MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
FEBRUARY 26, 1981 AT 7:30 P.M.
CALL TO ORDER
The Chairman, Carl Greenfield, called the
meeting to order at 7:35 P.M.

CONSIDERATION OF THE MINUTES
OF JANUARY 22, 1981
Mr. Bowen moved, seconded by Mr. Tucker,
to approve the minutes as written.

NEW BUSINESS
PS 81-3
Request of James Rust for preliminary plat
of Le Garent Estates.
Walter Elliott, Elliott & Hughes Engineers,
came forward to represent Mr. Garrison and
Mr. Rust in their request.
Mr. Elliott stated they came in about l~ years
ago for IF-8 zoning for a portion of this plat
but was denied by the City Council; then they
came in with a request for IF-9 which was
granted contingent on Mr. Rust developing
his adjoining tract as IF-9 also.
Mr. Elliott stated that since that time,
Mr. Rust has now become the lead developer.

Mr. Elliott said they had received the City
Engineer's letters of July 16, 1979, August
7, 1979, August 16, 1979, and February 11,
1981, and they feel they can comply with all
the comments.

Mr. Elliott said they plan to build a nice
single family subdivision with a 1500 sq.
ft. minimum floor space for each residence.
~lr. Elliott stated the owners, Mr. Rust and
Mr. Adcock, representative for Mr. Garrison,
were present to answer any questions.
Mr. Tucker asked if Mr. Rust would consider
coming in for a rezoning of his property. He
said it would be hard for the city to require
single family if this property is on record
as being Multi-Family.
Mr. Elliott said he could not answer this.
Mr. James Rust came forward. He said Mr.
Garrison was fixing to lose some land if he
didn't go ahead with this, so since time was
of importance, they came in with this pre-
liminary plat.

Mr. Rust said he would like to do whatever is
necessary to change the zoning to single
family. He said the city has the authority
to rezone property.
Mr. Rust said that at the time he had his
property zoned Multi-Family, he had made a
deal with the City of Hurst for water and
sewer, but later on they changed Mayors and
City Managers and the new administration did
not want to supply his property with water
and sewer.
Mr. Horvath said if Mr. Rust could get in
his zoning request by the first of next week,
it could be heard at the same time as their
final plat could be presented.
Mr. Elliott said it would be at least 3 months
before they come in with the final plat
because they have a lot of bulldozing and
clearing out of trees on this property.
Mr. Horvath said then there was no problem
of time in getting the zoning.
Mr. Tucker asked Mr. Elliott why he hadn't
submitted engineering with this preliminary
plat.

Mr. Elliott said he had submitted the
engineering on the IF-8 zoning and the
only thing that changed was the size of
the lots.
Mr. Tucker said both tracts need to be put
together and submitted together with
engineering.
Mr. Elliott said they would be put together
and submitted in the final form.
Mr. Bowen asked Mr. Elliott about #5 of the
Engineer's letter of February ll, 1981 re-
garding Lot 3, Block 2, which does not comply
with the minimum lot depth requirement for
IF-9 zoning.
Mr. Elliott said they would need to file for
a variance on this lot. He said there is a
residence on this lot at this time.

Mr. Elliott said he would request the variance
before submitting the final plat and if he
could not get the variance, they would just
lose one lot.
The Chairman recognized Councilwoman Sharyl
Groves in the audience.
The Chairman called for anyone wishing to
speak in favor of or in opposition to this
request to please come forward.
There being no one wishing to speak, the
Chairman closed the public hearing.
Mr. Snyder told Mr. Elliott that in the
future he was to submit topography and drain-
age with a preliminary plat.
PS 81-3
APPROVED
Mr. Bowen moved, seconded by Mr. Tucker, to
approve PS 81-3 contingent on the rezoning
of Mr. Rust's property to IF-9 and the problem
of Lot 3, Block 2, being resolved before sub-
mitting the final plat, and that additional
utility easements be granted if necessary and
all the Engineer's comments be satisfied.
This motion carried 3-0.

PS 81-4
Request of Cross Roads Development Co.
for preliminary plat of Blocks 7, 8, &
9, Snow Heights North Addition.
Mr. Delbert Stembridge, Consulting Engineer,
came forward to represent Cross Roads Dev.
Company in their request.
Mr. Stembridge said this is 3 blocks con-
sisting of 28 lots in Multi-Family zoning.
He said they plan to construct fourplexes
on them with some Multi-Family at a later
date.
Mr. Stembridge said he had received the
Engineer's letter and they take no exceptions
to any of the comments. He said they are
willing to dedicate the storm drainage for
Rufe Snow and also the dedication of Lewis
Drive. Mr. Stembridge said his client takes
no exception to ¡tern #3 regarding pro rata.
Mr. Bowen said there was a letter from
T.E.S.C.O. requesting additional easements.

