MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
AUGUST 26, 1982 - 7:30 P. M.

The meeting was called to order by the
Chairman, George Tucker, at 7:30 P. M.

CONSIDERATION OF THE MINUTES
OF JULY 22, 1982
Ms. Nash moved to approve the minutes
as written.

This motion was seconded by Mr. Tucker
and the motion carried 2-0 with Mr.
Bowen & Mr. Wood abstaining since they
were not present at the meeting.

Request of Lyle Cherry for preliminary
plat of Lot 9, Block 7, Clearview Addn.
Request of Lyle Cherry for final plat
of Lot 9, Block 7, Clearview Addition.

PS 82-24
The Chairman stated that the Commission
has a question regarding the zoning on
these two requests. He said the property
shows to be zoned Commercial-Specific Use
and the Specific Use cannot be transferred.
Mr. Tucker said the file regarding the
zoning is locked in the vault. He said if
the Commission hears these, it would be an
injustice.

Ms. Nash made the motion to postpone
PS 82-24 until a clarification of the
zoning is made.
This motion was seconded by Mr. Bowen
and the motion carried 4-0.
Request of L. E. Sattawhite for
preliminary plat of Lots 1 & 2, Block
14, Glenann Addition.
Request of Lena Silay for final plat
of Lot 1, Block 14, Glenann Addition.
Delbert Stembridge, Consulting Engineer,
came forward to represent Mr. Sattawhite
and Mrs. Silay in their requests.
Mr. Stembridge said the preliminary
request was for Lots 1 & 2 of Block 14,
but the final plat was only for Lot 1.
Mr. Stembridge stated they have complied
w;-th all the City Engineer1s comments.
Ms. Nash made the motion to approve
PS 82-7.
This motion was seconded by Mr. Bowen
and the motion carried 4-0.
Mr. Wood made the motion to approve
PS 82-25~
This motion was seconded by Mr. Bowen
and the motion carried 4-0.
Request of Burk Collins to rezone
Maroaks Addition from its present
classification of IF-9-1600-0ne Family
Dwellings to a proposed classification
of 2F-9-Two Family Dwellings.
This property is located south of
Douglas Lane where Douglas Lane ends its
westerly direction and begins its
northerly direction.
Burk Collins came forward. He said he
is a local developer presently developing
a retail shopping center on Rufe Snow.
Mr. Collins said he was requesting to
build 2100 sq. ft. duplexes.

Mr. Tucker asked what prompted him to
want to change the zoning to duplexes.
Mr. Collins said the economy. He said
there was more demand for duplexes than
single family.
Mr. Tucker asked if he plans to sell
the duplexes.
Mr. Collins said he does. He said he is
presently building some duplexes on
College Circle and Abbott Street which
are the same type as he pl ans for ',1aroaks.
The Chairman opened the Public Hearing
and called for those wishing to speak in
favor of this request to please come
forward.
There being no one wishing to speak in
favor of this request, the Chairman called
for those wishing to speak in opposition
to this request to please come forward.

Marvin Smith, 7609 Douglas Lane, came
forward. He said he has lived on this
street for 35 years. He said he was
representing himself and his father.
Mr.. Smith said he was not totally opposed
to this request. He said they are not
opposed to duplexes, but they do not want
duplexes on Lots 9 through 15 of Block 3 .
Mr. Smith said he owns 20 acres on the
other side of these lots and he plans to
build some 4000 or 5000 sq~ ft~ homes.
He said he feels they need a little
cushion between the duplexes and his
property. Mr. Smith said his home is
just about 600 feet from this property and
he plans to build 2 or 3 more large homes.
Mr. Smith said the 2100 sq~ ft~ duplexes
would only be 1250 sq. ft. per side. He
said people do not keep duplexes up and
there is always trash everywhere.

Mr. Smith said he is definitely opposed
to duplexes on Lots 9 through 15, Block 3,

Mr. Smith said when he had this property
zoned, he planned to build 1600 sq. ft.
homes, but with the economy the way it
was, he sold it.
Mr. Smith asked if there was a require-
ment for duplexes to have carports or
garages.
Mrs. Calvert said there was not.
Mr. Wood asked if there was any.duplex
zoning in this area.
Mr. Tucker said there was not.
Mr. Tucker asked Mr. Collins if he saw
any problem with using Lots 9 through 15
for a buffer.

Mr. Collins said he could make a buffer,
but he did not see the difference in
1600 sq. ft. houses and 2100 sq. ft.
duplexes.
Mr. Bowen said the City Engineer made a
comment in his letter regarding this area
being located in the watershed which
drains through Morgan Meadows Addition,
and that the City Council had denied
development in Foster Village, Section 11~
which is adjacent to this property, until
such time that the drainage problem in
Morgan ~eadows is resolved. He said he
knew this information pertains to platting
and not zoning, but since this property is
already platted, he felt this should be
mentioned.
Mr. Bronstad said this area would drain to
Windcrest Addition and Windcrest Addition
to Morgan Meadows Addition.
Mr. Bowen said he felt this should be
checked into.
Mr. Tucker said this is a zoning request,
not platting.

Doug Long, Consulting Engineer, came
forward. He said he had a report from the

City Engineer regarding an August, 1980
meeting which Mr. Smith, Jim Harris
with Foster Village, and several others
attended. He said the report stated
they were meeting with haste to correct
this channel.
Mr. Long said he did not know this
addition was shut down. He said he knew
the city has been doing work in Morgan
Meadows.
Mr. Long said they might come back with
a replat of this area for single family
attached.
Mr. Tucker asked Mr. Collins if ~e plans
to sell each side to different owners.
Mr. Collins said he plans to sell the
whole duplex.

