PS 85-42 PS 85-42 APPROVED PZ 85-62 ~ MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, JULY 11, 1985 - 7:30 P. M. The meeting was called to order by the Chairman, Don Bowen, at 7:35 P. M. Planning & Dev. p & Z Coordinator ABSENT: Marjorie Nash Request of The Cambridge Company for replat of Lots lR & 2R, Block 2, and Lots 4 & 5, Block 13, Snow Heights North Addition. Mr. Wood made the motion to approve PS 85-42. This motion was seconded by Mr. Schwinger and the motion carried 5-0. Request of Growth Investors, Inc. to rezone Lots 12 thru 22, Block 13, Lots 1 thru 5, Block 14, & Lots 1 thru 9, Block 11, Windcrest Addition, from their present classification of R-2 (Single Family) to R-4-SD (Separate Ownership Duplex). This property is located on both sides of Starnes Road and bounded on the north by Maroaks Addition. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mike Stephens, 1550 Norwood, Hurst, came forward. He presented pictures to the Commission. He said he was requesting to change single family detached to single family attached. Mr. Stephens stated there were 43 lots north of Starnes that abut duplex zoning. ~ Page 2 P & Z Minutes July 11, 1985 . Mr. Stephens stated there were 114 rental houses in the area and he wishes to upgrade the neighborhood. He said these duplexes would be for first time home buyers. He said this zoning would serve as a buffer to the nice existing single family. Mr. Stephens stated he wants to change the deed restrictions from 1000 square foot units to 1200 square feet, a total of 2400 square feet. He said every unit would have two car garages, would be landscaped, have a sprinkler system, and a fence. He said all this would be put in the deed restrictions. . Mr. Stephens stated they plan to build a quality product, there would be no negative effect on the property and the crime rate would not go up. He said he would like to do something positive to the neighborhood. E. E. Freeman, 3000 Commercial Court, Bedford, came forward. He said he was with Westgate Builders and they own several lots on Windcrest Drive and Windhaven. He said the area is bad and he had rather have this than what is there. Mr. Freeman said he plans to build 1600 to 1700 square foot homes. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. . Ray Yoakum, 6808 Starnes Road, came forward. He read some letters to the Commission from neighbors who were in opposition to the request. He stated this zoning would destroy the existing nature of the neighborhood by introducing undesireable elements of absentee ownership, transient occupants, increased traffic, and would be detrimental to the property values as well as a menace and hazard to their families and children ~ Page 3 P & Z Minutes July 11, 1985 . Mary Atkins, 7133 Douglas Lane, came forward. She said her property is to the east of this request. Ms. Atkins stated all the homes on Douglas Lane are 2000 square feet or more. She said she would agree that the housing in the area is bad, but they do not want more. Ms. Atkins said the property next to their property must be 1600 square feet and they would rather have all of this addition changed to 1600. She stated many of the homes in Foster Village are 1600 square feet or more. Ms. Atkins said the duplexes would cause more traffic and she is against this request. . Connie Keener, 7101 Douglas Lane, came forward. She said they came through their property with a cement drainage ditch and all the development drains there. She said they find all kinds of things in this drainage ditch such as: 5 railroad ties, large spools, fence posts, christmas trees, 50 gallon drum, carpet, and an aluminum camper shell. Ms. Keener said they do have a drainage problem and this request would cause more drainage. She requested the ditch be changed off their property on to Windcrest. She said she felt they had not been dealt with properly. Kevin Mullins, 7308 Meadowview Terrace, came forward. He said he lives at the corner of Meadowview and Starnes. Mr. Mullins said he agrees with everything that has been said. He said he felt this would destroy the neighborhood. He said there are $120,000 to $130,000 being built there. Mr. Mullins stated if duplexes go in, he will have to sell his home and move. . Chairman Bowen closed the Public Hearing. ~ Page 4 P & Z Minutes July 11, 1985 . PZ 85-62 DENIED Mr. Schwinger made the motion to deny PZ 85-62. This motion was seconded by Mr. Wood and the motion carried 5-0. 3. PZ 85-63 Request of Coco Venture to rezone a portion of Tract 10D, J. H. Barlough Survey, Abstract 130, from its present classification of R-2 (Single Family) to C-2 (Commercial). This property is located on the west side of Davis Boulevard, south of College Hill Assembly of God Church. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Jim Stephens came forward. He requested approval of this small area. . Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 85-63 APPROVED Mr. Wood made the motion to approve PZ 85-63. This motion was seconded by Mr. Tucker and the motion carried 5-0. Chairman Bowen stated the next five cases located in the Mangham Airport area would be heard together, but would be voted on individually. 4. PZ 85-72 Tract 1 Request of E-Systems, Inc. to rezone Tract 12C, T. K. Martin Survey, Abstract 1055, from its present classification of AG (Agriculture) to I-I (Industrial). Walker Survey, Abstract 1652, from their present classification of AG (Agriculture) to I-I (Industrial). This property is located east of Cardinal Lane and east of Mangham Airport. 6. PZ 85-74 Tract 3 Request of E-Systems, Inc. to rezone part of Tracts lA & 5, L. C. Walker Survey, Abstract 1652, from their present classification of AG (Agriculture) to I-I (Industrial). This property is located south of Mangham Airport and west of Grapevine Highway. 7. PZ 85-75 Tract 4 Request of E-Systems, Inc. to rezone part of Tract 11, T. K. Martin Survey, Abstract 1055, from its present classification of I-I (Industrial) and R-3 (Single Family) to R-7-MF (Multi- Family). This property is located south of Cardinal Lane and west of Mangham Airport. . 8. PZ 85-76 Tract 5 Request of E-Systems, Inc. to rezone Tract 11, T.K. Martin Survey, Abstract 1055, Tracts 1, 2A, and part of Tract 2, L.C. Walker Survey, Abstract 1652, and part of Tract 8, John Barlough Survey, Abstract 130, from their present classification of R-3 (Single Family) to C-l (Commercial). This property is located south of Cardinal Lane at Sunnybrook Drive. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. . ~ Page 6 p & Z Minutes July 11, 1985 . Larry Lewis, Senior Planner, came forward to represent E-Systems. He said he had made a land use and thoroughfare plan of North Richland Hills to present. He said the purpose is to implement a compatible use for the land. Mr. Lewis said there is a lack of thoroughfares and a lack of the proper zoning. He said the previous plan called for improvements on Cardinal Lane. He said this thoroughfare locates roads away from local streets on to major thoroughfares and it significantly reduces the city's time and cost. Mr. Lewis said there is a lack of retail between Davis and Precinct Line Road. He said the homeowner pays about 60% of the taxes which would be lowered by having more retail. . Mr. Lewis said the present thoroughfare plan of North Richland Hills shows more single family, small amounts of Multi-Family and small amounts of commercial and industrial. He showed their plan. He said there would be 5 major roads, two going east and west and three going north and south. He said they plan to extend Smithfield Road, Amundson Road, and Watauga Road. Mr. Lewis said there are several benefits to Multi-Family. He said the zoning lines are along major thoroughfares and serve as a buffer because it separates the single family, industrial, and existing mobile home park. Mr. Lewis said there would be ample open space with a pool and club house. . Mr. Lewis stated there is a demand for Multi-Family with the rapid population growth doubling every 10 years. He said North Richland Hills is projected to have 90,000 by the year 2000. Mr. Lewis stated they conducted a survey of North Richland Hills, Arlington, ~ Page 7 P & Z Minutes July 11, 1985 . Bedford, Euless, Hurst, and Richland Hills. He said North Richland Hills had not kept pace with the others. He said North Richland Hills has the largest vacant, completed homes. He said it has the largest single family which is 20% vacant or unfinished. Mr. Lewis stated there are other benefits with Multi-Family. He said it increases the tax base and decreases the single family tax burden. He said North Richland Hills can be competitive and provide a needed mix of people. . Mr. Lewis stated the commercial site at the northeast corner of Watauga and Amundson would be convenient to those living to the north, south, and west. He said there would be 95,000 square feet of retail. He said there is single family to the north of this tract and they plan to put a masonry wall along the north side of this property. Mr. Lewis stated there were three proposed industrial strips, north and south of Watauga Road and along Crane Road. Mr. Lewis said in summary, they feel it is a compatible land use and thoroughfare plan. Mr. Schwinger asked about Walker Branch. Mr. Lewis said it was on the eastern portion of the Multi-Family use. Mr. Wood stated 120 acres of Multi-Family is quite a large buffer. Mr. Lewis said major thoroughfares are provided. . Mr. Schwinger asked about the extension of Smithfield Road. Page 8 P & Z Minutes July 11, 1985 . Mr. Lewis said they would have to get right-of-way from property owners to extend it to their property. Mr. Tucker