CALL TO ORDER The meeting was called to order by the Bill Fenimore, Acting Chairman, at 7:05 P. M. ROLL CALL PRESENT: Secretary Members Billy Cypert Bill Fenimore Harold Schubert Ron Hubbard Forrest Grubb Richard Royston Wanda Calvert Alt. Members Dir. Planning & Dev. P & Z Coordinator ABSENT: Jack Roseberry Hans Kossler CONSIDERATION OF THE MINUTES OF MAY 16, 1985 Mr. Cypert made the motion to approve the minutes as written. This motion was seconded by Mr. Hubbard and the motion carried 3-0 with Mr. Fenimore and Mr. Grubb abstaining since they were not present at the meeting. . 1. BA 85-3 Request of Sabine Valley Ind. to vary from the Zoning Ordinance #1080 on Lot 17, Block 2, Richfield Addition, to allow house to be built over the side building line. This property is located at 6853 Richfield Drive. Acting Chairman Fenimore opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Ron Strebeck came forward to represent Sabine Valley Ind. He stated the plat show a 25 foot building line on either side of the lot. He said his designer called the city to see if it could have a 15 foot side yard and was told he could. Mr. Strebeck stated the house was built, inspected and passed, but when he came down to sell the property, they found the error. Page 2 Z B A Minutes July 18, 1985 . . BA 85-3 APPROVED 2. BA 85-4 . ~ Mr. Grubb asked when the architect asked about the 15 foot building line. Mr. Strebeck said it was some time around the first of the year. He said the zoning ordinance states they would have a 15 foot side building line. He stated they had trouble fitting the house on the lot and thought the 25 foot side building line was in error and that is why he called the city. Mr. Grubb asked Mr. Royston about this. Mr. Royston stated R-3 zoning allows 15 foot side building lines, but this is 20 feet. He said it was platted for a 25 foot building line to match the other building lines. Acting Chairman Fenimore called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. Mr. Grubb made the motion to approve BA 85-4. This motion was seconded by Mr. Schubert and the motion carried 5-0 with the following vote recorded: Grubb, yea, Schubert, yea, Fenimore, yea, Cypert, yea, and Hubbard, yea. Hans Kossler came in at 7:10 P. M. Request of St. John the Apostle Day School to vary from the Zoning Ordinance #1080 on Tract 9H, W. W. Wallace Survey, Abstract 1606, to allow them to continue using two mobile home buildings for class rooms. This property is located at 7421 Glenview Drive. Acting Chairman Fenimore opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. ~ Page 3 Z B A Minutes July 18, 1985 . Jack Nabors, Chairman of the School Board, came forward. He stated they had planned to build an all purpose building, but it has been delayed and time has slipped by. Mr. Nabors stated they need the space bad and the buildings are in good condition. Mr. Grubb asked how many years are they asking for. Mr. Nabors said they need it for at least two years. Mr. Grubb asked if these buildings had been approved by the fire department. Mr. Nabors stated the buildings were approved. . Acting Chairman Fenimore said he felt a limitation should be put on it again. He asked Mr. Nabors if they still plan to build a building. Mr. Nabors stated they still plan to build an all purpose building. Mr. Kossler asked what the holdup was. Mr. Nabors said funds and other things. He said they had discussed buying another church, but decided against it. Mr. Kossler said the buildings look permanent to him. He said he did not feel if given two years that they be allowed to come back for another extension. Allen Loving came forward. He said he would appreciate if if the Board would give the extension. He said the trailers are very sturdy and a lot of work has been put in them. . Acting Chairman Fenimore called for those wishing to speak in opposition to this request to please come forward. ~ Page 4 Z B A Minutes July 18, 1985 . There being no one wishing to speak, the Acting Chairman closed the Public Hearing. Acting Chairman Fenimore asked if there had been any correspondence. Mrs. Calvert said there was a letter from Dr. Hahn who was in favor of the request. Mr. Grubb stated he felt they should go ahead and grant this for three years because they would need that much time for the architect and the building of the building. Mr. Royston said the present buildings meet all the requirements except the outside. . BA 85-4 APPROVED Mr. Grubb made the motion to approve BA 85-4 with the stipulation that the extension be granted for three additional years and no further extension be granted. This motion was seconded by Mr. Schubert and the motion carried 5-0 with the following vote recorded: Grubb, yea, Schubert, yea, Cypert, yea, Fenimore, yea, and Hubbard, yea. 3. BA 85-5 Request of Michael W. Spinks to vary from the Zoning Ordinance #1080 on Lot 3, Block 2, Smithfield Acres Addition, to allow him to enclose his garage and widen the driveway to provide uncovered parking for two cars. This property is located at 7120 Smithfield Road. Acting Chairman Fenimore opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Mr. Spinks came forward. He said he wishes to enclose his garage and make a den and make uncovered parking for two cars. Pàge 5 Z B A Minutes July 18, 1985 . . BA 85-5 APPROVED ADJOURNMENT /// . ~ Mr. Schubert asked if the house was two bedrooms or three. Mr. Spinks said it was three bedrooms. Mr. Grubb asked how many cars he had. Mr. Spinks said he only has one and it is a van which does not fit in the garage. Acting Chairman Fenimore called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. Mr. Schubert asked about the 6 foot side yard requirement. Mr. Royston stated you can pave your yard all the way to the property line if you wish to. Mr. Cypert made the motion to approve BA 85-5. This motion was seconded by Mr. Schubert and the motion carried 5-0 with the following vote recorded: Cypert, yea, Schubert, yea, Fenimore, yea, Hubbard, yea, and Grubb, yea.
