CALL TO ORDER The meeting was called to order by the Chairman, Carl Greenfield, at 7:40 P.M. ROLL CALL PRESENT: CHAIRMAN MEMBERS Carl Greenfield George Tucker Ronnie Newman Don Bowen Marjorie Nash ABSENT: CITY STAFF PRESENT: Director of Public Works/ Utility City Planner Planning & Zoning Coordinator Clerk Cecil Forester Wayne Snyder Wanda Calvert Patricia Hutson CONSIDERATION OF THE MINUTES OF FEBRUARY 26, 1981 Mr. Bowen moved, seconded by Mr. Tucker, to approve the minutes as written. The motion carried 3-0 with Mr. Newman abstaining since he was not present at the February meeting. NEW BUSINESS PS 81-10 POSTPONED Request of Curtis Moore & B. R. Flories for preliminary plat of Dalworth Industrial Park Addition. The Chairman stated that the owners had requested this be postponed till a later date. PS 81-11 Request of Alan D. Arnold for preliminary plat of Lot 2, Block 2, Henry Addition. Mr. Delbert Stembridge came forward to represent Mr. Arnold. He said this is a commercial tract located on Linma St. Mr. Stembridge said Mr. Arnold wants to build a metal storage shed 28 x 40 ft., but was told by the City Staff that he must plat the property before he can get a building permit. Mr. Stembridge said he had received a . . . Page 2 P & Z Minutes March 26, 1981 copy of the Engineer's letter and would like to connnent on it. He said #1, he will provide an easement as soon as they can detect where it is. Mr. Stembridge said he had searched the city utility maps and couldn't find it. He said the house was very old and a porch had been built on and he hopes it isn't under it. Mr. Stembridge said in regard to Item #2, it was usually the policy of the city to not require this since the subject already is hooked up to city water. He said he requests the Commission waive Item #2. Mr. Forester said the man is already on city water. The Chairman called for anyone wishing to speak regarding this matter, to please come forward. There being no one wishing to speak, the Chairman closed the public hearing. PS 81-11 APPROVED Mr. Newman moved, seconded by Mr. Bowen, to approve PS 81-11 subject to getting the water line taken care of and to exempting Item #2. The motion carried 4-0. PZ 81-4 Request of Charles Beane to rezone Lots 29-66, Block 42Bl, and Lots 67-100 Block 42B2, Richland Terrace Addition, from the present classification of Community Unit Development zoning to a proposed classi- fication of Multi-Family-Quadrop1exes. This property is located south of Maplewood Drive and east of Cloyce Drive. This property will be known as Lots 33R-43R, Block 42Bl, and Lots 67R-77R, Block 42B2, Richland Terrace Addition. The Chairman called for anyone wishing to speak in favor of this request to please come forward. Page 3 p & Z Minutes March 26, 1981 . There being no one wishing to speak in favor of the request, the Chairman called for anyone wishing to speak in opposition to this request to please come forward. Bobby McCown, 5020 Susan Lee Lane, came forward to represent the property owners against this request. He said he lived directly behind the proposed quadroplexes. He said it would be an invasion of privacy, the area was quite congested and they did not feel they would have any more privacy with a privacy fence. He said the existing privacy fence is not maintained. He said that they would rather see this area developed into lower single story dwellings as opposed to quadrop1exes. Mr. McCown said if the Commission does approve these quadrop1exes they would like for there to be no balconies, less windows, etc. on the back so they won't feel their privacy is being invaded. . Mr. McCown said they realize the property has to be developed in some way. They kind of feel like this property is theirs also and that it would degrade their property. Mr. McCown said no one he has talked to is in favor of this request; they feel there are enough apartments in North Richland Hills now, especially in the immediate vicinity they live in. He said when he first moved here, he had no problem getting on Davis Blvd., but now he has to go up and under the under- pass. He felt the apartments would just add to the problem. Mr. Greenfield asked if the feeling of the group was for the present zoning. Mr. McCown said it was. . Mr. Snyder said community unit development required a site plan which was submitted several years ago providing for one story townhouses, 8 units per block. What could be built today would be 71 units. There is an approved . . . Page 4 P & Z Minutes