MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
DECEMBER 13, 1984 - 7:30 P. M.

The meeting was called to order by the

CONSIDERATION OF THE MINUTES
OF NOVEMBER 8, 1984
Mr. Schwinger made the motion to
approve the minutes as written. This
motion was seconded by Ms. Nash and
the motion carried 3-0.

Ms. Nash made the motion to approve
the minutes as written. This motion
was seconded by Mr. Schwinger and the
motion carried 3-0.
Acting Chairman Bowen stated that item
#6, PZ 84-82 had been postponed until
January 10, 1985.

PZ 84-89
Request of the City of North Richland
Hills to rezone Lot 3, Parchman
Addition, from its present
classification of U (School, Church,
and Institution District) to C-l
(Commercial District). This property
is located at 3927 Vance Road.
Acting Chairman Bowen opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.

Mr. Wheeler stated there was an error
made when the lines were drawn on the
zoning map for the church zoning. He
said since it had been so long since
the error was made, the City Staff
felt it should be done as a zoning
change.
Acting Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.
PZ 84-89
APPROVED
Mr. Schwinger made the motion to
approve PZ 84-89 as requested. This
motion was seconded by Ms. Nash and
the motion carried 3-0.

PS 84-78
Request of Stephen Hinkle for
preliminary plat of Lot 4, Block 4,
Hewitt Estates.

Ms. Nash made the motion to approve
PS 84-78 subject to the engineer's
let~er. This motion was seconded by
Mr. Schwinger and the motion carried

Estates.

Mr. Schwinger made the motion to
approve PS 84-79. This motion was

Lakes Addition.
Acting Chairman Bowen asked if there
was anyone present to represent this
request.

Mr. Schwinger made the motion to
approve PS 84-106 subject to the
Engineer's letter and also subject to
changing the names of the streets.
This motion was seconded by Ms. Nash
and the motion carried 3-0.

PS 84-109
Request of Charles Owen Companies for
preliminary plat of Lots lR & 2, Block
33, College Hill Addition.
PS 84-109
APPROVED
Ms. Nash made the motion to approve
PS 84-109 subject to the Engineer's
comments. This motion was seconded by
Mr. Schwinger and the motion carried
3-0.
6.
PZ 84-82
POSTPONED
Request of Burk Collins Investments,
Inc. to rezone part of Lot 1, Lot 2 &
3, and part of Lot 4, Richland Oaks
Addition, from their present
classification of R-l (Single Family
District) to C-l (Commercial
District). This property is located
on the east side of Strummer Drive at
Bedford-Euless Road.

This request was postponed until the
January 10th meeting.

PZ 84-83
Request of Alan W. Hamm to rezone
Tracts 9 & 9A, William Cox Survey,
Abstract 321, from their present
classification of AG (Agriculture
District) to R-2 (Single Family
District). This property is located
on the south side of Starnes Road,
approximately 550 feet west of Post
Oak Drive.
Acting Chairman Bowen opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.

Mr. Hamm came forward. He stated this
is a small tract they wish to develop
into high quality single family homes.
Acting Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
Dr. Edward K. Hahn, 7500 Windswept,
Colleyville, came forward. He said he
was not sure if he was for or against
this request. Dr. Hahn asked for the
size of the lots and houses they wish
to build.
Acting Chairman Bowen stated the lots
would be 9,000 square feet and the
houses would be a minimum of 1,600
square feet.
Dr. Hahn stated he had no problem with
that.

Acting Chairman Bowen called for
anyone else wishing to speak to please
come forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.
PZ 84-83
APPROVED
Mr. Schwinger made the motion to
approve PZ 84-83 as requested. This
motion was seconded by Ms. Nash and
the motion carried 3-0.
Acting Chairman Bowen stated the next
three (3) requests would be heard
together. He said there would be one
Public Hearing for all three, but
there would be separate motions.

PZ 84-84
Request of Hanson Properties to rezone
a portion of Tract 3BIB, T.K. Martin
Survey, Abstract 1055, from its
present classification of AG
(Agriculture District) to R-2 (Single
Family District). This property is
located on the east side of Crane
Road, approximately 300 feet north of
Main Street.

