CALL TO ORDER The meeting was called to order by the Chairman, Don Bowen, at 7:30 P. M. ROLL CALL PRESENT: Chairman Secretary Member Alt. Member Dir. Planning/Dev. PS 85-54 Request of Campus Hills Joint Venture for preliminary plat of Lot 1, Block 7, Richfield Addition. . PS 85-54 APPROVED Mr. Wood made the motion to approve PS 85-54 subject to the Engineer's comments. This motion was seconded by Ms. Flippo and the motion carried 4-0. Arnold Pent came forward. He stated the applicant should be Campus Hills Joint Venture instead of G. L. Cummings, Jr. 2. PS 85-55 Request of John Barfield, Herman Smith, and the City of North Richland Hills for replat of Tracts AR & B, Block 2, Crestwood Estates. PS 85-55 APPROVED Mr. Schwinger made the motion to approve PS 85-55. This motion was seconded by Mr. Wood and the motion carried 4-0. . Page 2 P & Z Minutes September 12, 1985 . 3. PS 85-58 Request of Johnston & Son Construction Inc. for replat of Block 6, Meadow Lakes Addition. PS 85-58 APPROVED Mr. Wood made the motion to approve PS 85-58. This motion was seconded by Mr. Schwinger and the motion carried 4-0. 4. PS 85-59 Request of Stanley M. Peskind and Lawrence R. Burk for preliminary plat of Lot 2, Block 2, and Block 3, Tapp Addition. John Burgess with Carter and Burgess, Inc. came forward. . Chairman Bowen asked about the small piece of land at the southeast corner of this property that was separated from this property by the TESCO transmission line. He said he requests they plat this property or give it to the city for street right of way. Mr. Burgess stated that had been discussed for a right turn, but it is in limbo at present. He said they had thought about putting a sign on it. Chairman Bowen said it was not shown as part of this plat. Mr. Burgess stated that was an oversight and would be corrected. PS 85-59 APPROVED Mr. Wood made the motion to approve PS 85-59 subject to the Engineer's comments and subject to the owner granting to the city the southeast corner of his property which is cut off by the TESCO transmission line. This motion was seconded by Ms. Flippo and the motion carried 4-0. . ~ Page 3 P & Z Minutes September 12, 1985 . 5. PZ 85-101 Request of R.G.A. Development to rezone Tracts 1, lA, part of Tract 2, S. Richardson Survey, Abstract 1266, and part of Tract 1, A. Hood Survey, Abstract 683, from their present classification of AG (Agriculture) to R-6-T (Townhouses and Garden Homes District). This property is located south of Wilson Lane and west of Keller-Smithfield Road. Chairman Bowen stated this case was postponed at the last meeting because of a tie vote. He stated the Public Hearing was held at that time. PZ 85-101 APPROVED Mr. Schwinger made the motion to approve PZ 85-101. This motion was seconded by Mr. Wood and the motion carried 3-1 with Ms. Flippo voting against. . 6. PZ 85-102 Consideration of an amendment to the Zoning Ordinance #1080 regarding warehousing. Chairman Bowen stated this request was postponed from the last meeting. He read the contents of the ordinance. Chuck Owen, 6129 Abbott Avenue, came forward. He stated he was against deleting mini-warehouses from the C-2 classification. Mr. Owen felt it would devalue the land zoned C-2. . James R. Stephens, 3604 San Bar Lane, Colleyville, Texas, came forward. He stated he was in opposition to deleting the mini-warehouses from C-2. He stated they had purchased a piece of land on Davis Boulevard which is 600 feet deep and they plan to put retail on the front and mini warehouses in back. Mr. Stephens said he was not opposed to it in general, but they need it for this tract of land because they are unable to design it for a larger warehouse. ~ Page 4 P & Z Minutes September 12, 1985 . Mr. Stephens said he had never built mini warehouses before. He said this change would catch them in the middle of their study and plan. Mr. Stephens said he would request if the Commission does make the change, could time be granted to complete their study. Mr. Wood asked about a grandfather clause. Mr. Royston stated any changes would not affect the grand father clause, but the Commission could add a time limit. Chairman Bowen stated he felt a 6 month time limit would be sufficient. PZ 85-102 APPROVED Mr. Wood made the motion to approve PZ 85-102 subject to a grandfather clause of 6 months from the date of adoption to obtaining a building permit. This motion was seconded by Mr. Schwinger and the motion carried 4-0. . 