MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS

CONSIDERATION OF THE MINUTES
OF OCTOBER 27, 1983
Ms. Nash made the motion to approve
the minutes as written. This motion
was seconded by Mr. Wood and the
motion carried 5-0.

PS 83-105
DENIED 10/27/83
Request of Vantage Corporation for
reconsideration of the preliminary
plat of Lot 1, Block 3, Richland
Terrace Addition (previously submitted
as Lot 3, Block A, Northeast Center
Addition).
Ms. Nash made the motion to reconsider
PS 83-105. This motion was seconded
by Mr. Bowen and the motion carried
5-0.
Ted Faust, architect for the project,
came forward.
Mr. Hannon said the property next to
this property, Racetrac Petroleum, was
required to have a back-water study
and asked if a back-water study was
done on this property.

Mr. Faust said he was instructed by
the City Staff to contact the Corps of
Engineers. He said they contacted
them and the Corps of Engineers found
the floor level is above the flood
level.

Mr. Hannon said ours is different from
the Corps of Engineers. He asked Mr.
Foust what their floor level would be.
Mr. Faust said he did not have that
information with him, but according to
the Corps of Engineers, they were
okay.
Mr. Hannon said he would hate to see a
new building built there and the first
heavy rain have 3 to 4 feet of water
in it. He said the engineer's study
for the Racetrac property is in the
City Engineer's office and he could
look at it.
Mr. Faust said he had already seen it.

Mr. Hannon made the motion to approve
PS 83-105 subject to the Engineer's
comments. This motion was seconded by
Mr. Bowen and the motion carried 5-0.

Mr. Riddle said they may have to bore
the street and would request they

Request of Sabine Valley Industries
for final plat of Richfield
Subdivision.
Mr. Bowen said he had a question for
the representative present.
Mr. John Barnett with Carter & Burgess
Engineers came forward.
Chairman Tucker said the fire
department had requested the street
name of "Valley Drive" be changed
since there is already a street in
North Richland Hills by that name.
Mr. Barnett said that would be no
problem.
Mr. Bowen said the zoning should be
shown as 1F-9-1500.
Mr. Barnett said they will change that
also.

APPROVED
Mr. Bowen made the motion to approve
PS 83-114 subject to changing the
street name and showing the correct
zoning classification on the plat.
This motion was seconded by Ms. Nash
and the motion carried 5-0.

PS 83-115
Request of Aubrey Brothers for replat
of Lots 9R & lOR, Block 2, and Lot lR,
Block 5, Flamingo Estates.
Chairman Tucker said since this is a
replat in single family zoning, there
would need to be a Public Hearing. He
opened the Public Hearing and called
for those wishing to speak in favor of
this request to please come forward.
Dick Perkins with Teague NaIl and
Perkins Engineers, came forward to
represent Mr. Brothers.

Mr. Hannon said he has two problems
with the replat. He said number 1,
the off-set of the street, Boca Raton,
needs to be straightened, and number
2, there were no construction plans
submitted for the street.

Mr. Perkins said they have a request
for a preliminary plat to the north of
this property and if it is not
approved, they will not need this
replat. He said if it is approved,
they will do the construction plans
for both.
Mr. Perkins said in regard to the
realignment of the street, they
already have a lot that is barely
usable now.
Mr. Hannon said the lot looked large
enough. He asked what the area of the
lot was.
Mr. Perkins said the area of the lot
was not the problem, it was the shape
of it.

Mr. Hannon said if the street is not
straightened, it would make a
dangerous intersection. He said they
could probably move it farther to the
west. Mr. Hannon said there would be
15 houses there and a potential
entrance onto Rumfield Road if it ever
develops.
Mr. Hannon showed Mr. Perkins how the
road could be changed.
Mr. Perkins said he felt the traffic
would be relatively minor there as
they would not be going anywhere. He
said their preference would be to
leave the road the way it is, but
would not want to be denied for this
reason.
Mr. Bowen said he agreed with Mr.
Hannon. He said there might not be
much traffic now, but it would be
later and he feels it should be
realigned.