Request of Hanson Properties to rezone
the southern portion of Tract 3Rl and
Tract 3R4, T. K. Martin Survey,
Abstract 1055, from their present
classification of AG (Agriculture
District) to R-2 (Single Family
District). This property is located
west of Precinct Line Road and south
of Amundson Drive.

Request of Hanson Properties to rezone
a portion of Tract 3B2 & Tracts 3B2E,
3B2A, 3B3Al, 3B2Bl, 3B3B & 3B2C, T.K.
Martin Survey, Abstract 1055, from
their present classification of AG
(Agriculture District) to R-2 (Single
Family District). This property is
located on the west side of Precinct
Line Road and south of Amundson Drive.

Acting Chairman Bowen opened the
Public Hearing and called for those
wishing to speak in favor of these
requests to please come forward.
Jackey Fluitt with Stembridge &
Associates, came forward to represent
Hanson Properties. He stated these
requests were to clean up a few tracts
which surround approximately 20 acres
of land already zoned R-2. Mr. Fluitt
stated they plan to develop this
property into single family dwellings.
Acting Chairman Bowen called for those
wishing to speak in opposition to
these requests to please come forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.
PZ 84-84
APPROVED
Mr. Schwinger made the motion to
approve PZ 84-84. This motion was
seconded by Ms. Nash and the motion
carried 3-0.

APPROVED
Ms. Nash made the motion to approve
PZ 84-85. This motion was seconded by
Mr. Schwinger and the motion carried
3-0.

11. PS 84-88
Request of Hanson Properties for
preliminary plat of Nob Hill Addition.
PS 84-88
APPROVED
Ms. Nash made the motion to approve
PS 84-88. This motion was seconded by
Mr. Schwinger and the motion carried
3-0.
12. PZ 84-87
Request of F. J. F. Development
Company to rezone Tract 5B, William D.
Barnes Survey, Abstract 146, from its
present classification of AG
(Agriculture District) to R-2 (Single
Family District). This property is
located at the northwest corner of
Keller-Smithfield Road and John Autry
Road.

Owen D. Long, Consulting Engineer,
came forward. He said F. J. F.
Development consists of owners Joe
Fuchs, Darrell Jester, and Ed Foster.
He said they had been building in
Hurst, Euless, and Bedford. Mr. Long
said their subdivision would be
similar to Kingswood Estates. He said
the Commission had a preliminary plat
of the layout of the lots.
Acting Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
Mary Worley, 7720 John Autry Road,
came forward. She said she is not
really against this request, but feel
that Smithfield Road needs to be
improved before any more development
is done.

Sandra Norenberg, 7708 John Autry
Road, came forward. She said she
lives across the street from this
area and she is not opposed to this
request, but feels Smithfield Road
cannot handle this development.

Acting Chairman Bowen stated the only
way we can get roads is to have
development.
Chuck Ballenger, 7700 John Autry Road,
came forward. He stated he agrees
with the state of the road. He said
he was a runner and he is aware of the
many pot holes. Mr. Ballenger stated
there were enough developers using the
road to pay for it. He said he feels
the road is the key issue.
Jerry Tate, 7605 Oak Ridge Drive, came
forward. He said he is not opposed to
development progress, but feel they
should improve the roads. He said it
is so narrow there is no place for the
children to walk to school. Mr. Tate
said he had been going to the race
track for 8 years and he knows how bad
it is. He said it needs to be widened
to handle the traffic. Mr. Tate said
Starnes Road is bad, too. He said it
is too narrow to meet a gravel truck.
Mark Norenberg, 7708 John Autry Road,
came forward. He asked if there are
plans to improve these roads.
Mr. Wheeler stated the city is
planning to hire a new Planning
Director to implement the Master Plan.
He said he knows Smithfield Road is to
be improved and widened, but he does
not know the actual date.
Mr. Norenberg asked who could give him
these answers if he came to the city.
Mr. Wheeler said he would try to help
him.
Mr. Norenberg asked if this developer
would be required to improve
Smithfield Road.
Mr. Wheeler said people who have
frontage on the road would be
assessed.

