CALL TO ORDER ROLL CALL CONSIDERATION OF THE MINUTES OF OCTOBER 23, 1980 NE~J BUSINESS PS 80-47 ~ MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, NOVEMBER 20, 1980 The meeting was called to order by the Chairman, Carl Greenfield, at 7:40 P.M. Request of Ron Lusk for final plat of Lots 8-14, Richland Heights Addition. Ernest Hedgcoth came forward to represent Mr. Lusk in his request. Mr. Hedgcoth said he had made the necessary corrections. He said the request had been postponed due to the square footage of a lot. r·1r. Hedgcoth sa i d he made two lots ins tead of three facing Booth Calloway Road which are 12,000 sq. ft. lots now. ~1r. Hedgcoth stated he had received the City Engineer1s letters of October 15th and November 11th, and they agree to all the comments. Mr. Greenfield said he understands that Mr. Lusk has already signed a convenant with the city for improvements on Booth Calloway Road. Mr. Hedgcoth said that was correct. Mr. Hedgcoth stated that on item #2, he had moved the building line to 25 feet as requested; . . . ~ Page 2 P & Z Minutes November 20, 1980 he said he had placed the zoning on the plat, agreed to pay the pro rata, and signed a covenant for the street improvement. The Chairman called for anyone wishing to speak in favor of or in opposition to this request to please come forward. There being no one wishing to speak regarding this request, the Chairman closed the public hearing. PS 80-47 APPROVED ~1r. Bowen moved, seconded by ~1rs. Nash, to approve PS 80-47 subject to the Engineer's comments. Motion carried 3-0. PS 80-51 Request of Cross Roads Dev. Co. for preliminary plat of Blocks 2R, 5, & 6, Snow Heights North Addn. Request of Cross Roads Dev. Co. for final plat of Blocks 2R, 5, & 6, Snow Heights North Addn. PS 80-52 Delbert Stembridge, Consulting Engineer, came forward to represent Cross Roads Dev. Co. in their requests. Mr. Stembridge stated this was part of a 103 acre tract at Rufe Snow and Loop 820. Mr. Stembridge said he wasn't able to submit the construction plans at this time, but he is working closely with Knowlton, English, and Flowers on the drainage for Rufe Snow. Mr. Stembridge stated they have no objections to the pro rata, and they will be installing the sewer themselves. Mr. Bowen asked Mr. Stembridge if he was aware of the additional easements the utility companies had requested. Mr. Stembridge said he was aware of it and he would talk with the utility companies and will satisfy them. PS 80-51 APPROVED Mrs. Nash moved, seconded by Mr. Bowen, to approve PS 80-51 subject to the Engineer's comments and submission of Construction Plans and their approval by the City Engineer, and to satisfy the additional easements for the utility companies. Motion carried 3-0. PS 80-52 APPROVED Mr. Bowen moved, seconded by ~1rs. Nash, to approve PS 80-52 subject to the Engineer's comments and submission of Construction Plans and their approval by the City Engineer, and to satisfy the additional easements for the utility companies. Motion carried 3-0. PS 80-53 Request of Schick Shadel Hospital for final plat of Lot 1, Block D, Calloway Farms Addn. Ted Everage, Everage Engineers, came forward to represent Schick Hospital in their request. Mr. Everage said they had received the City Engineer's letter and agree to all the comments except item #1 which there is some question as to what it means. Mr. Greenfield said to disregard item #1. Mr. Everage said they would give any easements that are necessary. The Chairman called for anyone wishing to speak in favor of or in opposition to this request to please come forward. There being no one wishing to speak regarding this request, the Chairman closed the public hearing. PS 80-53 APPROVED Mrs. Nash moved, seconded by Mr. Bowen, to approve PS 80-53 subject to the Engineer's comments. Motion carried 3-0. PS 80-54 Request of Clark Brothers for preliminary plat of Lots 1-16, Block 1, NR~1 Industrial Park. Gordon Swift, Consulting Engineer, came forward to represent Clark Brothers in their request. ~ Page 4 P & Z Minutes November 20, 1980 . Mr. Swift said he had visited with the City Engineer regarding item #4 of the Engineer's letter regarding drainage. Mr. Swift said the drainage ditch originally was