HomeMy WebLinkAboutZBA 1983-07-21 Minutes . MINUTES OF THE SPECIAL MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS JULY 21, 1983 - 7:00 P. M. CALL TO ORDER The meeting was called to order by the Chairman, Jack Roseberry, at 7:02 P.M. OATH OF OFFICE Chairman Roseberry administered the oath of office to Hans Kossler and John Schubert. BUILDING OFFICIAL P & Z COORDINATOR Jack Roseberry Martin Erck John Schubert Hans Kossler Bill Fenimore Bill Rice Wanda Calvert ROLL CALL PRESENT: CONSIDERATION OF THE MINUTES OF JUNE 16, 1983 Chairman Roseberry stated the correct spelling of the attorney's name is: Charles Gumm. . Mr. Fenimore made the motion to approve the minutes with this correction. This motion was seconded by Mr. Erck and the motion carried 4-0 with Mr. Schubert abstaining since he was not present at the meeting. 1. BA 83-8 Request of Alan Hamm to vary from the Zoning Ordinance #179 on Lot 2, Block 35, Holiday West Addition, to be allowed to have an average of 750 square feet for the entire apartment project instead of the 750 square feet average per building. This property is located on the west side of Westchase Drive between Trinidad Drive and Buenos Aires Drive. Bill Phiefer, Developer of the property, came forward. He said they are requesting this variance to allow the efficiency units to be grouped and also be able to spread the floor plans. . Mr. Phiefer stated the Board has granted simular variances to Hilltop and Chasewood recently. Page 2 Z B A Minutes July 21, 1983 . Mr. Phiefer showed a site plan of a project they built in Bedford. He said this project would be simular. Mr. Phiefer said their one-bedroom units would be 496 square feet which be rented to a single person. He said their other units would be two-bedroom. Mr. Phiefer said they would only have two buildings of the efficiency apartments; the majority will be larger for families. Chairman Roseberry asked if they had built other apartment projects. Mr. Phiefer said they had built in Bedford. Chairman Roseberry asked if his need for this variance was to segregate the singles from the families. Mr. Phiefer said that was correct. . Mr. Phiefer showed the Board where the units would be located. Mr. Fenimore asked if they had built the apartments on Forrest Ridge in Bedford. Mr. Phiefer said they had. Mr. Fenimore said they were good looking apartments. Mr. Schubert asked how many rooms the efficiency units have. Mr. Phiefer said they have a living room-den, a bedroom, bath and kitchen-dining area. Mr. Erck asked how the traffic would get out of this complex. Mr. Phiefer said they could go out on West chase Drive, Buenos Aires, or Trinidad Drive. . Page 3 Z B A Minutes July 21, 1983 . Chairman Roseberry opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mrs. Calvert stated there had been no correspondence received. BA 83-8 APPROVED Mr. Fenimore made the motion to approve BA 83-8 as requested. This motion was seconded by Mr. Erck and the motion carried 5-0 with the following vote recorded: Fenimore, yea, Erck, yea, Schubert, yea, Kossler, yea, and Roseberry, yea. . 2. BA 83-9 Request of Aubrey M. Allred to vary from the Zoning Ordinance #179 on Lot 13, Block 26, Richland Terrace Addition, to be allowed to construct a 3-car garage on an existing foundation which is within one foot of the utility easement instead of the required 5 foot setback. This property is located at 7320 Oakland Lane. Mr. Allred came forward. He stated he had been living here 25 years and 23 years ago, he put in this foundation to build this garage. He said, at that time, there was no ordinance against it. . Mr. Allred said the slab is 4 feet off the west property line and that neighbor plans to help him build the garage. He said he had also knocked on doors in his neighborhood and asked if they had any objection to this, but there was no opposition to him building a 3-car garage on this existing slab. Page 4 Z B A Minutes July 21, 1983 . Chairman Roseberry asked if it would be on the easement. Mr. Allred said it would be 6 feet from the property line and he has a 5 foot easement, so it would be one foot off the easement. Mr. Schubert asked if Mr. Allred had submitted any plans for the garage. Mr. Allred said he needed to get the variance first. Mr. Fenimore asked if he was one foot off the 5 foot utility easement and 4 feet off the side property line. Mr. Allred said that was correct. He said there is already a 7 inch thick driveway to the back where the slab is. Mr. Allred said two years ago he took in his garage for a den and removed the driveway in front of it. . Mr. Schubert asked Mr. Allred if he contacted the property owners on both sides and in back of him. Mr. Allred said he did and they did not object. Mr. Schubert asked if he had underground utilities. Mr. Allred said he no, the sewer is in the easement and TESCO power lines are across it. Chairman Roseberry opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. . BA 83-9 APPROVED Mr. Erck made the motion to approve BA 83-9 as requested. This motion was seconded by Mr. Schubert and the motion carried 5-0 with the following vote recorded: Erck, yea, Schubert, yea, Kossler, yea, Fenimore, yea, and Roseberry, yea. Mr. Schubert made the motion to hear the next 3 requests together. This motion was seconded by Mr. Fenimore and the motion carried 5-0. 3. BA 83-10 Request of Jesse S. Canas to vary from the Zoning Ordinance #179 on Lot 21, Block 43, Richland Terrace Addition, to be allowed to construct a fence to the property line along Maplewood Avenue instead of the required 15 foot setback. This property is located at 7454 Gentling Place Court. . 4. BA 83-11 Request of Jesse S. Canas to vary from the Zoning Ordinance #179 on Lot 22, Block 43, Richland Terrace Addition, to be allowed to construct a fence to the property line along Maplewood Avenue instead of the required 15 foot setback. This property is located at 7458 Gentling Place Court. 