Mr. Perkins requested they approve the
replat subject to satisfying the City
Engineer so they would not have to
come back before this board.

Chairman Tucker called for those
wishing to speak in opposition to this
replat to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Ms. Nash made the motion to deny
PS 83-115. This motion was seconded
by Mr. Hannon and the vote was 2-3
with Bowen, Wood, and Tucker voting
against denial. The motion failed.
PS 83-115
APPROVED
Mr. Bowen made the motion to approve
PS 83-115 contingent on Boca Raton
being realigned with the street on the
south side subject to the approval of
the City Engineer. This motion was
seconded by Mr. Wood and the motion
carried 5-0.

PS 83-118
Request of Gibraltar Savings
Association for Short Form plat of Lot
5, Block 1, Carder Addition.

Chairman Tucker requested the engineer
for this request to come forward. He
said the Commission has some
questions.
Jerry Fleming with Freese & Nichols,
Inc. came forward.
Chairman Tucker said the Commission
members are concerned about the
drainage in this area and asked what
commitment they were going to make.
Mr. Fleming said Mr. Umbenhower should
answer that.

Mr. Lonnie Umbenhower, Regional Vice
President of Gibraltar Savings, came
forward. He stated that when they
requested a building permit to
remodel, they found the property had
not been platted. Mr. Umbenhower said
the city required they plat and have a
drainage study made. He said they
were required to take care of their
drainage and all the water on their
property.

Mr. Umbenhower said they found out
that the Bank of North Texas has two
years to take care of their drainage.
He said he had been in touch with the
bank's engineer, Doug Long. Mr.
Umbenhower requested the city give
them two years to match the bank's or
let them put a drainage system only on
their property or allow them to put up
a bond to do the drainage when the
bank does their's. He said he does
not feel they should be obligated to
do all this alone. Mr. Umbenhower
said they would like to have some time
on this, but would like to go ahead
with their building.
Mr. Riddle said if the Commission
approves this, it should be subject to
them working out an agreement with the
bank prior to going to the city
council.

Mr. Umbenhower asked if the city would
participate.
Mr. Riddle said there was no city
ordinance requiring the city to
participate.
Mr. Riddle said if Gibraltar Savings
had not come in for platting, the bank
would have had to put in the drainage
in two years alone.
Mr. Umbenhower said they would try to
get things worked out, but they need
to be allowed to go ahead with their
building.
Mr. Riddle said if they would get a
letter to him signed by both parties
stating they will do the drainage, the
city will issue them a building
permit.

Mr. Hannon made the motion to approve
PS 83-118 subject to Gibraltar Savings
providing the city with a document
from them and the Bank of North Texas
stating they will install the
drainage. This motion was seconded by
Mr. Wood and the motion carried 5-0.

Request of H. M Howe to rezone Tract
1, S. Richardson Survey, Abstract
1266, from its present classification
of Agriculture to proposed
classifications of IF-9-1500 One
Family Dwellings, 2F-9-Two Family
Dwellings, and Neighborhood Retail.
This property is located on the south
side of Wilson Lane and bounded on the
south by Green Valley Country Estates.

Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of these requests to
please come forward.
David Mullins with D. M Development
Company, came forward. He said he was
representing Galaxie Development and
they are requesting this zoning on
this 40 acre tract. Mr. Mullins said
they feel these zoning classifications
would be good for this area. He said
there would be a natural separation
between this and the Green Valley
Country Estates by a large drainage
channel. Mr. Mullins said they are
requesting the Neighborhood Retail
zoning to provide convenience to this
subdivision.

