CALL TO ORDER Dr. E. K. Hahn, Acting Chairman, called the meeting to order at 7:07 P. M. ROLL CALL PRESENT: Dr. E. K. Hahn Jack Roseberry Marie Hinkle Martin Erck Bill Rice Wanda Calvert BUILDING OFFICIAL P & Z COORDINATOR ABSENT: H. B. Helton Jesse Range CONSIDERATION OF THE MINUTES OF DECEMBER 10, 1981 Mr. Roseberry moved, seconded by Mr. Erck, to approve the minutes as written. This motion carried 3-0 with the following vote recorded: Roseberry, yea, Hahn, yea, and Erck, yea. Mrs. Hinkle abstained since she was not present for the meeting. . NEW BUSINESS BA 82-1 APPROVED Request of David C. Lambert to vary from the Zoning Ordi'nance #179 on Lot 7, Block 44, Richland Terrace Addition, to be allowed to erect a fence beyond the side building line. This property is located at 7525 Schiller Drive. Mr. Lambert came forward. He said he had just recently bought this property and he said he bought it because it was a corner lot so he would have a large back yard. . Mr. Lambert said he had some fence companies come out and give him an estimate on putting up a fence. He said they told him he would have to have a permit and there were some restrictions. Mr. Lambert said had he known there were restrictions, he would not have bought a corner lot. Mr~ Lambert said if he puts the fence on the building line, it would cut off 1/3 of his yarde ~ Page 2 Z B A Minutes February 11, 1982 . Mr. Roseberry asked if he wanted to put the fence on the property line-l0 feet from the curb. Mr. Lambert said that was correct. Mr. Roseberry asked if he had considered that this might be a traffic hazard. Mr. Lambert said he did not feel it would be a traffic hazard. Mr. Roseberry said it looked like if he backed out his driveway, his car would have to be almost in the street before he could see on comming cars from Abby Street. Mr. Lambert said he had not considered that. Dr. Hahn asked Mr. Lambert if he would consider moving the fence to the back corner of the house. Mr. Lambert said he would. . Mrs. Hinkle asked what type of fence this would be. Mr. Lambert said it would be a stockade fence. Mr. Erck asked what height it would be. Mr. Lambert said it would be of standard height. Dr. Hahn asked Mr. Rice what his feelings were regarding thi"s request. Mr. Rice said he did not see any problems. Dr. Hahn mentioned that there was no one present to contest this request. Dr. Hahn said he would request that Mr. Lambert move the fence to the rear of the house to give extra sight. . Mr. Roseberry said when a house is built next door to Mr. Lambert, the fence might bother them. . . . Page 3 Z B A Minutes February 11, 1982 ADJOURNMENT ~ Mrs. Hinkle said it would not because it would be their back yard. Mrs. Hinkle moved, seconded by Mr. Erck, to approve SA 82-1 with the stipulation that the fence be moved back to the back edge of the house. This motion carried 4-0 and the following vote was recorded: Hinkle, yea, Erck, yea, Hahn, yea, and Roseberry, yea. The meeting adjourned at 7:20 P.
