject to carrying out the necessary contracts. This motion was seconded by Mr. Schwinger and the motion carried 4-0. PS 85-9 Request of Cleta Oggier for short form plat of Lot 4, Block 1, Martin Addition. PS 85-9 APPROVED Mr. Wood made the motion to approve PS 85-9. This motion was seconded by Ms. Nash and the motion carried 4-0. PS 85-10 Request of David Barfield for replat of Lot 3R, Block 1, Martin Addition. PS 85-10 APPROVED Ms. Nash made the motion to approve PS 85-10. This motion was seconded by Mr. Schwinger and the motion carried 4-0. PS 85-12 Request of John C. Cook for replat of Lots 1R-1A1 & 1R-1A2, Block 6, Industrial Park Addition. PS 85-12 APPROVED Mr. Wood made the motion to approve PS 85-12. The motion was seconded by Mr. Schwinger and the motion carried 4-0. PZ 85-10 Request of The Kroger Company to rezone Lot 4, Block 1, Northland Shopping Center Addition, from its present classification of C-1 (Commercial) to C-I-Specific Use-Sale of Beer for off premise consumption. This property is located at 6246 Rufe Snow Drive. . . . ~ Page 3 P & Z Minutes February 14, 1985 Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Jack Cannon, a representative of Kroger Company, came forward. He said they were asking for this request to be able to be competitive with the other stores in the area. Acting Chairman Bowen said the City Council would need someone's name to put the specific use in. Mr. Cannon said that would be no problem. He said they would furnish one. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. PZ 85-10 APPROVED Mr. Schwinger made the motion to approve PZ 85-10. This motion was seconded by Ms. Nash and the motion carried 4-0. 9. PZ 85-11 Request of Sour Dough Slim Restaurant to rezone Lot 2, Block 1, Culp Addition, from its present classification of 1-2 (Industrial) to 1-2-Specific Use-Sale of Alcoholic Beverages. This property is located at 6702 Davis Boulevard. Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Jim Hughes, owner of the restaurant, came forward. He said the restaurant had been open for 14 months and he had found it impossible to compete without the sale of alcoholic beverages. . . . ~ Page 4 P & Z Minutes February 14, 1985 Acting Chairman Bowen asked if the specific use would be put in Mr. Hughes name. Mr. Hughes stated it would. Ms. Nash asked if they knew they have to sell a 60-40 ratio of food and drink. Mr. Hughes said they did. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. Bill Mabry, 7524 Bursey Road, came forward. He said he is one of their best customers. He said it feels good that they can have a nice family restaurant. Mr. Mabry said he used to be an alcoholic and he is against liquor. He said there is a junior high school in the area and there are no street lights. He said it is out in the country. Acting Chairman Bowen closed the Public Hearing. Ms. Nash said the restaurant meets all the requirements and she does not see how they can not approve the request. Acting Chairman Bowen said he agrees with Ms. Nash that they cannot legally deny the request. PZ 85-11 APPROVED Ms. Nash made the motion to approve PZ 85-11. This motion was seconded by Mr. Schwinger and the motion carried 3-1 with Mr. Wood voting against. 10. PZ 85-12 Request of Robert J. Sweeney and Patricia L. Brinkley to rezone Tract 8E, T.K. Martin Survey, Abstract 1055, from its present classification of AG (Agriculture) to R-2 (Single Family). This property is located at 8609 Martin Drive. . . . ~ Page 5 P & Z Minutes February 14, 1985 Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Robert Sweeney came forward. He said they were building an addition on their home which consists of a bath, bedroom and a family room. He said they were also remodeling the existing house. Mr. Sweeney said that when they were finished, their home would be valued at $137,000. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. PZ 85-12 APPROVED Mr. Wood made the motion to approve PZ 85-12. This motion was seconded by Ms. Nash and the motion carried 4-0. 11. PS 85-13 Request of Robert J. Sweeney and Patricia L. Brinkley for short form plat of Lot 23, Block 7, Glenann Addition. PS 85-13 APPROVED Mr. Wood made the motion to approve PS 85-13. This motion was seconded by Mr. Schwinger and the motion carried 4-0. 12. PZ 85-13 Request of R.G.A. Development Corp. to rezone a portion of Tract 1, Alex Hood Survey, Abstract 683, and a portion of Tract 2, S. Richardson Survey, Abstract 1266, from their present classification of AG (Agriculture) to R-4-SD (Separate Ownership Duplex). This property is located on the west side of Keller-Smithfield Road, approximately 1,195 feet north of Bursey Road. ~ Page 6 ~ & Z Minutes February 14, 1985 . Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Owen D. Long, Engineer, came forward to represent R.G.A. and the President, Mr. Austin. He stated the bulk of the area would be R-2, but they are requesting R-4-SD, dual ownership, on this small tract. Mr. Long stated they plan to deed restrict the duplexes to 1,200 square feet for each side. He said they felt there is a need for single family attached homes. Mr. Wood asked how many lots would there be. . Mr. Long said there would be 45. He said they had cut the amount back considerably and moved it farther north away from the existing residential area. Mr. Long said the price of the lots would dictate the size of the houses, but they plan to deed restrict to a larger house. He said there are nice wooded lots which would be higher than the normal lots. Mr. Wood said this area is sparsely developed and there are inadequate roads and he just could not see the need for duplexes in this area. . Mr. Long stated this property is in a planned 200 acre area, 50 acres being located in Keller. He said the roads are not there, but one must plan for the streets. He said they would build half of Keller-Smithfield Road, all of Bursey Road within their development and Wilson Lane. Mr. Long said the developer builds the roads. He said the Dallas investors do not understand this. Mr. Long said Davis Boulevard is planned in the next 5 years to be widened. ~ Page 7 P & Z Minutes February 14, 1985 . Mr. Long said, in their subdivision, they would build curb and gutter and a bridge. He said they need better density to make it all work. He said they have cut the duplex area way back from the original plan. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. . Ken Jendel, 8017 Valley Road, came forward. He said he lives west of the property in question. He said the roads are not adequate and if they open up Continental Trail, there will be more traffic. Mr. Jendel said they put homes in and then hope the roads come. He said that is not right. He said their area is 2 to 5 acre tracts with a minimum of 2,000 square feet homes. Elly Becker, 8024 Valley Drive, came forward. She said she is a realtor and she thought duplexes were to be used as a buffer between commercial and single family. She said she had found it difficult to sell duplexes. Ms. Becker said this request would make the traffic bad and down grade the area. She said she felt it was bad to have it in an agricultural area. Bill Mabry, 7524 Bursey Road, came forward. He said he would like to address the need for duplexes. He said there is a demand for people who need a tax write-off, investment groups. Mr. Mabry said this property is on the south end of their 200 acres so why don't they put the duplexes in Keller. He said he wants to protect his investment. . Mr. Mabry said if the developer does not like how we do in North Richland Hills, let them go somewhere else. ~ Page 8 P & Z Minutes February 14, 1985 . Pat Buchanan, 7417 Continental Trail, came forward. She said the property they are talking about is near her property. Ms. Buchanan said everyone talks about a Master Plan. She said the Star Telegram says the highway department knows nothing of it. Ms. Buchanan said she felt that duplexes would downgrade their property. Sandra Eddy, 8009 Valey Drive, came forward. She said we are not in the same stage of development as Dallas. She said she felt they should preserve this area. Ms. Eddy said she was concerned about the roads and the safety of her family. . Mary Mabry, 7524 Bursey Road, came forward. She said North Richland Hills does not need duplexes or smaller homes, but there is a need for larger homes. Ms. Mabry said it looks like they will have to move to Hurst. David Wells, 7508 Bursey Road, came forward. He stated Mr. Austin and Mr. Long are not residents of North Richland Hills and all they want to do is cut up the land into small lots and sell them and move on. Mr. Wells said you need to drive through some duplex areas and see how they look after about 3 years. He said he felt the developer should make something for North Richland Hills that the people could be proud of, but if they have duplexes, it will be a slum. . Tom Duer, 7312 Londonderry, came forward. He read from a quote of Councilman Jim Kenna: "Obviously, we can't have all R-l homes, but we haven't had many developers requesting the R-l zoning since we passed the zoning ordinance. We've