MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
APRIL 11, 1985 - 7:30 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Don Bowen, at 7:30 P. M.

Chairman Bowen introduced new member,

next Planning and Zoning meeting.
CONSIDERATION OF THE MINUTES
OF MARCH 14, 1985
Ms. Nash made the motion to approve
the minutes as written.

Request of Bill Marcum for preliminary
plat of Lot 1, Block 4, Henry
Addition.
PS 85-16
APPROVED
Mr. Wood made the motion to approve
PS 85-16. This motion was seconded by
Mr. Schwinger and the motion carried
5-0.

PS 85-21
Request of Lyle Cherry for replat of
Lot 9R-l, Block 7, Clearview Addition.
Mr. Bowen stated the Commission
determined there was an error in the
zoning map on this property which
should be C-2. He said the Commission
will see that the map is corrected.

Mr. Tucker made the motion to approve
PS 85-21. This motion was seconded by
Ms. Nash and the motion carried 5-0.

Mr. Schwinger made the motion to
approve PS 85-22. This motion was
seconded by Mr. Wood and the motion
carried 5-0.

Request of Williamsburg Association
for final plat of Lots 1 & 2, Block 7,
Industrial Park Addition.

Mr. Wood made the motion to approve
PS 85-23. This motion was seconded by
Mr. Schwinger and the motion carried
5-0.

PZ 85-32
Request of Quadrangle Development
Company to rezone Tract 3, John
McComas Survey, Abstract 1040, from
its present classification of AG
(Agriculture) to R-3 (Single Family).
This property is located approximately
521 feet north of Chapman Road between
Smithfield Road and Hewitt Street.

Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Walter Elliott, Elliott and Hughes
Engineers, came forward. He said this
property is north of Chapman Road and
bounded on the east by Smithfield Road
and on the west by Hewitt Street. He
said the property is 272 feet wide
along Smithfield Road, 267 feet wide
along Hewitt street, and 950 feet long
going east and west. Mr. Elliott said
immediately across the street on
Smithfield Road is Smithfield
Elementary school, some retail and a
day care center. He said there was
one lot that was zoned R-2, but the
rest of the homes are zoned R-3, but
do not meet the present R-3 criteria.

Mr. Elliott stated there was an old
residential house on this property
which would be torn down. He said to
the north of this property on
Smithfield Road, there are mixed
zonings, some single family and some
commercial. He said to the south,
there is a church and a frame
residential house. Mr. Elliott said
on Hewitt Street there is Agricultural
zoning to the west and north with
houses and then some R-2 zoning, some
with frame houses; then to the south
is R-3 zoning.
Mr. Elliott stated they had wondered
what was going to happen to Hewitt
Street, but there was an engineering
study made and the city plans to build
a new street and assess the property
owners.

Mr. Elliott stated the zoning
classification requires 7,500 square
foot lots and 1,400 square foot living
area houses, but their lots would
average 8,200 square feet and the
houses would be from 1,450, 1,500, and
up. He said this is not speculative
zoning, they will develop this
property. He said they are developing
Century Oaks Addition, north of this
property, now.
Mr. Elliott said at an average of $60
per square foot, $87,000 for 25 years
at 13% interest would be approximately
$1,050 to $1,100 per month and the
husband and wife would have to have an
annual income of $40,000 and up to
qualify.

Mr. Elliott said they feel this is the
proper use of the land and would be
compatible with the area. He said
most of the lots would be 110 feet
deep and 75 to 78 feet wide.

There being no one wishing to speak,
the Chairman closed the Public
Hearing.
PZ 85-32
APPROVED
Mr. Tucker made the motion to approve
PZ 85-32. This motion was seconded by
Ms. Nash and the motion carried 5-0.

PZ 85-33
Request of B, W & F, Inc. (Godfather's
Pizza) to rezone a portion of Lot 5,
Block 1, Northland Shopping Center
Addition, from its present
classification of C-l (Commercial) to
C-I-Specific Use-Sale of Alcoholic
Beverages. This property is located
at 6238 Rufe Snow Drive.

Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Mike Malone came forward. He said
they opened their new restaurant last
Wednesday. He said they want to sell
beer with their pizza. He said the
beer sales would be only 5 % of the
sales. Mr. Malone said they also have
a salad bar.
Chairman Bowen stated that when they
go to the City Council, the Council
would have to have the name of an
individual for the specific use.
Mr. Malone said he was aware of this.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.

APPROVED
Ms. Nash made the motion to approve
PZ 85-33. This motion was seconded by
Mr. Schwinger and the motion carried
4-1 with Mr. Wood voting against.

PZ 85-34
Request of Growth Investors, Inc. to
rezone Lots 1-18, Block 9, Lots 1-18,
Block 11, Lots 12-22, Block 12, Lots
1-27, Block 13, & Lots 1-5, Block 14,
Windcrest Addition, from their present
classification of R-2-1400 (Single
Family) to R-4-SD (Separate Ownership
Duplex). This property is located
north of Hightower Drive and bounded
on the north by Maroaks Addition.
Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Mike Stephens with Growth Investors
came forward. He said they wish to
build single family attached, separate
ownership duplexes. He said they want
to provide home ownership to people
who cannot afford single family homes.
Mr. Stephens said there is an existing
duplex subdivision to the north of
this property. He said there was
approximately 100 single family homes
that were rental property, then there
were some abandoned areas to the
south. Mr. Stephens said he wants to
upgrade the neighborhood. He said
they would deed restrict the size to
1,100 square feet per side with
landscaping and underground sprinkler
system. He said the ordinance just
requires single carports, but they
plan to build double car garages per
unit.

