CALL TO ORDER ROLL CALL APPOINTMENT OF P & Z SECRETARY CONSIDERATION OF THE MINUTES OF JULY 26, 1979 NEW BUSINESS PZ 79-30 APPROVED MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, AUGUST 23, 1979 The meeting was called to order by the Chairman, Mary Jo Shaunty, at 7:35 P.M. PRESENT: CHAIRMAN MEMBERS Mary Jo Shaunty Warren Eckhardt Jack Knowles Marjorie Nash CITY STAFF PRESENT: DIRECTOR OF P.W. P & Z CLERKS James Anderson Wanda Calvert Desi Smyth The Chairman appointed Warren Eckhardt to be the Secretary of the Planning and Zoning Commission. Mr. Knowles moved, seconded by Mrs. Nash to approve the minutes as read. Motion carried 4-0. Request of Crosson Dannis, Inc. to rezone a portion of Tract 11, Abstract 1606 from its present classification of Commercial to Commercial-Specific Use-Sale of Alcoholic Beverages. This property is located on Bedford-Euless Road approximately 300 feet from J.C. Penney warehouse. Mr. Chuck Dannis represented Crosson Dannis, Inc. in their request. He stated they wanted to rezone because they were building a Daniels restaurant and wanted to sell alcoholic beverages. He said Daniels is a family type restaurant and liquor would attribute to approximately 20% of their sales. Mrs. Shaunty asked Mr. Anderson where Dos Gringos was located. Mr. Anderson stated Dos Gringos would be on Lot 4 of Cochran Addition and Daniels will be on Lot 2. He also stated there are plans for five different restaurants in that Addition. . . . Mrs. Nash moved, seconded by Mr. Knowles to APPROVE PZ 79-30. Motion carried 3-1 with Mr. Eckhardt voting against. PZ 79-31 APPROVED Request of Roy A. Gifford and E. K. Arledge to rezone Tract lOB, Abstract 1606 from its present classification of Commercial to Commercial-Specific Use-Sale of Used Autos and Car Rental. This property is located on Bedford-Euless Road between First Church of Christian Scientist and La Quinta Motor Inn. Delbert Stembridge, Consultant Engineer, represented Mr. Gifford and Mr. Arledge in their request. He stated they would build a small building approximately 50'xlOQ'. He stated the purpose of the rental business would be to serve the motels in this area and it would be a convenience to their customers. Mr. Stembridge showed the Commission an architectural drawing of the proposed office building. Mrs. Shaunty asked if the cars would be a year or 2 years old or late models. Mr, Stembridge st~ted they would be late models. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of this request. Mrs. Shaunty asked Mr. Anderson what the City Council IS feelings were about the age of the cars. Mr. Anderson stated the Council prefers cars no older than 3 years. He said they could mention in the motion that the cars must not be older than 3 years old. . . . ~ Page 3 P & Z Minutes August 23, 1979 Mr. E. K. Arledge stated the State dealer code listed late model cars as up to 4 years old. He stated their rental cars would be of the current year. Mr. Eckhardt moved, seconded by Mrs. Nash to APPROVE PZ 79-31, with the stipulation that the cars would be 3 years old or newer. Motion carried 4-0. PS 79-57 APPROVED Request of Roy A. Gifford and E. K. Arledge for preliminary plat of Lot 4, Block 1, North Richland Hills Station Add·ition. PS 79-58 APPROVED Request of Roy A. Gifford and E. K. Arledge for final plat of Lot 4, Block 1, North Richland Hills Station Addition. Mr. Stembridge stated he has made all necessary corrections concerning the engineerls comments. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of these requests. Mr. Knowles moved, seconded by Mr. Eckhardt to APPROVE PS 79-57, subject to the engineerls comments. Motion carried 4-0. Mr. Knowles moved, seconded by Mr. Eckhardt to APPROVE PS 79-58, subject to engineer's comments. Motion carried 4-0. PZ 79-32 DENIED Request of Walter H. Lohse to rezone Lots 5R and 27R, Block 4, Richland Terrace Addition from its present classification of IF-9-0ne Family Dwelling to a proposed classification of Commercial. This property is located between Susan Lee Lane and Nancy Lane and borders Loop 820 Frontage Road on the north. Mr. Marvin D. Smith, 7609 Douglas Lane, builder, represented Mr. Lohse and himself because he is the purchaser of the lots. . . . "'I11III Page 4 p & Z Minutes August 23 ~ 1979 Mr. Smith showed the Commission aerial photographs of the lots in question. He stated these lots front on 820 Frontage Road, and to ,the east is Hudiburg. He stated they plan to build office buildings or they might have small retail. Mr. Smith stated that looking at the photos they should agree that it should be commercial. He stated the lots now