in the middle of College Hill Addition, but was moved to the outer boundary line. Mr. Swift said he did the drainage study for that area and he would reprint the drainage plans for Mr. Albin, City Engineer, since he was not working for the city at that time. r1r. Swift said that after r·1r. Albin reviews the drainage plans, he will get with him and make any agreement necessary. r..1r. Swift said he has a revised preliminary plat of this property which he would like to submit. He said it has an emergency exit. t1r. Swift said they will construct a barrier which will not allow trucks exiting through this emergency exit; it will only be large enough for a fire truck. . Mr. Greenfield asked Mr. Swift if he was aware that the fire marshall will require no parking on one side of the street in order to be able to get a fire truck through the area at anytime. Mr. Swift said he did not think anyone should be allowed to plat with the idea of on-street parking. Mr. Greenfield asked him if he would agree to the no parking requirement. r 1 r. S vi i f t sa i d he wo u 1 d . Mr. Greenfield asked Mr. Swift about the railroad spur - if it would interfere with the drainage ditch. Mr. Swift said it would not. He said that was a 125 ft. across drainage ditch and they have no plans to change it. . ~1r. Horvath asked r~r. Swift to elaborate on item #4 of the Engineer's letter regarding calculations for Calloway Branch drainage channel. ~ Page 5 P & Z ~1i nutes November 20, 1980 . t1r. Swift said the 62 ft. is large enough. Mr. Horvath asked about the contour lines. Mr. Swift said he will have a profile study made and will fix accordingly. Mr. Swift said that on the revised plan, he changed the sewer line to 10 inches. . Mrs. Calvert told the Commission that if they approve this request, they should make it subject to additional Engineer's comments regarding this revised preliminary plat. r~r. Horvath asked r1r. Swift if he \~as a\~are of the additional easements that were requested by the utility companies. r1r. Swift said he was. He said they would agree to all except the one next to the rail- road. He said the Federal Railroad will not allow an easement next to the railroad. Mr. Swift said he would work with the utility companies to satisfy them. The Chairman called for anyone wishing to speak in favor of or in opposition to this request to please come forward. There being no one wishing to speak regarding this request, the Chairman closed the public hearing. PS 80-54 APPROVED Mr. Bowen moved, seconded by ~1rs. Nash, to approve PS 80-54 subject to the additional utility easements being worked out and subject to the Engineer's comments now and any additional Engineer's comments on the revised preliminary plat. The motion carried 3-0. Request of Pizza Hut of North Texas to rezone Lot 1, Block 25, Clearview Addition, from its present classification of Local Retail to a proposed classification of Local Retail-Specific Use-Sale of Alcoholic Beverages. This property is located at 7901 Grapevine Hwy. PZ 80-41 . Thomas Anagnostis came forward to represent Pizza Hut and Gerald Anderson Beverage Company in their request. ~ Page 6 P & Z Minutes November 20, 1980 . Mr. Anagnostis said this is the second time they have made this request. He said they were denied the request in 1978. Mr. Anagnostis said he felt it was unfair to not be allowed to serve alcoholic beverages with their food. He said that no one would be allowed to leave the premises with an alcoholic beverage. Mr. Anagnostis said it would only be 5% of the net sales and he felt they should be allowed to sell alcholic beverages as the others in the area have. He said he had made a study of the restaurants in the area that have been allowed to sell alcoholic beverages with their food; they are Steak & Ale, Jo Beels, Dos Gringos, Red Lobster, Bennigans, Dos Vecinos, and Jamie's, not taking into consideration the places that sell beer for off-premises consumption. . The Chairman called for anyone wishing to speak in favor of or in opposition to this request to please come forward. There being no one wishing to speak regarding this request, the Chairman closed the public hearing. PZ 80-41 APPROVED Mr. Bowen moved, seconded by Mrs. Nash, to