HomeMy WebLinkAboutZBA 1984-05-17 Minutes . . . / CALL TO ORDER ROLL CALL MINUTES FOR THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS MAY 17, 1984 - 7:00 P. M. The meeting was called to order by the acting Chairman, Bill Fenimore, at 7:00 P. M. PRESENT: Members Bill Fenimore Harold Schubert Hans Kossler Ron Hubbard Billy Cypert Wanda Calvert Alt. Members P & Z Coordinator ABSENT: Jack Roseberry Martin Erck CONSIDERATION OF THE MINUTES OF APRIL 19, 1984 NEW BUSINESS 1. BA 84-8 Mr. Schubert made the motion to approve the minutes as written. This motion was seconded by Mr. Hubbard and the motion carried 3-0 with the following vote recorded: Schubert, yea, Hubbard, yea, & Fenimore, yea. Mr. Kossler and Mr. Cypert abstained since they were not present at the meeting. Request of John Lamantia to vary from the Zoning Ordinance #1080 on Lot 15, Block 45, Richland Terrace Addition, to allow a 2~ foot high split-rail fence to be built beyond the front and side building line. This property is located at 5100 Gentling Place. Mr. Lamantia came forward. He said he was requesting to vary from the height restriction. He said he wishes to build a 4 foot high split-rail fence. Mrs. Calvert said his application stated he wanted a 2~ foot high split-rail fence. Page 2 Z B A Minutes May 17, 1984 . Mr. Lamantia said no, it said he wanted to construct a split-rail fence to exceed the height restriction by approximately 2~ feet. Mrs. Calvert said she did not understand it that way. Mr. Lamantia said he needs the 4 foot height because he has a corner lot and needs to keep pedestrians off his property. Mr. Lamantia said he is trying to put in a yard. He said there is also two gas pipes which are an eyesore. Mr. Schubert asked Mr. Lamantia if he had a sidewalk. Mr. Lamantia said he did and it runs from front to back along Maplewood. . Mr. Schubert asked if it run along Gentling. Mr. Lamantia said it did not. Acting Chairman Fenimore asked what type of fence he plans to build. Mr. Lamantia said it was a two rail fence, 8 to 10 foot sections. He said if he had to, he could angle it at the corner for sight. Acting Chairman Fenimore asked where he planned to put the fence. Mr. Lamantia said he plans to put it two feet inside the sidewalk and 2 feet inside the curb. . Acting Chairman Fenimore said this Board could not grant a variance to put it there because that is city right-of-way. He said Mr. Lamantia's property starts 9~ feet from the curb. Acting Chairman Fenimore said if the Board grants this request, he would still have to get a permit to install the fence. ~ Page 3 Z B A Minutes May 17, 1984 . Mr. Schubert asked Mrs. Calvert if there had been any correspondence received. Mrs. Calvert said there had been none. Mr. Schubert asked Mr. Lamantia if he had talked to his neighbors about this fence. Mr. Lamantia said he had and none of them opposed it. Acting Chairman Fenimore opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . There being no one wishing to speak, the acting Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the acting Chairman closed the Public Hearing. Acting Chairman Fenimore said they will have to go with the requirement of the city regarding sight at the corner. Mr. Schubert asked what the diagonal lines were on the plat. Mr. Lamantia said that was the gas pipeline. Acting Chairman Fenimore asked Mr. Lamantia to show the Board where his privacy fence is and where he plans to put the split-rail fence. . Page 4 Z B A Minutes May 17, 1984 . BA 84-8 APPROVED Mr. Cypert made the motion to approve BA 84-8 to allow a split-rail fence installed on the property line on Gentling and Maplewood not to exceed four feet in height and that they must obtain a building permit for the fence and abide by the city requirement radius regarding sight at the corner. This motion was seconded by Mr. Kossler and the motion carried 5-0 with the following vote recorded: Cypert, yea, Kossler, yea, Fenimore, yea, Schubert, yea, and Hubbard, yea. 2. BA 84-9 Request of Better Living Corporation to vary from the Zoning Ordinance #1080 on Lot 8, Block 5, Windcrest Addition, to allow house to be built beyond the side building line. This property is located at 7121 Windhaven Road. . Kurt Lemon, Construction Manager for Better Living, came forward. He said there is a curve on Ridgetop which caused a small error in the survey of this lot. Mr. Schubert asked who his Surveyor was. Mr. Lemon said they used T. W. Barrow. Mr. Schubert asked if the problem was caused by pens being moved. Mr. Lemon said he was not sure, but felt the curve of the street throwed them off. He said the house only has one corner over the line. Mr. Lemon said since this happened, they are surveying after they set up the forms before they pour the foundation on all cul de sac lots. . BA 84-9 APPROVED OLD BUSINESS ADJOURNMENT ~/~A'~ S~CR TARY Z NING BOARD OF ADJUSTMENT . ~ Acting Chairman Fenimore said they also have a 25 foot building line to observe on both sides since it is a corner lot. Mr. Lemon said that was correct and it was hard to place a house on that small amount of land. Acting Chairman Fenimore opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the acting Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the acting Chairman closed the Public Hearing. Mr. Hubbard made the motion to approve BA 84-9 as requested. This motion was seconded by Mr. Cypert and the motion carried 5-0 with the following vote recorded: Hubbard, yea, Cypert, yea, Schubert, yea, Kossler, yea, and Fenimore, yea. None. The meeting adjourned at 7:30 P. M.
