MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
AUGUST 11, 1983 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, Jack Roseberry, at 7:05 P.M.

APPOINTMENT OF ZBA SECRETARY
Mr. Fenimore made the motion to
appoint Mr. Erck as secretary. This
motion was seconded by Mr. Kossler and
the motion carried 3-0.

CONSIDERATION OF THE MINUTES
OF JULY 21, 1983
Mr. Erck made the motion to approve
the minutes as written. This motion
was seconded by Mr. Fenimore and the
motion carried 4-0 with the following
vote recorded: Erck, yea, Fenimore,
yea, Kossler, yea, and Roseberry, yea.
NEW BUSINESS
1.
BA 83-13
Request of Jerry M. Ellis to vary from
the Zoning Ordinance #179 on Lot 10,
Block 46, Richland Terrace Addition,
to be allowed to build a fence beyond
the building line and join it with an
existing fence at his back property
line. This property is located at
5100 Abby Road.
Mr. Ellis came forward. He said he
had just bought this property and he
needs to put up a fence. Mr. Ellis
said the house to the east of him
already has a fence out to the
property line.

Mr. Ellis said this is a corner lot
and his bedrooms and air conditioner
are on the side next to Maplewood
which is a very busy street.

Chairman Roseberry asked Mr. Rice what
the building line was on Maplewood.
Mr. Rice said it was 15 feet.
Mr. Fenimore asked Mr. Ellis why he
made a jog in the fence.
Mr. Ellis said there was a telephone
terminal there so he made the jog in
the fence so they would not have to
come inside the fence.
Mr. Erck asked how far the fence would
be from the curb.
Mr. Ellis said he had not measured it,
but he wanted his fence the same
distance from the curb as the one to
the east of him. He said it looked
like it would be about 7 feet.

Mr. Rice said Mr. Ellis's request is
the same as the ones the Board
approved last month along Maplewood.
Mr. Fenimore asked how close to the
house would he agree to putting the
fence.
Mr. Ellis said he would like to have
at least enough space to put a gate.
Mr. Fenimore asked how this house got
finaled without putting in a sidewalk.
Mr. Rice said it was just an
oversight.
Mr. Fenimore asked if there was any
way the city could force the builder
to put the sidewalk in now.
Mr. Rice said there was no way the
city could force the builder to put it
in now, but the city could require the
property owner to put the sidewalk in
before a permit is issued for a fence
or any kind of construction or
remodeling on the property.

Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
There being no one wishing to speak,
the Chairman called for those wishing
to speak in opposition to this request
to please come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Mr. Erck asked if there had been any
correspondence.
Mrs. Calvert said there had been no
correspondence.
BA 83-13
APPROVED
Mr. Kossler made the motion to approve
BA 83-13 with the stipulation that the
fence be set 7~ feet back from the
curb. This motion was seconded by Mr.
Erck and the motion carried with the
following vote recorded: Kossler,
yea, Erck, yea, Fenimore, yea, and
Roseberry, yea.

BA 83-14
Request of Better Living Corporation
to vary from the Zoning Ordinance #179
on Lot 19, Block 2, Windcrest
Addition, to allow house to be built
beyond the front building line. This
property is located at 7013 Daleview
Trail.
Mark Carter with Better Living came
forward. He said this house is on a
cuI de sac and the garage extends
approximately 4 feet over the front
building line.
Chairman Roseberry asked if they were
building other homes in this area.
Mr. Carter said they were building
several homes in this area.

Chairman Roseberry asked if they were
being more careful since this
happened.

Mr. Carter said they were.
Mr. Fenimore said this can happen very
easily on a cuI de sac.
Mr. Rice said the city has started
requiring a "stake-out" inspection now
to try to keep this from happening
anymore. He said this "stake-out"
inspection is done before they pour
the concrete and the city requires
them to show the radius.
Chairman Roseberry opened the Public
Hearing and called for those wishing
to speak in favor of this request to
please come forward.
There being no one wishing to speak in
favor of this request, the Chairman
called for those wishing to speak in
opposition to this request to please
come forward.
There being no one wishing to speak,
the Chairman closed the Public
Hearing.
Chairman Roseberry asked if there had
been any correspondence.
Mrs. Calvert said there had not been
any received.
Mr. Erck asked Mr. Rice if they had
enough sideyard.
Mr. Rice said they did, they only need
6 feet.
Mr. Erck made the motion to approve
BA 83-14. This motion was seconded by
Mr. Fenimore and the motion carried
4-0 with the following vote recorded:
Erck, yea, Fenimore, yea, Kossler,
yea, and Roseberry, yea.