Mr. Collins asked when this ban on
development in this area was made. He
said he bought this property with the
idea it was ready to be developed.
Mr. Tucker asked Mrs. Calvert if she
knew about this.
Mrs. Calvert said she was not sure just
what the date was, but she could find
out for him.
Mr. Smith said he went to a meeting with
the City Manager, Jim Harris.with Foster
Village, Doug Long, and Allen Bronstad,
but was never told he could not develop
this property. He said he and Jim Harris
agreed to cut a ditch down to Chapman
Road. Mr. Smith said the city was going
to start immediately to get the needed
easements. He said he and Jim Harris
were willing to participate. He said the
City Engineer said it would cost about
$100,000, but they thought they could dig
it for about $25,000.

Mr. Smith said that was the last he ever
heard of it, but he was never told he
could not develop this property. He said

there was talk of holding up the Foster
Village development.
Mr. Tucker said he did not know if there was
a hold on development on this property,
but felt the Commission should go ahead
and act on this request.
The Chairman called for anyone else wish-
ing to speak to please come forward'.
There being no one wishing to speak, the
Chairman closed the Public Hearing.

APPROV ED
Mr. Wood made the motion to approve
PZ 82-21 with the exception of Lots 9
through 15, Block 3.
This motion was seconded by Mr. Bowen
and the motion carried 4-0.

PZ 82-22
Request of Herman Smith, Stonybrooke,
Inc., to rezone a portion of Tract A,
Block 13, Stonybrooke Addition, from its
present classification of Commercial to
a proposed classification of IF-9-1300-
One Family Dwellings.
This property is located approximately
150 feet east of Davis Blvd., approximately
250 feet south of Hightower Drive, and
bounded on the south by Brookhaven Drive.

Doug Long, Consulting Engineer, came
forward to represent Herman Smith in his
request.
Mr. Long said this tract is presently
zoned Commercial and they want to cut off
the west portion. He said he has a
gentleman who is building in the area and
needs more lots.
The Chairman opened the Public Hearing and
called for those wishing to speak in favor
of this request to please come forward.

Gail Geserick, 8400 Brookhaven Drive, came
forward. She said they were very anxious
for this development to go through.
H. S. Callicott, 8404 Brookhaven Drive,
came forward. He said he lives straight

across from this property and he sure
gets tired of all the johnson grass. He
said he was in favor of this request.
The Chairman called for those wishing to
speak in opposition to this request to
please come forward.
There being no one wishing to speak, the
Chairman closed the Public Hearing.

APPROVED
Ms. Nash made the motion to approve
PZ 82-22 as requested.
This motion was seconded by Mr. Bowen
and the motion carried 4-0.

PS 82-23
Request of Herman Smith, Stonybrooke, Inc.,
for preliminary plat of Lots 7 through 12
and Tract A-R, Block 13, Stonybrooke Addn.

Owen D. Long, Consulting Engineer, came
forward. He said he received the City
Engineerls letter and he had submitted
his response to it. Mr. Long said there
are always problems with the depth of a
lot in a cul de sac. He said you have trouble
meeting the requirement of the Subdivision
Ordinance, Page 97. Mr. Long said they
show a mean depth of 111 feet. He said he
has drawn house plans and you can put a
house on this lot.
Mr. Long said the City Engineer draws a
circle and tries to fit it in the lot.
Mr. Long said its just how you interpet
the Ordinance.
Mr. Long said they agree to pay the pro
rata and item #5, the Engineer misread
the plans. He said there was a stub out
shown. Mr. Long said right now it will
go through those back yards, but there
was a stub out for use when the Commercial
property is developed.
Mr. Tucker asked Mr. Bronstad if he could
see any problem with that lot. He said it
meets the square footage requirement.

Ms. Nash made the motion to approve
PS 82-23.
This motion was seconded by Mr. Wood
and the motion carried 4-0.

PZ 82-23
Request of T. W. Alley, Sr. to rezone
a portion of Lot 2, Block 4,
University Plaza Addition, from its
present classification of Local Retail
to a proposed classification of Commercial-
Specific Use-Multi-Story Office Building
and Restaurant.
This property is located on the east side
of Weyland Drive, bounded on the north by
University Plaza Apartments and on the
south by Bank of North Texas and Airport
Freeway.

Gary Teague, Consulting Engineer, came
forward to represent Mr. Alley. He said
when they previously came before this
Board he did not know the owner planned
a restaurant on this site. Mr. Teague
said the council recommended they come
back before the Commission for a Specific
Use zoning for a multi-story office
building and restaurant on this site.
Mr. Tucker asked what type of restaurant
they plan to have and where will it be
located.
Mr. Teague said the office building will
be located on the northeast portion of
this property with access off Weyland
Drive, and the restaurant will be on the
southeast portion. He said the owner has
not made a contract with anyone for the
restaurant so he is not sure if it will
be Steak & Ale, Denneys or just what.
The Chairman opened the Public Hearing
and called for those wishing to speak in

Mr. Wood made the motion to approve
PZ 82-23 as requested.
This motion was seconded by Mr. Bowen
and the motion carried 4-0.
ADJOURNMENT
The Chairman stated that on items 1 & 2
he would like to request the City Council
see if there has been a violation of the
State Law in platting only a portion of
a lot~ He asked if Councilman Davis
would get a ruling from the City Attorney
on this and also the status of the zoning
on this property.
The meeting adjourned at 8:25 P. M.