March 26, 1981 building plan of 1,000 sq. ft. under the existing zoning. Mr. McCown asked. the Commission to please consider the single story adjacent to their homes. Mr. Morris said he had copies of the plat as is and the proposed plat. He passed out copies to interested people in the audience and gave pictures to the Commission for viewing. Mr. Morris said he appreciates their desire to keep their neighborhood as nice as it is now and that is their intention also. Mr. Morris said it is currently platted into 71 small lots, 22 to 25 ft. wide. They propose to change to 22 larger lots, each having a quadroplex with spacing between them. There would not be a solid line of buildings. Mr. Morris said to notice on the plat the existing 17 units outlined in red and the blue area shows the three quadrop1exes currently being built. The green is the area in question. Mr. Morris said the street is 32' wide and 87' long, the alley is 871 ft. long. It will cost approximately $64,000.00 to pave, curb, and gutter it at Mr. Beane's expense. There will be no cost to homeowners or the city. The pictures shown to the Commission were shown to the audience. Mr. Morris said they were the existing quadroplexes that were currently being built. The proposed quadroplexes will be the same type. Mr. Morris said if the zoning change is approved, they will start on Cloyce. Also, their plans are to beautify the area. Every trash container will have its own individual compound. Mr. Beane would also house those trash containers . . . Page 5 p & Z Minutes March 26, 1981 now existing at his expense. He said that all construction and streets will be to city's codes. Mr. Morris said each quadroplex will have approximately $160,000 value for a total of 3~ million dollars plus an additional $64,000 for streets. Mr. John Huber of 5001 Susan Lee Lane came forward. He asked if there would be another alley next to the houses. It shows a privacy fence and utility easement. He said there was a 5' gap between the two fences. Mr. Tucker said that would have to be agreed upon by the owners. He said he believed there would be an alley fence then the utility easement. Mr. Huber said there is an access man hole inside his yard and they have to come into his yard to fix it. Mr. McCown said they preferred the alley was not there at all. It would be made a race track thereby increasing the noise level. Mr. Bowen asked Mr. Morris if they had any plans for a recreation area. Mr. Morris said none are proposed. Mr. Greenfield said with the present plan there is a recreation area shown. Mr. Snyder showed the current site plan to the audience and explained it would cut out an 8-unit complex. Mr. Morris said the parking needs bo be behind the building per city require- ments and that the alley would be used by the tenants and wouldn't be a race track. Mr. Morris said concerning access to the freeway with Maryanna paved and guttered it would open up another exit from Maplewood to the freeway. Page 6 P & Z Minutes March 26, 1981 . Mr. Tucker said that under the present zoning there are now 64 townhomes and the alleyway is planned in exact location in present zoning. Mr. Morris asked if the recreational area needs to be in the center? Mr. Greenfield said they were just showing where the present recreational is proposed. Mr. Snyder" said Mr. Morris proposed to change from 64 units to 88 units, a change in density. He said if the Connnission sees fit to approve the request the present recreation area would cease to exist. . Susan Walker of ·5009 Susan Lee Lane came forward. She said she respected the business standpoint of view but asked for them to look at it from theirs; you can look 25' away and see two stories staring them in the face. She said she didn't want a two-story dwelling there. She said the crime rate was increasing and the extra families would increase it even more and you can't get on the freeway where it was discussed because there is no ramp there. Henry Blanton, 3543 Paramont, came forward. He said he had property on Susan Lee between Short and Maplewood. He said where he lives now there is a two story apartment complex in back of his fence and that there are some problems that haven't been mentioned. People who moved there would take a short cut across his property. He said he had to put up a high fence to stop it. He said he was in favor of the apartments but would like to see a 6' fence rather than a 4' since people still climb over the 4' fence. . Harold Sandel, 5008 Susan