7. PZ 85-103 Request of Erin's Foods to rezone Lot 6, Block 1, Jack M. Estes Subdivision, from its present classification of C-1 (Commercial) to C-1-Specific Use-Sale of Beer for off premise consumption. This property is located at 3900 Rufe Snow Drive. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Kenneth C. Adcock, owner of Erin's Foods, came forward. He requested approval of this request to be able to compete with the competition. He said customers are driving across 820 to purchase beer. Mr. Adcock said there is commercial all around him and Rufe Snow is to be widened. . . . ~ Page 5 P & Z Minutes September 12, 1985 Chairman Bowen stated that since the bond program passed, Rufe Snow would be widened to 5 lanes. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Chairman Bowen said Mr. Adcock would have to furnish a name for the City Council for the Specific Use. Mr. Adcock said it would be his name. PZ 85-103 APPROVED Ms. Flippo made the motion to approve PZ 85-103. This motion was seconded by Mr. Schwinger and the motion carried 3-1 with Mr. Wood voting against. 8. PZ 85-104 Request of B & C Oil Company to rezone Lot A2, Parchman Addition, from its present classification of C-l (Commercial) to C-1-Specific Use-Sale of Beer for off premise consumption. This property is located at 6955 Grapevine Highway. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Otis Campsey, operator of B & COil Company, came forward. He said this request would help his sales and would bring in more revenue for the city. He said he felt it would help sell other items. Mr. Campsey said there were some churches in the area, but he had a surveyor measure them and it was 1416.40 feet from the Northeast Assembly of God Church and 1184.40 from the North Richland Hills Baptist Church. ~ Page 6 P & Z Minutes September 12, 1985 . Mr. Wood said he thought there was a church across the street. Chairman Bowen stated there was a bank across the street. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. Chairman Bowen stated the Commission received a letter from Phil Simmons, Pastor of North Richland Hills Baptist, in opposition to this request. He stated he would be present, but had to be out of town. . Mr. Wood said he agreed with this letter. He said this property joins church property to the north and west. He said this property is used for church purposes on Sunday and during the week. Chairman Bowen stated they had a case in the Smithfield area that was 305 feet from the front door of the church which the Commission and City Council denied. He said it was taken to court and we lost. Chairman Bowen closed the Public Hearing. PZ 85-104 APPROVED Mr. Schwinger made the motion to approve PZ 85-104. This motion was seconded by Ms. Flippo and the motion carried 3-1 with Mr. Wood voting against. 9. PZ 85-105 Consideration of an amendment to the Zoning Ordinance #1080 regarding the keeping of livestock. . Chairman Bowen stated this request was postponed at the last meeting. He said the Commission agreed that livestock should not be kept in just any residential area and requested the City Staff draft a new category. He said the new category would be R-1-S. ~ Page 7 P & Z Minutes September 12, 1985 . Chairman Bowen asked if anyone wished to speak regarding this matter. Mack Garvin, 6908 Little Ranch Road, came forward. He said he had read the ordinance and it looks good to him. Chairman Bowen said the individual would need to request the zoning change. He said the ones who are not grandfathered, may request the new zoning classification. PZ 85-105 APPROVED Mr. Wood made the motion to approve PZ 85-105. This motion was seconded by Ms. Flippo and the motion carried 4-0. 10. PZ 85-106 Request of World Class Motors, Ltd. to rezone Lot 5, Kips Big Boy Addition, from its present classification of C-l (Commercial) to C-1-Specific Use-Sale of Used Autos. This property is located at 7755 Northeast Loop 820. . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. John R. Maddox, General Manager for World Class Motors, came forward. He said they plan to sell fine European cars. He said they have another place in Grand Prairie on 360 and requests they be allowed to open World Class Motors, Phase 2 in North Richland Hills. Mr. Maddox showed the Commission pictures of the type of cars he plans to have. He said they desire to own and operate a retail outlet with a showroom and outside parking. Mr. Maddox said they would not take up the required parking spaces. . Chairman Bowen asked if this would be a low volume dealership. Mr. Maddox said it would be, but said he has a waiting list for cars. . . . ~ Page 8 P & Z Minutes September 12, 1985 Chairman Bowen asked Mr. Maddox if he was aware that this property will be in jeopardy when they build the new interchange. Mr. Maddox said he did, but he has a 3 year lease. He said their plans for Phase 3 is to build on their property. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 85-106 APPROVED Ms. Flippo made the motion to approve PZ 85-106. This motion was seconded by Mr. Wood and the motion carried 4-0. 11. PZ 85-107 Request of Winn-Dixie Texas, Inc. to rezone part of Lot 16A, Block 5, North Richland Hills Addition, from its present classification of LR (Local Retail) to LR-Specific Use-Sale of Beer for off premise consumption. This property is located at 7201 Grapevine Highway. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Buddy Oujesky came forward. He said they were requesting this for their building only, not the entire shopping center. Mr. Oujesky said they request they be allowed to compete with the other supermarkets in North Richland Hills. Chairman Bowen asked Mr. Oujesky if he was aware the City Council would need the name of an individual for the Specific Use. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 85-107 APPROVED Mr. Schwinger made the motion to approve PZ 85-107. This motion was seconded by Ms. Flippo and the motion carried 4-0. 12. PZ 85-108 Request of Bobby W. & Jerry A. Elliott to rezone Tract 2G2, M. Lynch Survey, Abstract 953, from its present classification of R-3 (Single Family) to C-2 (Commercial). This property is located on the north side of Harmonson Road, approximately 695 feet east of Honey Lane. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Anita Snow, Residential Sales Manager for Century 21, came forward. She said this was an older community with older homes. She said there are commercial properties, a church, a trailer park close by, and a home with a life estate. Ms. Snow stated she felt no one would buy the property for residential R-3 and build 1400 square foot homes. She said North Richland Hills Furniture Company is there and another person has an office in her home. Ms. Snow stated there are several pieces of property on Harmonson Road being advertised for sale for over $2.00 a square foot. She said this 1~ acres backs up to Multi Family for townhouses. Ms. Snow stated this was located in the middle of an area being used for commercial. ~ Page 10 P & Z Minutes September 12, 1985 . Ms. Snow said she feels this is the highest and best use of this property. She said they plan to build a nice contractor's office of tilt wall construction with parking for the staff and in the future, they request to be allowed to build other contractors offices. Charles Gatlin, 413 Crosstimber Drive, Hurst, came forward. He stated he has some property in the area and he feels single family is inappropriate. He said they are deep lots with narrow fronts. Mr. Gatlin said if the area makes the transition, he would be interested in selling his property. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. . Eddie Blackman, 6604 Harmonson Road, came forward. She said they had lived there for 27 years and requests it remain single family. Ms. Blackman said it would not help to have another business in the area. Lois Robertson, 6600 Harmonson Road, came forward. She said she is a Real Estate Agent, but she does not want anything across the street to go commercial. She stated she has a larger house that 1400 feet and has lived there for two years. Ginger Williams, 6525 Harmonson Road, came forward. She said she lives west of the property in question. She said she is against this rezoning. She said she does have her house up for sale. . Paul Zoeller, 6521 Harmonson Road, came forward. He said he lived next door to the Williams and has lived here two years. Mr. Zoeller said he realizes they have the North Richland Hills Furniture store, a church, and a trailer park, but does not feel this area is unattractive. ~ Page 11 P & Z Minutes