CALL TO ORDER The meeting was called to order by the Chairman, George Tucker, at 7:40 P. M. ROLL CALL PRESENT: Chairman Secretary Members P & Z Coordinator George Tucker Marjorie Nash Don Bowen Mark Hannon Mark Wood Wanda Calvert Honorable Mayor Dan Echols ABSENT: Alt. Member John Schwinger . Chairman Tucker said he would like to invite all citizens to attend workshops every Tuesday beginning April 24th and running 4 to 6 weeks. He said these workshops will be to complete the Comprehensive Master Plan for the City of North Richland Hills. Chairman Tucker asked that any citizen who wishes to serve on a Citizen's Committee to assist the Commission to please contact Ms. Calvert. He stated they would like to have a representative from each section of the city. 1. PS 84-31 DENIED 3/22/84 Request of Emory Bellard for reconsideration of final plat of Glenview Park Addition. This case was withdrawn prior to the meeting at the applicant's request and asked to have it heard on April 26th. 2. PS 84-33 Request of Gene Welborn for preliminary plat of Lot 3, Block 4, Hewitt Estates. . PS 84-33 APPROVED Ms. Nash made the motion to approve PS 84-33. This motion was seconded by Mr. Hannon and the motion carried 5-0. ~ Page 2 P & Z Minutes April 12, 1984 . 2. PS 84-34 Request of Gene Welborn for final plat of Lot 3, Block 4, Hewitt Estates. Delbert Stembridge, Consulting Engineer, came forward to represent Mr. Welborn. He stated they object to giving TESCO another easement. Mr. Stembridge said if they felt there was a need for it, they would grant it, but the service is already there. The Commission agreed. PS 84-34 APPROVED Mr. Hannon made the motion to approve PS 84-34. This motion was seconded by Mr. Bowen and the motion carried 5-0. Chairman Tucker asked that items 16 & 17 be acted on next so they could get all the platting taken care of before the zoning cases. . Ms. Nash made the motion to move items 16 & 17 to be next on the agenda. This motion was seconded by Mr. Wood and the motion carried 5-0. 16. PS 84-35 Request of Gene Welborn for preliminary plat of Lot 5, Block 1, North Edgley Addition. Mr. Hannon asked if they agreed to granting the easement requested by TESCO on this plat. Delbert Stembridge came forward to represent Mr. Welborn. He stated they would grant the easement. PS 84-35 APPROVED Mr. Hannon made the motion to approve PS 84-35. This motion was seconded by Ms. Nash and the motion carried 5-0. 17. PS 84-36 Request of Gene Welborn for final plat of Lot 5, Block 1, North Edgley Addition. PS 84-36 APPROVED Mr. Hannon made the motion to approve PS 84-36. This motion was seconded by Mr. Bowen and the motion carried 5-0. . ~ Page 3 P & Z Minutes April 12, 1984 . 4. PZ 84-24 Request of Herman J. Smith to rezone Lots 3 & 13, Block A, Richland Oaks Addition, from their present classification of R-1 (Single Family) to a proposed classification of C-1 (Commercial). This property is located on the north side of Airport Freeway between Oakridge Terrace and Mesa Verda. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Herman Smith came forward. He stated this request is for Lot 3, Block A, and a portion of Lot 13, Block A, part of which was taken for the freeway. Mr. Smith stated that Mesa Verda has been improved in conjunction with the building of the Texian Inn to make better ingress-egress. . Mr. Smith said they own the lot across the street from this property, 4801 Oakridge, but it has some deed restrictions and litigation before they can ask for a zoning change on it. He said the homeowners in the area have signed the necessary papers. Mr. Smith said the triangular property, Lots 6A & 7A, which was not taken in by the freeway, is partially owned by them, and they are clearing the title. He said they signed off the protective covenants several months ago. Mr. Smith stated they own approximately 75% of the area around this property. He showed the Commission an aerial view of the area. Mr. Hannon asked how they plan ingress to the property. . Mr. Smith said it would be from Mesa Verde. ~ ~ Page 4 P & Z Minutes April 12, 1984 . Mr. Hannon asked how many acres they had under contract. Mr. Smith said "16". He said the house on Lot 3 would be remodeled for an office building. Mr. Hannon asked if they had plans to open Oakridge Terrace to the north. Mr. Smith said if they did, they would have to go through the apartments. Mr. Smith said they plan to remodel the house in 1985 for office space and have a circular drive way. