HomeMy WebLinkAboutZBA 1985-01-22 Minutes . MINUTES OF THE SPECIAL MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, JANUARY 22, 1985 - 7:00 P. M. CALL TO ORDER The meeting was called to order by the Chairman, Jack Roseberry, at 7:00 P.M. ROLL CALL PRESENT: Chairman Members Alt. Members Jack Roseberry Billy Cypert Harold Schubert Ron Hubbard Forest Grubb Dir. Planning & Dev. P & Z Coordinator Richard Royston Wanda Calvert ABSENT: Hans Kossler Bill Fenimore APPOINTMENT OF ZBA SECRETARY Chairman Roseberry appointed Billy Cypert to serve as secretary. Mr. Cypert said he would agree to serve. . CONSIDERATION OF THE MINUTES OF DECEMBER 20, 1984 Mr. Cypert made the motion to approve the minutes as written. This motion was seconded by Mr. Schubert and the motion carried 4-0 with Mr. Grubb abstaining since he was not present at the meeting. 1. BA 84-20 Reconsideration of the request of Alexander Graham, M.D. to vary from the Zoning Ordinance #1080 on Lot 5, Block 33, Nor'East Addition, to allow a site smaller than 20,000 square feet in Local Retail zoning. This property is located at 5409 Davis Boulevard. This request was approved December 20, 1984 showing the address of 5413 Davis Boulevard, but the correct address is 5409 Davis Boulevard. . Chairman Roseberry said there were two plats on this property, one at the County showing the address as 5413 Davis and one at the city showing 5409 Davis. He said since notification had to be given to property owners within 200 feet of this property, the City Staff felt the request should be reconsidered stating the correct address. Page 2 Z B A Minutes January 22, 1985 . Chairman Roseberry said since he handled the sale of this property to Dr. Graham, he would excuse himself and turn the Chair over to Mr. Cypert. Acting Chairman Cypert opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Acting Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. Acting Chairman Cypert asked Mrs. Calvert if there had been any correspondence. . Mrs. Calvert stated there had been none. BA 84-20 APPROVED Mr. Grubb made the motion to approve BA 84-20 as amended. This motion was seconded by Mr. Schubert and the motion carried 4-0. Chairman Roseberry returned to the Chair. Mr. Hubbard asked to be excused since he was ill. He left at 7:07 P.M. 2. BA 85-1 Request of Blue Fountain Pools to vary from the Zoning Ordinance #1080 on Lot 2, Block 2, Parkridge Estates, to allow pool to be within one foot of the utility easement instead of the required 5 fool setback. This property is located at 6628 Quail Ridge Drive. . Jason Steenburgh with Blue Fountain Pools came forward. He said he has the owner of the home, Donald Duncan, with him. Page 3 Z B A Minutes January 22, 1985 · Chairman Roseberry asked if construction had already started on the pool. Mr. Steenburgh said they had not started construction. He said on their plot plan they showed the easement and showed 6 feet from the property line. Mr. Steenburgh said they do not know why the city requires an additional 5 feet. Mrs. Calvert stated it was to allow for large machinery to get in there to work. Mr. Grubb said there could be damage to the pool if they had to work there. · Donald Duncan came forward. He said he had not thought about that. He said the builder said they would have room for a pool when he bought the house. Mr. Schubert asked if the pool could be re-designed. Mr. Duncan said they only have 25 feet. he said the pool can only be 10 feet wide. Mr. Steenburgh stated the lot which joins this one also has a 5 foot easement so they would have 10 feet to work in and would not need any more. He said this easement is for an underground TESCO line. Mr. Royston asked if TESCO had signed it off. Mr. Steenburgh said yes TESCO had already approved their plans. He said if the TESCO line was overhead they would have to be 18 feet from it, but for underground, one can build right up to the easement. · Chairman Roseberry asked how large their house was. Page 4 Z B A Minutes January 22, 1985 · Mr. Duncan said 2,500 square feet. He said the house is too large for the lot. Mr. Steenburgh said the National Building Code will let you build a gunite pool within 4 feet of the property line. Mr. Schubert asked if they plan to have a walkway around the pool. Mr. Duncan said they plan to have one next to the house and garage. Mr. Grubb asked how close it was to the garage. Mr. Steenburgh said the pool is 4 feet from the garage. Chairman Roseberry asked if a pool is considered a structure. · Mr. Royston stated it was. Mr. Steenburgh said if the back property has an easement, they would have 10 feet and that would be all the they would need for large equipment. He said all other cities only require the 5 foot easement. Mr. Duncan said the only alternative would to make the pool only 9 feet wide and it would not be worth it. Chairman Roseberry opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. · There being no one wishing to speak, the Chairman closed the Public Hearing. . . . Page 5 Z B A Minutes January 22, 1985 Mr. Schubert asked if there had been any correspondence received. Mrs. Calvert said there had been none. Chairman Roseberry said he has problems with the additional 5 foot requirement, but that is the ordinance. He asked Mr. Royston what Hurst required. Mr. Royston said Hurst did make some revisions which allowed the deck to protrude, but Hurst's requirement is 6 feet. BA 85-1 APPROVED Mr. Grubb made the motion to approve BA 85-1. This motion was seconded by Mr. Cypert and the motion carried 4-0. ADJOURNMENT The meeting ned at 7:30 P. M.
