M. CONSIDERATION OF THE MINUTES OF APRIL 8, 1982 . NEW BUSINESS BA 82-5 . The meeting was called to order by the Chairman, H. B. Helton, at 7:05 P. M. PRESENT: H. B. Helton Jack Roseberry Martin Erck Bill Stimmel Alternant ABSENT: Dr. E. K . Ha h n Jesse Range CITY STAFF PRESENT: BUILDING OFFICIAL P & Z COORDINATOR Bill Rice Wanda Calvert Mr. Roseberry moved, seconded by Mr. Stimmel, to approve the minutes as written. This motion carried 3-0 with Mr. Helton abstaining since he was not present at the meeting. Request of Don McCormick to vary from the Zoning Ordinance #179 on Lot 1, Block 10, Foster Village Addition, to be allowed to have a carport beyond the side building line. This property is located at 6701 Starnes. Mr. McCormick came forward. He said he has a carport over his boat and wants to be able to keep it. Mr. McCormick said he did a good job on it and as far as the worry about fire, the carport is metal. Mr. Roseberry asked Mr. Rice about the set-back requirement on a corner lot. Mr. Rice said that on a corner lot you would have to set back behind the building line. He said you have a 6 ft. side yard requirement. ~ Pa ge 2 Z B A Minutes May 6, 1982 . Mr. Helton said this one is over approximately one foot. The Chairman opened the Public Hearing and called for those wishing to speak to please come forward. Ralph Thrasher, 6704 Starnes Road, came forward. He said Mr. McCormick wanted to get his boat off the street and behind his fence. Mr. Thrasher said this makes the neighborhood look neat. He said he was proud to have Mr. McCormick for a neighbor. Jerry Hampton, 6700 Starnes Road, came forward. He said this carport is neat, doesn't show the boat, and it doesn't obstruct any vision. The Chairman asked Mrs. Calvert if there had been any correspondence. Mrs. Calvert said there hadn't been any. . The Chairman closed the Public Hearing. Mr. Stimmel said he drove by and you could not see the boat. Mr. Roseberry said he was still concerned about the side line. Mr. Rice said Mr. McCormick should have been 15 feet away from the house if the carport was not going to be attached to the house. BA 82-5 APPROVED Mr. Erck moved to approve SA 82-5 as requested. This motion was seconded by Mr. Roseberry and the motion carried 4-0 with the following vote recorded: Erck, yea, Helton, yea, Roseberry, yea, and Stimmel, yea. BA 82-6 Request of T. J. Hubbard to vary from the Zoning Ordinance #179 on Lot 3, Block 5, Diamond Loch Addition, to be allowed to build a house without the required 20% rear yard. This property is located at the northeast corner of Suncrest Court and the cul de sac, at the intersection of Castle Combe Place. . Page 3 Z B A Minutes May 6, 1982 . T. J. Hubbard came forward. He said he has to house plans if anyone wants to see them. Mr. Roseberry asked if the house was larger than the lot. Mr. Hubbard said not hardly. Mr. Rice said they lack approximately 800 sq. ft. in the back yard. Mr. Roseberry asked how large the house was. Mr. Hubbard said it was 3398 sq. ft. He said he was selling the lot to Mr. Raney who will build the house for himself. Mr. Erck asked if there were neighbors on both sides of the property. Mr. Hubbard said there were. . The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Ed Briscoe, Developer of Diamond Loch, came forward. He said this is the only lot left to be developed and he has no objections to this request. Mr. Erck asked how long this lot had been vacant. Mr. Hubbard said he bought it in 1975. Mr. Briscoe said that Mr. Raney lives in Paris, Texas and wants to move here and build him a house on this lot. The Chairman called for those wishing to speak in opposition to please come forward. . Woodson M. Schmitter, 6437 Suncrest Drive, came forward. He said his house was north and slightly east of the property in question. He said their lot would be to the rear of this lot. Mr. Schmitter said there are advantages to having a house there, but not that large a house. He said the ~ Page 4 Z B A Minutes May 6, 1982 . patio would be 6 to 8 feet from his house. Mr. Schmitter said the Ordinances are written for a guide line. He said to accomodate one party would harm another. Mr. Schmitter said no house in this area is that large. He said to go to the tax office and make a check. Mr. Schmitter said he was against this large a house. He said a smaller one would be great. Mr. Stimmel asked Mr. Schmitter to show on the plat where his house was located. Mr. Helton said the Board needed to be aware that Mr. Hubbard has the required 6 ft. side yard. Mr. Rice said