stay grown up in weeds, have snakes, trash, etc. in them. If zoned commercial for office buildings they will have pavements that will get rid of the weeds and trash; they will put up a stockade fence to separate the residents from the office building, and the building will be of brick construction. Mr. Smith stated if he lived there he would rather have an office building next to him instead of weeds and motorcycle paths. He stated these lots were too small for residential structures. Mr. Anderson asked how old the houses were in this area? Mr. Smith stated they were built around the early 50 IS. He stated some houses are well kept and some are not. These houses were built before 820 Freeway was built. He stated these lots were definitely too small for multi-family. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of this request. Mr. Bill Tiro'f, 4709 Nancy Lane, stated he has lived there for 17 years. He stated he would like to see two new homes there and if he had wanted to live in Commercial zoning he would have moved to one. Mr. Tirof stated he was not contacted when Hudiburg was zoned. He stated he was definitely against a fast food chain being put on these lots. ~ Page 5 P & Z Minutes August 23, 1979 . Mrs. Margaret Turner, 4704 Susan Lee Lane, stated she did not want to live by anything like a 7-11. People will come down their street to get to that place and traffic would be terrible. Mrs. Garner, 4705 Nancy Lane, stated if they zoned these lots commercial she wanted hers to be zoned commercial too. Mr. Smith stated it would not be a fast food place. It will probably be an office building with maybe an insurance office or lawyerls office. He stated if they put in retail shops, they would probably be like a drapery shop or carpet shop. Mr. Smith stated that they keep their rental property very clean. . Mr. Smith also stated that they plan on having the entrances and exits on 820 which should keep the potential traffic problem down. Mrs. Shaunty asked Mr. Smith if he had considered building duplexes on these lots. Mr. Smith asked Mrs. Shaunty if she would live in a duplex on 820. Mrs. Shaunty stated she would rather see duplexes there rather than it to go Commercial. Mr. Anderson stated these lots are distress properties. He said he can understand the homeowners point of view, however, the city sends out several citations each summer for weeds, trash, etc. on these lots. He stated he felt the city would benefit by having these lots zoned Commercial. Mr. Tirdf stated he had known Mr. Smith a long time and he would like to see him build homes on these lots. He stated he had considered legal action against Hudiburg and the City for allowing those trucks there next to him. . Mrs. Nash moved, seconded by Mr. Knowles to DENY PZ 79-32. Motion carried 3-1 with Mr. Eckhardt voting against denial. ~ Page 6 P & Z Minutes August 23, 1979 . PS 79-54 APPROVED Request of J. B. Sandlin for replat of Holiday North Section 6. Mr. Anderson stated this is a request of the City staff. He stated after recording the original plat, the tax office requested change of Block numbers due to a duplication so the engineer re-numbered the blocks, but never brought the plat in to be recorded. The streets are in and the sale of lots have started. He said he requests that the Commission approve this replat. Nothing was changed but the block numbers. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of this request. Mr. Eckhardt moved, seconded by Mr. Knowles, to APPROVE PS 79-54. Motion carried 4-0. . PS 79-55 APPROVED PS 79-56 APPROVED Request of Curtis Ramey for preliminary plat of Lot 1, Block 33, College Hill Addition. Request of Curtis Ramey for final plat of Lot 1, Block 33, College Hill Addition. Mr. Delbert Stembridge represented Mr. Ramey in his request. He stated he intends to put in mini warehouses on this trianglar piece of land. He stated all engineer's comments have been corrected. Mrs. Shaunty asked what was it zoned? . Mr. Anderson stated it was zoned Commercial about 2 months ago. Jack Roseberry stated he and Mr. Ramey own this property which is a small piece of land with 526 ft. of road frontage. He stated he understands it is Council policy that if there is already water on property they would not be required to pay for it again. Mrs. Shaunty stated they could approve subject to the engineerls comments but it would be up to the Council to waive this. Mr. Knowles moved, seconded by Mr~ Eckhardt to APPROVE PS 79-55 subject to engineer~s comments. PS 79-59 APPROVED PS 79-60 APPROVED Request of Mobile Oil Corp. for preliminary plat of Lot 2, Block 25, Snow Heights Addition. Request of Mobile Oil Corp. for final plat of Lot 2, Block 25, Snow Heights Addition. Mr. Delbert Stembridge represented Mobile Oil in their requests. He stated that they wanted to put in an underground tank but in order to do that they had to get a building permit. When they tried to get the permit they found out they needed to plat the property. He said all engineerls comments were met. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of these requests. Mr. Eckhardt moved, seconded by Mrs. Nash to APPROVE PS 79-59 subject to engineerls comments. Motion carried 4-0. Mr. Eckhardt moved, seconded by Mrs. Nash to APPROVE PS 79-60 subject to engineerls comments. Motion carried 4-0. PS 79-61 APPROVED Request of Sabine Valley Industries for preliminary plat of Lot 20, Block 4, Diamond Loch Subdivision. PS 79-62 APPROVED Request of Sabine Valley Industries for final plat of Lot 20, Block 4, Diamond Loc~ì Subdivision. Mr. Malcolm Fleet, with Sabine Valley Industries stated they received letter from City engineer saying there were no comments that needed to be corrected. He stated the exterior would be stucco and rough cedar. They have already begun advertisinB for lease space for barber shops, flower shops, etc. ~ P!ige 8 P & Z Minutes August 23, 1979 . Mrs. Shaunty asked if this building would meet building codes. Mr. Anderson stated basically, yes. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of this request. Mr. Eckhardt moved, seconded by Mr. Knowles to APPROVE PS 79-61. Motion carried 4-0. Mr. Eckhardt moved, seconded by Mr. Knowles to APPROVE PS 79-62. Motion carried 4-0. PS 79-63 APPROVED Request of Folsom Investment, Inc. for preliminary plat of Walters Branch Addition. Mr. Bill Boomer, with Gordon Swift, stated they had no problems with the engineerls comments and they agree to correct all items. . Mrs. Shaunty asked if there would be a drainage problem? Mr. Anderson stated there was a flood channel grown up with trees and brush on this property and with the development of this property, this should clean the channel up. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of this request. Mr. Knowles moved, seconded by Mr. Eckhardt to APPROVE PS 79-63 subject to engineer's comments. Motion carried 4-0. PS 79-64 APPROVED Request of James Rust for preliminary plat of Lots 15-26, Block 1, and Lots 2-13, Block 6, Le Garent Estates. . . . . ~ Page 9 P & Z Minutes August 23, 1979 Walter Elliott, of Elliott and Hughes, represented Mr. Rust. He stated at the last meeting they presented a preliminary of first section. They satisfied conditions received in the letter from the city engineer and agree to correct all comments. Mr. Elliott stated the final plat will be combined with first section and developed at the same time. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of this request. Mrs. Nash moved, seconded by Mr. Eckhardt to APPROVE PS 79-64 as requested. Motion carried 4-0. PS 79-65 APPROVED Request of Whataburger for replat of Lot 1, Block 19, Clearview Addition. Mickey Nowell with Whataburger in Grand Prairie, represented Whataburger in their request. He stated they were going to do some minor remodeling and in the process found out they needed to replat the property into a separate block. Mrs. Shaunty asked if there was anyone who wished to speak in favor or in opposition of this request. Mr. Eckhardt moved, seconded by Mr. Knowles to APPROVE PS 79-65 as requested. Motion carried 4-0. PS 79-66 APPROVED Request of First United Bancorp. for preliminary plat of Lot 1, Block A, Northland Shopping Center Addition. PS 79-67 APPROVED Request of First United Bancorp. for final plat of Lot 1, Block A, Northland Shopping Center Addition. . . . Page 10 P & Z Minutes August 23, 1979 Mr. Gary Teague, of Teague, Nall & Perkins represented First United Bancorp. in their requests. He stated there were no problems in correcting the engineer's comments except about pro rata of $8.00 per foot. Mr. Teague stated he talked to the engineer and it was changed to $5.50 a foot per letter dated August 20, 1979. Mr. Robert Harrison, president of proposed bank on this nroperty, stated the bank would be a 5000 sq. ft. building. Mrs. Shaunty asked if there was anyone who· wished to speak in favor or in opposition of this request. Mr. Eckhardt moved, seconded by Mrs. Nash to APPROVE PS 79-66 subject to the engineer's comments with the pro rata being $5.50 instead of $8.00. Motion carried 4-0. Mr. Eckhardt moved, seconded by Mrs. Nash to APPROVE PS 79-67 subject to engineer's comments with the pro rata being $5.50 instead of $8.00. Motion carried 4-0.
