MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
AUGUST 16, 1984 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Jack Roseberry, at 7:00 P.M.

CONSIDERATION OF THE MINUTES
OF JULY 19, 1984
Mr. Hubbard made the motion to approve
the minutes as written. This motion
was seconded by Mr. Kossler, and the
motion carried 5-0 with the following
vote recorded: Roseberry, yea,
Cypert, yea, Schubert, yea, Kossler,
yea, Hubbard, yea.

NEW BUSINESS
1. BA 84-13
Request of Raymond L. Ahern to vary
from the Zoning Ordinance #1080 on Lot
6, Block 19, Snow Heights Addition, to
allow a carport to be built beyond the
front building line.
This property is located at 6720
Shauna Drive.
Mrs. Raymond Ahern of 6720 Shauna
Drive came forward. She said that
they would like to build a carport on
the front of their home to expand
their living area by converting the
garage into a den. She said it would
be less expensive to build a carport
than to add a room, which would cost
approximately $20,000.00 to
$30,000.00.

Chairman Roseberry said he thought she
could enclose the garage without
putting in a carport.
Mrs. Ahern said they need a carport to
protect their automobiles from hail
and storms.
Chairman Roseberry asked Mrs. Ahern if
she had any pictures or drawings of
the type of carport she was wanting.
Mrs. Ahern said she did and she
brought them forward.
Mr. Schubert asked how long she had
lived at 6720 Shauna Drive.
Mrs. Ahern said they had lived there
approximately six years.
Mr. Schubert asked Mrs. Ahern how many
cars she and her husband owned.

Mrs. Ahern said they had two
automobiles.
Chairman Roseberry asked Mrs. Ahern if
she understood that this carport would
have to be attached to the house.
Mrs. Ahern said she did.
Mr. Cypert asked if she knew what the
depth of the carport would be.
Mrs. Ahern said she thought it would
be 20 feet. She said they used to
park their cars in the driveway and in
front of their house, until they were
damaged by kids throwing bottles at
them.
Mr. Schubert said he noticed the
building line from the street was
approximately 26 feet, therefore if
Mrs. Ahern put up a carport of 20 feet
that would only leave 6 feet from the
street.

Chairman Roseberry said the building
line is usually 25 feet plus 9 1/2
feet right of way from the back of the
curb and it looks like the house sets
behind the building line.
Mr. Schubert said the carport would be
15 feet from the street.
Chairman Roseberry asked Mrs. Ahern if
there were other carports on her
street.
Mrs. Ahern said there were none on her
street, but there was one on the
street across from her.
Mr. Cypert asked Ms. Moss if there had
been any correspondence received.
Ms. Moss said there had been none.
Mr. Schubert asked Mrs. Ahern if she
had contacted her neighbors.
Mrs. Ahern said she had talked to a
few of them and none of them objected
to the carport.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
There being no one wishing to speak in
favor of this request, the Chairman
called for those wishing to speak in
opposition to please come forward.
There being no one wishing to speak
the Chairman closed the Public
Hearing.
Mr. Kossler stated he was not in favor
of allowing carports to be built
beyond the building line. He said he
feels they devalue the property. Mr.
Kossler said the Zoning Ordinance does
not allow carports to be built and he
is opposed to granting these
variances. He said he sympathizes

with Mrs. Ahern, but feels it is the
Board's obligation to protect the
City. He said he would like the Board
to consider this request very
seriously.
Chairman Roseberry said the ordinance
does not state "no carports"; it deals
with structures. No structures can be
built beyond the building line. He
said the overhang of a house is not
considered a structure.
Chairman Roseberry said he did not
feel it would devalue property. He
said he would prefer someone with a
boat to have a carport to park it
under.

Mr. Kossler said the Board should
consider sending a letter to the
Planning and Zoning Commission
encouraging them to change the
ordinance and permit carports or
buildings to be built beyond the
building line.
Chairman Roseberry said he was neither
for or against having carports.
BA 84-13
Denied
Mr. Schubert made the motion to deny
BA 84-13 as requested. This motion
was seconded by Mr. Kossler and the
motion carried 3-2 with the following
vote recorded: Roseberry, nay,
Cypert, nay, Schubert, yea, Kossler,
yea, Hubbard, yea.