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. . There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 84-24 APPROVED Mr. Wood made the motion to approve PZ 84-24. This motion was seconded by Ms. Nash, and the motion carried 5-0. 5. PZ 84-25 Request of Nassar Shafipour to rezone a portion of Lot 1, Block 4, Red Gate Addition, from its present classification of C-1 (Commercial) to a proposed classification of PD (Planned Development). This property is located east of Davis Boulevard, west of Irish Drive, bounded on the north by the TESCO easement and is approximately 600 feet north of Emerald Hills Way. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Victor Garcia, Architect for the project, came forward. He said this zoning request is for the second phase on this property. ~ ~ Page 5 P & Z Minutes April 12, 1984 . Mr. Garcia stated there is only one access to this property which is through the first phase. He said they want to change from quads to townhouses, but would have the same density, the same amount of units. Chairman Tucker stated he did not submit all the requirements, he did not show he meets the brick ordinance. Mr. Garcia stated he would make the corrections. Mr. Hannon said he was concerned about the 20 foot drive with a 6 foot turn a round. He said our requirements are for a 50 foot drive with an 80 foot turn a round. Mr. Hannon said he should discuss this with the city's fire department. . Mr. Garcia said he felt they would have no problem because they can use the TESCO right of way. Mr. Hannon said if the Commission approved these plans, they might not be able to obtain a building permit. He said he felt they would have to change their plans. Mr. Garcia said they can use the TESCO easement for emergency exit. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Hannon stated he had no problem with the request; he felt the property could not be used for commercial, but they need to have another access. . ~ ~ Page 6 P & Z Minutes April 12, 1984 . PZ 84-25 APPROVED Mr. Hannon made the motion to approve PZ 84-25 with the stipulation that prior to the request going to the City Council, the developer attach an emergency easement through the TESCO right of way as an all weather road access, and further, subject to modifying the plan to show brick construction. This motion was seconded by Mr. Wood and the motion carried 5-0. 6. PZ 84-26 Request of First Trends, Inc. to rezone Lot 3, Kip's Big Boy Addition, from its present classification of C-1 (Commercial) to a proposed classification of C-1-Specific Use- Sale of Alcoholic Beverages. This property is located at 7762 Bedford Euless Road. . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Joseph E. Nowlin came forward to represent First Trends. He stated this will be a new concept for their parent company, Trail Dust Steak House~ and they want to start in North Richland Hills. Mr. Nowlin said it would be a family, sit-down, fast food, and it would serve a Mexican type marinated chicken which had been very successful in Mexico and California. Mr. Nowlin stated the renovation of the 2,500 square foot building would cost approximately $200,000.00. He said they plan to have a compromise between fast food restaurants and sit-down restaurants. Chairman Tucker stated the Specific Use would have to be put in an individual's name. . Mr. Nowlin stated it would need to be put in the same name as the permit holder. ~ Page 7 P & Z Minutes April 12, 1984 . Chairman Tucker stated it could not be put in the corporation's name. Mr. Nowlin said they would probably want it in the name of Douglas Parker, but he would find out for sure prior to going to council. Ms. Nash stated that if Mr. Parker leaves the corporation, they would have to apply for another Specific Use permit. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 84-26 APPROVED Ms. Nash made the motion to approve PZ 84-26. This motion was seconded by Mr. Bowen and the motion carried 5-0. . 7. PZ 84-27 Request of J. C. Gideon to rezone Tract 2A, J.C. Bradford Survey, Abstract 139, from its present classification of Agriculture to a proposed classification of R-2 (Single Family). This property is located on the east side of Keller-Smithfield Road and is approximately 425 feet south of Shady Grove Road. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Delbert Stembridge, Consulting Engineer, came forward to represent Mr. Gideon. He said Mr. Gideon wants to build a single family residence. . Mr. Bowen asked what size house he plans to build. He said this is a one acre lot and he would like to have R-1 zoning to set the trend in this undeveloped area. ~ Page 8 P & Z Minutes April 12, 1984 . Mr. Stembridge stated R-2 zoning is what they need for the size house he plans to build. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 84-27 APPROVED Mr. Wood made the motion to approve PZ 84-27. This motion was seconded by Ms. Nash and the motion carried 4-1 with Mr. Bowen voting against. 8. PZ 84-28 Request of Monty Anderson to rezone Lot 3, Block 10, Richland Heights Addition, from its present classification of C-1 (Commercial) to a proposed classification of R-2 (Single Family). This property is located at 4416 Lynn Terrace. . PZ 84-28 WITHDRAWN This zoning request was withdrawn at the request of the subject prior to this meeting. 9. PZ 84-29 Request of Jeff Marsh to rezone Tract 4B, W.D. Bares Survey, Abstract 146, from its present classification of Agriculture to a proposed classification of R-2 (Single Family). This property is located on the north side of Starnes Road and approximately 500 feet west of Red Oak Street. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Delbert Stembridge, Consulting Engineer, came forward to represent Mr. Marsh. He stated Mr. Marsh wishes to develop this into single family lots and is requesting R-2 zoning. . Chairman Tucker asked how many acres are in this tract. Page 9 P & Z Minutes April 12, 1984 . Mr. Stembridge stated there are 3.2 acres. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 84-29 APPROVED Mr. Bowen said although he was in opposition to the previous request, he felt this one is appropriate because it is in an area where R-2 is already there. Mr. Bowen made the motion to approve PZ 84-29 as requested. This motion was seconded by Ms. Nash and the motion carried 5-0. 10. PZ 84-30 Request of Eddie Cook & Blake Cook to rezone Tract 3A, William Cox Survey, Abstract 321, from its present classification of Agriculture to a proposed classification of R-2 (Single Family). This property is located on the north side of Turner Drive and Approximately 200 feet west of Davis Boulevard. . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Eddie Cook came forward. He said, in the past, requests for Multi-Family and Duplex zoning have been denied for this property. Mr. Cook said he felt if they had R-1, the area would look over built so they are requesting R-2 which would be in common with the area. Mr. Cook stated they request the Commission approve R-2 zoning for this tract. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. . ~ Page 10 P & Z Minutes April 12, 1984 . John Larriviere, 6971 Cox Lane, came forward. He stated they have a drainage problem in this area and he would like to see something done before development of this property. Mr. Larriviere said Cox Lane cannot take the water now; in a 15 to 20 minute rain, the water gets up to his door step. He asked where the water would go; will it go to Davis Boulevard. Mr. Larriviere stated they also have traffic problems; the narrow street is only approximately 18 feet wide now. He stated this development would also cause more traffic of Davis Boulevard. Mr. Larriviere stated he would not oppose the R-2 zoning, but would like to know something about the development such as how many lots they plan. . Mr. Hannon stated there would be about 40 lots. Chairman Tucker closed the Public Hearing. Chairman Tucker explained that this was a zoning request in which the Commission has to decide which is the highest and best use of this land. He said what is around the property is taken into consideration. Chairman Tucker stated the problem of drainage and utilities will be addressed during the platting process, and if they cannot be solved, then the plat will not be approved. He said at the last City Council meeting, a plat was denied because of drainage. Chairman Tucker said they take into consideration the engineering of the property. . PZ 84-30 APPROVED Mr. Bowen made the motion to approve PZ 84-30 as requested. This motion was seconded by Mr. Hannon and the motion carried 5-0. ~ Page 11 P & Z Minutes April 12, 1984 . RECESS Chairman Tucker called a recess at 8:30 P. M. BACK TO ORDER Chairman Tucker called the meeting back to order at 8:35 P. M. with the same members present. 