MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
OCTOBER 28, 1982 - 7:30 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, George Tucker, at 7:30 P. M.

CONSIDERATION OF THE MINUTES
OF SEPTEMBER 23, 1982
Mr. Hannon said there should be a
correction made on page 10, paragraph 3,
change II i ntegri tyll to II obsc uri tyll .
Mr. Hannon made a motion to approve the
minutes with this one correction.

This motion was seconded by Mr. Bowen and
the motion carried 5-0.
The Chairman stated that Agenda item #10,
PZ 82-27, has been withdrawn.

PS 82-33
POSTPONED 9-23-82
Request of Alfred A. St. Arnold for replat
of Lot 1-R, Calloway Acres Addition.
The Chairman stated this request was post-
poned last month in order for this Commission
to get a legal opinion. He stated the
Commission received the legal opinion and
will now act on this request.
PS 82-33
APPROVED
Ms. Nash made a motion to approve PS 82-33
as requested.
This motion was seconded by Mr. Wood and
the motion carried 5-0.

PS 82-43
Request of Richard G. Argeris for replat of
Lot lR, Block 4, Morgan Meadows Addition.

James Schwend with Stembridge Engineers came
forward to represent Mr. Argeris. He said
they had received the City Engineer's comments
and take no exception to them.

The Chairman said since this was a replat
in single family zoning, there must be a
Public Hearing.
The Chairman opened the Public Hearing and
called for those wishing to speak in favor
of this replat to come forward.
There being no one wishing to speak, the
Chairman called for those wishing to speak
in opposition to this request to please
come forward.
William Bell, 6825 Meadow Creek Road, came
forward. He said he did not understand why
they were platting two lots into one lot.
Mr. Tucker said you cannot build over a
lot line. He said they want to build a
large house which would extend over the lot
line.
Mr. Bell said he had no objections to this.

APPROV ED
There being no one else wishing to speak,
the Chairman closed the Public Hearing.
Mr. Bowen made a motion to approve PS 82-43
subject to the EngineerHs comments.

This motion was seconded by Mr. Wood and the
motion carried 5-0.
The Chairman stated the Commission would hear
items 3 through 7 together and would have a
Public Hearing on them since they are replats
in single family and duplex zoning.
3. PS 82-46 Request of Northeast Construction Co. for
replat of Holiday West, Section 3-A.
4. PS 82-47 Request of Northeast Construction Co. for
replat of Holiday West, Section 4.
5. PS 82-48 Request of Northeast Construction Co. for
replat of Holiday West, Section 5.
6. PS 82-49 Request of ~ortheast Construction Co. for
replat of Holiday West, Section 6.

Terry Sisk, Northeast Construction Co.,
came forward. He said they needed to
divide Section 3 of Holiday West into 5
sections so they had to replat.
Mr. Bowen asked of they agree to the City
Engineer's comments.
Mr. Sisk said they did and in Section #7,
which are duplex lots, they have split the
lots so they can sell each side of the
duplexes to individual owners.
The Chairman opened the Public Hearing and
called for those wishing to speak in favor
of these replats to please come forward.
There being no one wishing to speak, the
Chairman called for those wj'shing to speak
in opposition to please come forward.
Doyle Morrow came forward. He asked if they
plan to reduce the size of the houses.

Mr. Tucker said they were not, that they are
not changing the zoning.
The Chairman closed the Public Hearing.
Mr. Hannon made a motion to approve PS 82-46,
PS 82-47, PS 82-48, PS 82-49, and PS 82-50
subject to the City Engineer1s comments.
This motion was seconded by Mr. Wood and the
motion carried 5-0.

Request of Hospital Corp. of America for
preliminary plat of Lot 1, Block E,
Calloway Farm Addition.
Roy Dale, Tucker Assoc., came forward to
represent the hospital. He said they had
received the Engineer's comments.

Mr. Bowen asked if they agreed to comment
#6 regarding the paying of pro rata.
Mr. Dale said he believed any fees would
have to be taken care of with the final plat.
Mr. Tucker asked if they plan to submit a
drainage plan on this property.

