CALL TO ORDER The meeting was called to order by the Chairman, George Tucker, at 7:35 P. M. ROLL CALL PRESENT: Chairman Secretary Members George Tucker Marjorie Nash Mark Wood John Schwinger Carroll Brents Alt. Member Councilwoman P & Z Coordinator Virginia Moody Wanda Calvert ABSENT: Don Bowen CONSIDERATION OF THE MINUTES OF AUGUST 23, 1984 Ms. Nash made the motion to approve the minutes as written. This motion was seconded by Mr. Schwinger and the motion carried 4-0 with Mr. Wood abstaining since he was not present at the meeting. . 1. PS 84-66 Denied 8/23/84 Request of Wayne Wall Builders for reconsideration of the preliminary plat of Blocks 13 thru 16, Briarwood Estates, 5th Filing (previously submitted as Willow Park Addition). ¡... Chairman Tucker stated they have complied with all the Engineer's comments and letters. PS 84-66 APPROVED Mr. Wood made the motion to approve PS 84-66. This motion was seconded by Ms. Nash and the motion carried 5-0. 2. PS 84-74 Request of Ruth Hodges Blessing for Short Form Plat of Lot 1, Block 1, W. A. Blessing Addition. . Chairman Tucker stated they have answers to the Engineer's comments and they request the name of the Subdivision be allowed to remain for personal reasons. PS 84-74 APPROVED Ms Nash made the motion to approve PS 84-74 subject to the Engineer's comments with the exception of item #1. This motion was seconded by Mr. Schwinger and the motion carried 5-0. 3. PS 84-80 Request of Kingswood Estates Venture, Inc. for preliminary plat of Fair Oaks Addition. Charles Evans, Attorney, came forward to represent the owners. He said the Engineer, Mr. Long, has responded to all the comments with exception to the name change. Mr. Evans stated they do not wish to change the name of this subdivision. He said they are east of an area called Green Valley Country Estates which is not a recorded plat so they do not feel they should have to change the name of their subdivision. . Chairman Tucker said he agreed there is no reason to change it to Green Valley. PS 84-80 APPROVED Mr. Wood made the motion to approve PS 84-80 subject to the Engineer's comments with the exception of item #1. This motion was seconded by Ms. Nash and the motion carried 5-0. Chairman Tucker stated they would hear the next two cases together. 4. PS 84-101 Request of F. Wayne Martin for preliminary plat of Lots 1 & 2, Block 4, Londonderry Addition (previously submitted as Lots 1 & 2, Block 1, Martin-Withers Addition). 5. PS 84-102 Request of F. Wayne Martin for final plat of Lots 1 & 2, Block 4, Londonderry Addition (previously submitted as Lots 1 & 2, Block 1, Martin-Withers Addition). . ~ Page 3 P & Z Minutes September 13, 1984 . Jackie Fluitt with Stembridge & Associates came forward to represent Mr. Martin. Mr. Wood asked about item #8 regarding signing a covenant for street pro rata. Chairman Tucker asked Mrs. Calvert if she had Staff recommendation regarding this. Mrs. Calvert said she did not, but that since that was only two lots, they might allow them to sign a covenant, she was not sure. Mr. Wood asked about fire coverage. . Mr. Fluitt said Mr. Riddle had suggested they put a building line on the back so no structure could be built in the area not covered. Chairman Tucker said that would be sufficient. PS 84-101 APPROVED Mr. Wood made the motion to approve PS 84-101 subject to the Engineer's comments. This motion was seconded by Mr. Schwinger and the motion carried 5-0. PS 84-102 APPROVED Mr. Wood made the motion to approve PS 84-102 subject to the Engineer's comments. This motion was seconded by Ms. Nash and the motion carried 5-0. 6. PZ 84-60 Request of J. D. Scott with Scott and Burton to rezone Lot 2, Block M, Smithfield Addition, from its present classification of AG (Agriculture) to C-2 (Commercial). This property is located on the north side of Main Street and bounded on the north by Amundson Drive (8209 Main Street). . ~ Page 4 p & Z Minutes September 13, 1984 . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Bill Warren, Attorney, came forward to represent Scott and Burton. He said they were automotive air condition specialists having a total of 40 to 50 years experience. Mr. Warren said they do business allover the Metroplex and out of state. . Mr. Warren said he usually starts by telling the history of the property, but this property has no history; it has always been pasture land. He showed pictures of the area. Mr. Warren stated the property is by the railroad and north of the railroad is high Industrial zoning with a cabinet shop, welding shop, and the storage of some old tanks. He said Bates Container on Davis Boulevard is not far from this property. Mr. Warren said they feel it is totally unsuited for residential; they would not be able to get financing close to the railroad. Mr. Warren said the place is an eye sore now with an old house on the property and another one to the west. Mr. Brents asked why there were no pictures made of the area south of this property. Mr. Warren said there were no homes there. He said there was one southeast of the property on the south side of Main Street. Mr. Brents said he knew there were about four nice homes there on the south side of Main Street. . . . . ~ Page 5 p & Z Minutes September 13, 1984 Mr. Warren said his client plans to build an automotive air conditioning shop there with six bays and an office. He said they would repair auto air conditioners within the shop. Mr. Warren said they have equipment which makes no noise, no smoke or fumes. He said their hours would be 7:30 to 5:30 Monday thru Friday and 7:30 to 1:00 on Saturday. Mr. Warren said it would not be an eyesore. He said the area should be industrial, but they feel the best use for the property is for commercial. Mr. Wood asked if Mr. Warren thought it would be good for duplexes. Mr. Warren said he did not feel it would be good for duplexes. Mr. Warren requested rebuttal time. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. Gerald Stewart, 8840 Main Street, came forward. He said they know this property is an eyesore to the neighborhood, but this is not the ideal use for this property. Mr. Stewart said this is a "y" shaped piece of property with a street on both sides and a school right down the street. He said the Glenann Addition has lived with the airport for many years and feel this area should be single family. He said he requests they consider this very carefully. Councilwoman Virginia Moody came forward. She said her son goes to Smithfield Junior High and has to go by this property twice each day. Ms. Moody said she felt there should be a better location for these people to have their business which would not be in a residential area. ~ Page 6 P & Z Minutes September 13, 1984 . Tony Skur, 6536 Sherri Lane, came forward. He said he was against this zoning request. He said it would be a drastic change in zoning which would change the area forever. Mr. Skur said it would bring in more traffic. He said there are lots of little people who walk to school in this area. He said also there are 18 wheeler trucks that park across the street from this area, sometimes as many as 27. Mr. Skur said he felt this was spot zoning and would be taking the residential atmosphere away for commercial. . Mr. Skur said he is not in favor of duplexes either. He said the property to the east is duplex and duplex zoning would make it more congested. Mr. Skur said he felt the property would be good for single family. He said it is an eyesore now and they need to clean up the property, but they do not need commercial. Mr. Skur said they have about 250 people in Glenann and they are opposed to this zoning. Glenn Walker, 8400 Glenann, came forward. He said he moved away from the hustle and bustle to the peace and quiet of this area, but it looks like it is following him. Mr. Walker said they do not want antifreeze running down the street into their yards, killing their grass. Chairman Tucker asked for a show of hands of the people who were in opposition to this request. There were several present. Chairman Tucker called for anyone else wishing to speak, to please come forward. . . . . ~ Page 7 P & Z Minutes September 13, 1984 Mr. Warren returned for this rebuttal. He said he understood the people's general concern, but requested they look at his pictures. He said it would be a very attractive shop with no waste. Mr. Warren said they would clean up each evening. He said this land would not stay agriculture forever; it will probably be industrial. Rene' Hawkins, 8417 Donna, came forward. She asked if the city could obtain this land for a City Park since they do not have one near them. Chairman Tucker said it takes money to do that, but they could ask the City Council. Mr. Wood said he felt it was too small for a City Park. He said it could never go industrial