Mr. Hannon said the Neighborhood
Retail classification will cease to
exist if the new Zoning Ordinance is
approved. He said Mr. Mullins could
withdraw his request because what
would be done with that
classification they do not know.
Mr. Mullins said they have a time
schedule, but would be willing to work
with the City Staff.
Mr. Wood asked why they feel they need
so much duplex zoning.
Mr. Mullins said they have a market
available for it, but they would be
flexible.
Mr. Wood asked if they would consider
single family on the whole tract.
Mr. Mullins said they have a market
for duplexes, but if the Board feels
single family would be better, they
would consider it.
Chairman Tucker called for those

Erwin Parman, 7325 Continental Trail,
came forward. He said he lives at the
northeast corner of Continental Trail
and Valley Drive. Mr. Parman said he
represents himself and five other
neighbors. He said when they
purchased their land in 1973, they had
to agree to not subdivide their
acreage.
.
Mr. Parman said he urged the
Commission to not change the zoning
from Agriculture to a multi-home
situation. He said they bought their
homes to get away from apartments.
Mr. Parman said they would not
oppose the development of the land if
they would restrict it to mini-ranch
with a minimum of one acre tracts. He
said on the north side of Wilson Road
there are large homes. Mr. Parman
said this zoning would make it a
congested area. He said Wilson Road
is the only access into this property.
Mr. Parman said he hoped the
Commission would give careful
consideration to keep their area
uninhabited.
Mary Pfirman, 7325 Continental Trail,
came forward. She asked, if this is
approved, who would supply the water
and sewer. Mrs. Pfirman said they
have no sewer and they are on Keller
water. She said the roads in this
area are bad and she feels North
Richland Hills should take care of
their property before they grant
any more development. Mrs. Pfirman
said they have a minimum of 2,000
square foot houses and Londonderry
Addition has the same restriction, and
she feels with these small lots and
small houses, their property value
would go down.
Chairman Tucker asked Mr. Riddle if
North Richland Hills would serve this
area water and sewer.

W. E. Chilton came forward. He said
he owns the property to the east of
this property. He said the access to
this property is only by Wilson Lane
and asked how many people would be put
on this 40 acres and would Wilson Lane
be expanded or how do they plan to
take care of the added traffic.
Mr. Riddle said Wilson Lane is in
Keller city limits and the developer
would have to satisfy the City of
Keller regarding the road.
Chairman Tucker said it makes it hard
for this Commission to make a decision
since the street is not in our city.
Mr. Parman came forward. He asked
where the 80 foot drainage ditch runs
from.

The Commission showed the interested
property owners the proposed plat of
the property.
Chairman Tucker said these are zoning
requests, not plats, so the situation
could change.
Chairman Tucker stated that if the
developer cannot satisfy the City
Engineer and the City of Keller, they
cannot develop this property.
Chairman Tucker closed the Public
Hearing.
Mr. Hannon said he understands the
concern of the adjoining property
owners, but the time for large lots is
no longer feasible. He said in regard
to the duplex zoning, he does not feel
that is feasible and would recommend
denial of it and the Neighborhood
Retail.

Chairman Tucker stated they have the
right to appeal to the City Council.
14. PZ 83-65
Request of Aubrey Brothers to rezone
Tract 1EIA, Oziah Rumfield Survey,
Abstract 1365, from its present
classification of Agriculture to a
proposed classification of IF-9-1500
One Family Dwellings. This property
joins the new Flamingo Estates on the
north and is approximately 700 feet
east of the intersection of Eden Road
and Rumfield Road.

Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Dick Perkins with Teague NaIl &
Perkins Engineers, came forward. He
stated this would be an extension of
Flamingo Estates and would be Phase 2.
Mr. Perkins said they were requesting
the same zoning as the existing
Flamingo Estates.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.

Mr. Bowen made the motion to approve
PZ 83-65. This motion was seconded by
Mr. Wood and the motion carried 3-2
with Nash and Tucker voting against.