Mr. Stembridge said he would add whatever
easement is needed.
Mr. Tucker said he had no problems if they
agreed to dedicate Lewis Drive.
The Chairman called for anyone wishing to
speak in favor of or in opposition to this
request to please come forward.
There being no one wishing to speak, the
Chairman closed the public hearing.
PS 81-4
APPROVED
Mr. Tucker moved to approve PS 81-4 subject
to the development of the property in line
with the Engineer's comments, subject to the
dedication of Lewis Drive and the 16" line
and the additional utility easements.
Mr. Stembridge stated he wouldn't give the
additional utility easement, because when he
dedicates Lewis Drive, they would be located
within the city right of way.

Mr. Tucker said he would like to withdraw his
previous motion.

Mr. Tucker moved to approve PS 81-4
contingent .. on the developer meeting
all the Engineer's requests and the
dedication of Lewis Drive and paragraph
two which adds the 10" water line.
This motion was seconded by Mr. Bowen
and the motion carried 3-0.
PS 81-5
Request of J. D. Griffith for preliminary
plat of Lot 29, Block 11, Glenann Addition.
PS 81-6
Request of J. D. Griffith for final plat of
Lot 29, Block 11, Glenann Addition.
Mr. Griffith came forward. He said he was
requesting the approval of his preliminary
and final plats.
Mr. Bowen asked Mr. Griffith if he had seen
the Engineer's letter.
Mr. Griffith said he had not.

Mrs. Calvert said Mr. Griffith's Engineer,
O. D. Long, had been sent a copy.
Mrs. Calvert gave Mr. Griffith a copy of
the Engineer's letter.
Mr. Horvath told Mr. Griffith the City Council
would hear his final plat, if approved, and
his request to vary from the brick ordinance
on the same night, which would be March 9th.
The Chairman called for anyone wishing to
speak in favor of or in opposition to these
requests to please come forward.
There being no one wishing to speak, the
Chairman closed the public hearing.

Mr. Bowen moved, seconded by Mr. Tucke~ to
approve PS 81-5 subject to the Engineer's
letter.

PS 81-7
Request of Clark Brothers, Inc. for final
plat of Lots 1-22, Block 34, Holiday West
Addition, Section A.
Gordon Swift, Consulting Engineer, came
forward to represent the Clark Brothers,
Inc. in their request.
Mr. Swift said he had received a copy of
the City Engineer's letter regarding these
duplex lots and they are in agreement with
all the Engineer's comments.
Mr. Tucker said he was bothered by the
length of the street with no outlet. He
said the street is almost 1000 feet long
and ends in a cuI de sac. Mr. Tucker
said if there was a toronado or any emergency
there would be no way out.
Mr. Tucker said he knew this was a little
late to be discussing this, but in the
future, they should refrain from having that
long a street with no outlet.

Mr. Tucker said the developer should make
enough on-site parking to keep the cars from
being parked on the street so emergency
vehicles would have no problem.
Mr. Swift said the duplexes would have garages
with parking in front of them, but the street
is wide enough to accommodate on-street parking.
Mr. Swift said he doesn't have any control
over how many vehicles there will be. He said
the cars are getting smaller and smaller, and
he felt in time people may start riding more
bicytles.
Mr. Snyder said he was aware of what Mr. Tucker
was speaking of, and asked Mr. Swift if he had
any ideas that would help this Commission.
Mr. Swift said the basic idea was to have a
buffer zone between the Single Family and
Industrial zoning. He said he may not be able
to work in NRH in the future, but his office
will be recommending changes in design toward
an affordable house. Mr. Swift said they

could not continue to build houses the
young cannot afford. He said they would
like to cut down the roadway and stop
living in the roadway. He said he would
suggest putting in alleys as access to the
residences and providing sidewalks; this
way the emergency vehicles could have access.
Mr. Jess Prideaux, representative of Clark
Brothers, Inc., came forward. He said the
Zoning Ordinance requires 4 parking spaces
per dwelling.
The Chairman called for anyone wishing to
speak in favor of or in opposition to this
request to please come forward.
There being no one wishing to speak, the
Chairman closed the public hearing.

APPROVED
Mr. Tucker moved, seconded by Mr. Bowen, to
approve PS 81-7 contingent on the Engineer's
comments.

