MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
DECEMBER 10, 1981 - 7:00 P. M.
CALL TO ORDER
The meeting was called to order by the
Chairman, H. B. Helton, at 7:02 P. M.

CONSIDERATION OF THE MINUTES
OF JUNE 11, 1981
Mr. Range moved, seconded by Mr. Erck, to
approve the minutes as written.
This motion carried 4-0 with Dr. Hahn
abstaining since he was not present.

CONSIDERATION OF THE MINUTES
OF JULY 9,1981
Mr. Erck moved, seconded by Dr. Hahn, to
approve the mi'nutes as written.
This motion carried 3-0 with Mr. Roseberry
and Mr. Range abstaining since they were
not present.
NEW BUSINESS
1. BA 81-15
APPROVED
Request of Mike McCoy to vary from the
zoning ordinance #179 on Tract 3C1, Abstract
499, J. B. Eden Survey, to be allowed to
bui'ld in Agricultural Zoning without the
required 150 ft. road frontage.
This property is located on the West side of
Eden Road between 7201 and 7221 Eden Road.
This address is 7217 Eden Road.
Mike McCoy came forward. He said he wants to
build a house on this property which is in
Agricultural zoning, but lacks a little being
wide enough to meet the code.

Mr. Helton stated the tract showed to have
123.6 ft. road frontage instead of the
required 150 ft.
Bill Rice stated Mr. McCoy already has his
perk test approved.
Mr. Erck asked Mrs. Calvert if there had
been any correspondence regarding this
request.
Mrs. Calvert stated there had been none.
Mr. Range asked if there was a house built
on the tract to the north of this property.
Mr. McCoy stated there was.
Mr. Range said this plat shows it not to
have the proper amount of road frontage.
The Chairman called for those wishing to
speak in favor of this request to please
come forward.

There being no one, the Chairman called for
those wishing to speak ion opposition to
please come forward.
Glenn Pargmann, 7221 Eden Road, came forward.
He said he owns the property adjacent to this
property.
Mr. Pargmann asked if this request would
affect the Agr;-cultural zoning of his house
which he bought from Mr. McCoy.
Mr. Helton asked if he had enough road
frontage.
Mr. McCoy said he had enough before he sold
it to Mr. Pargmann~
Bill Rice said the only way it would affect
him would be if he came ion for a building
permtt to remodel or something, he would
then have to get a variance also.

Mr. Roseberry said this request would have
no bearing on Mr. Pargmann1s property.

Mr. Helton said he would like to have an
Attorney1s opinion on this.
Mr. Roseberry said it made Mr. Pargman1s
property non-conforming. He said if you
even get a permit to put in a pool, you
would need a variance.
Mr. Pargmann said they are in a dispute;
he said he would have had enough road
frontage if he could have bought more from
Mr. McCoy.
Mr. Roseberry said unless there is a policy
change, you would have no problem, but there
is a large turn over in board members; it
is how you interpet the law.
Mr. Pargmann asked if this one would not
set a presidence over the other.
Mr. Roseberry said it would not.

Mr. Rice said he could issue a permit for
up to 50% of the existing building without
requiring a vari"ance.
Mr. Range said if the Board denies this
request, Mr. Pargmann could get his 150 ft.
road frontage.
Mr. Pargmann said he would request the Board
postpone any action on this until they get
their dispute settled.
Dr. Hahn said he didn1t feel the Board should
postpone this request.
Mr. Helton asked if this property was plattede
Mr. Rice said it was not.
Mr. Pargmann said he has a copy of his survey.
Dr. Hahn moved, seconded by Mr. Erck, to
approve BA 81-15 as requested.

This motion carried 5-0 with the following
vote recorded: Hahn, yea, Erck, yea, Range,
yea, Roseberry, yea, and Helton, yea.
