MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
MAY 16, 1985 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Jack Roseberry, at 7:00 P.M.

CONSIDERATION OF THE MINUTES
OF JANUARY 22, 1985
Mr. Cypert made the motion to approve
the minutes as written. This motion
was seconded by Mr. Schubert and the
motion carried 4-0 with Mr. Kossler
abstaining since he was not present at
the meeting.

NEW BUSINESS

BA 85-2
Request of Joe B. Ballew to vary from
the Zoning Ordinance #1080 on Lot 20,
Block 13, Holiday North Addition, to
allow house to be built beyond the
side building line. This property is
located at 7553 David Drive.
Mr. Ballew came forward. He said his
house is 12 years old and is built 8~
feet over the building line on the
Susan Lee Lane side. Mr. Ballew said
they discovered it when there was a
survey made to sell the property.
Mr. Schubert asked if he was the
original owner.
Mr. Ballew stated he was.

Chairman Roseberry said there were two
subdivisions there which joined but
had different set-backs.

Mr. Ballew said that was correct. He
said up to David Drive on Susan Lee,
it is a 15 foot set-back, then at
Susan Lee and David Drive, it is 25
feet.
Mr. Schubert asked if the property
line had been changed.
Mr. Ballew said it had not. He said
the mortgage company could hardly
believe they loaned money on the house
without making a survey.
Chairman Roseberry asked Mrs. Calvert
if there had been any correspondence.
Mrs. Calvert stated there had been
none.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
There being no one wishing to speak in
favor of this request, the Chairman
called for those wishing to speak in
opposition to this request to please
come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Chairman Roseberry asked Mr. Royston
if he saw any problems with this
request.
Mr. Royston stated that it does not
present a problem because the other
houses have a 15 foot set-back.
Chairman Roseberry stated the
inspection department requires a
stake-out inspection where they pull a
string to make sure this does not
happen, now.

Mr. Royston said their neighbor on the
other side of the street has the same
problem which needs correcting, also.
Mr. Cypert made the motion to approve
BA 85-2 as requested. This motion was
seconded by Mr. Kossler and the motion
carried 5-0 with the following vote
recorded: Cypert, yea, Kossler, yea,
Schubert, yea, Hubbard, yea, and
Roseberry, yea.

The meeting adjourned at 7:10 P. M.
