CALL TO ORDER The meeting was called to order by the Acting Chairman, Jesse Range, at 7:05 P.M. ROLL CALL PRESENT: ACTING CHAIRMAN SECRETARY MEMBERS COUNCILMAN BUILDING OFFICIAL P & Z COORDINATOR ABSENT: Jesse Range Jack Roseberry E. K. Hahn Martin Erck Harold Newman Bill Rice Wanda Calvert H. B. Helton CONSIDERATION OF THE MINUTES OF MAY 6, 1982 Mr. Roseberry moved, seconded by Mr. Erck, to approve the minutes as written. . The motion carried by a vote of 2-0 with Hahn and Range abstaining since they were not present at the meeting. NEW BUSINESS 1. BA 82-7 Request of Firestone Tire & Rubber Company to vary from the Zoning Ordinance #179 on a portion of Tract A, Richland Plaza Addition, to be allowed to have more than one free-standing sign on the property. This property is located on the northwest side of Grapevine Hwy., between Richland Plaza Drive and Broadway Street. The Acting Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. Ira Noble, Store Manager at 6313 Grapevine Hwy., came forward. . Mr. Noble asked if the ordinance meant one sign per business. He said he wants one sign for their company. Mr. Noble said their store is almost totally unidentifi ed ~ He sa id they want to put up a ~ Page 2 Z B A Minutes June 10, 1982 . 30 ft. pole sign just off the drive to help and assist people in finding their store. Mr. Noble said this will also help the City of NRH in additional revenue. Mr. Noble said he had several pieces of evidence to show. He said the front of the store will have a sign on it and they further intend to renovate the outside and inside of the store. Mr. Noble said they want to have a new image. Mr. Noble showed a picture of the sign they wish to install. Mr. Roseberry said he understood they agreed to move the sign back away from the street. Mr. Noble said they would like to put it at approximately the same distance as the Richland Plaza sign. . Mr. Noble said several stores have moved out of the shopping center and they want to let the people know they are there and are going to stay there. Mr. Range said he felt they did have a unique situation. Mr. Noble said their identification had been gone for about two months. Dr. Hahn asked about the illumination of the sign. Mr. Noble said there would be a timer on the sign and the one on the front of the building will coincide with it. He said it would be off by 11:00 P. M. or earlier if necessary. Dr. Hahn said it should not be left on all night. . The Acting Chairman said since our Zoning Ordinance is so vague, he would like for Mr. Rice to explain why he felt the need for a variance. ......... Page 3 Z B A Minutes June 10, 1982 . Mr. Rice said in Industrial zoning, the new sign ordinance will allow one free- standing sign per business, but in our present Zoning Ordinance on pages 35 and 39, it only allows one per area or sub- division. Mr. Range read from the Zoning Ordinance, Page 105: II Interpretation, Purpose and Conflict-In interpreting and applying the provision of this ordinance, they shall be held to be the minimum requirements for the promotion of the public safety, health, convenience, comfort, prosperity or general welfare. II Mr~ Range said he really could see no objection ~ Mr. Roseberry said he was still concerned about the R.O.W. easement. He said where they have marked for the sign is on the State right-of-way. . Mr. Noble said he was not sure where the property line was. Mr. Rice said they would need to make sure where the property line is. Mr. Erck asked if this sign would be in line with the Richland Plaza sign. Mr. Noble said it would be. Mr. Roseberry said both the plat and pi'cture shows the sign on the R.O.W. Mr. Noble said he had a letter to Ms. Calvert from A~ B. Davis stating the sign would be put within their property boundary. The Acting Chairman called for those wish- ing to speak in opposition to this request to please come forward. There being no one wishing to speak, the Acting Chairman closed the Public Hearing. . . . . Page 4 Z B A Minutes June 10, 1982 SA 82-7 APPROVED Mr. Roseberry moved to approve SA 82-7 as requested with the stipulation that the sign be put within their property boundary. This motion was seconded by Mr. Erck, and the motion carried 4-0 with the following vote recorded: Roseberry, yea, Erck, yea, Hahn, yea, & Range, yea. Mr. Range said he would like to request that in the future, the City Staff would site where the need for the variance is found in the Zoning Ordinance. ADJOURNMENT The meeting adjourned at 7:35 P. M.
