HomeMy WebLinkAboutResolution 2006-091RESOLUTION NO. 2006-091 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, THAT: 1. The City Manager be, and is hereby authorized to execute the attached City- Developer Agreement with Richland Retail, L.P. for the purpose of receiving the Developer's financial contribution for future improvements to Shady Grove Road as an act and deed of the City. Staples, City Attorney APPROVED AS TO CONTENT: ike Curtis, P.E., Public Works Director CITY-DEVEL(aPER AGREEMENT This agreement is made by and between the City of North Richland Hills, Texas ("City"} a Texas municipality acting by and through its duly authorized City Manager and Richland Retail, L.P. ("Developer") a Texas Limited Partnership acting by and through its General Partner, Jasmine Investments, LLC, for the purpose of documenting their agreement for construction by Developer of 1,300 Linear Feet of Shady Grove Road as a condition of development of property known as Brentwood Estates Addition, Block 5, Lots 1, 2R-l, 2R-Z and ZR-3 an addition to the City of North Richland Hills, Tarrant County, Texas with City participation in the cost of such road. WITNESSETH For and in consideration of the mutual undertakings herein set forth, the parties agree as follows: 1, City agrees to reconstruct to City standards and specifications a 1,3Q0 linear foot section of Shady Grove Road (the "Street") from the Summit Bank drive approach located approximately 300 feet West of Davis Boulevard to the West property line of Lot 1, Block 5, Brentwood Estates Addition to the City of North Richland Hills, Tarrant County, Texas as such Lot is shown on the approved at the August 9, 1999 City Council meeting of the City of North Richland Hills. Such Street is classified as a Minor Collector street on City's Master Thoroughfare Plan and shall be constructed in accordance with such plan with curb and gutter to a width of 44 feet as measured from face of curb. Such construction shall commence at such time as City acquires right of way on the opposite side of such road from DeveIoper's property. Such Street is an infrastructure improvement required for development of the property being platted by Developer. 2. The City's licensed professional engineer has determined that Developer's roughly proportionate share of the cost of such infrastructure improvement is $75,040. 3. Developer agrees to pay City $275,004 within thirty (34) days of the approval of this Developer Agreement. 4. Developer agrees to construct the public improvements and the access drive between Lot 1 and 2R-3 prior to the development of either lot. 5. It is further agreed that no permits will be granted for the construction of improvements unless and until the expiration of thirty {34) days of the approval of this Developer Agreement without a court challenge to any provision of this Developer Agreement.
