MINUTES OF THE REGULAR MEETING OF THE
PLANNING AND ZONING COMMISSION OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
APRIL 26, 1979
CALL TO ORDER
The regular meeting of the Planning and
Zoning Commission was called to order by
the Chairman, Mary Jo Shaunty, at 7:35 P.M.

CONSIDERATION OF THE MINUTES
OF MARCH 22, 1979
Mr. Grubb moved, seconded by Mr. Knowles,
to approve the minutes as read. Motion
carried 4-0.
CONSIDERATION OF THE MINUTES
OF MARCH 29, 1979
Mr. Knowles moved, seconded by Mr. Eckhardt,
to approve the minutes as read. Motion
carried 3-0 with Mr. Grubb abstaining since
he was not present at this meeting.
NEW BUSINESS
PZ 79-14
APPROVED
Request of Stop N Go Markets to rezone Lot 1,
Block 1, Northland Shopping Center Addition,
from its present classification of Local
Retail to a proposed classification of Local
Retail-Specific Use-Sale of Beer for off-
premise consumption.
This property is located in the Southeast
corner of Watauga-Smithfield Road and Rufe
Snow Drive.
Mr. Ron Eagan represented Stop N Go Markets
in their request.
Mr. Grubb asked when this store would be
built.
Mr. Eagan stated they already had it about
50% built.

Mr. Anderson stated the reason they already
had the building started, they thought
since the City was wet, they would have no
problem in selling beer. They did not
realize they still had to have a specific
use zoning in order to sell the beer.
The Chairman asked if there was anyone who
wished to speak in favor or in opposition
of this request.
Mr. Grubb moved, seconded by Mr. Knowles,
to approve PZ 79-14 as requested. Motion
carried 4-0.
PZ 79-15
APPROVED
Request of Frank Ayers, Jr. to rezone Tract
2C1, Abstract 311, from its present classi-
fication of Agriculture to a proposed classi-
fication of 1F-9-0ne Family Dwelling.
This property is located on the West side of
Douglas Lane and approximately 800 ft. South
of Starnes Road.

Request of Frank Ayers, Jr. for preliminary
plat of Lot 58, Block 8, Windcrest Addition.
Request of Frank Ayers, Jr. for final plat
of Lot 58, Block 8, Windcrest Addition.
Mr. Delbert Stembridge represented Mr. Ayers
in his requests. He stated Mr. Ayers wanted
to build a swimming pool. He said Mr. Ayers'
pool contractor came in for a permit and was
told that the permit had been approved but
was not typed up and to come back in about 3
days and pick it up. Mr. Stembridge stated
the contractor then went out and started
digging the hole for the pool, and when he
came back in to pick up the permit, he found
out the inspector had not approved the permit
because the property would have to be rezoned
and platted. Mr. Stembridge stated Mr. Ayers
doesn't feel he should have to pay the pro
rata since he is not a developer. There is
already a house on the land and he only wants
to build a swimming pool in his back yard. He
stated that Mr. Ayers does not feel he should
have to give the City the easement until all
the other property owners on his street are
required to.

Mr. Anderson stated this street is to be a
main thoroughfare and the city will need
the right of way.