Kevin Mullins, 7308 Meadowview
Terrace, came forward. He said he
lives in Foster Village, north of
Starnes. He said there are 326 single
family residences and on Windhaven and
Windcrest, there are 114 rent houses.
He said there are also 47 duplexes
which border the elementary school.
Mr. Mullins said the rental property
is not maintained. He said if the
Commission grants this request, there
would be 79 duplexes and 306 cars on
Starnes Road, but if it stays single
family, ther~ would only be 79 cars.
Mr. Mullins said he requests the
Commission deny this request.
Kurt Lemon, 7204 Windcrest Court East,
came forward. He said he bought a
$100,000 home last year. Mr. Lemon
said he was concerned with the added
traffic the duplexes would create.
Mr. Tucker asked how long had the
Windcrest Subdivision been there.
Mr. Lemon said he was not sure, but he
had worked for Better Living when they
were building it.
Mr. Tucker asked Mr. Lemon what he
would propose for this property.
Mr. Lemon said he felt they should
build 1,600 square foot single family
homes there.
Mary Atkins, 7133 Douglas Lane, came
forward. She said she was against
this zoning request. She said they
would like to see high quality homes
close to the size of their property.
Ms. Atkins said they do not want
any more rental property. She said
the Commission upheld the 1,600 square
foot requirement close to their larger
homes on Douglas Lane. Ms. Atkins
said she requests the Commission leave
the zoning as is.

Vincent Evelsizer, 7281 Windcrest
Court East, came forward. He said he
lives directly across the street from
this property. Mr. Evelsizer said the
traffic will be bad and the road is in
bad condition now. He said he hoped
the Commission would go with the
people who live there and vote against
this request.
Melinda Gunter, 7208 Windcrest Court
East, came forward. She said before
they bought, they checked the area and
found it was all single family. She
said she represents 6 families who
were unable to attend the meeting who
are in opposition to this request,
also. Ms. Gunter said she has a
petition to submit in opposition to
this request.
Randy L. Peterson, 7201 Windcrest
Court East, came forward. He said at
$60 per foot, the duplexes would sell
for $66,000 instead of $100,000 for
the single family homes. He said he
felt it would lower the value of his
home and feel this request should be
denied.
Chairman Bowen closed the Public
Hearing.
PZ 85-34
DENIED
Ms. Nash made the motion to deny
PZ 85-34. This motion was seconded by
Mr. Tucker and the motion to deny
carried 5-0.

PZ 85-35
Request of Mike Cook to rezone a
portion of Commercial Tract A,
Richland Plaza Addition, from its
present classification of C-1
(Commercial) to C-2 (Commercial).
This property is located north of
Kentuckey Fried Chicken on Grapevine
Highway (the old miniature golf
course).

Chairman Bowen opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Mike Cook, President of Mike's Garden
Center, came forward. He said he
plans to have a retail business with
outside storage for plants. Mr. Cook
said this property had been vacant for
6 or 7 years.
Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

PZ 85-35
APPROVED
Mr. Tucker made the motion to approve
PZ 85-35. This motion was seconded by
Mr. Wood and the motion carried 5-0.
9.
PZ 85-37
Request of Hanson Properties and Billy
G. Mitchell to rezone Tracts 3B7, 3B3,
3C3, & 3C4, T. K. Martin Survey,
Abstract 1055, from their present
classifications of R-7-MF
(Multi-Family) & AG (Agriculture) to
R-6-T (Townhouse & Garden Home). This
property is located on the west side
of Precinct Line Road, approximately
1,100 feet north of Martin Drive.
David Barfield carne forward.
Chairman Bowen stated our Zoning
Ordinance as written only allows
attached houses in R-6-T zoning. He
said the Commission had discussed this
and see the need to make a change in
the Zoning Ordinance. Chairman Bowen
said, legally, the Commission cannot
hear this request as submitted.

Mr. Tucker stated the Commission wants
to help and they have asked the staff
to write an amendment to the Zoning
Ordinance.

CONSIDERATION OF PROPOSED

Mr. Barfield said he had meetings with
Mr. Line and the city staff regarding
this request.
Mr. Tucker said he would recommend
postponing this request until they get
the Zoning Ordinance amended. He
asked how long it would take.
Mr. Royston said it would take through
next month.
Mr. Barfield said they have a contract
which expires in 90 days.
Mr. Tucker said it would take
approximately 45 days to get it
amended. He said they had rather have
this zoning as to have the
multi-family zoning.
Mr. Tucker made the motion to
postpone PZ 85-37 until such time that
an amendment is approved to allow
detached townhouses or garden homes.
This motion was seconded by Ms. Nash
and the motion carried 5-0.
Mr. Tucker made the motion to
recommend approval as modified. This
motion was seconded by Mr. Schwinger
and the motion carried 5-0.
The meeting adjourned at 8:20 P. M.