15. PS 83-112
Request of Aubrey Brothers for
preliminary plat of Flamingo Estates,
Section 2.
Dick Perkins came forward. He said in
the City Engineer's letter, item 3
requesting escrow for Rumfield Road,
they would rather sign a covenant
running with the land since there is
no existing road.
Mr. Riddle said that would be okay as
long as they split the front footage
to go with each lot. He said they
would let them sign a covenant.
Mr. Wood asked if it would be against
each lot.
Mr. Riddle said there would be a
covenant on each lot recorded at the
Court House.
Mr. Wood said most mortgage companies
would not accept them.

Mr. Riddle said it would figure about
$57.00 a front foot.
Mr. Perkins said in regard to the
drainage, they would not need a letter
from Mrs. Hazelwood as long as they
don't do any grading on her property;
she has a stock tank and the water has
always gone there.
Mr. Riddle said they would need to
show that it drains to an established
water drain.
Mr. Perkins said they would be glad to
do that.

16. PZ 83-66
Request of Gene Huggins to rezone
Block 42C and Lot 21R, Block 5,
Richland Terrace Addition, from their
present classifications of
Multi-Family and IF-9 to a proposed
classification of Commercial. This
property is located on the north side
of Northeast Loop 820 Frontage Road
and is bounded on the west by Cloyce
Drive.
Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.

Ernest Hedgcoth, Consulting Engineer,
came forward to represent Mr. Huggins.
He said Mr. Huggins wishes to
construct a Honda Dealership on this
property. Mr. Hedgcoth said there
would be 6,000 square feet of showroom
and 11,000 square feet of parking. He
said there would be a 6 foot screening
fence along the east and north
property line to Susan Lee Lane and
the access to the property would be
from the Access Road; none would be
from Cloyce or Short Streets. Mr.
Hedgcoth said it will cost
approximately $550,000 to construct
this facility which would be in
operation 5~ days a week, 9 to 5 week
days,half day on Saturdays, and closed
on Sundays. He said they would sell
approximately 125 cars per month and
with the used cars, it would total
approximately 175 cars per month.
Mr. Hedgcoth said they have 6 other
dealerships in Virginia and some in
Florida. He said they have a Lincoln
Mercury dealership in Washington, D.C.
and a Datsun/GMC dealership in Lake
City, Florida. Mr. Hedgcoth said in
Phase I, they would expand the 7~ acre
tract to the west and could later add
a GMC/Jeep or a Lincoln/Mercury
dealership.

Mr. Hedgcoth said the present zoning
is Multi-Family and one lot is single
family.

Mr. Hedgcoth said Roger Crownrich
Architects from Dallas will do the
project. He said they had been the
architect for Frank Kent Cadillac,
Jack Williams Chevrolet, and Integrity
Buick.
Mr. Hedgcoth said Solomon Peters, a
design specialist with Crownrich
Architects, was with him.

Mr. Peters came forward. He said they
have designed approximately 8
dealerships in the Metroplex. He
showed their proposal for this site.
Mr. Peters said it has been designed
to integrate into the existing
residential area. He said it would be
a combination of painted brick and
masonry; it would be one story with a
metal roof or clay masonry roof. Mr.
Peters said they plan a landscape
buffer on the north and east side. He
showed the Commission and neighbors
pictures of the proposed structure.
RECESS
Chairman Tucker called a recess at
9:00 P. M. to allow the neighbors time
to look the plans over.
BACK TO ORDER
Chairman Tucker called the meeting
back to order at 9:10 P. M. with the
same members present.
Chairman Tucker called for those
wishing to speak in opposition to this
request to please come forward.