Mr. Grubb asked Mr. Ayers if he would be
willing to sign a covenant for the pro rata
and give the easement.
Mr. Ayers stated he would be willing to sign
the covenant that he would pay the pro rata
and give the easement when the work is done
on the street and when the other property
owners had to give the same.
The Chairman asked if there was anyone who
wished to speak in favor or in opposition
of these requests.
Mr. Knowles moved, seconded by Mr. Eckhardt,
to approve PZ 79-15 as requested. Motion
carried 4-0.
Mr. Grubb moved, seconded by Mr. Eckhardt,
to approve PS 79-31 as requested and that
Mr. Ayers be allowed to sign a covenant for
the pro rata and easement to be paid when
the street is put in. Motion carried 4-0.
Mr. Grubb moved, seconded by Mr. Eckhardt,
to approve PS 79-32 as requested and that
Mr. Ayers be allowed to sign a covenant for
the pro rata and easement to be paid when
the street is put in. Motion carried 4-0.
PZ 79-16
This case was moved to the end of the agenda
since there was no one to present the case.
PZ 79-17
APPROVED
Request of Jessie R. Johnson to rezone Lots
4 & 5, Block 3, Meacham Addition from its
present classification of 1F-9 to a proposed
classification of Industrial.
This property is located on the South side of
St. Louis and Southwestern railroad track,
directly across from the proposed Smith
Business Center.
Mr. Jessie Johnson presented his request to
the Commission. He stated he purchased this
property a few months ago. He said he plans
to build a small warehouse and shop. He stated
there would be no water and sewer problems.
The Chairman asked if there were any who wished
to speak in favor or in opposition of this
request.

Jerry Fields, 6421 Smithfield Road, stated
there were about 4 houses around this property
that are still on septic tanks. He stated
they all need to be on the sewer. He said
maybe they could when this property is
developed.
Mr. K.D. Bell, 7829 Arthur Dr., stated he
was not speaking in favor or against this
request, but he wanted to know why Mr.
Johnson was asking for Industrial instead of
Commercial.
Mr. Anderson stated that it is the City
Council 's policy to try to protect the zoning
along the railroad track. He stated they
would rather it be Industrial.
Mr. Bell asked if this would affect Guy Street.
Mr. Anderson stated it is a dedicated street,
but there are several alternatives. He said
it could possibly be abanåòned.
Mr. Bell stated this property is adjacent to
his property.
Mr. Anderson stated the property owners would
be protected. He stated that in Industrial
zoning where it abutts residential, the City
ordinance requires a 6 ft. sight barring
fence be installed, and if the property is
lighted, the lighting will have to be set so
it would not constitute a nuisance to the
residences.
Mr. Bell asked if Mr. Johnson~s house was
included in this zoning request.
Mrs. Johnson stated it did not include their
house. She stated the house is still in her
name, Virginia Goodman. She stated she owned
this property before she married Mr. Johnson.
Mr. Grubb stated the council tries to find
the best use of the land and this Industrial
zoning is what they feel is best for property
along the railroad.
The Chairman asked if there was anyone else

to approve PZ 79-17 as requested. Motion
carried 4-0. I
Request of Jack E. Roseberry and Lee Bonham
to rezone Tract 2F, Abstract 1040, from its
present classification of Agriculture to a
proposed classification of Commercial.
This property is located on the West side
of Smithfield Road and 120 ft. South of
Odell Street.
Mr. Jack Roseberry presented his request to
the Commission. He stated this property is
approximately 93 feet wide on Smithfield Rd.
and 210 feet deep. He stated that due to the
neighborhood being in transition, he feels
this would be the best use of this property.
Mr. Roseberry showed the Commission some
pictures of the adjoining properties.
Mrs. Shaunty asked Mr. Roseberry what he
planned to do with the property.
Mr. Roseberry stated he plans to construct
a brick building for Commercial rental pro-
perty. He stated he has employed Mr. Delbert
Stembridge to draw up the platting of the
property which will be heard next month.
The Chairman asked if there was anyone who
wished to speak in favor or in opposition
of this request.
Mr. Knowles moved, seconded by Mr. Eckhardt,
to approve PZ 79-18 as requested. Motion
carried 4-0.
Request of Richland Enterprises for pre-
liminary plat of Holiday West, Section 3.
There was some discussion as to the zoning
of thi s property·.
Mr. Grubb stated the zoning should be shown
on the plat.
Mr. Gordon Swift Consulting Engineer with
offices at 309 W. 7th St. represented Richland
Enterprises in their request. He stated he
had read the Engineer's letter and that there
was too much information and too many details
that really did not concern the Commission.