September 12, 1985 . Mr. Zoeller stated he requests it stay single family. He said they are going to build garden homes near here and Diamond Loch is only three blocks down. Mr. Zoeller said he felt commercial would not be the best use of the land. Shelby Holly, 6524 Harmonson Road, came forward. He said he felt it should be changed to something compatible such as multi-family. He said commercial would be spot zoning. Mr. Holly said he had rather keep it single family or multi family. Mr. Wood said the property behind this property is zoned for duplexes. Chairman Bowen closed the Public Hearing. . Mr. Wood stated the property is surrounded by single family, garden homes, and duplex and recommend it stay that way. Chairman Bowen stated that C-2 is a wide category. PZ 85-108 DENIED Mr. Schwinger made the motion to deny PZ 85-108. This motion was seconded by Ms. Flippo and the motion to deny carried 4-0. Ms. Snow asked if it would be enough acreage to go multi family. Mr. Wood said the Commission does not feel it should go multi family, they feel it should stay residential. Chairman Bowen said there are several residential categories. . Mr. Royston said he would be glad to work with Ms. Snow in finding a suitable zoning classification. PZ 85-109 Request of Bogies Restaurant to rezone part of Lot 1R, Block 1, Walkers Branch Addition, from its present classification of C-l (Commercial) to C-1-Specific Use-Sale of Alcoholic Beverages. This property is located at 8407 Grapevine Highway. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Harris Hughey, one of the owners, came forward. He said they plan a restaurant in Harwood Plaza and they need to sell beer to survive. He said they would sell the 60/40 ratio. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. . There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 85-109 APPROVED Ms. Flippo made the motion to approve PZ 85-109. This motion was seconded by Mr. Schwinger and the motion carried 4-0. 14. PZ 85-110 Request of Sun Development Company, Inc. to rezone part of Tract 3, NRH Industrial Park Addition, from its present classification of 1-2 (Industrial) to R-7-MF (Multi-Family). This property is located along Industrial Park Blvd., east of Rufe Snow Drive, and south of the railroad. Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Larry Ortiz, owner, came forward. He said they bought this property about 6 months ago. He said they plan to name it Grand Central Business Park. . . . ~ Page 13 p & Z Minutes September 12, 1985 Mr. Ortiz said they wish to down zone 35 acres from 1-2 to R-7-MF. He said it would serve as a buffer to the subdivision around the property. Mr. Ortiz said he had been working with the city to dedicate a street across the railroad tract through the city's property to Watauga Road. He said it would eliminate traffic to Rufe Snow. Chairman Bowen asked the proposed density. Mr. Ortiz said it would be 16 units per acre. Mr. Wood asked about the road. Mr. Royston stated it would run from the cuI de sac through the city property. He said he has sent a letter to the railroad requesting a crossing. Mr. Royston said the city feels regardless of what zoning is there, the road would be a good link. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. David Brown, 5741 Acapulco Drive, came forward. He said he is against this request. He said there is a chain link fence across the end of their street and is to be used for fire protection only. He asked if this could be changed. Mr. Brown said if these apartments go in we would have another Arlington. He said he had rather it stay commercial. Mr. Brown said apartments cause higher crime rate, drug busts, and more traffic. Jesus Bustamante, 7100 Barbados, came forward. He said apartments would cause traffic and if Acapulco is opened, it would cause more traffic. He said high school kids would be taking short cuts to the school. . . . ~ Page 14 P & Z Minutes September 12, 1985 Mr. Bustamante said apartments would cause crime to increase. He said Channel 8 had a story on Sun Development, about them letting the apartments run down. Mr. Bustamante requests denial. Joe Williams, 7101 Barbados, came forward. He said there are too many apartments in the area that are not rented. He said they make the traffic bad and the crime bad. Mr. Williams said he had lived here for 20 years