because under the new ordinance, you have to have at least two acres to request a zoning change to Industrial. Chairman Tucker closed the Public Hearing. Mr. Wood said this piece of land is within 200 feet of R-2 zoning, AG is across the street with residential homes on it and he feels it could be used for duplexes. Chairman Tucker said this is a residential area and this zoning would cause an infringment of commercial into residential. He said this Commission wrote the Zoning Ordinance to keep and protect our older areas. PZ 84-60 DENIED Mr. Schwinger made the motion to deny PZ 84-60. This motion was seconded by Mr. Brents and the motion to deny carried 5-0. ~ Page 8 P & Z Minutes September 13, 1984 . 7. PZ 84-61 Request of Charles Owen Company to rezone Tract 10D, J. H. Barlough Survey, from its present classification of R-2 (Single Family) to C-2 (Commercial). This property is located on the west side of Davis Boulevard, bounded on the west by College Hill Addition, and is approximately 100 feet north of Ross Road. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Chuck Owen, 6129 Abbott, came forward to represent the Charles Owen Company. He said he lives about two blocks from this property. He said they have done residential development about 100 yards from this site and have done an Industrial Park on Rufe Snow Drive. Mr. Owen said there is C-2 zoning about 300 feet south of this site on the west side of Davis; 50 acres of I-I directly across the street; and several C-2 zoned tracts along Davis Boulevard to Highway 26. Mr. Owen said they feel this request is compatible with the other tracts around it. He said there is a carwash, a fence company, excavating company, and a machine shop. Mr. Owen said their intention is to build show room warehouse distribution which will be landscaped. He said he felt it would upgrade the area around it. Mr. Owen said they are the prospective buyers of the property and the owner will live adjacent to this development. . Jack Roseberry, 8912 Martin Drive, came forward. He said he owns property to the south of this property and he would like to see this request go through. He said he felt it would help the area to develop. . . . ~ Page 9 P & Z Minutes September 13, 1984 Mr. Roseberry said his property is zoned C-2 with 526 feet of road frontage. He said they need something to clean up the area and develop it. James Phillips, 7540 Bursey Road, came forward. He said he owns three pieces of property to the south of this site and he felt this would help the area. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. Jan H. Powell, 6020 Price, came forward. He said his property joins this property on the back. Mr. Powell said he felt this would degrade his property. He said he bought it because of the farm atmosphere. Mr. Powell said he felt with this development, there would be drainage problems. Chairman Tucker closed the Public Hearing. Chairman Tucker said this presents a real problem. He said it is on a major thoroughfare, but it backs up to residential. He said he does not like C-2 next to residential, there should be a transition, but Davis Boulevard is not good for residential. Mr. Wood made the motion to approve PZ 84-61. This motion was seconded by Mr. Schwinger. The motion failed by a vote of 2-3 with Tucker, Nash, and Brents voting against. PZ 84-61 DENIED Ms. Nash made the motion to deny PZ 84-61. This motion was seconded by Mr. Brents and the motion to deny carried 3-2 with Wood and Schwinger voting against denial. Chairman Tucker said he was not against commercial, but feels there should be a better plan. ~ Page 10 p & Z Minutes September 13, 1984 . 8. PZ 84-62 Request of B & B Development to rezone Lot 3R, Block F, Richland Oaks Addition, from its present classification of R-2 (Single Family) to LR (Local Retail). This property is located on the west side of Strummer Drive, approximately 289 feet south of Grapevine Highway. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Don Brown, Architect at 108 West 8th, Fort Worth, came forward to represent the owners. He said they plan a one story professional office building. Mr. Brown said to the east of this property is single family residences whose rear yards back up to this property; south is a 4 foot service alley; west and north is zoned commercial and has a convenience store and a chiropractic clinic. He said it would be 6,400 square foot building used by doctors. Mr. Brown said they would provide the necessary parking and 2,400 square feet of landscaping. He said it would be a brick, stucco, and glass building. Mr. Brown said the property had been vacant for over 30 years and they felt the related use to the chiropractic clinic would be good. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. . Lynn Barnes, 5105 Pearl Drive, came forward. He said Strummer has been used excessively with the added commercial use and this would make it worse with the ingress-egress into commercial. Mr. Barnes said he felt it would also decrease the value of his property. ~ Page 11 P & Z Minutes September 13, 1984 . Norman Davis came forward. He said he lives on Wagon Wheel but owns 5109 Pearl Drive. Mr. Davis said since they have had Bennigan's at the end of Strummer, there has been excessive traffic. He said he felt sure this request would increase the value of B & B Development's property, but it would decrease his property. . Alfred Stanford, 5101 Pearl Drive, came forward. He said they trusted these people; they came in and platted the two lots into one lot and now they want to change the zoning. Mr. Stanford said they have a light at the beer joint at Bennigan's and will need another one on the other end of Strummer. He said he was not against Commercial or Local Retail zoning, but this is not a good area for either. Mr. Stanford said they would have to widen the street to accommodate the traffic. He said they have problems now getting out at Bedford Euless Road, Jerri Jo and Grapevine Highway. Mr. Sanford said he felt the zoning should be left residential. Donna Barnes, 5105 Pearl Drive, came forward. She said she has problems backing out and going in her driveway. Ms. Barnes said it is an extremely dangerous area. She said it is a beautiful area and she does not want commercial zoning; it would ruin the area. Twyla Stanford, 5101 Pearl, came forward. She said it would add so much more traffic. Mrs. Stanford said Strummer is an access from Bedford Euless to Grapevine Highway. She said she also thinks this request would take away from the residential atmosphere. . Chairman Tucker said there was C-l zoning along the highway, but once you allow commercial to start down a residential street, it would keep coming down and Strummer is not a good street for commercial zoning. PZ 84-62 DENIED Mr. Schwinger made the motion to deny PZ 84-62. This motion was seconded by Ms. Nash and the motion to deny carried 5-0. 9. PZ 84-63 Request of Aubrey C. Lewis to rezone Tracts 3Al & 3AIA, John McComas Survey, Abstract 1040, from their present classification of AG (Agriculture) to R-3 (Single Family). This property is located on the west side of Smithfield Road, approximately 500 feet south of Odell Street. . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Ron Lewis came forward to represent his father in this request. He said they wish to add approximately 400 square feet on to an existing house. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 84-63 APPROVED Mr. Wood made the motion to approve PZ 84-63. This motion was seconded by Ms. Nash and the motion carried 5-0. RECESS Chairman Tucker called for a recess at 8:55 P. M. BACK TO ORDER Chairman Tucker called the meeting back to order at 9:05 P. Lynch Survey, Abstract 953, from their present classification of R-3 (Single Family) to R-4-SD (Separate Ownership Duplex). This property is located on the east side of Dawn Drive, approximately 190 feet south of Glenview Drive. This case was withdrawn. 11. PZ 84-65 WITHDRAWN Request of Ron Lusk to rezone a portion of Tracts 2Al & 2A2, M. Lynch Survey, Abstract 953, from their present classification of R-3 (Single Family) to C-l (Commercial). This property is located at the southeast corner of Dawn Drive and Glenview Drive. This case was withdrawn. 12. PS 84-82 WITHDRAWN Request of Ron Lusk for preliminary plat of Lots lA thru lOB and 11, Block 4, Nor'Tex Addition. This case was withdrawn. 13. PZ 84-66 Request of Kenneth C. Whitley, Trustee Oak Hills Joint Venture, to rezone Lots 12 thru 37, Block 7, Oak Hills Addition, from their present classification of R-3 (Single Family) to R-4-SD (Separate Ownership Duplex). This property is located on the south side of the St. Louis and Southwestern Railroad, approximatley 379 feet east of the intersection of Amundson Road and the railroad. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Owen D. Long, Consulting Engineer and part owner of Oak Hills Joint Venture, came forward. He said they plan to start soon on the construction of the sanitary sewer at this site. ~ Page 14 p & Z Minutes September 13, 1984 . Mr. Long said they would like to have 26 duplex lots to back up to the railroad which would be single family attached. He said this would be the same zoning as is on the other side of the railroad. Luke Arms, 8441 Dawn, came forward. He asked where the children would go to school. Mr. Wood said they would probably go to Smithfield Elementary and Smithfield Junior High. Chairman Tucker said that schools have their own legislative powers and we can not take their needs into consideration, but he said the schools and the Commission trade information now so they can plan their growth. . Mr. Arms said he felt this zoning request would create more traffic. Chairman Tucker said the Commission plans to submit the Thoroughfare Plan to the City Council in about two weeks. He said if one zones and plats, they must build the streets which is the only way the city can get the streets built. Mr. Long said they will build their half of Amundson Road. Chairman Tucker said without developers, the city could not make it. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. . Gerald Stewart, 8840 Main Street, came forward. He stated he was in opposition to this request. He said he does not feel this is a duplex area. Mr. Stewart said there would not be 26 lots, there would be 52 duplexes which would mean 200 people. . . . ~ Page 15 p & Z Minutes September 13, 1984 Mr. Stewart said his brother lives in a very exclusive neighborhood, which is within 200 feet of a railroad, and causes no problems. He said he does not feel this railroad is a nuisance, but he does wish they would fix the crossing on Main Street. Mr. Stewart said he felt this area should stay single family. He said this is one way to pack areas for profit. He read from the Zoning Ordinance page 55 regarding home occupations. He asked how could you guarantee they would not do all these occupations in duplex zoning. Mr. Wood said that is what is allowed, not what they cannot do. He said they are also allowed in single family. Mr. Stewart said they were against duplex zoning previously when William Garrison came in for a zoning change and do not feel they should change now. Stephen Roberson, Surveyor, came forward to represent Mr. & Mrs. Marcus H. Roberson at 7008 Eden Road. He said they were in opposition to this request. Mr. Roberson said they would have duplexes behind their house. Chairman Tucker closed the Public Hearing. Mr. Wood said in regard to Mr. Stewart's remark about Mr. Garrison, Bill Garrison asked for duplex and fourplex zoning in the middle of a residential area. Chairman Tucker said they are asking for this duplex zoning to serve as a buffer between the railroad and the single family. PZ 84-66 APPROVED Mr. Schwinger made the motion to approve PZ 84-66. This motion was seconded by Mr. Wood and the motion carried 4-1 with Mr. Brents voting against the request. ~ Page 16 P & Z Minutes September 13, 1984 . 14. PZ 84-67 Request of Kenneth C. Whitley, Trustee Oak Hills Joint Venture, to rezone Lot 24, Block 1, Oak Hills Addition, from its present classification of AG (Agriculture) to C-l (Commercial). This property is located at the northwest corner of Precinct Line Road and Amundson Road. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Owen D. Long came forward. He said they are working to get this corner improved. He said Amundson was proposed to be a collector street and felt the land would be best used as Commercial. Mr. Long said they had a life estate on this property and Mr. Gee had passed away and they are now requesting a zoning change. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. Lee Ann James, 8408 Donna, came forward. She said she was not sure if she was for or against this request, but felt the Commission should hold up on all these changes until they get Precinct Line Road improved. She said she knew the land would have to be developed sometime, but she hates to see it go commercial when there is so much congestion in this area. Chairman Tucker closed the Public Hearing. Mr. Wood said it does not have to go commercial. He said the Master Plan shows it to be residential. Mr. Wood said he felt some sort of residential would be compatible. . ~ Page 17 P & Z Minutes September 13, 1984 . Chairman Tucker said he would have a hard time voting on this case. He said some areas along Precinct Line Road could go commercial, but he saw nothing wrong with residential going up against a thoroughfare if it is done right. PZ 84-67 DENIED Ms. Nash made the motion to deny PZ 84-67. This motion was seconded by Mr. Schwinger and the motion carried 5-0. Chairman Tucker stated the Commission would hear the next two cases together. 