*Mr. Anderson stated that he did
not agree with Mr. Swift but that
he did not feel that item #10----

But, he said, in reading all the comments,
there really was none that pertained to the
preliminary plat except one comment regarding
the loop streets that measure longer than
1000 ft. He stated there was only one
comment that affects the preliminary plat.
* Mr. Anderson stated that he would agree with
Mr. Swift and that he did not feel that item
#10 regarding the distance of over 1000 ft.
would be a problem. He asked Mr. Swift if
he had measured to see how much over 1000 ft.
they were.
Mr. Swift stated he did not know exactly how
much over they were. He stated the Engineer
had measured around the curves.
Mr. Anderson stated you have to measure
around the street as it curves because you
can not lay a water hose through houses,
you must follow the street.
Mr. Swift stated they had tried several plans
and they feel this one is the best for the
neighborhood. He explained how they had
changed some of the streets.
Mr. Grubb stated these Engineer comments were
not unusual. He stated we have these on most
every plat. He said that most of the time,
the fire chief goes out and looks over the
property and sees what is needed.
Mr. Anderson stated he had talked with the
fire chief and he said they could put in more
fire plugs. He stated it would be ok as long
as there wasn't ever more than 500 feet be-
tween the fire plugs. Mr. Anderson stated
there also could be some minor problem with
the lighting, but he didn't feel there would
be a problem.
Mr. Swift asked Mr. Anderson if they have a
long block, say 800 ft., and they have the
611 curb filled, could they go to a 711 curb
in order to meet the design criteria. He
said it would eliminate his client being out
approximately 20 to 30,000 dollars worth of
storm drainage. He stated it would be much
more economical for his client.

Mr. Anderson stated that our City Ordinance
requires that the curb and gutter carry it
if there are no storm drains. He stated the
concept of carrying water in the street
should be used with discretion. He said
there is a limit to how much water we are to
allow in the street. It is a judgement
matter and would recommend Mr. Swift get
with him or the City Engineer and go over
these problems in the early stages. Mr.
Anderson stated he does not see any major
problems with this layout.
Mr. Swift stated they use the 7" curb in
most cities.
The Chairman asked if there was anyone who
wished to speak in favor or in opposition
of this request.
Mr. Grubb moved, seconded by Mr. Knowles,
to approve PS 79-33 subject to the Engineer's
comments being corrected prior to the final
plat going to the council. Motion carried
4-0.

PS 79-34
APPROVED
Request of Sandlin Homes for replat of
Block 1R, Northridge Addition.
Mr. Mike Sandlin presented his request to the
Commission. He stated they did not want to
change the zoning as they are planning to go
with the original plan for the Townhouses.
He stated they are trying to fit the Town-
houses on the lots and in order to success- .
fully do this they need to enlarge the lots.
This way there would be 29 lots instead of
33. Mr. Sandlin stated he had talked to Mr.
Bronstad regarding the water lines and found
there would be no problem. They would leave
them as they are. Mr. Sandlin stated they
plan to put a street or alleyway through the
project.
The Chairman asked if there was anyone who
wished to speak in favor or in opposition
of this replat.
Mr. Grubb moved, seconded by Mr. Eckhardt, to
approved PS 79-34 subject to the Engineer's
comments. Motion carried 4-0.

ADJOURNMENT

Request of Marvin Smith to rezone Tracts
13A & 13B, Abstract 130, from its present
classification of Commercial to a proposed
classification of Industrial.
This property is located on the West side of
Smithfield Road at the St. Louis and South-
western Railroad track.
Mr. Anderson stated that since there was no
one here to present this request, he would
explain this request. He stated Mr. Smith
came in last month to change the zoning of
this property from Agriculture to Commercial,
but the City Council stated they had rather
the property be zoned Industrial since it runs
along the railroad track. The council re-
quested that Mr. Smith go back through P & Z
at the city's expense and request it be
changed to Industrial zoning.
The Chairman asked if there was anyone who
wished to speak in favor or in opposition
of this request.
Mr. Eckhardt moved, seconded by Mr. Grubb,
to approve PZ 79-16 as requested. Motion
carried 4-0.
