The meeting was called to order by the
Chairman, Jack Roseberry, at 7:10 p.m.

Bill Fenimore made the motion to approve the
minutes as written. This motion was seconded
by Harold Schubert and the motion carried
4-0 with the following vote recorded:
Fenimore, yea; Schubert, yea; Roseberry, yea;
Kossler, yea.

Request of Walter Browning, Joy Homes, to
vary from the Zoning Ordinance #179 on Lot 1,
Block 1, Fossil Creek Trails Addition, to
allow a 15 ft. building line on Meadow Lakes
Drive instead of the required 30 foot.
This property is located at the southeast
corner of Meadow Lakes Dr. and Lariat Dr.
Mr. Browning came forward. He stated this was
the only lot on Meadow Lakes Drive that
doesn't have a 15 ft. building line.

Mr. Roseberry asked Mr. Browning if he
understood that this was the only one with-
out a 15 ft. building line.
Mr. Browning replied yes.
Mr. Schubert asked if the lot in question
was on the corner and if this was approved
is it possible there will be a fence on the
property line.
Mr. Browning stated the fence would only
come up to the building line.
Mr. Fenimore asked Mr. Browning to explain
how the house will set.
Mr. Browning stated the house will face
Lariat with the side being on Meadow Lakes Dr.
Mr. Roseberry opened the Public Hearing and
called for those wishing to speak in favor
of this request to please come forward.

Mr. Jay Hartley, 4117 Lariat, came forward.
Mr. Hartley stated he had recently moved in
and was not speaking either for or against.
He stated he was wanting to know what exactly
was being asked for.
Mr. Fenimore showed Mr. Hartley the plans and
what was being asked to be changed.
Mr. Roseberry stated that the purpose of
the Ordinance was to keep uniform building
lines within the City.
Mr. Hartley asked if there was a sidewalk
ordinance.
Mr. Browning stated yes, there was and that
there would be a sidewalk.
Mr. Roseberry asked Mr. Rice if the Staff
felt there were any problems with this
request.
Mr. Rice stated the Staff sees no problem.

The Chairman called for those wishing to
speak in opposition to this request to
please come forward. There being no one
wishing to speak, the Chairman closed the
Public Hearing.

Harold Schubert made the motion to approve
BA 82-21 as requested. This motion was
seconded by Hans Kossler and the motion
carried 4-0 with the following vote
recorded: Schubert, yea; Koss1er, yea;
Roseberry, yea; Fenimore, yea.
2. BA 82-22
DENIED
Request of Gary Neisler to vary from the
Zoning Ordinance #179 on Lot 10R-1, Block
8, Fossil Creek Trails Addition, to be
allowed to construct an addition onto his
house beyond the side building line. He
wants a 15 ft. building line instead of the
required 30 foot.
This property is located at 6216 Riviera Dr.
Gary Neisler, 6216 Riviera Drive, came
forward. He stated he wanted the building
line changed from 30 foot to 15 foot.
He said he had two letters from neighbors
stating they had no problem with this change.

Mr. Neisler stated he had a three car
garage now and wants to build a four car
garage with a gameroom also. This will
be used for his mobile home, two cars and
a boat.
Mr. Roseberry asked if the other houses are
on 30 ft.
Mr. Neisler stated his was 30, his next
door neighbor wrote a letter giving their
approval and the neighbor across the street
has a fence within 10 feet.
Mr. Fenimore stated that Mr. Neisler was
asking for the same thing as the previous
guy. He stated it was a normal thíng to ask
for in any city.
Mr. Roseberry asked Mr. Neisler to read
the letters.
Mr. Neisler read the letters.
Mr. Schubert asked if they could hold him
to this.
Bill Rice stated that he had to have four
spaces for off street parking.

Mr. Fenimore asked what the proposed size
of the building was.

Mr. Neisler stated it would be 30 feet
deep and 45 feet wide with an additional
room being 30 feet deep and 45 feet wide.
Mr. Roseberry asked if the area inside
the garage counted as off site parking.
Mr. Rice stated yes, it did.
The Chairman opened the Public Hearing and
called for those wishing to speak in favor
of this request to please come forward.
There being no one, the Chairman called
for those wishing to speak in opposition to
please come forward.
There being no one, the Chairman closed
the Public Hearing.

Mr. Kossler make the motion to approve
BA 82-22 as requested. The motion was
seconded by Mr. Fenimore. The motion
failed by a vote of 3-1 with the following
vote recorded: Kossler, yea; Roseberry,
yea; Fenimore, yea; Schubert, nay.
3. BA 82-23
APPROVED
Request of Stuart Hunter to vary from the
Zoning Ordinance #179 on Lot 7, Block 23,
North Richland Hills Addition, to be
allowed to construct a carport beyond the
front building line.
This property is located at 4625 Cummings Dr. E.
Mr. Hunter came forward. He stated that
he was wanting to build a carport in front
to protect his vehicle from the elements.
Mr. Hunter stated that he planned to build
it out of whatever is suitable and also
added his neighbors had no objections.
Mr. Roseberry asked Mr. Hunter if he had
any plans of what he proposes.
Mr. Hunter stated he did not bring any but
it was going to have a roof and four uprights.
He said it was going to be as basic as
possible and match his house.

