MINUTES FOR THE SPECIAL MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
JUNE 26, 1984 - 7:00 P.M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Jack Roseberry, at 7:00 P.M.

CONSIDERATION OF THE MINUTES
OF MAY 17, 1984
Mr. Cypert made the motion to approve
the minutes as written. This motion
was seconded by Mr. Hubbard and the
motion carried 4-0 with the following
vote recorded: Schubert, yea,
Kossler, yea, Hubbard, yea, and
Cypert, yea. Mr. Roseberry abstained
since he was not present at the
meeting.

NEW BUSINESS
1. BA 84-10
Request of James P. Williams to vary
from the Zoning Ordinance #1080 on Lot
4, Block 4, Emerald Hills Addition, to
allow him to build a carport beyond
the front building line. This proper-
ty is located at 7912 Limerick Lane.
Mr. Williams came forward. He said he
had just bought a new car for his wife
and he would like to build a carport
beyond the front property line to
preserve the car.
Mr. Schubert asked if there was
presently a garage there.

Mr. Williams said he did not have a
garage. He said he took pictures of
his house from three angles and a
picture of a carport similar to the
one he would like to build.

Mr. Roseberry asked him to share his
pictures with the Board Members.
Mr. Williams said he wanted to buy an
anonymous carport.
Mr. Schubert asked if there was ever a
garage at 7912 Limerick Lane.
Mr. Williams said it did have one at
one time, but it had been enclosed
when he bought the home nine years
ago.
Mr. Schubert stated that the Board
Members are continually being faced
with this particular situation in
which the garage has been enclosed as
a den, living quarters, or work shop
which leaves the cars exposed outside.
He said enclosing your garage is
against zoning requirements.

Mr. Roseberry asked how close Mr.
Williams wanted to go to the property
line.
Mr. Williams said he would not like to
see it connected to the house at all.
He said that would make it look like a
country shed. He said he thought it
would look nicest free-standing and
lower than the eave.
Mr. Roseberry said he believed the
carport had to be attached to the
house.
Mr. Hubbard asked if there were any
other houses on the block with
carports.
Mr. Williams said there weren't any on
his block, but there was one on the
block behind him.

Mr. Schubert asked Mr. Williams if he
had contacted his neighbors about the
carport.
Mr. Williams said that he had and
there were none to protest it.

Mr. Roseberry asked Ms. Moss if there
had been any correspondence received.
Ms. Moss said there had been none.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
There being no one wishing to speak,
the Chairman called for those wishing
to speak in opposition to this request
to please come forward.
There being no one wishing to speak,
the Chairman closed the Public Hearing.
Mr. Schubert asked Ms. Moss if there
had been letters sent to the property
owners.

Ms. Moss said there had been letters
sent out and there had been no corre-
spondence received.
Mr. Schubert commented on how many
requests for carports they had been
receiving.
Mr. Kossler stated his sympathy for
people wanting a carport, but he feels
it would ruin the look of the street.
He said it would be better for the
City if Mr. Williams would repaint his
car after five years.
Mr. Williams said his street is not a
through street and it is in a very
secluded area.

APPROVED
Mr. Schubert made the motion for
BA 84-10 to be approved as requested.
The motion was seconded by Mr. Hubbard
and the motion carried 4-1 with the
following vote recorded: Roseberry,
yea, Schubert, yea, Hubbard, yea,
Cypert, yea, and Kossler, nay.

2. BA 84-11
Request of James Phillips to vary from
the Zoning Ordinance #1080 on Tract
10D2, J. H. Barlough Survey, Abstract
130, to allow him to plat the property
without the required street frontage.
This property is located approximately
133 feet West of Davis Boulevard and
approximately 93 feet from Ross Road.
Chairman Roseberry appointed Mr. Hans
Kossler to act as Chairman during this
request due to a conflict of interest.
Mr. James Phillip came forward. He
said the land was developed during the
1960's and there had been a business
there ever since then. He bought it
in December, 1983. It had never been
platted. When he tried to plat it he
found out that it didn't have enough
road frontage. He said he had tried
to buy adjacent property in order to
have adequate road frontage, but the
owner would not sell.

Mr. Kossler asked Mr. Phillips if he
was aware of this road frontage
problem prior to buying the property.
Mr. Phillips said he was not aware of
the problem.
Mr. Cypert asked if there were any
buildings on the property now.
Mr. Phillips said there was a 35 X 30
foot brick building in the southwest
corner of the lot. He said the
building had been there longer than
the utility easement.
Mr. Kossler asked Mr. Phillips if he
had deeded access to his property.
Mr. Phillips said he did have deeded
access to his property.
Mr. Schubert asked Mr. Phillips what
his plans for the property were.

Mr. Phillips said he owned Northeast
Fence Company, which is presently
located on Davis Boulevard, and has
plans to move it to the property in
question.
Mr. Schubert asked Mr. Phillips if he
felt the 15 foot entrance way was
adequate for his business.
Mr. Phillips said it was much larger
than the lot he is presently using.
Mr. Schubert asked if the lot and
entrance way was paved or gravel.
Mr. Phillips said it was gravel.
Acting Chairman Han Kossler opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.

Mr. D. Phillips of 6208 Abbott Drive
came forward. He said he had owned
all of the property at one time, but
he broke it up into three lots and
sold it. He said he felt his son's
business would benefit from the move.
Mr. Schubert asked if the inspector
came out to look at the easement when
it was being built.
Mr. Phillips said the inspector at
that time made the inspection and told
Mr. Phillips to put the building on
the building line.
Mr. Schubert asked Mr. Phillips what
would happen if the request was turned
down and a 50 foot egress be required.
Mr. Phillips stated that it would
cause his son's business to fail.
There is no one that will sell their
property for them to use as an entrance.

Mr. Jack Roseberry, 8912 Martin Drive,
came forward. He said the shape of
his property was unusual and it would
be very impractical for him to sell
the corner of it to Mr. Phillips.

Councilwoman Virginia Moody, 7720
Cedar Park Avenue, came forward. She
said she thought Mr. Phillips
represented a very important part of
the City, meaning the small
independent businessmen. She said she
hoped the Board Members would vote in
favor of this request.
Mr. James Park, 4733 Redondo, came
forward. He owns the property which
is adjacent to the north side Mr.
Phillips property. He said he had no
objection to the variance.
The Acting Chairman asked for those
wishing to speak in opposition to this
request please come forward.
There being no one wishing to speak,
the acting Chairman closed the Public
Hearing.
Mr. Schubert asked Ms. Moss if there
had been any correspondence received
on this request.
Ms. Moss said there had been none.
Mr. Cypert made the motion to approve
BA 84-11 to allow Mr. Phillips to plat
the property without the required
street frontage. This motion was
seconded by Mr. Hubbard and the motion
carried 4-0 with the following vote
recorded: Schubert, yea, Kossler,
yea, Hubbard, yea, Cypert, yea,
Chairman Roseberry abstaining.
None.