Mr. Dale said they have redone the 100 year
flood study and will present it with the
final plat. He said only a portion of this
property is in the flood plain, and they are
not sure what they plan to do with it, but
feel they have done all that needs to be
done at this time. Mr. Dale said any
improvements done outside the floodway
boundry would not improve the flood stream.
Mr. Hannon said our ordinance requires a
drainage study.
Mr. Dale said he had done a study on the
100 year flow with no improvements to the
channel. He said any improvements would
decrease the flow.

Mr. Dale showed the study to Mr. Hannon.
Mr. Riddle said the city would need construction
plans consisting of the drainage study and
water and sewer layout before submitting a
final plat.
Mr. Dale said they feel they should wait
until this portion of the land is developed.
Mr. Riddle said it is a part of this plat and
our ordinance states it is required.

APPROV ED
Mr. Dale said he would furnish one to the city.
Mr. Wood made a motion to approve PS 82-52
subject to the Engineer's comments and subject
to receiviong drainage plans to satisfy the
City Staff and City Engineer.
This motion was seconded by Ms. Nash, and the
motion carried 5-0.
9.
PZ 82-26
Request of Lynda Word to rezone Lot 8, Block
7, Clearview Addition, from its present
classification of IF-9-0ne Family Dwelling to
a proposed classification of 1F-9-Specific
Use-Nursery School.
This property is located at 7817 Maplewood.

Tim O'Neil came forward to represent Ms. Word
and Mr. & Mrs. Dollar. He said they in no way
want to waive their rights to the variance

that was granted in 1965. Mr. O'Neil
said they feel they were covered by this
variance, but were told by the City Staff
they needed a zoning change.
Mr. Tucker said he did not feel the
Commission could hear this request under
these circumstances.
Mr. O'Neil said it is not the intention
of his clients to go to court, he said they
want a Specific Use permit, but if they do
not get it, they want to keep the variance.
Mr. O'Neil said their attorney says they
have the variance, the minutes of the
Zoning Board of Adjustment meeting shows
the variance was granted.
PZ 82-26
POSTPONED
Mr. Hannon made a motion to postpone PZ 82-26
until they can get an opinion from the City
Attorney regarding this matter.
This motion was seconded by Ms. Nash and
the motion carried 5-0.

Wayne Goodman, 7825 Maplewood Drive, came
forward. He said Lynda Word owns this
property now, not the Dollars. He said he
checked the Courthouse.
Mr. Goodman said they had complained to the
city for years, but James Anderson was the
only one who tried to do something about it.
We said it is a nuisance to the neighborhood.
He said it is a business, not a 1F-9-0ne
Family residence.
Mr. Goodman said they keep too many kids in
that 1600 or 1700 sq. ft. house. He said
the traffic is terrible, they block his drive-
way and turn around in his yard. Mr. Goodman
said about a week ago, a car almost hit his
little grandson who was playing in his yard.

Mr. Goodman said the variance was granted
temporarily:to the Haleys who requested to
keep 5 children in their home.
Mr. Goodman said they have had several
meetings, trying to get this business dis-
continued.

ADJOURNMENT
Mr. Goodman said the last meeting they had,
they talked to the City Attorney who stated
there had been several citations issued
because it was non-conforming and stating
they would take legal action of they did
not cease to have a business there.
Jo Ann Williams, 7900 Maplewood, came
forward. She asked if the variance was
granted to the Haleys or to the property.
Mr. Tucker said the City Attorney would have
to answer that, and if this request comes
back for a hearing, the neighbors will have
a chance to speak.
Request of William Garrison to rezone
Tracts 3B1B, 3B1B1, 3B1C, 3B6, 3B5A, 3B5,
3B2, 3BA1, 3B2Bl, & 3B, Abstract 1055, T. K.
Martin Survey, from their present classification
of 1F-9-1500-0ne Family Dwellings to a proposed
classification of Multiple Family.
This property is bounded on the west by Crane
Road, on the east by Precinct Line Road, and is
just north of the intersection of Main Street
and Crane Road.
The Chairman stated this request was
withdrawn.
The meeting adjourned at 8:25 P. M.