Mr. Fenimore asked if he presently had a
garage.

Mr. Hunter replied yes, but like everyone
else had outgrown its space.
Mr. Schubert asked if this would open the
door to having a 30 foot set back. He also
stated that he has wanted a carport but felt
that it would stick out like a sore thumb.
Mr. Rice stated that the City Council and
Z B A has issued several variances to
allow carports. He said it was the Board's
decision and that the Staff has no objections.
Mr. Kossler stated that he felt it was up
to the neighbors and if they don't object
it is o.k.
Mr. Fenimore asked Mr. Rice what the
building line was.
Mr. Rice stated that he did not know.

Mr. Hunter stated he didn't know what
the building line was, but a builder said
there was plenty of space.
Mr. Schubert made the motion to approve
BA 82-23 as requested. This motion was
seconded by Mr. Fenimore and the motion
carried with a 4-0 vote with the following
vote recorded: Schubert, yea; Fenimore,
yea; Roseberry, yea; Kossler yea.
4. BA 82-24
APPROVED
Request of Marvin D. Smith to vary from the
Zoning Ordinance #179 on Lot 24, Block lR,
Holiday West Addition, to be allowed to
have a fence beyond the side building line.
This property is located at 7137 Meadow
Park N.
Mr. Marvin Smith came forward. Mr. Smith
stated this request resulted from complaints
on the brick walls. He stated that if
the fences are taken down, a lot of privacy
will be taken away from these owners. He
stated that these fences have been here
for about four years and there are probably
more allover the City.

Mr. Roseberry stated that in defense of
Mr. Rice, the Zoning Board of Adjustment
has had many requests turned down for
fences and therefore asked the City to
look into this and stop it. He stated

the City was allowing builders to do what
citizens were being turned down for. He
stated that it was creating problems.
Mr. Smith stated he could not see the
advantage of taking down an 8-10 foot
fence.
Mr. Roseberry asked if items 24 and 25
were the same.
Mr. Rice stated they were.
Mr. Roseberry asked if it would be in
order to do both cases at the same time.
Mr. Fenimore stated he drove down to the
intersection of the addition and found it
not to be a traffic hazard. He stated he
pulled up to the intersection as he was
leaving the addition, stopped, looked
both ways and had no problem with traffic.

Mr. Rice stated he was informed this morning
by Bill Rutledge, Utility Inspector, that
Mr. Smith's fence was built over a sewer
clean out.
Mr. Rice stated that Mr. Wen came in for
a fence permit and was given one but that
he did not put the fence where he was
instructed to do so.
The Chairman opened the Public Hearing and
called for those wishing to speak in favor
of this request to please come forward.
Mr. Chen Wen came forward. He stated that
a car ran into the fence and if the fence
hadn't been there it would have been in
his bedroom. He stated he felt he was
being discriminated against.
Mr. Wilson Edward, 5513 Pleasant Meadow,
came forward. Mr. Edwards stated he felt
that Mr. Wen was being discriminated against.
He stated that when he was looking for a
subdivision to live in, the entrance was
important. He said if the fence is taken
down it will take away from the development.

Mr. Fenimore asked if it was a problem to
the City.
Mr. Rice stated no, the problem was V1Slon
coming into and leaving the addition.
The Chairman called for those wishing to
speak in opposition to this request to
please come forward.
There being no one, the Chairman closed
the Public Hearing.
Mr. Fenimore made the motion to approve BA 82-24
as requested. This motion was seconded by
Mr. Kossler and the motion carried by a
4-0 vote with the following vote recorded:
Schubert, yea; Fenimore, yea; Roseberry,
yea; Kossler, yea.
5. BA 82-25
APPROVED
Request of Chen H. Wen to vary from the
Zoning Ordinance #179 on Lot 1, Block 11,
Holiday West Addition, to be allowed to
have a fence beyond the side building line.
This property is located at 7132 Meadow
Park S.

Mr. Chen Wen came forward. He repeated
his earlier statements and presented the
Zoning Board of Adjustment with a petition
in favor of the variance from his neighbors.
The Chairman opened the Public Hearing and
called for those wishing to speak in
favor of this request to please come
forward.
Mr. Bill Williams, 5512 Pleasant Meadow,
came forward. He stated he felt the wall
should stay and the accident he witnessed
cbuld have been a lot worse had the wall
not been there. Mr. Williams stated that
he enters and exits that intersection every-
day and has no problems.
Mr. Edwards came forward and restated his
earlier statement.
Ms. Annette Mobley, 7128 Meadow Park S.t
came forward. She stated she was the one
involved in the accident and if it hadn't

real bad. She stated that the walls were
important to the subdivision and if the
entrance was a problem it needs stop signs.
The Chairman called for those wishing to
speak in opposition to this request to

Mr. Kossler made the motion to approve
BA 82-25 as requested. This motion was
seconded by Mr. Fenimore and the motion
carried 4-0 with the following vote
recorded: Kossler, yea; Fenimore, yea;
Roseberry, yea; Schubert, yea.
The Chairman adjourned the meeting at
8:12 p.m.