said 1920 apartments is a large amount. He said he had read that North Richland Hills has about a 5 year supply of apartments. Mr. Tucker said North Richland Hills is not like Arlington and he does not want it that way. He said he might agree to some Mul~i-Family, but not all in one place. James David Lucas, Administrator of the land to the east of this property came forward. He said he may have to ask for some Multi-Family for their property. Mr. Wood asked Mr. Lucas if he had any plans for his property. . Mr. Lucas said they had temporary ones. Mr. Wood asked what the general use was. Mr. Lucas said there would be about 3 different types of Multi-Family, and along Highway 26 and Precinct Line would be commercial. Chairman Bowen called for those wishing to speak in opposition to these requests to please come forward. . Charles Scoma, 8300 Cardinal Lane, came forward. He said he felt they were closing in on him. He said he estimates they paid approximately 85¢ per square foot and they will gain 100 million. Mr. Scoma said he was not opposed to the development of North Richland Hills, but feel we do not need Multi-Family and apartments. He said what we need is more jobs. Mr. Scoma said he does not want North Richland Hills to be like Arlington or Haltom City. ~ Page 9 P & Z Minutes July 11, 1985 . Mr. Scoma said the citizens of North Richland Hills are depending on the Commission to make the right decision and deny these requests. Robert Marks, 8229 Pearl Street, came forward. He said he was speaking for his father and himself. He said he had seen a large growth in North Richland Hills such as the widening of Davis Boulevard and the many retail shops. He listed the many shopping centers close to this area. Mr. Marks said we do not need any more retail. Mr. Marks said if there are large amounts of vacancies of single family, there would also be vacancies of apartments. He said he does not mind looking out at houses, but does not want to look out and see apartments. . Charles Rutledge, 6409 Sunnybrook, came forward. He said his daughter is the manager of an apartment complex and it is getting so hard to rent apartments that they are giving away color TV's and microwaves. Mr. Rutledge said he is opposed to this zoning. . Cindy Fortier, 6425 Sunnybrook, came forward. She said Mr. Lewis stated they wanted to keep the country atmosphere; how can you do that with 120 acres of apartments? Ms. Fortier said they would bring in low income people and would cause crime. She said she wanted to be proud of North Richland Hills. Ms. Fortier said in 1981 they had a flood and she got trapped in her home because of the water. She said this development would cause more drainage problems. Ms. Fortier also said they have had problems with low water pressure and this development would make it worse. She said she requests the zoning be changed to single family with some parks. ~ Page 10 P & Z Minutes July 11, 1985 . Bryan Foley, 6305 Shirley Drive, came forward. He said he agrees with all that his neighbors have said. He said he has a petition with 115 signatures in opposition to this zoning. He said they are against the Commercial and the Multi-Family. Gerald Stewart, 8840 Main Street, came forward. He said he is opposed to these zoning requests. He said he applaud the Planning and Zoning Commission in the development of a Master Plan for North Richland Hills and he does not feel the one submitted tonight is acceptable for our city. . Peter Cheese, 8212 Pearl Street, came forward. He said he was from Great Brittain and the reason he moved to North Richland Hills was the pride in home and community of North Richland Hills so please do not spoil that. David Barfield, 6825 Precinct Line Road, came forward. He said he was one of the developers of one of the nicest subdivisions in North Richland Hills, Nob Hill Addition. Mr. Barfield said the Commission has a big job and feels they need to study the plan submitted before they make a decision. Mr. Barfield said he may wish to develop some property along the same lines as has been submitted. Alice Scoma, 8300 Cardinal Lane, came forward. She said no one has said anything about the schools. She said all the schools already have portable buildings. Mrs. Scoma said they keep talking about a 6-lane thoroughfare, but the property owners have not requested a 6-lane thoroughfare between them and their neighbor. . Mr. Lewis came forward. He said there is no existing retail in the neighborhood. He said they have provided thoroughfares to handle the traffic and the drainage will be solved. ~ Page 11 P & Z Minutes July 11, 1985 . Mr. Lewis said they will be more than doubling the single family, but are taking the traffic away from the neighborhood. He said in regard to the schools, he talked to them and they said this size apartment complex would only