MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
NOVEMBER 15, 1984 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Acting Chairman, Billy Cypert, at 7:00
P. M.

took the oath of office.

CONSIDERATION OF THE MINUTES
OF AUGUST 16, 1984
Acting Chairman Cypert stated the vote
was in error on the last page of the
minutes. He said the vote showed 3-2,
but the yeas and nays are reversed.
Mr. Schubert made the motion to
approve the minutes with this
correction. This motion was seconded
by Mr. Hubbard and the motion carried
3-0 with Mr. Grubb abstaining since he
was not present at the meeting.
1.
BA 84-14
Request of Kenneth L. Knowles to vary
from the Zoning Ordinance #1080 on Lot
1, Block 26, North Richland Hills
Addition, to allow him to build a
carport awning beyond the side
building line on an existing slab.
This property is located at 7351
Riviera Drive.

Mrs. Calvert stated Mr. Knowles could
not be present since he works nights
and was not told he would be required
to be present. She said a staff
member went out to look where he
wanted the carport and said they had
no problem with it. Mrs. Calvert said
he wants to put it on an existing slab
in the back and to the side of his
property.

Mr. Schubert said he had seen the
place and the slab was in the back.
Mrs. Calvert said Mr. Knowles asked
the Board to go ahead and hear his
request if possible.
Acting Chairman Cypert opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.
There being no one wishing to speak in
favor of this request, the Acting
Chairman called for those wishing to
speak in opposition to please come
forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.

Mr. Hubbard asked if there had been
any correspondence.
Mrs. Calvert said there had been none.
Acting Chairman Cypert said he drove
through the area and there are other
carports in the area.
Mrs. Calvert stated the reason Mr.
Knowles gave for requesting the
variance for the carport was to keep
from parking cars in front of his
house. He said it was dangerous.
Mr. Schubert asked if he had a garage.
Acting Chairman Cypert said he has an
existing garage.
Mr. Schubert asked if he planned to
build it himself.
Mrs. Calvert stated she did not know.

Mr. Schubert said he was opposed to a
homeowner building it because they do
not look as good.

Mr. Schubert said the Board denied the
last request for fir a carport.
Acting Chairman said it was because it
was going to be only six feet from the
street.
Mr. Grubb stated he could not see any
problem with granting this request.
Mr. Hubbard said the Board needs to
establish whether they are are for or
against carports.
Acting Chairman Cypert stated there
are only four members present tonight
and they have to have four
affirmatived to pass a request, so all
members present would have to vote for
the request in order for it to pass.

POSTPONED
Mr. Hubbard made the motion to
postpone BA 84-14 until the next
meeting to give Mr. Knowles a chance
to come or get someone to represent
him. This motion was seconded by Mr.
Grubb and the motion carried 4-0 with
the following vote recorded: Hubbard,
yea, Grubb, yea, Schubert, yea, and
Cypert, yea.

BA 84-15
Request of Rite Home Builders, Inc. to
vary from the Zoning Ordinance #1080
on Lot 13, Block 12, Kingswood
Estates, to allow the house to be
built beyond the front building line.
This property is located at 7741 Red
Oak Street.
Rocky Grieco with Rite Home Builders
came forward. He said they had an
encroachment on the 25 foot set back.
He said the survey shows 1~ to 2 feet
over the building line. Mr Grieco
said they made an error.

Mr. Grubb asked if the house was
already built.

Mr. Grieco stated it was. He said the
bay window is over the building line.
Mr. Schubert asked when the error was
detected.
Mr. Grieco stated it was detected when
the survey was made to sell the house.
Acting Chairman Cyperts opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.

APPROVED
Mr. Grubb made the motion to approve
BA 84-15 as requested. This motion
was seconded by Mr. Hubbard and the
motion carried 4-0 with the following
vote recorded: Grubb, yea, Hubbard,
yea, Schubert, yea, and Cypert, yea.

BA 84-16
Request of John Parish Building
Company to vary from the Zoning
Ordinance #1080 on Lot 13, Block 2,
Meadowview Estates, to allow the house
to be built beyond the front building
line; the building line be changed
from 30 feet to 24 feet. This
property is located at 8632 Kirk
Court.

