MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
NOVEMBER 13, 1980
CALL TO ORDER
The meeting was called to order by the
Chairman, H. B. Helton, at 7:02 P.M.

CONSIDERATION OF THE MINUTES
OF OCTOBER 9, 1980
Dr. Hahn said that on the last page,
paragraph 8, it should read lIacquaintancell.
Mr. Range moved, seconded by Dr. Hahn, to
approve the minutes with this one correction.
The motion carried 4-0 with the following
vote recorded: Helton, yea, Roseberry, yea,
Hahn, yea, and Range, yea. Mrs. Hinkle
abstained due to being absent at this meeting.
NEW BUSINESS
BA 80-17
APPROVED
Request of David Barfield to vary from the
Zoning Ordinance #179 on a portion of Tract
3R, Abstract 1055, to be allowed to convert
a building previously designated as a barn
or storage building to a temporary residence
for a period of 3 years until such time as a
permanent residence can be completed.
This property is located on the west side of
Precinct Line Road, approximately 700 feet
south of Amundson Drive.
David Barfield came forward. He said he
brought his plans and perk test in to Mrs.
Calvert as was requested.
Mr. Barfield asked if the Board wanted him
to explain his request again for the record.
Mr. Helton said that would not be necessary.

Mr. Range asked if the city staff had
reviewed the plans.
Mr. Browning said the plans meets the
city codes except for the 75% brick.
Dr. Hahn asked Mr. Barfield about the perk
test.
Mr. Barfield said he was required to have
a one inch drop per hour and his tested to
have one inch drop per 35 minutes.
Mr. Roseberry asked Mr. Barfield if he planned
to convert the structure back to a barn at the
end of the 3 years.
Mr. Barfield said that was his plans now, but
if something changed, he would come back
before the Board.
Mr. Barfield showed the Board his plans. He
said the building is of sheet metal, Mesco
type building.
Mr. Barfield also showed the Board an
architectural rendering of the house he plans
to build which will be octagon shape with
solar heat. He said it would take approxi-
mately 2 years to build.
Mr. Barfield said the house would have 3000
sq. ft. floor space and appraised at $196,000.
The Chairman called for anyone wishing to
speak in favor of or in opposition to this
request to please come forward.
There being no one to speak, the Chairman
closed the public hearing.
Mr. Range moved that BA 80-17 be approved
with the stipulation that after 3 years, it
be reverted back to a barn or storage building.
This motion was seconded by Mr. Roseberry, and
the motion carried 5-0 with the following vote
recorded: Helton, yea, Roseberry, yea, Hahn,
yea, Range, yea, and Hinkle, yea.

BA 80-21
POSTPONED
Request of Rolling Hills Baptist Church
to vary from the Zoning Ordinance #179 on
Lots 1 & 2, Block C, Richland Oaks Addition,
3rd Filing, to be allowed to remodel an
existing building which does not nor can
be made to meet the city building codes,
and that they not be required to replat the
lots into one lot since the building extends
across the lot line.
This property is located at the northeast
corner of Oakridge Terrace and Bridal Path.
John Higgins came forward to represent the
Trustees of Rolling Hills Baptist Church.
Mr. Higgins said this is a small building
which is being used as a temporary meeting
place for different church groups.

Mr. Higgins said the church is in the process
of future development of a retirement center.
He said they want to convert this 2000 sq. ft.
building into a mock-up apartment complex
illustrating the proposed Retirement Center.
Mrs. Calvert said the person that came in and
talked with Mr. Caldwell, City Building Official,
and her said they planned to have a Day Care
Center in this building.
Mr. Higgins said he did not know who came in
nor where the idea came from about a Day Care
Center; he has not heard anything about this.
Mr. Browning said the city was never contacted
for a re-ok permit and inspection to use the
building. He said the City Inspector and the
Fire Marshal is supposed to inspect the build-
ing before they are allowed electrical power.
Mr. Browning said he had talked to the Fire
Marshal, Johnny Howard, and he said he had
not been contacted, either.
Mr. Range asked Mr. Higgins if this building
was to be a display, not to be used.
Mr. Higgins said that was correct, but that it
is now being used by church groups.