5. BA 83-12 Request of Jesse S. Canas to vary from the Zoning Ordinance #179 on Lot 15, Block 45, Richland Terrace Addition, to be allowed to construct a fence to the property line along Maplewood Avenue instead of the required 15 foot setback. This property is located at 5100 Gentling Place. Mr. Canas with Wilshire Properties came forward. He gave the Board a more detailed drawing of where he wants the fences. . Mr. Canas said there is a 15 foot building line along Maplewood and with the sidewalks, he wants to set the fence out close to the sidewalks. Page 6 Z B A Minutes July 21, 1983 . Mr. Canas said on Lot 22, Block 43, he would come off 50 feet from the curb and come at an angle so there would be no obstruction of view at the intersection. Mr. Fenimore asked Mr. Canas if he was wanting to put the fence out to the sidewalk. Mr. Canas said he would like to put it on the property line. Chairman Roseberry asked if this Board approved this request, would Mr. Rice allow it. Mr. Rice said he would. Mr. Erck asked what kind of fence he plans to put up. Mr. Canas said a 6-foot wood fence. . Mr. Schubert asked if the smooth side would be out. Mr. Canas said it would be. Mr. Kossler asked what the ordinance requires. Mr. Rice said the ordinance states they can have no structures past the building line. Mr. Kossler asked about the safety. Mr. Rice stated he had checked it out and you could see around the corner at the intersection with the fence at the angle he shows in the diagram. Mr. Kossler asked Mr. Canas if he knew about the ordinance before he built these houses. Mr. Canas said he did not. He said he took the job at the end of May after the houses were already started. . Page 7 Z B A Minutes July 21, 1983 . Mr. Fenimore said being a builder, he understands Mr. Canas problem in loosing yard space. He said he wants to get as much yard as possible. Mr. Kossler said he could have built somewhere else. Mr. Schubert asked if there was a stop sign at the intersection. Mr. Canas said there was. Chairman Roseberry opened the Public Hearing and called for those wishing to speak in favor of these requests to please come forward. . George Farley, 5109 Maplewood Court, came forward. He said he was not sure if he was for or against these requests. Mr. Farley said he would like to see the plans. He said he does not have any objection to Mr. Canas getting additional yard area if it does not block the view at the intersection. Mr. Farley said he does not think there is a stop sign there and Maplewood is a busy street. Mr. Fenimore showed the drawings of where the fence would be to Mr. Farley and others who were interested. Mr. Farley said, after seeing the plans, he has no objection to these requests. Chairman Roseberry asked if the owner of Lot 16 was present. He was not. Mr. Schubert said this fence would be like an entrance into the addition. Chairman Roseberry called for anyone wishing to speak in opposition to these requests to please come forward. . There being no one wishing to speak, the Chairman closed the Public Hearing. Page 8 Z B A Minutes July 21, 1983 . Mrs. Calvert stated there had been no correspondence received. Mr. Fenimore asked Mr. Rice if he could see any problem with this. Mr. Rice said not if the fence is put up according to these drawings. Mr. Kossler said he felt there would not be enough room to see around it and feels they should move the fence back. Mr. Rice said that from the sidewalk to the curb would be 6~ feet. Joan Jansky, 5112 Gentling Place, asked to be allowed to speak. She said she moved here 3 months ago, and would not be opposed to this if they would have the fence far enough back to see around it. . Mr. Erck said he was concerned with the fence being only one foot from the sidewalk. Mr. Canas said he could put the fence 2~ feet from the sidewalk. Mr. Rice said that would look nice, you could put flowers or something there. Mr. Farley said that down the street, there are houses with fences out to the property line; this would be no different. BA 83-10 APPROVED Mr. Kossler made the motion to approve BA 83-10 with the stipulation that the fence be constructed 2~ feet from the inside edge of the sidewalk. This motion was seconded by Mr. Schubert and the motion carried 5-0 with the following vote recorded: Kossler, yea, Schubert, yea, Erck, yea, Fenimore, yea, and Roseberry, yea. . ~ Page 9 Z B A Minutes July 21, 1983 . BA 83-11 APPROVED Mr. Kossler made the motion to approve BA 83-11 with the stipulation that the fence be constructed 2~ feet from the inside edge of the sidewalk and as shown in the diagram. This motion was seconded by Mr. Erck and the motion carried 5-0 with the following vote recorded: Kossler, yea, Erck, yea, Fenimore, yea, Schubert, yea, and Roseberry, yea. BA 83-12 APPROVED Mr. Kossler made the motion to approve BA 83-12 with the stipulation that the fence be constructed 2~ feet from the inside edge of the sidewalk. This motion was seconded by Mr. Schubert and the motion carried 5-0 with the following vote recorded: Kossler, yea, Schubert, yea, Erck, yea, Fenimore, yea, and Roseberry, yea. OLD BUSINESS Chairman Roseberry stated he was contacted by Councilman Newman who said this Board's letter to the council was discussed in a pre-council meeting and the City Council wishes to commend this Board for their efforts and hopefully this bad newspaper reports will not happen again. . Mr. Kossler asked Mrs. Calvert how the new proposed Zoning Ordinance was coming along. Mr. Calvert stated there is a worksession scheduled with Planning and Zoning and the City Council for August 1st. She said after that meeting, if there are not many changes, then they will decide when they will set the dates for the Public Hearings.