Lee Lane, came forward and said they filed a petition with more than the required signatures. . . . Page 7 p & Z Minutes March 26, 1981 He said they would like their privacy and with community unit development there are certain provisions that could be made. He said there could be a deletion of windows in the back and he would rather have single stories. Mr. Bowen asked if it is possible for the city to make decisions concerning overlook windows. Mr. Forester said it would have to be voluntary. Sue Turner, 4921 Susan Lee Lane, came forward. She said she would like to know where would the trash containers be located; would people use them, what about pests, and regarding the privacy fence children take the boards off. She said there would be transient people and crimes would increase. She said it might cost the developer 3~ million dollars to build the proposed quadroplexes, but the homeowners would lose several thousand dollars in value to their homes. Mr. Greenfield asked if they had an additional fence. Mrs. Turner said she had a 4' cyclone. Mrs. Sutphin, an associate of Mr. Morris, came forward. She said each trash bin would be on a concrete pad at each individual compound. The present apartments have no designated place, but they will combine the trash containers. She said the original design turned the apartments so the balconies overlooked the balconies but the city would not allow this. She said this could be an alternative. Mr. Greenfield asked how the dumpster would be emptied in the space avàìlable. Mr. Tucker said an alleyway usually was not wide enough to turn around in. . . . Page 8 P & Z Minutes March 26, 1981 Mrs. Sutphin said they have been assured by t~e builder that this will be taken care of. Mr. Tucker said it appears to him that there would be a 30-37% increase in density over the original plan. Mr. Bowen asked if the other quadroplexes were turned as Mrs. SUtphin said, would there be no windows? Mrs. Sutphin said there would be two windows per unit. Mrs. Walker came forward again. She said there is a 5' easement between the two fences, then there would be a 20' utility easement. She asked if parking would be on this 20' easement. Mr. Tucker said it would be for emergency vehicles. Parking would not be on this 20' easement. Mr. McCown said the existing easement is a fire hazard. The owners can't get to the weeds unless they crawl over the fence. Mr. Forester said the owners could fence in the utility easement. Mr. Greenfield asked if the city maintains the easement. Mr. Forester said he wasn't sure. Mr. Newman said the homeowners could beautify the fence. Mr. Sandel said privacy was a major factor, he would like to see it stay single story. Mr. Tucker said the present fence should be torn down and an agreement made with the property owners. Mr. Morris said if the Commission would agree to this zoning, he would suggest . . . Page 9 P & Z Minutes March 26, 1981 to the owners a masonry fence. He said he doesn't feel the tenants would be transient. The rent will be $400 per unit per month for a 1,000 sq. ft. apartment. RECESS The Chairman called a recess at 8:45 P.M. BACK TO ORDER The Chairman called the meeting back to order at 9:00 P.M. with the same members present. Mrs. Walker said they would like the current zoning to be maintained. Mr. Morris said considering the cost it would be unprofitable to build single story. He understands that it has been zoned townhouses for eleven years and he feels quadroplex zoning would be better. The Chairman closed the public hearing. Mr. Tucker said the proponent was changing the density over 30% and was changing from single to two story. He said in his opinion the case has not been made. He said he realizes the economy is not the same, but the proponent may want to re-evaluate the request to the Commission to come up with an alternative so economics can be taken into consideration as well as that of the citizens. Mr. Newman said he concurs. Mr. Greenfield asked what the density range was. Mr. Tucker said 64 to 88. Mr. Snyder said community unit develop- ment was designed for flexibility in design, something unique. He said the Commission needs to take this into consideration. Mr. Tucker said Charles Beane is now here, he may address the Connnission if he desires. Page 10 p & Z Minutes March 26, 1981 . Mr. Greenfield asked Mr. Beane if he would like to speak. Mr. Beane said he had talked to the home- owners during the recess and found out their main concern was the two