Mrs. Hinkle asked Mr. Higgins to explain
again what they plan to use the building for.
Mr. Higgins said they plan, in the future,
to build a Retirement Center; in order to
sell the people on the idea, they need to
have a IIMock Apartment" to show. He said
the plumbing would not be hooked up.
Mr. Roseberry asked what the zoning was on
this property.
Mr. Higgins said it was residential.
Mr. Helton said he felt the church should
re-submit their request.
Mr. Roseberry asked if they had appeared
before the Planning and Zoning Commission.
Mr. Higgins said they had not as yet.
Mrs. Hinkle asked Mr. Higgins about the floor
plan that was submitted with the application.
Mr. Higgins said he had not seen this floor
plan and did not know where it came from.
Mr. Higgins said they want to see if there
is enough interest in a Retirement Village
before they come in for a zoning change.
Dr. Hahn said it seemed to him that they have
a request for one thing and they are asking
for another.
Mr. Helton said it looks like the Board
should postpone this request until the
church makes up its mind or decides what they
want.
Mr. Higgins said he was telling the Board
what the church wants to do. He said he
doesn1t know where the idea of a Day Care
came from.
Mr. Range moved, seconded by Mrs. Hinkle, to
postpone SA 80-21 until next month and that
they re-submit their application.

This motion carried 5-0 with the following
vote recorded: Helton, yea, Roseberry, yea,
Hahn, yea, Range, yea, and Hinkle, yea.
Dr. Hahn asked Mrs. Calvert if the property
owners within 200 feet of this property
would have to be contacted again.
Mrs. Calvert said they would not since it
was in the motion to be heard at the next
month1s meeting.
BA 80-22
APPROVED
Request of Victor L. Caldwell to vary from
the Zoning Ordinance #179 on Lots 2 & 3,
Block 1, A. G. Walker Subdivision, to be
allowed to install a metal rail 1811 above
the ground on pipe posts around 3 sides of
his building.
This property is located at 7131 Grapevine Hwy.
Victor Caldwell came forward. He said this
property is located at the intersection of
Grapevine Highway and Glenview Drive.

Mr. Caldwell said this is a very busy inter-
section and lots of cars dash through his
property to save having to wait for a traffic
light.
Mr. Caldwell said he needs this rail fence up
for that reason and also for security. He
said he had 3 autos stolen from his property.
Mr. Helton asked if the fence would be open
during the day.
Mr. Caldwell said it would not be, but there
would be entrances into the property which
would be open in the day and blocked at night.
Mr. Helton asked what the ordinance was regard-
ing this.
Mr. Browning said that Ordinance #179 does
not allow any type of structure past the front
of the building.
Mr. Roseberry said a rail fence is required now
by the City Council on every car lot that is
allowed in North Richland Hills.

Mr. Caldwell said he has the property leased.
He said he doesn1t know where the property
line is, but the owner furnished the Board
with a plat of the property.
Mr. Madera said they were well within their
property line.
Mr. Browning said the property pin shown
on the plat shows the fence would be within
their property line.
Dr. Hahn asked how close together the rods
would be.
Mr. Caldwell said he wasn1t sure how close
he would have to put them until he started;
he would need to see how close they needed
to be to make it sturdy enough.
Mr. Roseberry asked Mr. Caldwell if he would
object to using two inch pipe.
Mr. Caldwell said he had already purchased
the one inch pipe.
Mr. Range asked Mr. Caldwell if there were
many pedestrians in that area.
Mr. Caldwell said there were not.
Mr. Roseberry asked Mr. Caldwell if he could
weld some plates on the rail fence and paint
them so the fence could be seen.
Mr. Caldwell said the posts would be 8-10 feet
apart and he guessed he could hang "no parkingll
signs on it.
The Chairman called for anyone wishing to
speak in favor of or in opposition to this
request to please come forward.
Martin Erck came forward. He said he occupies
the building next door to this property.
Mr. Erck said the danger is the cars running
through their property. He said he feels this
is more dangerous than someone not being able
to see the rail fence.

