This motion was seconded by Mr. Bowen and the motion carried 5-0 wi th Mr. Wood abstaining since he was not present at the meeting. . PS 83-41 COnsideration of correction of recorded plat of Lots AR-1, AR-2, AR-3, and AR-4 J Calloway Addi tion. PS 83-41 APPIDVED Mr. Harmon made the mot ion to approve PS 83-41. This ßX)tion was seconded by Mr. Bowen and the ßX)tion carried 5-0. 2. PS 83-102 Request for reconsideration of replat of Lots lA-R & lB-R, Block 10, Richland Heights Addition. Mr. Harmon made the motion to open for reconsideration of this replat. This motion was seconded by Ms. Nash and the motion carried 5-0. . Page 2 P & Z Minutes October 27, 1983 . PS 83-102 APPIDVED Mr. Hannon made the mot ion to approve PS 83-102. This motion was seconded by Mr. Wood and the motion carried 5-0. 3. PS 83-104 Request of Housanan Financial COrporation for replat of Lot 2R, Block 2, Jack M. Estes Subdivision. Mr. Stanley Housanan came fOIWard. He said the need for modifying the plat was for renovation and an addition to the property. PS 83-104 APPIVVED Ms. Nash made the mot ion to approve PS 83-104. This motion was seconded by Mr. Harmon and the motion carried 5-0. 4. PS 83-105 Request of Vantage COrporation for preliminary plat of Lot 3, Block A, Northeast center Addition. . PS 83-105 DENIED Mr. Harmon said this preliminary plat does not meet the City's Subdivision ordinance. He made the motion to deny PS 83-105. This motion was seconded by Mr. Bowen and the motion carried 5-0. 5. PS 83-106 Request of Richland Enterprises for replat of Lots F-R, G-R, & H-R, Block 14, Richland Terrace Addition. Ron lVJcGough came fOIWard to represent Richland Enterprises. He said the reason for the replat was to straighten the lot line between Lots G and H to make it better for bui lding conditions; also on Lot F they needed to vacate an easement so they could put a larger building on it and abutt it to the adjacent building. Mr. Bowen said they had a letter from Gene Riddle stating they had left off an easement and requested the easement be put back on the plat. . Page 3 P & Z Minutes October 27, 1983 . Mr. McGough said that had already been done. PS 83-106 APPIDVED Mr. Wood made the ßX)t ion to approve PS 83-106. This motion was seconded by Ms. Nash and the ßX)tion carried 5-0. 6. PS 83-107 Request of Cleta T. Oggier for final plat of Lot 2, Block 1, Martin Addition. Delbert Stmbridge, COnsulting Engineer, came forward to represent Ms. Oggier. He said they had received the City Engineer's comments and have responded. PS 83-107 APPIDVED Mr. Bowen made the motion to approve PS 83-107. This motion was seconded by Ms. Nash and the motion carried 5-0. . O1ainnan Tucker said the next two requests would be heard together, but would be voted on separately. 7. PS 83-108 Request of D. C. McKee for prel iminary plat of Lot 1, Block 1, McKee Addition. 8. PS 83-109 Request of D. C. McKee for final plat of Lot 1, Block 1, McKee Addi t ion. Tan Vogt, Engineer, came forward to represent Mr. McKee and requested approval of the plat. PS 83-108 APPIDVED Mr. Harmon made the ßX)t ion to approve PS 83-108 subject to the Engineer's comments. This motion was seconded by Ms. Nash and the ßX)tion carried 5-0. PS 83-109 APPIDVED Mr. Hannon made the mot ion to approve PS 83-109. Burk COlI ins came fOIWard and requested approval of this final plat. PS 83-110 APPIDVED Mr. Harmon made the mot ion to approve PS 83-110. This motion was seconded by Mr. Bowen and the motion carried 5-0. 10. PS 83-111 Request of P & S Construction for final plat of Meadowview Estates, Phase 4. Charles Parish came fOIWard and requested approval of this final plat. PS 83-111 APPIVVED Mr. Bowen made the mot ion to approve PS 83-111. This motion was seconded by Mr. Wood and the motion carried 5-0. 