and has watched apartment complexes. He said they only look good for about 2 years. He said we don't need the apartments. David Blackwell, 7105 Barbados, came forward. He said it would devalue their property. He said he did not want two story apartments looking into their back yards. Walter Alexander, 7136 Barbados, came forward. He said he agrees with what all the other neighbors said and he is opposed to multi-family. Michael Kimbro, 7109 Barbados, came forward. He said he is opposed to this request. Joel Eide, 7133 Barbados, came forward. He said his property backs up to this property and he is opposed to apartments. Gene Thomas, 5713 Acapulco Drive, came forward. He said traffic on Trinidad is bad now; what would it be if this is passed. He said living close to a railroad would be bad for children. Mr. Thomas said they may not be asking for Acapulco to be opened now, but they will. He said he is opposed to this zoning request. ~ Page 15 P & Z Minutes September 12, 1985 . Holly Johnson, 5704 Bermuda, came forward. She said there are too many apartments in the area now. She said she likes the neighborhood and wants it to stay the way it is. Ms. Johnson said Rufe Snow is already the most accident prone area in Tarrant County. Steve Vanlandingham came forward. He said it is a good neighborhood now and he is against this request. Lou Estill, 5708 Bermuda, came forward. He said there is already too much traffic and he is against this rezoning. Mark Lauritsen, 5721 Acapulco, came forward. He said he was opposed to this request because it would cause too much traffic and would lower the property value. . Jim Wagner, Acapulco, came forward. He said if these apartments go in, he would not feel safe to allow his child to play outside. He said if apartments go in, they will have no alternative but to open Acapulco. David Lee, Acapulco, came forward. He presented a petition to the Commission in opposition to this request. He said they do not want apartments. Mr. Ortiz said the information the man gave about Sun Development is incorrect. He said he is not asking for Acapulco to be opened. Mr. Ortiz said the City of North Richland Hills requires fences and also has a requirement for set backs for two story apartments. He said he did not wish to go to larger warehouses. Chairman Bowen closed the Public Hearing. . Page 16 P & Z Minutes September 12, 1985 . PZ 85-110 DENIED Mr. Schwinger made the motion to deny PZ 85-110. This motion was seconded by Ms. Flippo and the motion to deny carried 4-0. Chairman Bowen stated the next two requests would be heard together, but would be voted on individually. 15. PZ 85-112 Request of Campus Hills Joint Venture to rezone a portion of Tract 2A2, William Mann Survey, Abstract 1010, from its present classification of R-6-T (Townhouses and Garden Homes) to C-1 (Commercial). This property is located on the north side of Chapman Drive, approximately 415 feet east of Rufe Snow Drive. 16. PZ 85-113 Request of Campus Hills Joint Venture to rezone a portion of Tract 2A2, William Mann Survey, Abstract 1010, from its present classification of R-6-T (Townhouses and Garden Homes) to C-1 (Commercial). This property is located on the north side of Chapman Drive, approximately 385 feet east of Rufe Snow Drive. . Chairman Bowen opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. Taylor Gandy, 2501 Parkview Drive, Fort Worth, came forward. He said they received the present zoning in December from Agriculture to C-l Commercial. Mr. Gandy said there was a 15 foot surveying error on the east side of Rufe Snow and the city needs 15 feet for the widening of Rufe Snow so that is the reason for the request for the 30 foot strip from Chapman to the end of their property line. He said they need 400 feet for a first class retail center. . Page 17 P & Z Minutes September 12, 1985 . Mr. Gandy said the other request, they have a Mobil Service Station going in at the corner of Rufe Snow Drive and Chapman and they need more area along Chapman Road for better access. He said he requests approval of these requests. Chairman Bowen called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 85-112 APPROVED Mr. Wood made the motion to approve PZ 85-112. This motion was seconded by Mr. Schwinger and the motion carried 4-0. . PZ 85-113 APPROVED Ms. Flippo made the motion to approve PZ 85-113.