Dr. Hahn asked Mr. Caldwell what kind of
posts he plans to have.
Mr. Caldwell said they would be 2 inch
pipe posts.
Dr. Hahn said he was concerned if it would
be strong enough to keep out intruders.
The Chairman called for anyone else wishing
to speak to please come forward.
There being no one else to speak, the
Chairman closed the public hearing.
Mr. Roseberry moved, seconded by Mr. Range,
to approve BA 80-22 with the stipulation that
the one inch pipe rail fence be marked and
inspected by the city.
This motion carried 5-0 with the following
vote recorded: Helton, yea, Roseberry, yea,
Range, yea, Hahn, yea, and Hinkle, yea.
BA 80-23
APPROVED
Request of Michael H. Smith to vary from the
Zoning Ordinance #179 on Lot 6R, Block 10,
Richland Terrace Addition, to be allowed to
build a carport beyond the front building line.
This property is located at 5017 Roberta Drive.
Michael Smith came forward. He said he was
requesting to be allowed to build a carport
in front of his garage because he uses his
garage for a model railroad.
Mr. Helton asked what the carport would be
constructed of.
Mr. W. F. Smith, father of Michael Smith,
came forward. He said it is of enamel metal
which he feels would be an asset to the property.
He said it would be 17 feet by 19 feet.
Mrs. Hinkle asked how far it would be from
the street.
Mr. Smith said they plan to move the posts in
toward the house 3 feet.

The Chairman called for anyone wishing to
speak in favor of or in opposition to this
request to please come forward.
Tim Carroll came forward. He said he lives
directly across from Mr. Smith and he
represents most of the neighbors. Mr. Carroll
said they feel this this carport is a nice
addition to the area and they do not see why
he shouldn't be allowed to finish it.
Paula Gifford, 5100 Roberta Drive, came forward.
She said they have a problem with this area
deteriorating. She said the man has ample
property to put the carport on one side of the
house.
Mrs. Gifford said if she had to sell her house,
she feels no one would buy it because of the
house across the street with a carport stick-
ing out on the front.
Mrs. Gifford said she had lived here 16 years.
Bob Richmond, 5013 Roberta Drive, came forward.
He said he believes the carport enhances the
property. Mr. Richmond said it looks good and
he wishes he could afford one like it.
Mrs. Hinkle said there was another carport on
the block and it looks nice.
Mrs. Wayne Massie, 5008 Roberta Drive, came
forward. She said she thinks the carport
would help the looks of the neighborhood.
Mrs. Massie said she had lived here 21 years
and there are some in the neighborhood who
just likes to complain.
Dr. Hahn asked why it could not be built on
the side of the house.
Mr. Smith said the concrete is already there
and also that is where you always would park
your car.
Mr. Range asked if it was built on the north
side of the house, would they have to have a
variance also.
Mr. Browning said they would.

Mrs. Gifford said she doesnlt like it
sticking out on the front because it breaks
the continuity of the front of the houses.
Mr. Helton said Mrs. Gifford stated she
bought in this area 16 years ago; did nit
she buy with a carport in the neighborhood.
Mrs. Gifford said the other carport was
down the block.

Mr. Massie, 5008 Roberta Drive, came forward.
He said he felt the carport would look better
in the front. He said the one down the street
they are speaking of is next door to him, and
he has no objections to it. He said he feels
the carport would increase the value of the
property in the area.
Bob Richmond said one thing should be considered
if it was put on the side of the house, it
might obstruct the view of traffic.
The Chairman called for anyone else wishing to
speak regarding this matter to come forward.
There being no one else to speak, the Chairman
closed the public hearing.
Mr. Range said he felt it would make an
economic hardship for Mr. Smith to have to tare
the carport down, and if the variance were
granted, it would not cause a safety problem,
and ,t would protect Mr. Smith's property.
Mr. Range said that in view of this, he would
make a motion to approve BA 80-23 as requested.
This motion was seconded by Dr. Hahn, and the
motion carried 5-0 with the following vote
recorded: Helton, yea, Roseberry, yea, Hahn,
yea, Range, yea, and Hinkle, yea.
ADJOURNMENT
The meeting adjourned at 8:03 P.M.
