MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENTS OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, JUNE 14, 1979 The Chairman, H.B. Helton, called the meeting to order at 7:07 P.M. PRESENT: H.B. Helton Dr. E.K. Hahn Jo Ann Williams Jack Roseberry Jesse Range CITY STAFF PRESENT: James Anderson Wanda Calvert Mrs. Williams moved, seconded by Dr. Hahn, to approve the minutes with one correction on page 5-should read "She stated the Board approved the variance for the fence in the front yard but turned down the variance for the back yard". Motion carried 5-0. Request of Larry E. Romines to vary from the Zoning Ordinance #179 on Lot 8, Block 5, North Richland Hills Addition, to build a 1350 sq. ft. home instead of the required 1800 sq. ft. in 1F~12 zoning. This property is located at 4328 Cummings Dr. Mr. Romines presented his request to the Board. He stated the Deed requirement showed a minimum of 1100 sq. ft., but when they came in for the building permit for 1368 sq. ft., they found out it had been zoned for 1800 sq. ft. Mr. Romines stated he had personally talked to the neighbors and most of them are in favor of his building this 1368 sq. ft. home. He stated all the homes in this area are less than the 1800 sq. ft. requirement except maybe tWo. He stated the neighbors said they were tired of high weeds, rats, and snakes on this lot. Mr. Helton asked if there were any as small as the 1100 sq. ft. Deed requirement. Mr. Romines stated most are under the 1800 sq. ft. They are around 1400 to 1500 sq. ft. Page 2 Z B A Minutes June 14, 1979 . He stated that most of the houses were built before the zoning of this property. He stated they got their homes built much cheaper than he is. Mr. Romines stated that at $40.00 a sq. ft., 400 more sq. ft. would make his house jump from $52,000 to $70,000. He stated he did not need that much floor space and also could not afford it. Mr. Roseberry asked Mr. Romines if he had a loan commitment now. Mr. Romines stated he did not. He said that on April 30th, he signed a contract, but that was when they were having problems with loans and interest rates, so Mr. Giles said he would go ahead and start building and would wait and float a loan later. Mr. Romines said he was also in the process of changing positions at the railroad. He said he had worked for the railroad for 7 years as a brakeman and was going to school to be an Engineer so now he would have a higher rate of income. . Mrs. Williams stated she had a little infor- mation that might be of help. She said Mr. Halmontaller lives North of this lot and his house has 1564.84 sq. ft. in it and Mr. Rodgers at 4341 Cummings, who lives caddy-cornered from this lot has 1415.80 sq. ft., and then we have been given a letter which some people have signed that are against this request, but only one on the list lives within the 200 ft. radius of the property in question. Mrs. Williams stated none of these people who signed this petition have 1800 sq. ft. homes except Mrs. Hibler who is within the 200 ft. radius, the rest are less than 1700 sq. ft. except one which is 1743. Mrs. Williams stated that most of these houses were built before the 1800 sq. ft. zoning and the only requirement was the 1100 sq. ft. Deed .' restriction. . Mr. Anderson stated that all these houses were grandfathered in in 1967, and he be- lieves it was due to the quality of the houses and the size of the lots that determined the zoning factor. He stated that after a casual search of the tax records, he found very few of the homes that met the criteria for IF-12 zoning. Page 3 Z B A Minutes June 14, 1979 . Mrs. Williams stated the Hiblers have 3176 sq. ft. and the lady to the left of them have more than 1800 sq. ft. Mr. Romines stated he had talked to this lady and she stated her1s and Mrs. Hibler1s were the largest in the area. Mr. Helton asked how many vacant lots there were in this area. Mrs. Williams stated this is the only one. Mr. Anderson stated this property backs up to Grapevine Hwy. The entire area behind it is Commercial and Local Retail. The Chairman asked if there was anyone who wished to speak in favor of this request. . Mr. Marvin D. Rodgers, 4341 Cummings Dr., stated he lives across the street from this property. He stated his home is approximately 1475 sq. ft. He said if Mr. Romines builds the house he is requesting to build, it would be much better than the grass 4 ft. high that .is there every year with the rats and snakes in it. He stated if Mr. Romines can stand the chicken shack behind him., he was in favor of letting him go ahead and build this house. Mr. Walter Halmontaller, 4332 Cummings Dr., stated he had lived there 13 years and if anyone wants to come in and put up a tent on that property and will keep the grass mowed, he would be for them 100%. He stated he had tried to get the Jones Estate for 13 years to keep that grass mowed. He stated he has killed rats and snakes there. Mr. Halmontaller stated Mr. Romines I house would be an asset to the community, and he was in hopes the Board would give Mr. Romines their approval to build. The Chairman asked if there was anyone who wished to speak in opposition