15. PZ 84-68 Request of Kenneth C. Whitley, Trustee Oak Hills Joint Venture, to rezone Lot A, Block 7, Oak Hills Addition, from its present classification of AG (Agriculture) to 0-1 (Office District). This property is located at the southwest corner of Precinct Line Road and St. Louis and Southwestern Railroad. . 16. PZ 84-69 Request of Kenneth C. Whitley, Trustee Oak Hills Joint Venture, to rezone Lots B, 38 & 39, Block 7, Oak Hills Addition, from their present classification of AG (Agriculture) and R-3 (Single Family) to 0-1 (Office District). This property is located on the north side of Amundson Road at the St. Louis and Southwestern Railroad. Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. . Owen D. Long came forward. He said these cases were on opposite ends of the subdivision, one being 1.196 acres which includes the TESCO easement for parking for the office building. Mr. Long said this property joins the county barn. . . . ~ Page 18 P & Z Minutes September 13, 1984 Mr. Long said Mr. Jones, one of the owners of the property lives next to the property and across the street are nice homes. Mr. Long said the other end is 1.0321 acres. He said they needed more ingress-egress so they will use Meandering Drive. He said this area could have been duplex lots, but needed enough land to meet the zoning classification. Mr. Wood asked how much land was there without the TESCO easement. Mr. Long said he did not have that information. Mr. Wood asked if they could have opened the cuI de sac and made it single family. Mr. Long said they felt they needed to limit the streets onto Precinct Line Road and feel a small office would be better. Mr. Wood asked why they did not put duplex on the southwest corner. Mr. Long said they would have to back out onto the street and they were concerned with the traffic in that area. Chairman Tucker asked what size office they could put on these corners. Mr. Long said after taking the parking and landscaping off, not very large. Jess Nelson, 8013 Precinct Line Road, came forward. He said he would like to see offices all along Precinct Line Road. Mr. Nelson said it will be a major thoroughfare and felt it would be ideal for office zoning. ~ Page 19 P & Z Minutes September 13, 1984 . Chairman Tucker called for those wishing to speak in opposition to these requests to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Chairman Tucker said the shape and local of the property, a garden office with residential would be good. He said the size of the property would limit the size of the office. Mr. Wood said he had been against office zoning on these two tracts, but he does not see how single family or duplex could be built there and office zoning is the best alternative. PZ 84-68 APPROVED Mr. Wood made the motion to approve PZ 84-68. This motion was seconded by Ms. Nash and the motion carried 4-1 with Mr. Schwinger voting against. . Chairman Tucker opened the Public Hearing for PZ 84-69 and called for those wishing to speak in favor of this request to please come forward. Mr. Long said he had already spoken for both cases. Chairman Tucker called for those wishing to speak in opposition to please come forward. Steve Roberson came forward to represent Mr. & Mrs. Marcus Roberson, 7008 Eden Road. He asked if the small office would be one story. Chairman Tucker said it could be 38 feet high. Mr. Roberson said they were opposed to this zoning request. . This motion was seconded by Chairman Tucker and the motion carried 4-1 with Mr. Schwinger voting against. Chairman Tucker stated they would hear the next two cases together. 