11. PZ 83-58 Request of Sue Flory to rezone Tract 2GlAl and the west 11 feet of Tract 2G1, John McCanas Survey, Abstract 1040, fran the present classification of Agriculture to a proposed classification of IF-8-1500~e Fmnily Dwelling. This property is located on the north side of Odell Street and approximately 225 feet west of ~i thfield Road. . O1ainnan Tucker opened the Publ ic Hearing and called for those wishing to speak in favor of this request to please come forward. Ms. Flory came fOIWard. She said, as the Commission requested last month, she bought an additional 11 feet to meet IF-8 zoning and now requests her zoning request be approved. There being no one wishing to speak, the O1ainnan closed the Public Hearing. PZ 83-58 APPIDVED Mr. Wood made the motion to approve PZ 83-58 as requested. This motion was seconded by Ms. Nash and the motion carried 5-0. ) Request of David Wise to rezone Tract 2C4, M. Lynch Survey, Abstract 953, fran its present classification of 1F-7~e Fmnily Dwellings to a proposed classification of COmmercial. This property is located on the south side of Glenview Drive, approximately 120 feet west of Jackie Lee Street. 12. PZ 83-60 O1ainnan Tucker opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . Delbert Stmbridge, Consulting Engineer, came fOIWard to represent Mr. Wise. He said Mr. Wise has a contract on this property and they plan to develop this site for mini warehouses. Mr. Stmbridge said they feel this is a good location for this type of developnent. Mr. Wood asked Mr. S t mbr i dge i f he could see a trend for this area to go "COmmercial". Mr. Stmbridge said there are apartments being built across the street and a church is adjacent to this property. Mr. Wood said it is now bounded by residential. Mr. Stmbridge said it is zoned 1F-7 all around this property, but the city no longer has a IF-7 zoning. . ~ Page 6 p & Z Minutes October 27, 1983 . Thunnan Mbore, 4028 Jackie Lee Street, came forward. He said he had lived there for many years and now he feels he is hæmed in all around. Mr. Mbore said all the neighbors are against thi s zoning change. O1ainnan Tucker asked Mr. Mbore if he was speaking in opposition to this request. Mr. Mbore said he was. O1ainman Tucker called for anyone else who wished to speak in favor of this request to please come forward. There being no one else wishing to speak in favor of this request, the Chainnan called for others wishing to speak in opposition to this request to please come fOIWard. . O1ainnan Tucker asked all who were present to raise their hands if they were in opposition to this request. There were several people who raised their hands in opposition to this request. Chainnan Tucker closed the Pub I ic Hearing. Chainnan Tucker said there are a lot of long time residents living in this area and it has been zoned either residential or agriculture. He said he drives through this area many times because it is a pretty and nice area. Chainnan Tucker said he felt this zoning request would be Spot Zoning and he does not feel that would be the proper zoning for this area. . Chainnan Tucker said he did not want Glenview Drive to turn into a Davis Boulevard. He said he felt there was a better use for this property than this. ~ Page 7 P & Z Minutes October 27, 1983 . PZ 83-60 DENIED Ms. Nash made the mot ion to deny PZ 83-60. This motion was seconded by Mr. Bowen and the motion to deny carried 5-0. 13. PZ 83-61 Request of John Cook to rezone Tract 2, J. H. Barlough Survey, Abstract 130, and Tract 10, T. K. Martin Survey, Abstract 1055, fran their present classification of Agriculture to a proposed classification of IF-9-1600-one Family Dwellings. This property is located on the north side of Cardinal Lane and bounded on the east by Surmybrook Addition. O1ainnan Tucker opened the Pub I ic Hearing and called for those wishing to speak in favor of this request to please come forward. . Steve Cook came forward to represent Mr. Cook. He said they want to develop this property for single fami ly and request approval. O1ainnan Tucker called for those wishing to speak in opposition to this request to please came fOIWard. Charles Scoma, 8530 Cardinal Lane, came fOIWard. He said he was not necessarily for or against this request, but he does not understand the difference in IF-9, IF-12 , IF-15, etc. O1ainnan Tucker explained that 1F-9-1600 was 9,500 square foot lots and 1,600 square foot minimum homes. Mr. Scoma said he requests stability in the area as in Swmy Meadows which is 1F-12. He said with these size lots, there would be approximately 60 houses. Mr. Scana said he would like to see a preliminary plat of the