MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, FEBRUARY 25, 1982 CALL TO ORDER The Chairman, Carl Greenfield, called the meeting to order at 7:40 P. M. ROLL CALL PRESENT: CHAIRMAN SECRETARY MEMBERS COUNCILWOMAN DIRECTOR OF DEVELOPMENT P & Z COORDINATOR Carl Greenfield Marjorie Nash Don Bowen George Tucker Mark Hannon Sharyl Groves Allen Bronstad Wanda Calvert CONSIDERATION OF THE MINUTES OF JANUARY 28, 1982 Mr. Bowen moved, seconded by Mrs. Nash, to approve the minutes as written. This motion carried 4-0 with Mr. Hannon abstaining since he was not present at the meeting. . 1. PS 81-53 POSTPONED 2. PS 82-1 Request of Cambridge Companies, Inc. for final plat of Lots 3 & 4, Block 1, Northpark Plaza Addition, Phase 2. The Chairman stated that Cambridge Co. Inc. had requested this be postponed. Request of Nance Hodge for replat of Lot llR, Block 1, Crestwood Estates. Delbert Stembridge, Consulting Engineer, came forward to represent Mr. Hodge in his request. Mr. Stembridge said Mr. Hodge had been in previously to plat this lot into two lots so he could build a duplex, but he found the terrain was such that he could not build the duplex as planned. He said he now wishes to plat it back into one lot so he can build a single family home. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this replat to please come forward. . ~ Page 2 P & Z Minutes February 25, 1982 . There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PS 82-1 APPROVED Mrs. Nash moved to approve PS 82-1. This motion was seconded by Mr. Tucker and the motion carried 5-0. 3. PS 82-4 Request of Dyna-Co Development Co. for final plat of Lot 1, Block 6, Snow Heights North Addition. Delbert Stembridge, Consulting Engineer, came forward to represent Dyna-Co. in their request. Mr. Stembridge said he had submitted the construction plans to the City Engineer and had made the necessary corrections. . PS 82-4 APPROVED Mr. Bowen moved to approve PS 82-4 subject to the Engineer1s comments. This motion was seconded by Mr. Tucker and the motion carried 5-0. 4. PZ 81-45 Request of Nassar Shafipour to rezone Tracts B1A & 18B, Abstract 1606, W. W. Wallace Survey, from their present classification of Local Retail to a proposed classification of Commercial- Specific Use-Office Building and/or Apartments. This property is located on the east side of Davis Blvd. and is bounded on the east by Irish Meadows. . Delbert Stembridge, Consulting Engineer, came forward. He said this case was tabled at the last meeting and he has nothing further to present. Mr. Stembridge said he understood the Commission was going to take this under advisement and study it more. Mrs. Nash said this case must be lifted from table position. ~ Page 3 P &Z Mi,n,utes, February 25, 1982 . Mr. Tucker moved, seconded by Mrs. Nash, to lift this case from the table. The motion carried 5-0. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Mr. Stembridge said he was requesting approval of this request. There being no one else wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. . Mr. Tucker said it was up to the Commission members to look at this request to see if the present zoning of Local Retail was not the proper zoning. He said his fèèlings, after studying and going by and looking at this property several times, was that no real case had been made for the need to change the zoning. Mr. Stembridge said the only reason for the zoning change was to be allowed to construct a building higher than the Local Retail would allow. Mr. Tucker said there are two reasons for a zoning change: the zoning is outdated and the property is not being developed because it does not have the proper zoning or the owner by the present zoning is not being able to use his property. He said they needed to be convinced that the Local Retail zoning with its limitations is not the correct zoning for this property, especially since it has some residential behind it. Mr. Tucker said the height would interfere with the privacy of some of the residents. PZ 81-45 DENIED Mr. Tucker moved to deny PZ 81-45. . This motion was seconded by Mr. Hannon and the motion carried 5-0 for denial. ~ Page 4 P & Z Minutes February 25, 1982 . 5. PS 81-64 Request of Nassar Shafipour for preliminary plat of Lots 1 & 2, Block 2, and Blocks 3 and 4, Red Gate Addition. Delbert Stembridge came forward. He said he would like for the Commission to go ahead and act on this preliminary plat even though the zoning was denied. Mr. Stembridge said the preliminary engineering would not change much. Mr. Hannon asked if the set backs, easements, etc. would be the same as for Commercial zoning. PS 81-64 APPROVED Mr. Stembridge said the lots would be the same and what corrections that needed to be made could be made on the final plat. Mr. Tucker moved to approve PS 81-64 subject to the Engineer's comments and at final platting that the regulations dealing with set backs, etc. be adjusted to meet the Local Retail zoning. This motion was seconded by Mr. Hannon and the motion carried 5-0. . 