Mr. Wheeler stated this developer will
be required to either improve the road
or escrow money to pay for it when it
is done.
Mr. Norenberg asked what about Green
Valley Drive.
Mr. Wheeler said he did not believe
Green Valley Drive is proposed, but
that Starnes was.
Mr. Norenberg said John Autry Road is
a race track for dump trucks. He said
he is interested in seeing another
access to their property and wondered
if they would make a street to come
out to Smithfield Road.
Acting Chairman Bowen closed the
Public Hearing.

Acting Chairman Bowen said he shares
the people's concern for the roads,
but this is a zoning request; the
roads, drainage, etc. would be
addressed at the time of platting.
PZ 84-87
APPROVED
Mr. Schwinger made the motion to
approve PZ 84-87. This motion was
seconded by Ms. Nash and the motion
carried 3-0.
13. PZ 84-88
Request of New West Development to
rezone a portion of Tract lA, Thomas
Sprouse Survey, Abstract 1399, from
its present classification of AG
(Agriculture District) to R-5-D
(Duplex District). This property is
located on the south side of Bursey
Road and the west side of Douglas
Lane.
Acting Chairman Bowen opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.

Tony Jaecques with Bayer & Associates
came forward to represent New West
Development.

Mr. Jaecques stated they have a
rendering of the proposed project
which lies on the northern boundary of
North Richland Hills and the southern
boundary of Keller. He said since
Bursey Road is to be a thoroughfare,
they felt duplex zoning would be the
best use of this land. Mr. Jaecques
showed a layout of the project.
Acting Chairman Bowen asked if there
were to be 100 lots.
Mr. Jaecques stated there would be.

Verree Pearson, 7012 Bursey Road, came
forward. She said she represents
herself and her husband who own this
property. Mrs. Pearson said she does
not have this property for sale for
the best price because she cares what
happens to the area. She said she has
a home and one acre here and had lived
next door for 25 years, then lived
down the road with her parents
previously. Mrs. Pearson said she
wears two hats, one as a property
owner and one as the seller of the
property.
Mrs. Pearson said she had appeared
before this Commission in opposition
to apartments on the property of her
brother's which joins this property on
the west. She said they may have
received duplex zoning on it or may
intend to ask for it. Mrs. Pearson
stated there was commercial zoning at
the corner of Bursey Road and Rufe
Snow. She said she understands that
Bursey Road is to be a 5 lane road.

Mrs. Pearson said she was told these
would be nice duplex, but she went to
see for herself the New West
development in Euless. She said they
were very attractive with large
streets and they did not look like
duplexes. She said she would not mind
them backing up to her property.

Acting Chairman Bowen called for those
wishing to speak in opposition to this
request to please come forward.
Wayne Martin, 7816 Douglas Lane, came
forward. He said he owns property
adjacent to this property and he has a
dwelling under construction.
Mr. Martin asked if these duplexes
would be for rent or owner occupied.
Acting Chairman Bowen stated there are
two duplex zoning classifications,
R-4-SD (Separate Ownership Duplex) and
R-5-D (Duplex). He said the R-4-SD
allows two different people to
purchase the two units, but the R-5-D
is owned by one person. He said they
could live in one side and rent out
the other or rent both sides.

Mr. Martin said he was opposed to this
request and he has a petition he would
like to submit.
Acting Chairman Bowen said this would
have a more direct effect at the City
Council meeting. He said if there are
20% of the property owners within 200
feet of this property who sign the
petition, it would take 6 of the 7
council members to pass it.
Mr. Martin stated this request is not
compatible with the adjacent property
which has rural atmosphere. He said
there is no rental property in the
area. He said it would decrease the
property value and the roads are very
poor. Mr. Martin said he bought his
property to get away from rental
property and if this is approved, he
would not get to enjoy his objective.
He said he felt there was a better use
for this land.

Raymond Fried, 7100 Bursey Road, came
forward. He stated he has three acres
which join this property.

