CALL TO ORDER ROLL CALL The meeting was called to order by the Acting Chairman, Dr. E. K. Hahn, at 7:02 P. M. PRESENT: Acting Chairman Secretary Member Alt. Members Dr. E. K. Hahn Jack Roseberry Jesse Range Martin Erck Bill Stimmel ABSENT: Chairman Member - Resigned H. B. Helton Marie Hinkle CITY STAFF PRESENT: Dir. of Development P & Z Coordinator Allen Bronstad Wanda Calvert . CONSIDERATION OF THE MINUTES OF FEBRUARY 11, 1982 Mr. Roseberry moved, seconded by Mr. Erck, to approve the minutes as written. This motion carried 3-0 with Jesse Range and Bill Stimmel abstaining since they were not present at that meeting. The recorded vote was: Roseberry, yea, Erck, yea, and Hahn, yea. NEW BUSINESS The Acting Chairman stated that item BA 82-3 had been withdrawn prior to the meeting and would not be heard. BA 82-2 Request of Richard Boyer to vary from the Zoning Ordinance #179 on Lot 4, Block 16, Foster Village Addition, Section 8, to be allowed to build over the 6 ft. side yard requirement and next to a utility easement. This property is located at 6813 Starnes Rd. William H. Smith, Attorney at 729 Bedford Euless Road, came forward to represent Mr. Boyer. He said Mr. Boyer was building an addition onto his house and it became so involved that he hired David Weber, an associate of Fenimore Builders, to do the job. . ~ Page 2 Z B A Minutes April 8, 1982 . David Weber, 541 Greenwood Circle, Hurst, came forward. He said this addition is approximately a foot over the 6 foot building line. Mr. Roseberry asked if they had built over the easement. Mr. Weber said the structure is 5 feet from the side property line. He said it comes out 4 feet from the house. Mr. Roseberry asked if this is a room addition. Mr. Weber said it was a spa room. Mr. Erck asked how much completed is this room. Mr. Weber said approximately 60% finished. Mr. Bronstad asked if he had talked to TESCO and the other utilities about this. . Mr. Weber said they had not. Mr. Range said he felt the easement should be sufficient; if they needed more room, they should have requested a wider easement. Mr. Erck said it looked to him like the fence extends out to the ~ame distance as the spa. Mr. Weber said he was not sure where the fence was. Mr. Range said what Mr. Erck means is it looks like the spa extends out to the property line as the fence does. Mr. Smith said the fence might not enclose the easement. Mr. Erck said if the utility Company had to get in there to work, the fence would also have to come down. . Mr. Roseberry said that TESCO does not own the property. ~ Page 3 Z B A Minutes April 8, 1982 . Mr. Range said he could not find in the Ordinance where it said you had to stay 3 feet back from an easement. Mr. Roseberry said he did not know where it was, but he knew from past experience that the city required you to stay back 3 feet. Mr. Range said he believed that was for an accessory building. Mr. Range asked Mr. Bronstad to check the plat book and see if the property next to this property had an easement, also. . Mr. Bronstad said the plat did not show an easement on this lot nor on_the adjacent lot. He said this easement must have been dedicated after the plat was recorded. The Acting Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Acting Chairman called for those wishing to speak in opposition to this request to please come forward. BA 82-2 APPROVED There being no one wishing to speak, the Acting Chairman closed the Public Hearing. Mr. Range moved to approve BA 82-2. Mr. Roseberry asked Mr. Range if he would amend his motion to state: IIwith the stipulation that the addition not extend into the utility easementll. Mr. Range amended his motion. Mr. Roseberry seconded the motion and the motion carried 5-0 with the following vote recorded: Range, yea, Roseberry, yea, Erck, yea, Hahn, yea, and Stimmel, yea. . The Acting Chairman recognized Councilman Ramsey in the audience. ~ Page 4 Z B A Minutes Apri 1 8, 1982 . SA 82-4 Request of James A. Redmond to vary from the Zoning Ordinance #179 on Lot 7, Block 36, Richland Terrace Addition, to be allowed to build a carport approximately 15 feet beyond the front building line. This property is located at 5108 Karen Dr. Mr. Redmond came forward. He said he had been wanting a carport for a long time. Mr. Redmond said he likes to fool around tinkering on lawn mowers and cars. He said he has a lot of junk in his garage and has no room there. Dr. Hahn asked if he had contaoted anyone about building this for him. Mr. Redmond said he had talked to Mason Awning Company. He showed the Board some literature of how it would look. . Mr. Roseberry asked if the carport would be open. Mr. Redmond said it would be. Mr. Range said Mr. Redmond would still have 20 feet from the carport to the curb, enough room to park one vehicle outside the carport. Mr. Range said he could not see a visual problem. Mr. Redmond said his garage sets back further than the others on the street. Dr. Hahn asked if it would be aluminium. Mr. Redmond said it would be, and the steel posts would set right outside the edge of the driveway. He said it would be 18~ ft. by 20 ft. Mr. Erck asked how many carports there were in the area. . . . . Page 5 Z B A Minutes April 8, 1982 SA 82-4 APPROVED ADJOURNMENT ~ Mr. Redmond said he did not believe there were any. Mr. Erck asked Mr. Redmond to state again what his reason was for needing a carport. Mr. Redmond said he needeð it to work on lawn mowers and cars. Mr. Erck said he would not want to condone any excessive noise from cars, etc. Mr. Redmond said there would not be any noise. The Acting Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak, the Acting Chairman called for those wishing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. Mr. Stimmel said there was a large mobile home parked there and asked Mr. Redmond if it was his. Mr. Redmond said it was not his. Mr. Roseberry moved to approve SA 82-4 as requested. This motion was seconded by Mr. Stimmel and the motion carried 5-0 with the follow- ing vote recorded: Roseberry, yea, Stimmel, yea, Range, yea, Hahn, yea, and Erck, yea. The meeting adjourned at 7:35 P. M.