17. PZ 84-70 Request of Kingswood North Joint Venture to rezone a portion of Tract 1, Alexander Hood Survey, Abstract 683, from its present classification of AG (Agriculture) to 0-1 (Office District). This property is located at the northwest corner of Bursey Road and Keller-Smithfield Road. 18. PZ 84-71 Request of Kingswood North Joint Venture to rezone a portion of Tract 1, Alex Hood Survey, Abstract 683. and a portion of Tract 2, S. Richardson Survey, Abstract 1266, from their present classification of AG (Agriculture) to R-4-SD (Separate Ownership Duplex District). This property is located on the north side of Bursey Road, approximately 472 feet west of the intersection of Bursey Road and Keller-Smithfield Road, and a portion bounded on the east by Keller-Smithfield Road. . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Attorney Charles Evans came forward to represent Kingswood North Joint Venture. He showed the total plan for this property and the surrounding area. He said earlier tonight the Commission approved a final plat of a portion of this area. Mr. Evans said Wilson Road is planned to go through to Davis Boulevard and Bursey Road is planned to go through to Davis also. . ~ Page 21 p & Z Minutes September 13, 1984 . Mr. Evans stated the developer will give the right-of-way for Smithfield Road and Bursey Road and will curb and gutter both. Mr. Evans show pictures of the type of office building they plan for the 0-1 zoning. He said it would be for physicians, dentists, and attorneys. He said it would be a neighborhood concept where the people would not have to drive very far to the doctor or dentist. Mr. Evans said this property is across from Green Valley Raceway which we hope someday to be gone. He said he felt this office zoning would be beneficial to the area. Mr. Wood asked how many acres were there in this request. . Mr. Evans stated there were 12.875 acres. Mr. Evans stated the other request, PZ 84-71 would be single family attached simular to Los Colinas. He said the lots would be larger than necessary. He said the required area is only 3,500 square feet, but their lots would have from 6,500 to 9,000 square feet. Mr. Evans said they would be owner occupied, two single family homes with zero lot lines. He said the area would be 1,600 square feet homes to single family attached to office district. Mr. Evans said they feel this would be very beneficial to the neighborhood. He said the race tract is Commercial directly across the street. Mr. Evans requested rebuttal time. . He said his property is across the street from the property in question. He said they had lived there 12 years. Mr. Mabry said there are 14 or 15 people who have two acre tracts or more which are zoned Agriculture. He said they moved there to get away from the hustle and bustle. Mr. Mabry said they do not like the neighborhood concept Mr. Evans submitted. He said they had rather have the race track than what they are proposing. Mr. Mabry said he felt they should make it all single family. He said he knew it could not stay Agriculture, but it does not need to be high density. Mr. Mabry said they could build a multi-story office building there and 0-1 zoning would open the door to lots of things such as the Ku Klux Klan. Mr. Mabry said he requests the Commission take care of the people who live in the area and take a slower approach to these requests. He said he was not contacted by Mr. Evans. Nancy Gunn, 7520 Bursey Road, came forward. She said she is against both cases. She said they have lived here for 13 years after being transferred to Dallas. Mrs. Gunn said they commute to Dallas every day so they can live in this nice quiet area. She said their property lies southwest of the proposed Office zoning. Mrs. Gunn said any office building has office parking. She said the noise from the race track has never bothered them, but she is opposed to commercial zoning. Mrs. Gunn said she had seen a proposed thoroughfare plan which would take right-of-way off their property and would get a nice large tree. Mrs. Gunn said she is also against the duplex zoning. She said she saw a sign near Smithfield Road and Chapman Road which advertised 78 duplex lots so we don't need anymore. ~ Page 23 P & Z Minutes September 13, 1984 . Mrs. Gunn stated this development would increase the drainage and there are already problems with the drainage. She said she felt the city could get taxes elsewhere. Mrs. Gunn said nine families in this area were not contacted by Mr. Evans about this zoning request. . Jack Knowles, 7955 Smithfield Road, came forward. He said he lives at the corner of Smithfield and Bursey. He said east and west of this area is single family; if they put a