Mr. Fried said he is opposed to this
request and he has a petition of 85%
of the property owners within 200 feet
of the proposed project who are also
opposed to it. He said there are
several reasons he is opposed to this
request: 1. Having duplexes on two
sides of his property would lower his
property value; 2. the noise from
rental property, heavy street parking
and dense population would be a
continuous complaint; 3. the dense
population would cause traffic
problems and the roads are not
adequate to transport the present
population; 4. when we purchased
our home, there was no reason to
believe that this area would not be
developed into "like housing' with one
to three acre lots; 5. we intend to
raise our family in a country type
atmosphere and use our property for
agriculture as zoned. If the proposed
property is rezoned, we stand to loose
30% of our useable acreage due to the
nuisance ordinance; 6. the investors
of this project are not residents of
our community. If this project is
completed and sold, they will leave
all the problems to be solved. It
appears the investors only interest is
the monetary benefits they stand to
gain at the expense of the present
homeowners.
Tom Duer, 7312 Londonderry Drive, came
forward. He asked if the city has a
Master Plan and if so, what is
proposed for this area.
Acting Chairman Bowen stated the
Commission has the Master Plan about
complete, but he is not sure when it
will be adopted by the City Council.
Mr. Duer asked what it showed for this
area.

Acting Chairman Bowen said he was not
sure, but it was not R-5-D.

Mr. Duer stated he felt they should
build better roads before they allow
any development in this area.
Mr. Duer said he had lived in North
Richland Hills for 30 years and he had
rather have single family dwellings.
Ray Roberts, 7900 Douglas Lane, came
forward. He stated he lives directly
across from this property. He stated
he is in opposition to this request
and dittos everything that has been
said before him. Mr. Roberts said he
used to own the property at Bursey and
Douglas and when he sold it, he put
restrictions on it.

Mr. Roberts stated there is duplex
zoning next to the school which causes
problems because there are no garages
and lots of cars are parked on the
streets.
Phil Withers, 7812 Douglas Lane, came
forward. He said he was building a
home just east of this property and he
shares the sentiment of all who are
opposed to this project. He said he
wishes to enjoy the rural atmosphere.
Mr. Withers said he has fears of too
much traffic.
David Wilson, 7936 Douglas Lane, came
forward. He said he has two acres he
bought from Mr. Roberts which has a
restriction of 2,000 square foot
homes. Mr. Wilson said he bought it
because it was restricted. He said if
he had wanted a duplex, he would have
bought one. Mr. Wilson said he likes
the rural area. He said he would be
in favor of single dwellings, but no
duplexes.

Paul Johnson, 7820 Douglas Lane, came
forward. He said he knows this is
repetitious, but he is also opposed to
this request. He said he does not
feel the schools could handle the
density.

Mr. Johnson said he has his life
savings tied up in his home. He said
he used to own a duplex and he knows
how it can run down with renters.
Ms. Nash stated the Commission
received a letter from Charles and
Patsy Pennington who were unable to
attend this meeting, but were in
opposition to this request.
Kirk Wied, Developer of this project,
came forward. He said he was a
resident of this area and does have
concern for what goes in. He said he
was amazed with the opposition, but he
does not have a closed mind. Mr. Wied
said he felt this was the best use of
this land. He said the roads will be
improved once the property is
developed.

Mr. Wied requested the owners contact
him for a meeting.
Roland Barber, Wexford Court, came
forward. He said it was not how a
place is built, it is how it is
maintained. He said you can tell by
the Watauga side of Rufe Snow Drive.
He said it is an eyesore and he wishes
they could get them to clean up their
side. Mr. Barber said they do not
want this in North Richland Hills.
Sherry Johnson, 6409 Simmons, came
forward. She said she also owns 7820
Douglas Lane. She said duplexes are
not kept up like homes, they do not
take care of their lawns.

Mrs. Herbert V. Travis came forward.
She said they live in Fort Worth, but
they own 65 acres across Bursey Road
from this property. She said she
wanted them to know it is not zoned,
it is still agriculture. She said she
is not for or against this request,
but wanted them to know their property
which runs from the water tower west
is still agriculture.

Mrs. Travis asked about Bursey Road.
She said Keller had told her it was a
county road and would stay a county
road.
Mrs. Calvert stated it lies within our
city boundary and is proposed to be
widened someday.
Acting Chairman Bowen closed the
Public Hearing.

DENIED
Mr. Schwinger made the motion to deny
PZ 84-88. This motion was seconded by
Ms. Nash and the motion to deny
carried 3-0.
ADJOURNMENT
The meeting adjourned at 8:45 P. M.