generate approximately 75 children. Chairman Bowen closed the Public Hearing. . Mr. Tucker said our city must grow, we can not have all residences, we could not afford the taxes, we need employment, we need a mixed use, but he does not feel this is the best plan for North Richland Hills. Mr. Tucker said we have to have development to cure the water, sewer and drainage problems and the roads. He said some Multi-Family may be needed, but they do not need to take away the R-3. Mr. Wood said he agreed with Mr. Tucker. He said it was an excellent presentation, but they have too much Multi-Family. He said he agrees it needs to be developed instead of the airport, but feel there needs to be less Industrial, less Multi-Family, and more Single Family. Chairman Bowen said having the lowest percent of Multi-Family is intentional on the part of this Commission. PZ 85-72 DENIED Mr. Tucker made the motion to deny PZ 85-72. This motion was seconded by Mr. Schwinger and the motion to deny carried 5-0. PZ 85-73 DENIED Mr. Wood made the motion to deny PZ 85-73. This motion was seconded by Mr. Tucker and the motion to deny carried 5-0. . PZ 85-74 DENIED Mr. Schwinger made the motion to deny PZ 85-74. BACK TO ORDER Chairman Bowen called the meeting back to order at 9:20 P. M. with the same members present. 9. PZ 85-77 Request of Diamond Shamrock Company to rezone part of Tract 3A, William Mann Survey, Abstract 1010, from its present classification of C-l (Commercial) to C-I-Specific Use-Sale of Beer for off premise consumption. This property is located at the southeast corner of Rufe Snow Drive and Hightower Drive. . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Ken Eaton, 1101 E. First Street, came forward to represent Diamond Shamrock. He stated this was to be a combination convenience, gas service station. He said most of the ones on Rufe Snow Drive are allowed to sell beer and they wanted to be able to compete. Chairman Bowen stated there were delinquent taxes due on the property which will have to be paid prior to going to the City Council. Mr. Eaton said he was not aware of that and they would be paid. . This motion was seconded by Mr. Schwinger and the motion carried 4-1 with Mr. Wood voting against. 10. PZ 85-79 Request of Jeff Marsh to rezone Tract 4A, W.D. Barnes Survey, Abstract 146, from its present classification of AG (Agriculture) to R-2 (Single Family). This property is located on the north side of Starnes Road and bounded on the north and east by Kingswood Estates. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . David Barfield came forward to represent Mr. Marsh. He said there was R-2 around this property and they feel this is the highest and best use of the land. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 85-79 APPROVED Mr. Tucker made the motion to approve PZ 85-79. This motion was seconded by Mr. Wood and the motion carried 5-0. PZ 85-81 Request of Burk Collins Investments to rezone a portion of Tract 1, T. K. Martin Survey, Abstract 1055, from its present classification of AG (Agriculture) to R-2 (Single Family) 13. PZ 85-82 Request of Burk Collins Investments to rezone a portion of Tract 1, T. K. Martin Survey, Abstract 1055, from its present classification of AG (Agriculture) to R-8 (Single Family Detached-Zero Lot Line). 14. PZ 85-83 Request of Burk Collins Investments to rezone a portion of Tract 1, T. K. Martin Survey, Abstract 1055, from its present classification of AG (Agriculture) to R-5-D (Duplex). . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. Burk Collins came forward. He said he was aware of the opposition to these requests, but this land has problems. He said it lies in the flood plain which would require him to put in a concrete lined channel. Mr. Collins said the improvements would cost a half million dollars. He said this land had gone untouched for 60 years because of the problem. Mr. Collins said the owner, Mr. Chaison, thought he had it sold six times, but when they ran their cost, they found they could not do it. . Page 15 p & Z Minutes July 11, 1985 . Mr. Collins said he sat and listened to the reasons people were against this; some said they enjoyed sitting on their back porch and listening to the hoot owls or looking at the mesquite trees. He said some in Glenann Addition just did not want it developed. Mr. Collins stated that the owner is disabled and needs to sell this property. He said if you deny these requests, you would be telling him he can't develop his property. Mr. Collins said he had taken out a lot of the duplex zoning and added some R-2 and R-8. He asked the Commission to analysis this, talk to the owner, and then make a choice for the best use of the property. . Mr. Wood asked Mr. Collins if this property could be opened up to Amundson Road. Mr. Collins said it could be. He said it would probably take