MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, JULY 9, 1981 CALL TO ORDER The meeting was called to order by the Chairman, H. B. Helton, at 7:10 P. M. ROLL CALL PRESENT: CHAIRMAN MEMBERS ALTERNANT MEMBER ABSENT: Jesse Range Jack Roseberry H. B. Helton Dr. E. K. Hahn Marie Hinkle Martin Erck CITY STAFF PRESENT: BUILDING OFFICIAL P & Z COORDINATOR Bill Rice Wanda Calvert CONSIDERATION OF THE MINUTES OF JUNE 11, 1981 The Chairman stated the approval of the minutes of June 11th would have to be postponed since there are not enough members present who were present at that meeting. NEW BUSINESS BA 81-13 APPROVED Request of Charlie Erwin to vary from the Zoning Ordinance #179 on Lot 14, Block 5, Clearview Addition, to be allowed to con- struct a roof overhang beyond the front building line. This property is located at 7908 Clark St. Mr. Erwin came forward. He said he wanted to cover the sidewalk and a planter box he plans to build. Mr. Erwin said he had to put on a new roof and was not aware he needed a permit. He said the city red-tagged him. Mr. Erwin said while he was putting on the new roof, he decided to extend the roof over the sidewalk to make the house cooler and look nicer. Mr. Helton asked Mr. Rice how much the over- hang was beyond the building line. Page 2 Z B A Minutes July 9, 1981 . Mr. Rice said he believed it was approximately 6~ feet. beyond the front building line. Mr. Helton asked Mrs. Calvert if she had received any correspondence. Mrs. Calvert said Mr. Erwin brought in 10 letters from property owners within the 200 ft. radius who are in favor of this request plus 4 from neighbors just outside the 200 ft. radius who were also in favor of this request. Mrs. Calvert stated she had received one letter in opposition to this request which was signed IIConcerned Citizenll. She said she had no way of knowing if it was from someone within the 200 ft. radius or not. Mrs. Calvert stated there were 20 letters sent out. . Mrs. Hinkle asked if this overhang would block any view. Mr. Erwin stated it would not. He said he changed the pitch of the roof. Mr. Erck asked what kind of material Mr. Erwin used. Mr. Erwin said he used ~ inch decking set on 2 x 8ts and the columns were made of posts wrapped with brick. Mr. Erwin said tìe wants to bui,ld a 1611 planter box to put tropical plants in. He said the cornish board was deteriorating so he decided to fÎ'x it all up so it would look nice and be cooler. Mr. Erck asked Mr. Erwin if he planned to inclose this area with screen or something. Mr. Erwfn said he did not intend to i:nclose it. The Chairman called for those wishing to speak in favor of or in opposition to this request to please come forward. . Page 3 Z B A Minutes July 9, 1981 . There being no one wishing to speak, the Chairman closed the Public Hearing. Mr. Helton said if the Board decides to grant this request, he felt there should be a stipulation that it would never be inclosed even if Mr. Erwin decides to sell his property. Mr. Erck said he could see how this problem could happen. He said he had done things without realizing there was requirements by the ci'ty. Mr. Erck made a motion to approve BA 81-13 wi th the sti pul ati on that thei :overhang extension can never be inclosed. Thi,s moti on was seconded by Mrs. Hi nkl e and the motion carried 4-0 with the follow- ing vote recorded: Erck, yea, Hinkle, yea, Hahn, yea, and Helton, yea. BA 81-14 APPROVED Request of Epoch Development Corp. to vary from the Zoning Ordinance #179 on Lot 1, Block 8, University Plaza Addition, Phase I, to be allowed to erect a sign 10 feet behind the curb instead of on the face of the building as required in Article XVII, Section 12, of the Zoning Ordinance. This sign will be located on the south side of Harwood Road in the 8500 block. . Fred Trammel came forward to represent Epoch Development Corporation in their request. Mr. Trammel stated they' had built Phase I of the Haystack apartments and are now building Phase II. He stated these apart- ments are next to other apartment complexes owned by others which run into Hurst. He said they want to put up a sign to show which apartments are the "Haystack" apart- ments. Mr. Trammel said the sign would be made of rough cedar with the word HHaystackll cut out of wood~ . Mr. Helton asked if this was to be a permanent sign. Page 4 Z B A Minutes July 9, 1981 . Mr. Trammel said it would be permanent. Mr. Rice said the reason they are request- ing this variance is the Zoning Ordinance states in Article XVIII, Section 12, that all signs in Multi-Family zoning can only be on the face of the building and be no larger than 40 sq. ft. Dr. Hahn asked if the sign would be lighted. Mr. Trammel said it would not be lighted. Mr. Erck asked if there would be any drives that it might block the view. Mr. Erwin said it would not. . Mr. Helton asked Mr. Rice if he saw any problem with the sign. Mr. Rice said if th~put it where the plat shows it would be 140 feet from one drive and 294 feet from another, and that would not present a problem. He said that as long as they stay 50 feet from the corner, it would not block the view. Mr. Helton asked Mrs. Calvert if she had received any correspondence~ Mrs. Calvert said she had not received any. Dr. Hahn sai'd if the sign is put where it is shown on the plat, he doesn't see how it would obstruct any view. Mr. Trammel said that Phase 2 backs up to Jo Beel·s restaurant and there would be no way to place a sign there. Mr. Erck asked what the sign was to be made of. . Mr. Trammel said it would be 2 x 8 rough cedar bolted together and have 10 inch high and 3 inch thick letters glued in. The Chairman called for those wishing to speak in favor of or in opposition to this request to please come forward. . . . Page 5 Z B A Minutes July 9, 1981 ADJOURNMENT There being no one wishing to speak, the Chairman closed the Public Hearing. Dr. Hahn moved, seconded by Mrs. Hinkle, to approve BA 81-14 as requested. The motion carried 4-0 and the following vote was recorded: Hahn, yea, Hinkle, yea, Erck, yea, and Helton, yea. The meeting adjourned at 7:35 P.