of this request. . Sheryl Maze, 4312 Cummings Dr., stated she went around to the neighbors with a petition against this request. She stated a Mr. Appleby presently owns this property, and she wonders if he gave Mr. Romines his approval to do this. She stated her house was built in 1955 and the Page 4 Z B A Minutes June 14, 1979 · age of the houses in this area range from 25 years old to 5 years old. She stated this is an oversized lot and a small house on it would stick out like a sore thumb, and would ruin the value of the lot. Miss Maze stated she went to the tax office and got the square footage of all the houses in the block and the average was 1836 sq. ft. Mr. Anderson stated that was not true. Miss Maze stated she has her calculator with her and he could figure it up for himself. Mr. Anderson asked Miss Maze if she was aware that her house was only 1497 sq. ft. Miss Maze stated she knew the size of her house but they might some day add on to it. Mr. Anderson stated Mr. Romines might do that, too, some day. He asked Miss Maze how long she had been living there. · Miss Maze stated since 1961. Miss Maze stated this. 1836 sq. ft. is the average of 17 houses. She stated some of these houses have additions, garages, storage buildings, green houses, patios, etc., built on and this would make them con- siderably larger. Mr. Anderson stated the square footage is the heated and cooled area, which would not in- clude the garages, patios, etc. Mr. Roseberry asked Miss Maze if she was aware that it would be improfitable for any- one to build an 1800 sq. ft. home in this area. · Mrs. Williams reminded Miss Maze that her house was only 1497 sq. ft. She read the names on the petition that were against the request and read the square footage of their houses. They were: C.C. Maze, 4312 M.L. Gardner, 4305 Frank Koenig, 4300 Hazel Cooper, 4304 David Green, 4301 James E. Roe, 4309 Mrs. V.R. Ro e , 4205 II II - 1695 II II Mrs. Williams stated Mrs. Hibler was the only one within the 200 ft. radius of this property and Mr. Hibler signed the "for" petition. Miss Maze stated she felt that some that signed the petition "for" the house to be built would not have signed if it had been explained to them. Mrs. Williams requested the Chairman ask if there was anyone present that signed the IIfor" petition that wanted to withdraw his name. The Chairman asked if there was anyone present who signed the "for" petition who wished to withdraw his name. There were none. · Mr. Anderson stated that the way Miss Maze figured the average sq. ft. of the houses in the area was not quite fair. He stated you take this one so very large and the next one to it-1500 sq. ft., thats really not very fair. Mr. Anderson stated the very large one distorts the average. Miss Maze stated there are several within the 200 ft. area that has over 200 sq. ft., not including the garages, green houses, etc. Mrs. Williams stated the ones within the 200 ft. range-Mr. Courtney, Mr. McClung, Mr. Halmon- taller, Mr. Hafley, Mr. Rodgers, Mr. Hibler, Mr. Hafley, Mr. Walthall, and Mr. English, all have signed this petition in favor of this re- quest. Mr. Helton asked who owns the property now. Miss Maze stated Mr. Appleby does now and previously Jones Estate. Mrs. Calvert stated the City has an OK for Mr. Romines to ask for this request through Giles Builders. · , Page 6 Z B A Minutes June 14, 1979 . Mr. Baker, 4400 Cummings Dr., asked what was the regulation for sanitary sewer in North Richland Hills. He asked if you were allowed to go from your house across another person IS property. Mr. Baker also asked if Mr. Grummond held this property back. He stated he just did not want anyone to do something wrong or something they shouldn1t. Mr. Anderson asked Mr. Baker if he was re- ferring to the sewer being in the back. Mr. Baker stated that was correct. Mr. Anderson stated they put the sewer across the front now. Mr. Baker stated the lot was 134 and the sewer was 160 ft. back from Cummings Drive, so they would have to go across another personls property. Mr. Anderson stated that ordinarily the City would require a 5 ft. utility easement across the property. . Mr. Baker stated this would be considerably more than the 5 foot. Mr. Anderson stated this should not have any bearing on this variance request, that this is between the person owning the property behind and the person buying the lot. Mr. Romines stated in canvassing the neighbor- hood, he was told about Mr. Appleby thinking he bought a lot larger than he actually bought. He said Mr. Appleby was kinda mad about it, but Mr. Romines said it didn1t matter to him if the lot was 136 ft. or 125 ft., because that is large enough for him. Mr. Helton stated he was sure that no one could refuse to allow the sewer to be put in. Miss Maze stated that at one time when they were trying to change the zoning on this lot to Commercial, she did some checking and found that the Hiblerls lot was divided into parts A & B. . Page 7 Z B A Minutes June 14, 1979 . The Chairman asked if there was anyone else who wished to speak. Mr. Range moved, seconded by Mr. Roseberry, to APPROVE BA 79-7 as requested. Motion carried 5-0.