two years and would cost $125,000. He said there was an old crossing there and someone has tried to maintain it. Mr. Collins said the railroad is really particular with their property. Mr. Wood stated there would be a need for an outlet there. Chairman Bowen said on the plans for the R-8 zoning, it showed stucco which does not meet the city's building code. Mr. Collins stated that time did not permit them to get a detailed set of plans, but they would conform to the building code. . Page 16 p & Z Minutes July 11, 1985 . Robert Chaison, 1606 Cypress Drive, Irving, Texas, came forward. He said he was the owner of the property in question. He said they do have a drainage problem on this property, but it would be fixed in development. He requested that all parties give a little to make this work. Mr. Chaison said Mr. Collins is asking for 18.72 acres of duplexes and he has some single family next to Stonybrooke and Glenann. He said the taxes on this property are $7,000 per year. He said he had several contracts on the property which fell through. Mr. Chaison requested the Commission give fair consideration to these requests. Mr. Chaison said he felt sure they would be able to get an entrance over the railroad. . Rick Campbell, 6525 Simmons, came forward. He said he was in favor of these zoning requests. Chairman Bowen called for those wishing to speak in opposition to these requests to please come forward. Mark Jackson, 8404 Donna Drive, came forward. He said he left the east side of Fort Worth and came to North Richland Hills to get away from such development. He asked the sizes of the zonings. Chairman Bowen stated R-2 was a minimum of 1600 square foot homes, R-8 was a minimum of 1200 square foot homes, and R-5-D was a minimum of 1000 square foot per side. Mr. Jackson asked if there was a minimum lot size. Chairman Bowen stated there was. . Mr. Jackson said he is against rental property. ~ Page 17 P & Z Minutes July 11, 1985 . Billy Wofford, 7021 Stoneridge Drive, came forward. He said think about the motives, profits and increased building, paving over flood plains, paving streets; where is the water going. He said there would have to be a lot of land fill backing up to Stonybrooke. Mr. Wofford stated the streets are at their peak density now. He said with the increased building, the roads will not handle the traffic and they are not designed to handle the trucks necessary to handle the building. Mr. Wofford said if you pave over agricultural land, it cannot grow food or raise cattle. Mr. Wofford said there is a high vacancy rate now; who is going to rent them? . Mr. Wofford requested the Commission look at the requests. He said he would not be against single family, but was against multi-family and duplexes. v. L. Gibson, 8333 Odell Street, came forward. He said everything has already been said about apartments. He said there is a real problem getting out of Odell Street. He said it was hard to get out at that wrecking yard unless there was an entrance over the railroad track. Mr. Gibson said he would like to see the property cleaned up as it is a fire hazard, but would like to see a better type of homes. He said he was in favor of the R-2. He said he felt they should have a better development instead of worse. He requested the Commission reconsider and cut down on the density. . Page 18 P & Z Minutes July 11, 1985 . Gerald Stewart, 8840 Main Street, came forward. He said he was not opposed to PZ 85-80 and 81 which were asking for single family, but was opposed to the R-8 and R-5-D zoning. Mr. Tucker stated that R-8 zoning is single family detached with two car garages. Mr. Stewart said he was still opposed to it. He said Odell Street is not a good access and there is no back access and no east access. Mr. Stewart said a development like this should be adjacent to some school. Mr. Stewart said duplexes mean renting, deterioration of the community; North Richland Hills is planning the future so plan it right. . Don Chaille, 8405 Timberline Court, came forward. He said he was in favor of the R-2, but R-8 and R-5-D was inferior because of size and density. He said if it is feasible to develop 13 acres R-2, the other is also feasible. Mr. Chaille said R-2 is the only way to protect his property. He said the traffic would be bad. He said to protect the residence by making sure there is ingress-egress. James Bennett, 7120 Stonybrooke, came forward. He said his reason for being against these requests is the traffic. He said Stonybrooke Drive would soon have a yellow line going through it and no parking signs. Mr. Bennett said this development would devalue his property. He said Walker Branch runs in back of his house and it is in an earthen channel. He asked why they had to put in a concrete channel. . Mr. Tucker said that was a city requirement. ~ Page 19 P & Z Minutes July 