approve PZ 80-41 as requested. Motion carried 3-0. PZ 80-42 Request of Dr. James Waggener to rezone Tract 170 and a portion of 16B, Abstract 1606, from its present classification of IF-7 to a proposed classification of Local Retail. This property is located on the east side of Davis Blvd., one block south of Emerald Hills Way. Beryl Stewart came forward to represent Dr. Waggener and the YMCA in their request. He said they wanted to build a one story, 1600 sq. ft. doctor's clinic. Mr. Stewart said this piece of land has a 125 ft. frontage on Davis Blvd. . The Chairman called for anyone wishing to speak in favor of or in opposition to this request to please come forward. Page 7 P & Z ~1i nutes November 20, 1980 . Scotty Morrison came forward. He said he represented the YNCA who is selling the property. Mr. Morrison said they feel it would be an asset to the area. The Chairman called for anyone else wishing to speak regarding this matter to please come forward. There being no one else wishing to speak, the Chairman closed the public hearing. PZ 80-42 APPROVED r~rs. Nas h moved, seconded by ~1r. Bowen, to approve PZ 80-42 as requested. The motion carried 3-0. PZ 80-43 Request of Russel M. Haws to rezone Tract 3B, Abstract 308, from its present classification of Multi-family to a proposed classification of Local Retail. This property is located on the north side of Airport Freeway Frontage Road and approximately 250 ft. southwest of the intersection of Weyland Drive and the Frontage Road. . Ernest Hedgcoth, Consulting Engineer, came forward to represent Mr. Haws in this request. He said Mr. Haws needs the rezoning so he can build a two-story office building. Mr. Hedgcoth said they are proposing to build a two-story professional office building, but he is not sure if any of the spaces are leased yet, but they have been talking with several lawyers and doctors regarding this. Mr. Hedgcoth said the building would have steel columns with a rustic appearance similar to Jo Beel IS. He said it would be approximately 20,000 sq. ft. office building which would have wood trusses with wood and brick. Mrs. Nash asked if the site plan shown here is the said as the one on the plat. . Mr. Hedgcoth said that was only an architectural drawing. He said the drawing cuts off too soon, and they would have more flexibility with what the plat shows. r·1r. Hedgcoth sa i d they may deve lop the other property later, but at this time, they are only committed to the property in question which will be Lot 2, Block 5, Richland Oaks Addition, 5th Filing. He said the architectural drawing just shows what could be developed there. The Chairman called for anyone wishing to speak in favor of or in opposition to this request to please come forward. There being no one wishing to speak regarding this request, the Chairman closed the public hearing. PZ 80-43 APPROVED ~1r. Bowen moved, seconded by r1rs. Nash, to approve PZ 80-43 as requested. The motion carried 3-0. PS 80-55 Request of Russel M. Haws for final plat of Lot 2, Block 5, Richland Oaks Addition, 5th Filing. Ernest Hedgcoth came forward. He said this is the final plat of the property just heard for zoning to Local Retail. . . Mr. Hedgcoth said they had previously submitted a preliminary plat for 7.8 acres, and now they want to final plat a portion of this property. Mr. Hedgcoth stated they had received the City Engineer's comments and have no problem with any of them. He said in regards to item #1, the developer will use a six by six inch tapping sleeve and valve as suggested in the letter; #2, the developer agrees to pay the pro rata share of the six-inch water line along Airport Freeway at $4.00 per linear foot for 87.62 feet or $350.48; #3, the developer agrees to pay the pro rata cost of the 10-inch sewer line running along the northern boundary line of the subject's property which is 131.5 ft. at $5.50 per foot or $723.25; #4, the zoning will be placed on the final plat; and #5, the utility companies will be contacted concerning any required easements to be placed on the plat. r1r. Hedgcoth said they would grant the utility companies the 5 ft. easement which they had requested across the northern boundary. ~ Page 9 p & Z Minutes November 20, 1980 .