buffer to the east of the proposed single family, what are they going to put as a buffer to the east of the office zoning. Mr. Knowles said he felt the road could not handle the traffic. He said he tried to talk to Mr. Riddle several times, but he would never be there. He said he talked to Mr. Bronstad who said Wilson Road was proposed to go through to Davis Boulevard. Charles Bathman, 7935 Smithfield Road, came forward. He said he has three acres he built a home on. He said it is a valuable piece of property, approximately $200,000 and he does not feel office zoning in the area would be good. Mr. Bathman said this is the first time he had owned property in the country and he was not for this change. Mr. Bathman said the roads cannot handle the traffic. He said Bursey Road and Smithfield Road would have to have major ímprovements. Mr. Bathman said Mr. Evans did not contact him. . Mr. Evans came back for his rebuttal time. He said he felt the professional offices would blend with the area. . . . ~ Page 24 p & Z Minutes September 13, 1984 Mr. Evans stated it did flood to the north, but they would take care of that by taking the water to Bear Creek. Mr. Evans said the east-west thoroughfare plan shows Bursey Road to be an 80 foot right-of-way. He said with this road, he felt this would be the best use for the area, but if the Commission had rather have it as a Planned Development, they would agree to that. Mr. Wood asked how long would it be before it is developed. Mr. Evans said two to five years. He said they would develop the R-2 first, then the R-4-SD next, then the 0-1. Mr. Wood asked why they did not wait until that time to request the zoning. Mr. Evans said they do all this so they can put in the water, sewer, and curb and gutter to handle it all. Mr. Wood said he had rather have a Planned Development so they could tie it down. Mr. Evans said they would agree to 0-1-PD Chairman Tucker said he understands the concerns of the people living in the area who have both large homes and large acreage, but the area will change, we cannot stop it. He said he felt they owe it to the neighbors to try to work out a solution. Mrs.Gunn said she did not feel anyone was against development, it was the type of zoning classifications. Mr. Schwinger made the motion to deny PZ 84-70. This motion was seconded by Ms. Nash. ~ Page 25 p & Z Minutes September 13, 1984 . Mr. Evans asked if they could withdraw both requests and come back in with a Planned Development. Chairman Tucker stated they could. Mr. Schwinger withdrew his motion and Ms. Nash withdrew her second. PZ 84-70 WITHDRAWN Mr. Evans withdrew both cases. PZ 84-71 WITHDRAWN 19. PZ 84-72 Request of Jeou Hock Lin to rezone a portion of Lot 2, Block 13, Snow Heights North Addition, from its present classification of C-2 (Commercial) to C-2-Specific Use-Sale of Alcoholic Beverages. This property is located on the east side of Rufe Snow Drive, bounded on the south by McDonald's Restaurant. . Chairman Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Sam Lin came forward. He said they want to put in a high-class Chinese Restaurant. Chairman Tucker asked in whose name the Specific Use would be put. Mr. Lin said Jeou Hock Lin. Chairman Tucker called for those wishing to speak in opposition to this request to please come forward. . Bill Mabry, 7524 Bursey Road, came forward. He said he was in opposition to this request. He said he thinks the area caters to the high school. Mr. Mabry said he was a reformed alcoholic and on Christian principles, he was against the request. ~ Page 26 P & Z Minutes September 13, 1984 . Adene Jones, 7512 Bursey Road, came forward. She said she also objects to this request to sale alcoholic beverages for Christian principles. She said alcohol is too easy for young people to purchase and the restaurant will be too close to the high school. Chairman Tucker closed the Public Hearing. Chairman Tucker said legally, this Commission has no control over granting this request because there are others in the area. He said the county granted the wet area, not the city. Chairman Tucker said the State Law is very specific regarding distance to schools and churches. '. PZ 84-72 DENIED Mr. Wood made the motion to deny PZ 84-72. This motion was seconded by Mr. Schwinger and the motion to deny carried 3-2 with Tucker and Nash voting against denial. ADJOURNMENT The meeting adjourned at 10:55 P.
