HomeMy WebLinkAboutZBA 1984-12-20 Minutes ~ . MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS DECEMBER 20, 1984 - 7:00 P. M. CALL TO ORDER The meeting was called to order by the Chairman, Jack Roseberry, at 7:00 P.M. ROLL CALL PRESENT: Chairman Members Jack Roseberry Billy Cypert Harold Schubert Hans Kossler Ron Hubbard Wanda Calvert Alt. Member P & Z Coordinator ABSENT: Bill Fenimore Forrest Grubb CONSIDERATION OF THE MINUTES OF NOVEMBER 15, 1984 Mr. Cypert made the motion to approve the minutes as written. This motion was seconded by Mr. Schubert and the motion carried 30- with Mr. Kossler and Chairman Roseberry abstaining since they were not present at the meeting. The following vote was recorded: Cypert, yea, Schubert, yea, and Hubbard, yea. . Chairman Roseberry recognized State Representative Charles Evans in the audience. He stated Mr. Evans was doing a great job in Austin. 1. BA 84-14 Request of Kenneth L. Knowles to vary from the Zoning Ordinance #1080 on Lot 1, Block 26, North Richland Hills Addition, to allow him to build a carport awning beyond the side building line on an existing slab. This property is located at 7351 Riviera Drive. This request was withdrawn by the applicant since he was unable to attend the meeting. . ~ Page 2 Z B A Minutes December 20, 1984 . 2. BA 84-20 Request of Alexander Graham, M.D. to vary from the Zoning Ordinance #1080, Section 12.4.1(a) on Lot 5, Block 33, Nor'East Addition, to request a variance to allow a site smaller than 20,000 square feet for Local Retail zoning. This property is located at 5413 Davis Boulevard. Chairman Roseberry said he would have to step down from the chair on this request since he was an agent on the sale of this property to Dr. Graham. Chairman Roseberry appointed Billy Cypert to take his place as Acting Chairman. Chairman Roseberry stated there has to be four affirmative votes to pass a request. . Acting Chairman Cypert opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Charles Evans, Attorney, came forward to represent Dr. Graham. He stated Dr. Graham and Mr. Roseberry were here to answer any questions. Mr. Evans stated Dr. Graham purchased some property across from the Y.M.C.A. to put in a medical office. He stated there were some of the homes zoned Local Retail and some are residential. . Mr. Evans said after discussing this with Mrs. Calvert and the City Staff, he found out Dr. Graham needed to request a zoning change to Local Retail instead of Office Zoning. He stated this residential lot is not touching or contigous to the Local Retail lots so he is asking for a variance so he can go to Planning and Zoning and City Council and request Local Retail Zoning. ~ Page 3 Z B A Minutes December 20, 1984 . Mr. Kossler asked if Dr. Graham plans to use the house or does he plan to change the looks of the property. Dr. Graham stated he plans to add one room with parking in front and back. Mr. Schubert asked if Dr. Graham would have enough room for a driveway. Dr. Graham said he would. He said he plans to convert the garage into a drive-through so the patients would not get wet in bad weather. Mr. Evans said the reason Dr. Graham must request this variance is his lot is between two residential lots. . Mrs. Calvert said to qualify to request a change to Local Retail, one must have 20,000 square feet of area. She said Dr. Graham only has one lot, 109.88 by 125.4. Mrs. Calvert stated there were 7 lots along Davis Boulevard and 4 are already zoned Local Retail. She said if they were contigous, there would be no problem. Acting Chairman Cypert called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. BA 84-20 APPROVED Mr. Kossler made the motion to approve BA 84-20 as requested. This motion was seconded by Mr. Schubert and the motion carried 4-0 with the following vote recorded: Kossler, yea, Schubert, yea, Hubbard, yea, and Cypert, yea. . Chairman Roseberry returned to the chair. Page 4 Z B A Minutes December 20, 1984 . ADJOURNMENT . SECRETARY ZONING BOARD OF ADJUSTMENT . Chairman Roseberry stated he and Dr. Graham went to the Planning and Zoning Commission and asked for direction in this case. He said they also asked for an interpretation from the City Attorney, but never heard from him. Chairman Roseberry said Dr. Graham first bought the property contigent on getting the zoning, but he decided to go ahead and purchase the property anyway and request a variance. The meeting adjourned at 7:15 P.M.