11, 1985 . Mr. Bennett said he was an engineer and does not feel it necessary. Lou Baker, 8036 Odell Street, came forward. She said she is proud of her property and did not feel this would degrade her property, but the traffic would be terrible and requested the Commission reconsider. . Betty Stapleton, 7001 Stoneridge, came forward. She said they had been living there for 5 years. She said she had looked at other areas, but liked North Richland Hills. She said she was concerned about the traffic with only one outlet. Ms. Stapleton said it was already crowded with traffic. She also said she was concerned about the drainage; more concrete would cause more water. She said to keep it all single family dwellings. Joe Baker, 7004 Stonybrook, came forward. He said some of the owner's profits would be our losses. He said there is a lack of ingress-egress and requests denial of these zoning requests. Ed Nowe, 8432 Timberline Court, came forward. He said the amount of traffic this would generate would be very hazardous. Mr. Nowe said he is opposed to the reduced house size and he is opposed to these zoning requests. Gary Grosbeck, 1325 Marti Court, came forward. He said we are just considering the zoning, the water problem is a platting matter and they will have to satisfy the city engineer or they will not get to develop. . ~ Page 20 p & Z Minutes July 11, 1985 . Mr. Tucker said that was correct, it is a platting matter, but the Commission will listen. He said these duplexes would be about $65,000, which would be about $750 per month. He said a person would have to make $35,000 a year to qualify and he did not feel this would hurt the area one bit. Marilyn Baker, 7004 Stonybrooke, came forward. She asked if this was the smallest lot and size living unit. Mr. Tucker said it was. . Ms. Baker said putting in the smallest would be the cheapest and would have transients. She said she is concerned with the children and the traffic. Ms. Baker said she was not going to give up her front yard to widen Stonybrook Drive. She said this would just be investment property for someone. Dorothy Schlley, 7128 Stonybrooke, came forward. She said she was concerned about the drainage and thoroughfare. Mr. Tucker said you must put your trust in your Mayor, City Council, and City Staff to make the right decisions. Mr. Tucker asked Mr. Collins what the R-8 would sell for. Mr. Collins said he was not sure. He said residential lots go for $20,000 and the cost to develop this would be over $20,000. . Mr. Collins said the city would require him to have a flood study made by an engineer showing where the water is going and he would have to provide access or the city would not allow him to develop. He said when they previously received this zoning, they submitted a plan that showed no windows facing the back, but no pictures show that now. He said there would be 84 dwellings with two cars per living unit which would be 168 cars. Mr. Cooper said both sides of Bob Drive are full now. He said with regard to access on Harwood Road, there is also a site problem with the brick walls. Mr. Cooper said he feels he would have a hard time selling his house with two-story buildings and a road behind his fence. Mr. Tucker said the only difference in what Mr. Vielma is asking for is he is giving the Commission a chance to see what he is going to build. He said the developer can go ahead and build tomorrow, but with Planned Development he must build what he has here. John Chan, 5321 Colorado, came forward. He said he is opposed to having a concrete drive behind his fence. Mr. Chan asked why this requirement for site plan. Chairman Bowen said the developer requested this. . Mr. Tucker said in the Zoning Ordinance. Mr. Wood read from the Zoning Ordinance. Mr. Chan said he did not think that drive was a rear yard. Mr. Royston said each townhouse has its own individual lot and there can be a driveway in the back yard. Mr. Chan asked about the windows. Mr. Tucker said where they place the windows is not a requirement of the ordinance. Michael Martin, 5344 Colorado, came forward. He said they already have apartments there. He said that is a very small area to put 84 units on. Mr. Martin said he would agree if they were nice townhomes, but no one takes care of apartments. James Lamond, 5151 Beltline Road, came forward. He said he did a feasibility study which indicated there was no need for apartments or single family, but there was a need for townhomes so they down zoned the property. Mr. Lamond said they would cost $65 to $70 per square foot, $85,000 per unit. He said the townhomes would have sprinkler systems and be landscaped. He said they would be self contained units which will reduce the noise. Mr. Lamond said they would like to work with the city in platting the property. Christi Jarnido, 5309 Colorado, came forward.