story being adjacent to single family. He said he would change his plans and build one story row houses next to the single family and quadroplexes on the balance of the lots. Mr. Beane said the row houses would have 5/12 pitch roof that would block the view from these people. Mr. Beane said the reason he had to place the present quadroplexes the way he did, was there was a TESCO right-of-way there. Wanda Calvert said the Commission could approve the zoning subject to stipulations but postpone the replat. . Mr. Forester said they could also approve just a portion of this zoning request. The lots for the row houses would stay the same as they are now. Mr. Beane said he would like to go ahead with the zoning and submit the replat later. Mr. Snyder said there would have to be several stipulations added. Mr. Greenfield asked Mr. Sandel what were the homeownerĊĦ' thoughts on this. Mr. Sandel said the row houses would be fine if they have a pitch roof and if the quadroplexes are faced north and south. Mr. Beane said the quadroplexes could face Maryanna and the balconies could face west. Mr. Bowen asked how much density there would be. . Mr. Beane said there would be considerably less. . . . Page 11 P & Z Minutes March 26, 1981 Mr. Greenfield asked if something could be done about the fence problem. Mr. Sandel said he would like to see a center block wall 6 to 8 ft high. Mr. Beane said he would like to just repair the existing fence. Mr. Forester asked about the unkept area. Mr. Beane asked if a new 6 ft. wooden fence would be acceptable. Mr. Tucker asked if the 5 ft. easement was shown in metes and bounds description of the property. He asked the city to find out. Mr. Beane said the location of the fence was no problem to him. Mr. Beane said row houses would be 23 ft. high. He said there was no way people can see over this single story house. Mr. Sandel said that would be O.K. Mr. Tucker said technically, this ease- ment is your property and you can set your fence on the other side. Mr. Newman asked if the fence would still have a gap. Mr. Greenfield said the homeowners could use Mr. Beane's fence as the back of their fence. Mr. Greenfield said the fence would need to have the slick side next to the alley so no one could climb over into the homeowner's yards. Mr. Greenfield said it would be the option of the homeowners to move the fence. Mr. Bowen said he would prefer it be postponed until everything is worked out. Mr. Tucker said he would like to see it written down and re-examined at next meeting. Page 12 P & Z Minutes March 26, 1981 . Mr. Greenfield said that in the interest of all concerned he would like to see the issue resolved now. Mr. Newman said he agrees that if it can be stated in such a way that protects both homeowner and developer he would like to approve and postpone the replat. Mr. Huber said it was said a portion of the zoning could be approved. . Mr. Newman made a motion to approve PZ 81-4 with the following stipulations: (1) The same net density (64 units) be maintained. (2) The site plan of the entire site be submitted to Planning and Zoning with the replat for approval designating building sizes, locations of parking spaces, access, screening fences and other appropriate elements. The screening fence was agreed to be a 6 ft. stockade built so homeowners could use it as their fence and the slick side would be to outside of property. The motion was seconded by Carl Greenfield. The motion failed 2-2 for lack of majority with the following vote recorded: Greenfield, yea, Newman, yea, Tucker, nay, Bowen, nay. Mr. Beane asked if they could go with Block 42Bl, Lots 33R. thru 43R zoned for quadroplexes facing north and south with no windows on the east side and resubmit ~lk. 42B2 leaving fence as is. Mr. Sandel said he wants to be sure they get what was agreed to earlier would be approved later. He asked when it would be submitted again. Mr. Beane said he would resubmit them right away. PZ 81-4 APPROVED Mr. Tucker made a motion to approve PZ 81-4 in the following manner: That Block 42Bl be approved subject to . . . . Page 13 P & Z Minutes March 26, 1981 engineer's comments and Blk. 42B2 bé denied in present form and that it would be resubmitted immediately and that it would be for single story row houses. The motion was seconded by Mr. Newman. The motion carried 4-0. PS 81-9 POSTPONED Request of Charles Beane for replat of Lots 33R-43R, Block 42Bl, and Lots 67R-77R, Block 42B2, Richland Terrace Addition. Mr. Newman