6. PZ 82-1 CANCELLED Request of Fotomat Corp. to rezone a portion of Lot 2, Block 1, Northpark Plaza, 3rd Section, from its present classification of Local Retail to a proposed classification of Local Retail-Specific Use-Fotomat. This property is located approximately 123 feet east of Rufe Snow Drive and 97 feet north of Watauga Road. Michael Land came forward to represent Fotomat in their request. The Chairman stated the Commission had discussed this matter and felt this request for a Specific Use zoning is not needed and their money would be refunded. 7. PZ 82-2 Request of TLB-GSC Enterprises, Inc. to rezone Tracts 2 & 3A, Abstract 1753, J. C. Yates Survey, Tract 2, Abstract 1891, D. H. Hightower Survey, and Tract 2F, Abstract 366, w. W. Cook Survey, from their present classi- fication of 1F-9-0ne Family Dwelling to a proposed classification of Multiple Family. . Page 5 P & Z Minutes February 25, 1982 . This property is located northwest of the Fort Worth Christian School and is parallel to the St. Louis and South- western Railroad. Theron Bonham, 1625 Weyland, came forward. He said they were requesting this zoning change to be allowed to build duplexes, quadroplexes, and sixplexes. Mr. Bonham said this buffer of heavier density would be bounded by Fort Worth Christian, the railroad tracts, and industrial zoning. Mr. Bonham stated the channel they built handles the drainage beautifully, but on Bogart Street there was considerable flood- ing last fall. Mr. Bonham stated they had donated land for the city to grade out a drainage. He said he had discussed the drainage of this piece of property with the Corp of Engineers and they said their drainage ditch would handle the water. Mr. Tucker asked how many units there would be per acre. . Mr. Bonham said it probably wouldn't stand more than 10. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. PZ 82-2 APPROVED There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Bowen moved to approve PZ 82-2. This motion was seconded by Mr. Tucker and the motion carried 5-0. 8. PZ 82-3 Request of The Cambridge Companies, Inc. and Crossroads Development, Ltd. to rezone Blocks 2 & 3, Snow Heights North Addition, and Tracts 2B4, 20, & a portion of Tract 2A, Abstract 1606, W. W. Wallace Survey, from their present classification of Local Retail . Page 6 P & Z Minutes February 25, 1982 . . PZ 82-3 APPROVED 9. PZ 82-4 . ~ to a proposed classification of Commercial. This property is located on the north side of N. E. Loop 820, bounded on the east by Reynolds Drive, and is parallel to the T.E.S.C.O. right-of-way. Neil Cukerbaum came forward to represent The Cambridge Companies, Inc. in their request. He said they have 12 acres for a shopping center and they want to expand the retail from 12 acres to 18 acres. Mr. Cukerbaum said they want to have hotel- motel and mixed office use with one story and multi story. He said they would tie the property together with roads. Mr. Cukerbaum said the reason for the zoning change was the two story limitation in Local Retail zoning. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Hannon moved to approve PZ 82-3 This motion was seconded by Mr. Bowen and the motion carried 5-0. Request of Burk Collins and Tommy Lok Chinese Restaurant to rezone a portion of Lot 3RB, Block 25, Clearview Addition, from its present classification of Local Retail to a proposed classification of Local Retail-Specific Use-Sale of Alcoholic Beverages. This property is located on Grapevine Hwy. just north of North Hills Animal Clinic. Burk Collins came forward. He said he was requesting this Specific Use for a Chinese Restaurant. ~ Page 7 P & Z Minutes February 25, 1982 . Mr. Collins said restaurants adjacent to him already have the Specific Use zoning. Mr. Collins said Mr. Lok has had a Chinese restaurant in Arlington for 5 years and they feel this restaurant would be an asset to the City. He said he has Mr. Lok here if there are any questions. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. . PZ 82-4 APPROVED Dr. Thomas Duer, 7312 Londonderry, came forward. He said he came in support of this request. The Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Tucker moved to approve PZ 82-4. This motion was seconded by Mr. Bowen and the motion carried 5-0. 10. PZ 82-5 Request of Burk Collins and Mama's Pizza, Inc. to rezone a portion of Lot 3RB, Block 25, Clearview Addition, from its present classification of Local Retail to a proposed classification of Local Retail- Specific Use-Sale of Alcoholic Beverages. This property is located on Grapevine Hwy. just north of North Hills Animal Clinic. Burk Collins came forward. He said Mama's Pizza is a 22 restaurant chain and he has their representative, Nelson Rhine, here if there are any questions. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Dr. Thomas Duer came forward. There being no one wishing to speak, the Chairman closed the Public Hearing. PZ 82-5 APPROVED Mr. Hannon moved to approve PZ 82-5. This motion was seconded by Mr. Tucker. Mrs. Nash asked who the Specific Use was to be to. Mr. Collins said IIChris Farkasll. The motion carried 5-0. ADJOURNMENT The meeting adjourned at 8:15 P.