Jim Bowen, 4704 Susan Lee Lane, came
forward. He said he was opposed to
this property being rezoned to
Commercial for several reasons: 1. It
would cause excessive traffic due to
the design of the on/off ramps of the
freeway, thus forcing patrons of this
business to cut through the
residential streets; 2. The lights
would make it difficult to sleep at
night. Hudiburg Chevrolet already
creates this problem; 3. The
homeowners would be surrounded by
commercial property which would lessen
the property value; 4. Based on the

instability of the economy and the
erratic success of the automotive
industry, it could become a car
dealership graveyard.
Mr. Bowen said he did not feel they
should take multi-family residential
property, which is more compatible
with the existing development
surrounding this property and change
it to satisfy one man or a corporation
when they could move across the
highway or down the road and would
already have the proper zoning.
Mr. Bowen requested the Commission
re-evaluate this request.
Mr. Wood asked Mr. Bowen if he had
rather have high density rather than
security controlled commercial.

Mr. Bowen said he felt mulit-family
would not lessen the value of their
property as much as commercial would.
James M. Wilson, 4705 Susan Lee Lane,
came forward. He said he was against
this request. He said they have
interference from Hudiburg with the PA
system, the lights and the traffic.
Mr. Wilson said they are residential
and would like to maintain the
residential atmosphere.
Philip Wacaster, 4708 Susan Lee Lane,
came forward. He said he opposes this
request because they already have
excess traffic from Hudiburg.
Lynda Sutphin, 5028 Maryanna Way, came
forward. She said was against this
request; she is not against the
commercial zoning, but is against a
car dealership. Ms. Sutphin said she
would be more in favor of an office
building. She said it would make the
traffic in the area bad and she is
against this type of development.

Betty Grimes, 4813 Susan Lee Lane,
came forward. She said she is against
this zoning request.

Chairman Tucker closed the Public
Hearing.
Chairman Tucker said most of the time,
the car dealerships are lighted for
security and this does generate a
light problem for the neighborhood.
He also said they do generate traffic
and if they develop this property into
two dealerships, it would create more
traffic. Chairman Tucker said
Hudiburg Chevy is obnoxious.
Chairman Tucker said if this property
is developed as multi-family, there
would be traffic, but it would not be
all night and would be considered as
residential.
Mr. Hannon asked the architect if
there are lighting systems they could
use that would keep the light off the
neighborhood.
Mr. Peters said there are a number of
lighting systems they could use. He
said he also feels Hudiburg is
obnoxious. Mr. Peters said their
anticipated lighting would be 3 to 4
foot candles which would be 20 to 30
feet away from the poles. He said
Hudiburg's is a general aluminated
system and their's would be a
directional system which would be from
the property line in; they would have
some mounted on the buildings at 40 to
50 feet. Mr. Peters said this
dealership would not be as large as
Hudiburg.
Mr. Hannon said he would request an 8
foot masonry fence as opposed to the
6 foot wood fence.
Mr. Peters said they have previously
constructed fencing out of the same
masonry as the building and they would
agree to this.
Mr. Wood made the motion to approve PZ
83-66 subject to the fence on the east
property line being 8 feet.

This motion died for lack of a second.
Mr. Hannon made the motion to approve
PZ 83-66 subject to installing an 8
foot masonry fence on the north and
east sides and subject to the approval
of a sight lighting system which would
have the direct lights into the
property and away from the residential
property. This motion was seconded by
Mr. Wood. The vote was 2-3 with Nash,
Bowen, and Tucker voting against. The
motion failed.

PZ 83-66. This motion was seconded by
Mr. Bowen and the motion to deny
carried by a vote of 3-2 with Wood and

Request of Robert H. Martin to rezone
Tract AIA, J. C. McComas Survey,
Abstract 1040, from its present
classification of Agriculture to a
proposed classification of 1F-12-1800
One Family Dwelling. This property is
located at 7600 Hewitt Street.
Chairman Tucker opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
Ernest Hedgcoth, Consulting Engineer,
came forward to represent Mr. Martin.
He said Mr. Martin requested a
building permit to enlarge his home
and found it had not been zoned nor
platted. Mr. Hedgcoth said they are
requesting zoning compatible to the
surrounding area.