moved, seconded by Mr. Bowen, to postpone PS 81-9. The motion carried 4-0. PZ 81-5 Request of KEM Advertising for Bank of North Texas and Hudiburg Chevrolet to rezone a portion of Lot 1, Block 2, Carder Addition, from the present classification of Commercial-Specific Use- Sale of Alcoholic Beverages to a pro- posed classification of Commercial- Specific Use-Billboard. This property is located south of Airport Freeway next to the store "Wallpaper to Go". Kerry E. Moseley came forward. He said he owns the ground lease and in con- junction with Bank of North Texas and Hudiburg Chevrolet, he wishes to install a sign. Mr. Tucker asked about the height. Mr. Moseley said the maximum would be 60'. It would not obstruct anyone's view. He said it would be a 14' x 48' flag type sign. Mr. Greenfield asked what direction it would face. Mr. Moseley said it would face the traffic on Airport Freeway. Mr. Moseley showed the artist's drawings of the sign. Page 14 P & Z Minutes March 26, 1981 . Mr. Moseley said it would flag over the building so it wouldn't be over the parking area. He said it would not interfere with traffic. Mr. Greenfield asked where the pole will be located. Mr. Moseley said it would be next to where the "w" is in "Wallpaper to Go". He said they have an exclusive lease of all of the property and the permission of the landowner. Mr. Moseley said they have stipulations not to interfere with the tenants. Mr. Greenfield called for anyone wishing to speak in favor of or in opposition to this request to please come forward. There being no one wishing to speak, the Chairman closed the public hearing. . PZ 81-5 APPROVED Mr. Newman moved, seconded by Mr. Tucker to approve PZ 81-5. The motion carried 4-0. PZ 81-6 Request of Dean Nelson for William M. Kerch to rezone Lot 7, Block 6, Clearview Addition, from the present classification of 2F-9 with the stipulation that a certain floor plan be used to a proposed classification of 2F-9. This property is located at the north- west corner of Maplewood Drive and Joreen Drive. Dean Nelson came forward to represent Mr. Kerch. He said the present plans are oversized and it is a Spanish structure. He said he wants to build a duplex but use his own plans. Helen Butler, 7913 Maplewood~ came forward. She said her property line connects the property in question. She wanted to know the size, etc. . He said both families would enter on one common drive off Joreen. Welton Butler asked about the distance between the houses. Mr. Greenfield said the minimum side yard is 6 ft. Mr. Nelson said the design will increase the value. A smaller structure would look less expensive. He said the elevation makes it look larger than it is. Mr. Nelson showed the plans to the Commission and Mr. and Mrs. Butler. Mr. Tucker showed the present plans. Mr. Butler asked who was to live in it. . Mr. Nelson said Mr. Kerch plans to live there, but he doesn't know which side he will occupy. He said Mr. Kerch travels a lot and wants the protection of a neighbor. The Chairman closed the public hearing. PZ 81-6 APPROVED Mr. Bowen moved, seconded by Mr. Tucker, to approve PZ 81-6. The motion carried 4-0. PZ 81-7 POSTPONED Request of William R. Spain to rezone a portion of Lot 8, Block 33, Nor'East Addition from the present classification of IF-9 to a proposed classification of Local Retail-Specific Use-Snowcone Building. This property is located on the west side of Davis Blvd., approximately 414 feet north of Lola Drive. This property will be known as Lot 8R, Block 33, Nor'East Addition. APPROVED The Chairman asked if all members had read this. All members said they had. The Chairman called for anyone wishing to speak in favor of or in opposition to the amendment to please come forward. There being no orie wishing to speak, the Chairman closed the public hearing. Mr. Newman moved, seconded by Mr. Bowen, to approve this amendment regarding accessory buildings. The motion carried 4-0. AMENDMENT TO ZONING ORDINANCE #179 REGARDING DESIGNATED PARKING SPACES FOR THE DISABLED APPROVED The Chairman asked if all members had read this. All members said they had. Mr. Greenfield called for anyone wishing to speak in favor of or in opposition to this amendment to please come forward. There being no one wishing to speak, the Chairman closed the public hearing. Mr. Bowen moved, seconded by Mr. Newman, to approve this amendment regarding the handicapped parking spaces. The motion carried 4-0. OLD BUSINESS None. ADJOURNMENT The meeting adjourned at 10:15 P.M.