The Chairman called a recess at 8:20 P. M.
BACK TO ORDER
The Chairman called the meeting back to
order with the same members present.
PS 81-8
Request of Clark Brothers, Inc. for final
plat of Tracts 1, 2, & 3, NRH Industrial
Park Addition.
Gordon Swift, Consulting Engineer, came
forward to represent Clark Brothers, Inc.
in their request.
Mr. Swift said they are in compliance with
the preliminary which was previously approved,
however, after having several meetings with
the City Engineer and City Staff regarding
the widening of Rufe Snow and the alternate
route, they have made several changes.

Mr. Swift said he requests approval of the
final plat. He said they will cooperate
with such an alignment at a later date, but
request to be allowed to continue only a
portion of the street to be completed pending
the decision of the Rufe Snow project.

Mr. Swift presented a letter in answer
to the Engineer's comments of 2-ll-8l &
11-12-80 regarding said property. He
said they understand the cuI de sac is
long; however, an emergency access ease-
ment has been provided. Mr. Swift said
fire hydrants will be installed as needed
to accommodate businesses. He said a more
detailed topographic map is included in
these final plans.
Mr. Swift said they are in agreement with
the Engineer's letter and the revised final
plat submitted this evening complies with
the Engineer's comments.
Mr. Horvath asked Mr. Swift if he could
get a site plan ready before the council
hears this request.
Mr. Jess Prideaux came forward. He said
he has site plans available now.

APPROVED
Mr. Bowen moved, seconded by Mr. Tucker,
to approve PS 81-8 subject to the Engineer's
comments of February 11, 1981 and November 12,
1980.
This motion carried 3-0.
PZ 81-1
WITHDRAWN
This request was withdrawn since it did not
comply with Ordinance #490.
PZ 81-2
Request of Amon T. Adcock (W.A.H. Corp.)
to rezone a portion of Tract 8, Abstract
321, Wm. Cox Survey, from its present
classification of Agriculture to a proposed
classification of IF-9-l500.
This property is located on the south side
of Starnes Road, approximately l630 feet
west of Smithfield Road and bounded on the
south by Briarwood Estates.

Jack Angel came forward to represent
Mr. Adcock arid W. A. H. Corp. He said
this property is south of Starnes Road
and north of Briarwood Estates.
Mr. Angel presented a large drawing of
what they plan to do.
Mr. Bowen said the drawing showed Multi-
Family zoning to the east.
Mr. Angel said that was in error, there
was a strip of Agricultural zoning between
their property and the Multi-Family zoning.
The Chairman called for anyone wishing to
speak in favor of or in opposition to this
request to please come forward.
There being no one wishing to speak, the
Chairman closed the public hearing.
Mr. Snyder asked Mr. Angel if they had
consulted the property owners to the east
about an outlet.

Mr. Angel said they had not because they
would have an outlet to the west.
PZ 81-2
APPROVED
Mr. Tucker moved, seconded by Mr. Bowen, to
approve PZ 81-2 as requested.
This motion carried 3-0.
PZ 81-3
Request of J. E. Brannon to rezone Tract
18, Abstract 1266, S. Richardson Survey,
from its present classification of
Agriculture to a proposed classification
of IF-9-l600.
This property is located on the north side
of Rumfield Road and bounded on the west
by Kirk Lane.
J. E. Brannon came forward. He said he has
2.5 acres which he would like to rezone from
Agriculture to IF-9. Mr. Brannon said this
zoning would be consistant with the develop-
ment in the area at this time.

Mr. Tucker asked Mr. Brannon if he planned
to have all 9500 sq. ft. lots.

Mr. Brannon said that more than half of
the lots would be 10,000 sq. ft.
Mr. Horvath asked Mr. Brannon if he was
aware that the old Master Plan of the City
of North Richland Hills shows Eden Road
extending due north to intersect with
Kirk Lane.
Mr. Brannon said he was not aware of this.
Mr. Horvath said Mr. Snyder is not very far
along with his study, but he might like to
comment on this.
Mr. Snyder said Mr. Brannon needs to keep
in mind the city might require some right
of way for this extension. He said he had
just started on a 9 month study of the city
and could not say just now whether the road
would be extended or not.
Mr. Brannon said he would like to mention
there are some streets that are in dire
need of improvement in this area.

The Chairman called for anyone wishing to
speak in favor of this request to please
come forward.
There being no one wishing to speak in favor
of this request, the Chairman called for any-
one wishing to speak in opposition to come
forward.
Mr. O. G. Tobias, 8800 Rumfield Road, came
forward. He said he lives across the street
from the property in question.
Mr. Tobias said the houses on Eden Road and
Kirk Lane are all on much larger lots. He
said the streets are not such to accommodate
anymore traffic, and the water supply is
terrible. Mr. Tobias said he was sure that
in time, they would be required to tie into
the city sewer.
Mr. Tobias said he would like to suggest to
the Commission that they turn down this
request.