area to see how the traffic would flow. . ~ Page 8 P & Z Minutes October 27, 1983 . He said they also have a drainage problem. He said a great aIOOunt of water flows across this field. Mr. Scoma said if this request is approved, they would have no way to take care of the drainage problan on the south side of Cardinal Lane. Mr. Scoma said there is also the problEm of fire protection. He said he believes the city should think about this. He said they do not have sufficient water and sewer in this area. Mr. Scoma asked i f they p I an the local utilities to be under ground as in Sunny Meadows; would they have street lights, off-street parking, and sidewalks? He said he has a number of questions about this developnent. . O1ainnan Tucker said, by law, the zoning does not take into consideration these questions. He said they are taken care of in the platting of the property. Chainnan Tucker said what this Commission has to consider is the best use of this land. He said when they subni t the preliminary and final plat, they will show the layout of the lots and they must provide adequate water and sewer, required size of streets, lights and fire hydrants. Chainnan Tucker said they must meet the city's Subdivision Ordinance. Chainman Tucker asked Mr. Bronstad to explain what is required. . Mr. Bronstad said they must subnit water and sewer plans showing where the I ines wi II be and how they plan to serve the subdivision. He said there will be a 16 inch water line up through the subdivision and the sewer is adequate. Mr. Bronstad said they will be required to put up street lights, also. He said when they submit their plans for the subdivision, they will be sent to the City Engineer for review to make sure they meet the city requirements. ~ Page 9 p & Z Minutes October 27, 1983 . Næ. Scoma said he felt they should consider the density and size of these homes. He said he has a 5,500 square foot home and feels the smaller homes would hinder the resale value of his home. Mœ. Scoma said he feels the land should be used for residential, but feels the lots and houses should be larger. Horace Childress, 8400 cardinal Lane, came forward. He said he has a hane directly south of this area and strongly opposes the lot size and house size they propose. Næ . Childress said he felt they should be 3/4 acre lots and 2,500 square foot homes, and should be deed restricted to this. He said his home is on 6 acres and is 2,500 square foot. . Mr. O1ildress said they have a drainage problem. He said in 1981, water came down across his land one foot deep. Næ. O1ildress said he would like to request a drainage ditch be constructed to take care of the problEm. O1ainnan Tucker closed the Pub I ic Hearing. Mr. Hannon said he felt they have seen the end of large lots since the cost of land is so expensive, and 1F-9 is a large lot. He said in the last several IOOnths, they have been approving homes smaller than these and feel this request is ~propriate. Næ. Wood said 1,600 square feet is the minimum house size, some houses would probably be 2,000 square feet or larger. . Page 10 P & Z Minutes October 27, 1983 . PZ 83-61 APPIVVED 14. RFXIXNITICN OF STlIDENIS IN AUDIFNCE ADJOORNVIENr Chainnan Tucker said this Commission has been studying this city for several IOOnths and they studied the econanics of it. He said they have several areas with large lots and would like to be able to keep it that way, but it is not econanical; very few people can afford a 2,500 square foot home now. Mr. Bowen made the IOOtion to approve PZ 83-61. This motion was seconded by Mr. Hannon and the motion carried 5-0. Amendnent to allow up-grading of mobile home use. O1ainman Tucker said the ordinance should read: "Any single mobile home use on one and one-half (Ii) acres or more existing at the time of the passage of this ordinance or at the time of annexation may upgTade a non-confonning use as follows: The mobile home may be IOOved fran the si te and replaced with a newer and as large or larger mobile home as exists on the site." Ms. Nash made the root ion to recommend approval to the City COuncil this amendnent to the Zoning Ordinance #179. This lOOt ion was seconded by Mr. Wood and the motion carried 5-0.