he does have enough side yard. Mr. Schmitter said the point he wanted to make was if they moved the house closer to the front and to the other side, it would not be so close to him. . Mr. Erck asked Mr. Rice what size the front yard was. Mr. Rice said it couldn't come much further to the front without needing another variance. L. S. Forester, 4513 Castle Combe Place, came forward. He said this house would not affect him, but he didn't see why it had to be such a monstrosity, 33% larger than the other houses in the area. Mr. Forester said Castle Combe was a one-block long street and with the circular drive, it would make it real nice for kids to use as a turn-a-round. He said he has one and they use his for that all the time. . Mr. Forester said we have a Zoning Ordinance for a real purpose. He said the builder should adhere to the Zoning Ordinance instead of the ordinance adhereing to the builder. Mr. Forester said he is against changing zonings anyway. He said he used to own a home on Holiday that backed up to some vacant land. Mr. Forester said they changed to zoning and every morning at 7:00 A. M. there was a marching band next to his back yard. Page 5 Z B A Minutes May 6, 1982 . . . Mr. Forester said he would still like to know why the house has to be so large. He said also there are two beautiful trees that would have to be cut down and he hates to see any trees cut down. Mr. Hubbard said he doesn't see why anyone wouldn't want to have this nice house. He said he could build an "LII shaped house on this lot and build up to 6 ft. of the neighbor's side yards. Mr. Erck asked how many would be living in the house. Mr. Briscoe said there would be only two. Mr. Briscoe said he knows these people and they have designed this home to put their antique furniture in. He said they need large rooms. Mr. Briscoe said their home in Paris has 8500 sq. ft. The Chairman asked Mrs. Calvert if there had been any correspondence. Mrs. Calvert said there had not been any. Mr. Roseberry said the driveway, the 6 ft. side yard, nor the size of the house has anything to do with this variance; only the rear yard. He said the Board has granted several variances for lots on cul de sacs in this area. Mr. Schmitter said you could build a smaller house. Mr. Rice said the Board could give a variance on the front yard requirement which would help if they could move the house to the front. Mr. Roseberry said that would not help the side yard. Mr. Briscoe said it wouldn't hurt the appearance to extend it to the front. Mr. Schmitter said he was not opposed to having a house there, but he thinks they need to talk and make a compromise. ~ Page 6 Z B A Minutes May 6, 1982 . Mr. Erck said he felt there should be a conference. Mr. Roseberry said he did not feel the Board could act on a variance on the front yard, they could only act on the one they have requested. Mr. Stimmel said this is a variance from Ordinance #179 and he felt it would cover any variance. Mr. Helton said he felt they should keep in mind what was requested. The Chairman closed the Public Hearing and called for a motion. Mr. Roseberry moved to approve BA 82-6 as requested. Mr. Erck seconded the motion and Rose- berry, Erck, and Helton all voted yea. . Mr. Stimmel said he would like to see them move the house forward. He said he felt there should be a compromise. Mr. Stimmel said before he votes, he would like to consider a variance to move the house up. He said as it stands, he would have to vote IInoJl, but he would like to see a compromise. Mr. Helton asked Mr. Rice if he saw any problem with moving the house forward. Mr. Rice said he didn't. He said if they moved it forward 5 feet, they would have the required back yard. Mr. Raney said he has a time problem, he has already sold his house in Paris and needs to build now. Mr. Roseberry requested a recess. RECESS BACK TO ORDER The Chairman called a recess at 8:05 P. M. The Chairman called the meeting back to order at 8:35 P. M. with the same members present. . '" ~ Page 7 Z B A Minutes May 6, 1982 . The Chairman said that after the discussion and confusion, he would like the motion made again. BA 82-6 APPROVED Mr. Roseberry said he would like to amend his previous motion. He moved to approve BA 82-6 with the stipulation that they scoot the house to the front and west side building lines as possible. This motion was seconded by Mr. Stimmel. The motion carried 4-0 with the following vote recorded: Roseberry, yea, Stimmel, yea, Erck, yea, and Helton, yea. ADJOURNMENT The meeting adjourned at 8:40 P. M. . .