11. PZ 84-31 Request of Robert Hawkins to rezone Tracts 3C2A & 4A, William Mann Survey, Abstract 1010, from their present classification of Agriculture to a proposed classification of R-2 (Single Family). This property is located on the south side of Hightower Drive and approximately 400 feet west of Little Ranch Road. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Mr. Hawkins came forward. He stated he bought two acres and is requesting R-2 zoning. Mr. Hannon asked if he plans to build on both lots. Mr. Hawkins said he plans to build a home on one lot and may someday either sell the other one or build on it. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 84-31 APPROVED Mr. Hannon made the motion to approve PZ 84-31 as requested. This motion was seconded by Ms. Nash and the motion carried 5-0. . ~ Page 12 P & Z Minutes April 12, 1984 . 12. PZ 84-32 Request of James L. Buchanan to rezone Lot 1, Block 1, Lightfoot Addition, from its present classification of C-l (Commercial) to a proposed classification of C-I-Specific Use- Sale of Beer for off-premise consumption. This property is located at 7716 Davis Boulevard. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mr. Buchanan came forward. He said he was requesting approval of a specific use permit to sell beer. Chairman Tucker asked if the previous owner sold beer. . Mr. Buchanan said they had sold beer there for 8 or 9 years. He said it was Valley View Grocery. Chairman Tucker asked Mr. Buchanan if the permit would be in his name. Mr. Buchanan said it would be. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 84-32 APPROVED Mr. Bowen made the motion to approve PZ 84-32 as requested. This motion was seconded by Ms. Nash and the motion carried 5-0. 13. PZ 84-33 Request of Clarence Kidd to rezone Lots 26 & 27, Block 1, Thompson Park Estates, from their present classification of R-1 (Single Family) to a proposed classification of C-l (Commercial). This property is located on the west side of Precinct Line Road approximately 1,400 feet south of Martin Drive. . ~ Page 13 P & Z Minutes April 12, 1984 . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Tom Williams, 1500 Inter First Bank Building, Fort Worth, Texas, came forward to represent Mr. Kidd. He said Mr. Kidd owns Kidd Plumbing located at 7651 Northeast Loop 820. Mr. Williams said they wish to build a similar type building and move their office there because the building they occupy now is not large enough. Mr. Williams stated the subject tract is presently zoned R-1. He said there is agricultural zoning to the south of this property all the way to Grapevine Highway. Mr. Williams stated they feel the property along Precinct Line Road will all become commercial someday. . Mr. Williams stated that across the street is in Hurst City limits and they do have residences with some commercial and at the northeast corner of Precinct Line Road and Martin Drive is already developed commercial. He said the southeast corner is vacant, but is commercially zoned. Mr. Williams stated they do not feel this would adversely affect the City of Hurst and feel this is a reasonable zoning request. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Wood read a letter received from the City of Hurst which stated they were in opposition to this request. . ~ Page 14 P & Z Minutes April 12, 1984 . Mr. Hannon said he would like to point out that the development at Precinct Line and Martin Drive is very light commercial. Chairman Tucker said the property along Precinct Line Road might go commercial someday, but he felt it was not ready for commercial. PZ 84-33 DENIED Mr. Bowen made the motion to deny PZ 84-33. This motion was seconded by Mr. Wood and the motion to deny carried 5-0. 14. PZ 84-34 Request of Quadrangle Development Company to rezone a portion of Coventry Place Estates from its present classification of PD (Planned Development) to a proposed classification of R-2 (Single Family). This property is located at the southeast corner of Smithfield Road and Starnes Road. . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Walter Elliott, Civil Engineer, 1004 w. Euless Blvd., Euless, TX, came forward to represent Quadrangle Development. He stated the president of this company, William E. Pastuer, is in the audience if there are any questions. . Mr. Elliott stated this was an old subdivision, platted in 1974, owned by Bob Legge'. He stated it was previously zoned IF-9 for single family homes; the property to the east had not been developed. Mr. Elliott stated they tried to get the sanitary sewer up there, but it was some distance away. Then they started having economic problems and the building business took a nose dive. In 1977, a group came back in and was granted a Planned Development zoning on this property for a retirement center. ~ Page 15 p & Z Minutes April 12, 1984 . Mr. Elliott said Herman Smith and John Barfield had built nice homes in this area and they now wish to continue the building on this piece of property. He said they are asking for 9,000 square foot lots and 1,600 square foot homes, but this would just be a minimum because he felt sure most would be larger than 1,600 square feet. Mr. Elliott stated he had prepared a map of the area with the existing zoning: north and east, Crestwood Estates, is R-2 with 1,500 square foot homes and larger; north is C-1 & C-2 (Commercial) and I-2 (Industrial); west is C-l and a strip of Agriculture, which they will possibly come for a zoning change soon; then there is Multi-Family and R-2 which was approved last year and will be developed soon; to the south is R-3. . Mr. Elliott stated they will continue with the plat, but will submit new engineering. Mr. Elliott stated they feel this is the highest and best use of this property. Mr. Hannon asked if his client owns the C-l tract which joins this property. Mr. Elliott stated he did. Mr. Hannon asked if they plan to extend Starnes Road. Mr. Elliott stated they will if they can get some help with the adjoining property owners and the city. He said he felt this would be an asset to both the citizens and the city. PZ 84-34 APPROVED Mr. Hannon made the motion to approve PZ 84-34 as requested. This motion was seconded by Ms. Nash and the motion carried 5-0. 15. PZ 84-35 Request of Harwood Hills Partnership to rezone the south portion of Block 4, Northridge Addition, from its present classification of R-7-MF (Multi-Family) to a proposed classification of R-6-T (Townhomes). This property is located at the northeast corner of Harwood Road and Bob Drive. . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Ken Groves, Architect and Engineer, 2205 W. Division, Arlington, Texas, came forward. He stated he represents Harwood Hills Partnership and Archie Brown who wishes to build on this land. Mr. Groves said they are requesting a change from apartment zoning to townhome-garden type homes. He read from the Zoning Ordinance #1080 regarding this zoning classification. Mr. Groves showed a site plan with 60 units. He said there would be apartments on the west, but single family on the east and they felt this would be a good transition from apartments to single family. Ms. Nash said she would be in favor of the lower density. . ~ Page 17 P & Z Minutes April 12, 1984 . Chairman Tucker stated this zoning classification allows 10.4 units per acre and under the apartment zoning, under the grandfather clause, it allows 19.8 and the new zoning allows 16 units per acre. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. . Robert Barbour, 5344 Bob Drive, came forward. He said he was not totally opposed to townhouses, but they have a terrible problem with parking on the street on both sides of Bob Drive from Harwood Road north. Mr. Barbour stated he has been employed as a fireman for 30 years and you cannot get a fire truck down that street. He said he lives the fifth house down on Bob Drive and he has to go around to get to his house. Mr. Barbour said he requests they fix it where they cannot park on Bob Drive. Mr. Hannon stated the city has a city ordinance against this and Mr. Barbour should give his complaint to the Public Work's department or the Police department. Mr. Bowen said the difference in this zoning is they could sell them instead of renting and it would also reduce the density. He said they have an excellent submittal with covered parking in the rear. Mr. Hannon showed Mr. Barbour the layout. Chairman Tucker closed the Public Hearing.
