MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, JANUARY 8, 1981, 7:00 P. M. The meeting was called to order by the Chairman, H. B. Helton, at 7:00 P. M. PRESENT: CHAIRMAN SECRETARY MEMBERS H. B. Helton Jack Roseberry Jesse Range E. K. Hahn Marie Hinkle CITY STAFF PRESENT: BUILDING OFFICIAL Bill Rice P & Z COORDINATOR Wanda Calvert Mrs. Hinkle moved, seconded by Mr. Range, to approve the minutes as written. The motion carried 4-0 with the following vote recorded: Hinkle, yea, Range, yea, Hahn, yea, and Helton, yea. Mr. Roseberry abstained since he was not present at the December 11th meeting. Request of Shug McPherson to vary from the Zoning Ordinance #179 on Lot 13, Block 4, Meadow Lakes Addition, to be allowed to have house built beyond the front building line. This property is located at 6500 Boulder Ct. The Chairman stated that since the filing of this request, a new survey was made by David Moak Surveyors which showed this house was not beyond the front building line as previ- ously shown so therefore, there would be no need for this variance. Dr. Hahn moved, seconded by Mr. Range, to dismiss BA 80-25. The motion carried 5-0 with the following vote recorded: Hahn, yea, Range, yea, Hinkle, yea, Roseberry, yea, and Helton, yea. ~ Page 2 Z B A Minutes January 8, 1981 . This property is located at 6505 Boulder Ct. BA 80-28 APPROVED Request of Guy Carter to vary from the Zoning Ordinance #179 on Lot 18, Block 45, Richland Terrace Addition, to be allowed to have house built approximately 3 feet beyond the front building line. This property is located at 5109 Maplewood Ct. . ~ Page 3 Z B A Minutes January 8, 1981 . Mr. Guy Carter came forward. He said he was the builder and developer of this property. Mr. Carter said that for some reason, they had to move the fire plug which was located at the right corner of this house, and he feels the stakes were moved at this time. He said the subcontractor must have measured from the wrong stake causing this error. Mr. Carter said the house has already been sold and VA has accepted it with the stipulation that he write them a letter regarding the Board1s decision. Dr. Hahn asked Mr. Carter if the first notice of this was at the time of closing. Mr. Carter said it was. Mr. Range said the Board sees this quite often. . Mr. Carter said that in all his years of building, this was the first time this had happened to him. Mr. Range asked Mr. Carter if his contractors were aware of the building line requirement. Mr. Carter said he had a supervisor that usually catches such things as this, but he felt the moving of the fire plug was what caused the error. Mr. Roseberry said that fn looking at the drawing, they could have pulled the other corner of the house around and made it right. Mr. Helton asked Mr. Rice if he had any suggestions of ways that would keep this from happening. r·1r. Rice said this situation can happen very easily on a cul de sac. He said that in the future, he would request the City Inspector inspect them more closely before the concrete is poured. . Page 4 Z B A Minutes January 8, 1981 . Mr. Range asked Mr. Rice if he had any suggestions on how far beyond the build- ing line the Board should grant. Mr. Rice said that 3 feet was far enough. He said that most of the time, the house would only be a few inches over the build- ing line. Mr. Roseberry said when he builds a house, he always sets it back further than re- quired so there will not be this problem. Mr. Carter said his subcontractor has poured more foundations than he has seen, but this was just an error. He said they almost made a mistake on another one of these houses, but the inspector caught it. Mr. Carter said he has 28 more lots to develop in this area and he will be more careful. Mr. Range moved, seconded by Mr. Roseberry, to approve BA 80-28 as requested. . The motion carried 5-0 with the following vote recorded: Range, yea, Roseberry, yea, Hinkle, yea, Hahn, yea, and Helton, yea. OLD BUSINESS Mr. Helton asked Mrs. CalVert about Mr. Reynold's request, BA 80-24, which the Board postponed last month. Mrs. Calvert said she spoke with the City Attorney regarding Mr. Reynold·s request, and he suggested we require Mr. Reynolds go before Planning and Zoning and the City Council for an amendment to his Planned Development Zoning since he would be changing the plans he had submitted at the time of the zoning change. Mrs. Calvert said she informed Mr. Reynolds of this and refunded his $100.00 which he had paid for the ZBA request. She said that Mr. Reynolds spoke with his attorney and they decided not to go before P & Z and the City Council and just cancel the plans for the addition to the shopping center. . ~ Page 5 Z B A Minutes January 8, 1981 . Mrs. Calvert said, in other words, Mr. Reynolds withdrew his variance request. COUNCIL VIEWS ON ENCROACHMENT OF BUILDING LINE Dr. Hahn said in regards to the building beyond the building line, he feels this should be a decision by the City Council, or the City Council should give the inspectors some leadway in this matter. . Mrs. Calvert asked Dr. Hahn if he was say- ing we should not require them to go before this Board Ï'f they are only a few inches over the building line. Dr. Hahn said he didn't think there should be so much of this happening and he feels this should be discussed with the City Council. He said maybe there could be just a form to fill out if this happens. Mr. Roseberry said that the builder should just make sure he sets the forms far enough back that this could not happen. Dr. Hahn said that on cul de sacs they have the problem of not enough back yard. Mrs. Calvert said maybe they are trying to put too large a house for the size or shape of the lot. Dr. Hahn said that was the problem. He asked Mr. Rice if he could bring the builder's attention to the problem when they come in for their building permit. Mr. Rice said he would tell them of the problems of building on a cul de sac when he approves their plans and maybe they will be more careful. ADJOURNMENT The meeting adjourned at 7:25 P.