Mr. Bowen asked Mr. Tobias if he would
show where his property was on the plat.
Mr. N. L. Jordan, 8800 Kirk Lane, came
forward. He stated he lives just north
of this property.
Mr. Jordan said they all have 3 to 5
acre tracts and don't feel they should
allow these small homes around them.
Mr. Jordan said they do have some problems
with septic tanks in this area. He said he
does not feel the Commission should grant
this request.
Mr. Bowen asked Mr. Jordan'where his property
was in conjunction with Mr. Brannon's.
Mr. Berwyn Caswell, 8900 Kirk Lane, came
forward. He said the septic tanks would
be a problem and the streets are already a
problem.
Mr. Caswell said when he bought his property,
there was a deed restriction of no smaller
than 1 acre lots and 1800 sq. ft. homes.
Mr. Snyder asked about the sizes of the
homes in the area.
Mr. Caswell said there were some 2000 sq. ft.
but most were 1800 sq. ft. He said he
believed they were building some on Kirk
Lane that were smaller.
Mr. Brannon said this development would be
much better than in Meadowview Estates in
which 165 lots are being laid out, some
smaller than his.
Mr. Brannon also stated there would be no
s~ptic tanks in any of these houses, they
would be on city sewer.
Mr. Brannon said he had this property up for
sale for two years and had no inquiry from
any of these neighbors. He said now they
can look out their window and see a weed
patch instead of a nice development.

Mr. Snyder asked Mr. Brannon if he has a
design for the development.
Mr. Brannon said he might build him a home
on one of the lots. He said the tract is
not large enough for Agricultural use.
Mr. Brannon said he plans to have 9 lots.
Mr. Snyder said his comment was for his
study. He said he needs to know what size
lots and houses Mr. Brannon is planning.
Mr. Snyder said the city will need to be
sure they have adequate service for this
area.
Mr. Brannon said he brought the preliminary
plat in tonight to Mrs. Calvert.
Mrs. Calvert gave each Commission member a
copy of Mr. Brannon's preliminary plat.

Mr. Greenfield said if Eden Road is ex-
tended, Mr. Brannon would have to scrap
3 lots.
Mr. Brannon said if this happens, he would
have to alter his plat.
Mr. Snyder asked Mr. Brannon what his time-
table was.
Mr. Brannon said he has no timetable.
Mr. Bowen asked Mr. Brannon if he would
consider larger lots.
Mr. Brannon asked if he meant IF-12 zoning.-
Mr. Bowen said that was correct.
Mr. Brannon said he could, but he felt the
IF-9 was more feasible. He said he could
sell this tract now to someone and they
could put a shack on it with a bobwire fence
around it since it is zoned Agriculture.
Mr. Snyder asked Mr. Brannon what he would
like to do.

Mr. Brannon said he would rather have the
IF-9 zoning, but would agree to IF-12.
Mr. Bowen said he would like to ask the
people if they would agree to the IF-12.
Mr. Tobias said he would not object to
the larger lots and larger homes, but
would rather it stay one tract.
Mr. Jordan said he would like to see one
nice home built on this tract.
Mr. Caswell said he thinks there should
not be more than two homes on this tract.
Mr. Tobias said the feeling of the neighbors
is they had rather not have more than two
homes on this tract. He said he has 9 acres,
but most of the other neighbors have from
l~ to 3 acre tracts.
Mr. Bowen said he sympathizes with these
people and he would feel better with the
IF-12 as opposed to IF-9 zoning.

Mr. Tucker said he feels the days of l~ to
2 acre tracts are in the past; ranchetts
are nice, but very few people have that kind
of money. He said he would feel better with
the larger lots.
Mr. Snyder said he was inclined·' to believe
the larger zoning would be compatible with
the area and it would not harm the surround-
ing area.
Mr. Tucker said if there were 5 lots instead
of 9, the land would be easier to sell.
Mr. Greenfield asked Mr. Brannon his feelings
on fewer lots.
Mr. Brannon said he would agree to the IF-12
zoning. He said small lots are selling for
$12,000 to $15,000. He said he would also
have to take into consideration the extension
of Eden Road.

Mr. Greenfield asked Mr. Brannon what siz"e
lot he was planning to keep for himself.
Mr. Brannon said he would like to have one
that was from 95 ft. to 120 ft. deep.
Mr. Bowen said IF-12 zoning requires a
minimum of 1800 sq. ft. houses.
Mr. Brannon said that would be fine.

APPROVED
Mr. Bowen moved, seconded by Mr. Tucker,
to approve PZ 81-3 contingent on the request
being changed to IF-12-l800.
This motion carried 3-0.
