MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENTS OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS,
NOVEMBER 8, 1979
The meeting was called to order by the
Chairman, H.B. Helton, at 7:00 P.M.
PRESENT:
H.B. Helton
Jack Roseberry
Dr. E.K. Hahn

CITY STAFF PRESENT: Gary Caldwell

Mr. Range stated that on Page 12, paragraph
# 8, he believed they did not word the motion
correctly. He stated the Board agreed to
grant r~r. Reynold1s request.1.Mr. Reynolds
needed 30 feet, which would be a 20 ft. build-
i ng 1 i ne .
There was discussion regarding the motion.
Mr. Range moved, seconded by Mrs. Williams,
to amend the minutes on page 12, paragraph
# 8, to read: IIMr. Roseberry moved, seconded
by Dr. Hahn, to APPROVE BA 79-16 to allow a
20 ft. building line in lieu of the 50 ft.
building line as prescribed in Ordinance #
179. Motion carried 5-0.11 This motion
carried 5-0.
Request of Steve Simpson to vary from the
Zoning Ordinance #179 on Lot 3, Block 4,
Irish Meadows Addition, to allow house to
be built 2 feet over the building line.
This property is located at 7908 Irish Drive.
Mr. B.H. Sanders represented Mr. Simpson in
his request. He stated that he was sort of
a silent partner of Mr. Simpson1s. He said
he usually takes care of things like this
for him. Mr. Sanders stated this house was
on a cul-de-sac and he guessed the concrete
man, when he went to square up the house, he
must have moved the stob forward instead of
moving the other corner back.

Mr. Range asked if this plot plan was just
as it was built.
Mr. Sanders stated that it was.
Mr. Range stated that it looked like an
honest mistake to him.
Mr. Roseberry stated he almost had this to
happen to him on a house he built.
Mr. Sanders stated that he usually checks
them, but this one slipped by him.
The Chairman asked if there was anyone who
wished to speak in favor of or in opposition
to this request.
Mr. Range moved, seconded by Mr. Roseberry,
to APPROVE BA 79-15 as requested. Motion
carried 5-0.
BA 79-17
APPROVED
Request of LaDonna Ballas to vary from the
Zoning Ordinance #179 on Lot 8, Block 8,
Briarwood Estates, to be allowed to have a
fence 15 ft. beyond the south building line.
This property is located at 6929 Post Oak Dr.

Byron Ballas presented his and his wifels
request to the Board. He stated that they
made a mistake out of ignorance.
Mr. Helton asked Mr. Ballas if he put the
fence up, himself.
Mr. Ballas stated he got a fence company to
put it up.
Mrs. Williams asked what fence company it was.
Mr. Ballas said the man IS name was Rickey
Whitaker.
Mrs. Williams asked Mr. Ballas if the man
told him they needed a permit to put up a
fence.
Mr. Ballas stated he didnlt. He said their
house is on a curve. He showed pictures of
the fence and of the view from several angles.

He stated that these pictures show that it
is no safety hazard. It does not block the
view. Mr. Ballas stated that he is not
trying to make excuses for his error.
Mr. Helton asked Mr. Ballas why he put the
fence there.
Mr. Ballas said that he and his neighbor
plan to drape it with roses. He also stated
he put it there because of a drainage pro-
blem. He said the builder did not take care
of the drainage. Mr. Ballas stated he has
built a retainer wall to keep water out of
his garage. He said they had a lot of
erosion.
Mr. Helton asked how high was it slanted
down to.
Mr. Ballas stated it slanted down to 3 ft.
high. He said to look at the drawing he had
prepared for them.

Mr. Range said he wanted to compliment Mr.
Ballas on the neatness of his drawing. It
was very explanatory.
Mr. Helton asked Mr. Caldwell if it was
alright to have it 3 ft. high.
Mr. Caldwell stated that only if it were
shrubs.
Mrs. Williams asked Mr. Ballas why he has
the fence only on one side.
Mr. Ballas said he built a retainer wall on
the other side and a plume to keep the water
out of his house.
Mrs. Williams said she wanted to ask another
question about the fence. She asked if this
Rickey Whitaker was a fence builder, and if
he owned the company, and if so, '¡what was the
name of it.
Mr. Ballas stated that he called a fence
supply company and asked if they had someone
to install the fence. He said they told him

they did not, but they would have someone
contact him.
Mrs. Williams stated she was of the opinion
that all fence companies knew they had to
have a permit to install a fence.
Mr. Caldwell stated that we have this
happening every day. He said the city
could not catch everyone, but when they
run across one, they shut him down.
Mr. Ballas stated that this Rickey Whitaker
works at G.D. and does this after hours.
Mr. Roseberry stated that he felt that this
fence supply company on Smithfield Road
should be contacted and told that one must
be bonded and must take out a permit before
he installs a fence in North Richland Hills.

Mrs. Williams asked Mr. Ballas to explain
again why he put up the fence.
Mr. Ballas stated it was mostly aesthetic.
He stated he also was putting rocks there
to help in the drainage and erosion.
Mr. Range stated it was an attractive fence.
Dr. Hahn asked Mr. Ballas why he didn1t check
to see if it was legal.
Mr. Ballas stated that his wife called the
city hall and a Mr. Brown told her they
could build it, so they did, and then this
Mr. Brown came out and stopped them. Mr
Ballas said Mr. Brown never told them they
would need a variance or a permit.
Mr. Helton stated he had looked at the pictures
and he sees no safety problem.
Mr. Ballas said he did not feel there was a
safety problem. He said he wanted to
apologize again for his error.
The Chairman asked if there was anyone who
wished to speak in favor of or in opposition
to this request.

Camille Schenk stated she lives next door
to Mr. & Mrs. Ballas. She said she drives
a little Toyota and she has no problem
seeing to back out of her driveway or any-
thing. She said the erosion is very bad
and this should help. She said she likes
the fence and is proud they put it there.
Mr. Helton stated that Mr. Ballas had tried
to do what was right.
Mr. Roseberry moved, seconded by Mr. Range,
to APPROVE BA 79-17 as requested. Motion
carried 5-0.
ADJOURNMENT
The meeting adjourned at 7:45 P.M.