Charles Parish with John Parish
Builders came forward. He said they
made an error, they thought they had a
25 foot building line instead of a 30
foot building line. Mr. Parish gave
the Board a copy of the plat of the
subdivision. He stated the 30 foot
building line comes down Kirk Lane
which is IF-12 zoning because they had
an agreement with the neighbors to

build large homes on Kirk Lane. Mr.
Parish said they just made an error,
they built 24 feet from the property
line.
Mr. Parish said the house is complete,
they have a contract on it and the
mortgage found the error.
Acting Chairman Cypert opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman called for those
wishing to speak in opposition to this
request to please come forward.

the Acting Chairman closed the Public
Hearing.
Mr. Schubert asked how close the
corner of the house was to the side
property line.
Mr. Parish stated it was six feet.
BA 84-16
APPROVED
Mr. Hubbard made the motion to approve
BA 84-16 as requested. This motion
was seconded by Mr. Grubb and the
motion carried 4-0 with the following
vote recorded: Hubbard, yea, Grubb,
yea, Schubert, yea, and Cypert, yea.

BA 84-17
Request of John Parish Building
Company to vary from the Zoning
Ordinance #1080 on Lot 12, Block 2,
Meadowview Estates, to allow the house
to be built beyond the front building
line; the building line be changed
from 30 feet to 25 feet. This
property is located at 8628 Kirk
Court.

Charles Parish came forward. He
stated this is a similar problem; they
built on a 25 foot building line
instead of a 30 foot.

Mr. Parish said the majority of the
subdivision has 25 foot building
lines. He said the house is
completely built. Mr. Parish said it
is on a court, separated from Kirk
Lane.
Acting Chairman Cypert opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman called for those
wishing to speak in opposition to
please come forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.

APPROVED
Mr. Grubb made the motion to approve
BA 84-17 as requested. This motion
was seconded by Mr. Hubbard and the
motion carried 4-0 with the following
vote recorded: Grubb, yea, Hubbard,
yea, Schubert, yea, and Cypert, yea.

BA 84-18
Request of John Parish Building
Company to vary from the Zoning
Ordinance #1080 on Lot 11, Block 2,
Meadowview Estates, to request the
building line be changed from 30 feet
to 25 feet. This property is located
at 8624 Kirk Court.
Charles Parish came forward. He said
this is a nice big lot, but shallow.
He said they are building 2,000 to
2,200 square foot houses on these lots
and it does not leave much back yard.

Mr. Parish stated this lot is in the
same court as the previous requests.
He said no house has been built yet,
but request the Board change the
building line to 25 feet instead of
the 30 foot shown on the plat.

Acting Chairman Cypert opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman called for those
wishing to speak in opposition to
please come forward.
There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.
Mr. Schubert asked Mr. Parish if they
could build a house to curve around
the lot.
Mr. Parish said they have a plan
picked out for this lot which has two
offsets. He said the house has 2,200
square feet and the patio comes within
10 feet of the back property line.

Mr. Grubb said this would align all
the houses on a 25 foot property line.
Acting Chairman Cypert said it would
look better to have the same setback.
Mr. Schubert asked Mr. Parish if he
had not made the mistake on the other
two, would he have not asked for these
on these lots.
Mr. Parish said he was not sure, but
probably not. He said he felt it
would look better with the the same
building line.
Mr. Grubb said this zoning
classification does call for a 25 foot
building line.
BA 84-18
APPROVE
Mr. Schubert made the motion to
approve BA 84-18 as requested. This
motion was seconded by Mr. Grubb and
the motion carried 4-0 with the
following vote recorded: Schubert,
yea, Grubb, yea, Hubbard, yea, and
Cypert, yea.

BA 84-19
Request of John Parish Building
Company to vary from the Zoning
Ordinance #1080 on Lot 10, Block 2,
Meadowview Estates, to request the
building line be changed from 30 feet
to 25 feet. This property is located
at 8620 Kirk Court.
Charles Parish came forward. He said
this is the same request as the
previous request.
Acting Chairman Cypert opened the
Public Hearing and called for those
wishing to speak in favor of this
request to please come forward.
There being no one wishing to speak,
the Acting Chairman called for those
wishing to speak in opposition to this
request to please come forward.

There being no one wishing to speak,
the Acting Chairman closed the Public
Hearing.
Mr. Schubert asked if the house would
face the east.
Mr. Parish said it would face east.
He said they do not have a house plan
picked for this lot yet, but it would
be one-story. Mr. Parish said the
drive would be from Kirk Lane.
Mr. Schubert asked if they had
requested any variances is the rest of
the subdivision.
Mr. Parish said they had not requested
any.
BA 84-19
APPROVED
Mr. Schubert made the motion to
approve BA 84-19 as requested. This
motion was seconded by Mr. Hubbard and
the motion carried 4-0 with the
following vote recorded: Schubert,
yea, Hubbard, yea, Grubb, yea, Cypert,
yea.