stuffed the city with R-2 zoning to the point that it is overflowing. I keep asking . . . ~ Page 9 p & Z Minutes February 14, 1985 myself how Colleyville and Hurst get the nice developments with the big homes. We're getting developers wanting to build apartments and duplexes. This is prime property on Bursey. There's no reason to take a beautiful piece of farmland and fill it with zoning you normally find on the borders of zones. We need to start turning down those coming in and asking for less. I recognize the need for first homes, but I really think we have enough smaller homes available in our city without building anymore." Mr. Duer said he is opposed to duplexes in this part or any part of the city. Don Winters, Wilson Lane, came forward. He said he had lived in this area for 40 years and at the present address for 3 years. He said he went to the Keller City Council and they turned down the duplex zoning. Mr. Winters said he wants to be able to continue to live in this area. Tom Ferman, 7325 Continental Trail, came forward. He stated he moved here in December, 1971 and Bursey Road is the same as it was in 1971. Mr. Ferman said if you want to see how duplexes look, just drive down Davis Boulevard. He said he thought some had never been occupied. Mr. Ferman said he had enjoyed the country living and had raised his children there and now has his grandchildren there. Dale Eddy, 8009 Valley Drive, came forward. He said he was a realtor and he knows the only one's that buy these duplexes are investors. He said he knows a person who bought one and now can not afford it. ~ Page 10 P & Z Minutes February 14, 1985 . Brenda Bishop, Bursey Road, came forward. She said she had lived there 9 years. She said she is not against development, but thinks they should make a quality development. Ms. Bishop said she was president of Smithfield P.T.A. and they plan to have 4 portable buildings next year and she asked how are the schools going to handle this development. Acting Chairman Bowen said the Commission had discussed this with the school and they say they will take care of the growth. He said the city has no control on the schools. . Jack Knowles, 7955 Smithfield Road, came forward. He said he was the closest residence to the proposed zoning. He said to ask yourself what are you inviting in this area. Mr. Knowles said we do not need duplexes in this area. Nadine Brooks, 8000 Valley Road, came forward. She asked if any of the Board or Mr. Long and Mr. Austin had ever lived in a duplex. She said her daughter had lived in one. She said it was an unhealthy atmosphere: fights, drug dealing, etc. Ms. Brooks said with this development, the police would have to build a station out there to take care of the problem. Acting Chairman Bowen closed the Public Hearing. He called for a show of hands of the people who were opposed to this request. Approximately half of the council chamber were in opposition to the request. PZ 85-13 DENIED Mr. Wood made the motion to deny PZ 85-13. This motion was seconded by Ms. Nash and the motion carried 4-0. . ~ Page 11 P & Z Minutes February 14, 1985 . 13. PZ 85-14 Request of R.G.A. Development Corp. to rezone a portion of Tract 1, Alex Hood Survey, Abstract 683, and a portion of Tract 2, S. Richardson Survey, Abstract 1266, from their present classification of AG (Agriculture) to R-2 (Single Family). This property is located approximately 600 feet north of Bursey Road and 450 feet west of Keller-Smithfield Road. Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Owen D. Long, Engineer, came forward. He said they are asking for 9,000 square foot lots and 1,800 square foot homes. He said R-1 is 13,000 square foot lots which has an excessive amount of land. Mr. Long stated that Mayfair, the nicest subdivision in Hurst, is 9,000 square foot lots. He said R-2 would make a nice area which would be in the center of the 200 acres. Mr. Long said the prices of houses are $75.00 a square foot now and this would be a quality development as was Kingswood. Mr. Wood asked about the 1,800 square foot homes. Mr. Long said they plan to deed restrict them to 1,800 square foot minimum. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. Elly Becker, 8024 Valley Drive, came forward. She said she would like to see the area go R-l. . ~ Page 12 p & Z Minutes February 14, 1985 . Bill Mabry, 7524 Bursey Road, came forward. He said he was also against this R-2 request. He said he felt they should have R-1. He said he agreed with what Councilman Jim Ramsey brought up at the City Council meeting. He said Councilman Richard Davis recommended raising the square footage to 1,800. Mr. Mabry said he would have spoken against that, but they had already closed the Public Hearing. He said he feels they need R-1. Mr. Mabry said he owns a lot in Mayfair in Hurst. He said he gave $55,000 for it and then was offered $80,000 for it. . Mr. Mabry said North Richland Hills needs larger lots as well as larger homes. Sandra Eddy, 8009 Valley Drive, came forward. She said she agrees with Bill Mabry. She said homeowners and tax payers differ from the developers. Mary Mabry, 7524 Bursey Road, came forward. She said she feels they need R-1 lots. David Wells, 7508 Bursey Road, came forward. He said he would like to see North Richland Hills have something to be proud of. He said this is a wooded prime area for executives. Tom Duer, 7312 Londonderry, came forward. He asked if the property to the west was R-2. Acting Chairman Bowen stated it was. . Mrs. Renfro, 7401 Continental Trail, came forward. She said she had 5 acres and has had many people knock on her door wanting to buy her property. . . . ~ Page 13 P & Z Minutes February 14, 1985 Acting Chairman Bowen closed the Public Hearing. Mr. Wood said he felt there is a need for both R-l and R-2 zoning, but we should have either R-l or R-2. He said the Commission upgraded the old ordinance from 1,200 to 1,400, 1,300 to 1,600, and then the 1,800. Mr. Wood said he could not understand why they need to combine them. He said either have R-1, R-2, or a PD development. Mr. Schwinger made a motion to approve PZ 85-14 with 9,000 square foot lots and 1,600 square foot homes. The motion died for lack of a second. PZ 85-14 APPROVED Ms. Nash made the motion to approve PZ 85-14 with the stipulation that the houses be a minimum of 1,800 square feet. This motion was seconded by Mr. Bowen and the motion carried 3-1 with Mr. Wood voting against. 14. PZ 85-15 Request of Mediplex, Inc. to rezone Lot 1, Block 5, Richland Oaks Addition, from its present classification of C-l (Commercial) to C-I-Specific Use-Sale of Alcoholic Beverages. This property is located at 8701 Airport Freeway. Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. George W. Boring, Attorney, came forward. He said this property is the former Jo Beel's restaurant and they plan a new restaurant. He said the President of Mediplex is here if you need to ask any questions. Mr. Boring said they were asking the Commission to allow them to serve mixed drinks as the previous restaurant did. . . . ~ Page 14 P & Z Minutes February 14, 1985 Ms. Nash asked in whose name would the specific use be. Mr. Boring said it would be in Jeanne Edmonds, the President of the company. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. PZ 85-15 APPROVED Mr. Wood made the motion to approve PZ 85-15. This motion was seconded by Ms. Nash and the motion carried 4-0. 15. PZ 85-16 Request of Oak Hills Joint Venture to rezone Lot 24, Block 1, Oak Hills Addition, from its present classification of AG (Agriculture) to 0-1 (Office District). This property is located at the northwest corner of Precinct Line Road and Amundson Road. Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Owen D. Long, part owner and engineer, came forward. He stated this was a 5 acre tract on which they wish to build an office complex. Mr. Long stated one of the owners, Mr. Barfield, has had success in building office complexes. He said this would be 6 lots on a cul de sac. Mr. Long stated they would build their half of Amundson and will do what is necessary on Precinct Line Road. Mr. Wood asked if there would be curb cuts on Precinct Line Road. Mr. Long said he would suggest the openings be on the cuI de sac, but he would not like to say there would be no curb cuts on Precinct Line Road. . . . ~ Page 15 P & Z Minutes February 14, 1985 Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. This motion was seconded by Mr. Schwinger and the motion carried 3-1 with Ms. Nash voting against. 16. PZ 85-17 Request of California-Texas Properties to rezone a portion of Tract 5, s. Richardson Survey, Abstract 1266, from its present classification of AG (Agriculture) to R-7-MF (Multi-Family). This property is located on the west side of Davis Boulevard at Cherokee Trail. Acting Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Dick Perkins with Teague Nall & Perkins, came forward to represent California-Texas. He said this property is well suited for this development. Acting Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, . the Acting Chairman closed the Public Hearing.
